DEFINITIONS & ABBREVIATIONS Definitions Medical Device In-Vitro Medical Device Advertising of medical devices Medical Devices National Registry National Establishment Registry Number means any instrument, apparatus, implement, machine, appliance, implant, in vitro reagent or calibrator, software, material or other similar or related article: A. Intended by the manufacturer to be used, alone or in combination, for human beings for one or more of the specific purpose(s) of: 1. Diagnosis, prevention, monitoring, treatment or alleviation of disease, 2. Diagnosis, monitoring, treatment, alleviation of or compensation for an injury or handicap, 3. Investigation, replacement, modification, or support of the anatomy or of a physiological process, 4. Supporting or sustaining life, 5. Control of conception, 6. Disinfection of medical devices, 7. Providing information for medical or diagnostic purposes by means of in vitro examination of specimens derived from the human body; and B. Which does not achieve its primary intended action in or on the human body by pharmacological, immunological or metabolic means, but which may be assisted in its intended function by such means. means a medical device, whether used alone or in combination, intended by the manufacturer for the in-vitro examination of specimens derived from the human body solely or principally to provide information for diagnostic, monitoring or compatibility purposes. This includes reagents, calibrators, control materials, specimen receptacles, software and related instruments or apparatus or other articles. means any form of information, canvassing activity or inducement intended to promote the supply or use of medical devices. is the database of both registered establishments and medical devices the SFDA has authorized to be placed on the KSA market. the number issued to a person by the SFDA under the establishment registration provisions of the Medical Devices Interim Regulation. INTRODUCTION Purpose The purpose of this document is to provide guidance on obtaining an importation license for medical devices intended for demonstration or training purposes only. Scope... This document is applicable to any medical devices establishment wishes to import medical devices intended for demonstration or training purposes only. Background Medical devices may be placed on the market and/or put into service only if they comply with the applicable provisions of the Medical Devices Interim Regulation, as signified by the SFDA issuing the manufacturer with a written marketing authorization. Devices that may access KSA for purposes rather than marketing, such as for demonstration or training purposes only, are exempt from marketing authorization requirements. This document describes the requirements for obtaining an importation license for medical devices intended for demonstration or training purposes only. PRODUCTS IMPORTED AS EXHIBITS IN EXHIBITIONS ARE SUBJECTED TO SAUDI CUSTOMS. Page 5 of 12

REQUIREMENTS General 1 Medical devices intended for demonstration or training purposes only are exempt from marketing authorization requirements. 2 No person shall import a medical device (intended for demonstration or training purposes only) unless the SFDA has issued an importation license. 3 The advertisement of a medical device for which the SFDA has not issued a medical device marketing authorization (MDMA) is prohibited. Therefore, only sufficient experts (physicians / surgeons) can be informed about such details. Pre-requisite 4 Only medical devices establishments that have the following can import medical devices intended for demonstration or training purposes only: o national establishment registry number, that is issued by SFDA through SFDA s MDNR o Medical Device Establishment License (MDEL), that is issued by SFDA Submitting to SFDA 5 Importers shall submit the documents specified in REQUIRED DOCUMENTS electronically via MDIL portion that is available on the SFDA s website. once satisfied, SFDA will send an importation license (MDIL) to the applicant s email. Responsibility 6 Importers shall undertake that he will: o use the device for demonstration or training purposes only, o re-export the device out of Saudi Arabia as soon as the reason for the importation is finished (the maximum period is six months), or destroy it, with informing SFDA/MDS by providing evidence of re-exporting or destroying it, and o indicate on the label of device that it is for demonstration or training purposes only, and not for sale. FLOWCHART Start Purpose of importation is demonstration or training The advertising of a medical device for which the SFDA has not issued a MDMA is prohibited. Therefore, only sufficient experts can be informed about such details. Annex2 Attestation for importers of medical devices intended for demonstration or training purposes only م.5.6.7.8.9 1 2... نتعهد نحن شركة / مؤسسة /مستودع... و سجل تجاري رقم... وتاريخ... فرع... بأن األجهزة/المنتجات الطبية التالية: رقم الفاتورة تاريخ الفاتورة عدد البنود الشركة المصنعة بلد الصنع والقادمة عن طريق منفذ... نتعهد باآلتي: 1. أن بنود الشحنة الواردة في الفاتورة / الفواتير مطابقة للشروط والمعايير الدولية. 2. مراعاة شروط النقل والتخزين حسب توصيات الشركة الصانعة مع إيضاح مكان التخزين بعد فسح الشحنة 3. إقرار بأن األجهزة ال تستخدم على المريض وإنما يقتصر استعمالها على مجال العرض و التدريب فقط بغض النظر عن كفاءة األجهزة لالستخدامات العالجية أو التشخيصية. 4. أن البنود الواردة الشحنة ال تحتوي على أي مواد مخدرة أو مواد متفجرة أو مواد مشعة أو أي مواد محظورة. إحضار أصل الفاتورة وشهادة المنشأ لدى منفذ الوصول. استخدام المواد المطلوب استيرادها في األغراض الموردة من أجلها باإلضافة إلى عدم تداولها في غير األماكن المخصصة لذلك و تحمل جميع األضرار الناجمة عن سوء استخدام المواد المذكورة في طلب إذن االستيراد أو استخدامها في غير الغرض الذي وردت من أجله. األفراد القائمين بالعمل مؤهلون علميا وعمليا وضع البطاقة التعريفية على الجهاز/المنتج الطبي والتي تتضمن بأن الجهاز/المنتج الطبي سيستخدم لغرض العرض أو التدريب فقط وليس للبيع. أن يتم إعادة تصدير األجهزة/المنتجات الطبية بتاريخ... )ستة أشهر كحد أقصى( أو إتالفها وإخطار الهيئة )قطاع األجهزة والمنتجات الطبية( بذلك مع إحضار مايثبت ذلك.
