1 Terms & conditions GENERAL Nissan Road Miles Programme (the 'Programme') is a loyalty programme operated by Arabian Automobiles Co. LLC (hereinafter referred to as 'Arabian Automobiles'). As a member, you will earn Miles when making qualifying purchases at participating Arabian Automobiles outlets in the UAE, when showing your Nissan Road Miles Membership Card at the time of purchase. These terms and conditions relate to the membership, earning and redeeming of Miles under the Programme from its launch. 1. Arabian Automobiles reserves the right to withdraw or cancel any or all of the Nissan Road Miles Membership Cards issued; refuse to award Miles; withdraw Miles; refuse the right to redeem Miles collected for any breach of these conditions or failure to pay for the purchases without prior notice. 2. By using your Nissan Road Miles Membership Card in any of the Programme's participating outlets for the purpose of earning Miles, you automatically provide acceptance of the Programme along with its rules, terms and conditions. 3. Your Membership of the Programme can be revoked or refused if you are involved in any act of fraud, cheating with or without cause and without notice. The Membership can also be revoked if you are found to be involved in any sort of misuse of the Nissan Road Miles Membership Card of the Programme. 4. Arabian Automobiles reserves the right to modify or close the Programme, or to change, cancel or withdraw any of the terms and conditions, without assigning any reason whatsoever at any point of time at its own discretion. It reserves the right to discontinue Programme Memberships - existing or new - temporarily or permanently for a period of time, as decided by the management. 5. Benefits and offers made to you through the Programme may change or be withdrawn without prior intimation. Arabian Automobiles will not be responsible for any liability arising from such situations. 7. You are responsible for notifying the Nissan Road Miles Member Service Centre, in writing, of any change in your address or contact details. 8. Arabian Automobiles has the right to contact members for the purpose of providing membership information, account statements and redemption details even if you have opted out of receiving communications. This excludes communications pertaining to promotions and offers, which will not be sent to you if you have opted out of such communications as a member. 9. Arabian Automobiles will not be liable for any unlawful or misuse of a Nissan Road Miles Membership Card or account, and it is your responsibility to ensure that your Nissan Road Miles Membership Card is kept in a safe and secure location at all times. 10. As a member you are responsible for any loss, damage or theft of your Nissan Road Miles Membership Card. You must report any loss, damage or theft immediately to the Nissan Road Miles Member Service Centre. Replacement Nissan Road Miles Membership Cards that are issued for any reason whatsoever will be replaced for a penalty of 100 Miles, which will automatically be deducted from your account. If you do not have a balance of 100 Miles or more, Miles will be 'loaned' to you and any Miles you earn until such time as the loan has been repaid will not be available for redemption. 11. Any loss of Nissan Road Miles Membership Card(s) or misuse of lost Nissan Road Miles Membership Card(s) shall be your sole responsibility and Arabian Automobiles will not be held responsible. The loss should be advised immediately to Nissan Road Miles Member Service Centre and the lost Nissan Road Miles Membership Card will be suspended within 96 hours of receipt of such a request to prevent any fraudulent use. A new Membership Card will be issued to you with a new Membership Number to prevent any fraudulent use of the previous card. 12. By participating in the Programme, you consent to Arabian Automobiles retaining the information provided to Arabian Automobiles about you, including details of any purchases made and the use of this information to offer you products and services that are likely to be of interest and for Arabian Automobiles market research purposes. 13. If you indicate that you would like Arabian Automobiles to pass any contact details to any carefully selected 6. 2 3rd party partners of the Programme for the purposes of offering you more products and services relevant to you, Arabian Automobiles may from time to time do this. As a member, you can make this choice on the enrolment form at the time of joining the Programme. You can also add or remove this preference by contacting the Nissan Road Miles Member Service Centre. 14. These terms and conditions shall be governed by the laws of Dubai and any dispute may be referred to the courts of Dubai. 15. The terms and conditions as published on the Arabian Automobiles website from time to time shall be final and binding and supercede the terms and conditions herein and other information as provided in relation to the Programme. MEMBERSHIP 1. The Nissan Road Miles Membership Card shall always remain the property of Arabian Automobiles and you will only be the custodian of the same. 2. An individual who has attained the age of 18 years is entitled for the membership of the Programme. The membership to the Programme is free and it is not a corporate card/corporate membership and is not valid for Arabian Automobiles staff. Applications received from members under the age of 18 will be rejected. 3. Membership is non-transferable and can only be used by you as the authorised Cardholder. You may cancel your membership at any time by giving Arabian Automobiles a written notice. 4. You will receive your plastic Nissan Road Miles Membership Card by post. You may use the Temporary Nissan Road Miles Membership Card you receive while making transactions at the participating outlets until you receive your plastic card. It would generally take about 14 to 21 days for the delivery of your plastic Nissan Road Miles Membership Card from the day of your transaction. 5. The Membership will be allotted purely at the discretion of the management and final decisions on all matters relating to the Nissan Road Miles Membership Card shall rest with Arabian Automobiles. 6. A member who has not transacted within a 12-month period will be deemed by the Programme as 'Inactive'. No communications, including quarterly statements, will be sent to members in Inactive Status. To avoid becoming an Inactive member, ensure that you have at least one transaction within a 12-month period. Members in Inactive Status will be re-activated to Active Status as soon as they make their next transaction, and will begin to earn Miles from this date onwards. EARNING A bonus of 5,000 Nissan Road Miles is awarded with the purchase of your vehicle. Then onwards you can earn 2 Nissan Road Miles on every AED 1 spent. 1. At the time of purchase, Miles will be credited to your account only upon presentation of your plastic Nissan Road Miles Membership Card, your Nissan Road Miles Membership Number or your temporary Membership Card given when enrolling into the programme. 2. All Miles earned under the Programme are valid for 24 months. All unused Miles over 24 months will expire and shall not be available for redemptions. Miles about to expire or those that have expired will be reported on your quarterly statement and you can access your details on your account at any time by calling our toll free number 800-NISSAN ( ) 3. Miles once redeemed against a purchase can in no event be re-credited. 4. In the event of a Purchase Return by a member, all Miles earned on the original transaction for the returned items will be reversed from the members account, including any bonus Miles earned on promotional items. The member will receive either cash refund or credit note, as per Arabian Automobiles terms of purchase. When using the Credit Note for a future purchase, the member will earn Miles against this purchase. 5. Your Miles balance cannot be pooled with the Miles balance of any other member at any point of time. 6. Miles earning is as per the prescribed earning rate outlined in the membership guide and on the Arabian Automobiles website. Arabian Automobiles reserves the right to change all or some of the earning rates without prior notification. However, Arabian Automobiles will endeavour to advise you of any changes in the earning rates in advance. 7. Miles can be earned only at participating outlets as set forth in the membership guide and on the Arabian Automobiles website.

3 Arabian Automobiles reserves the right to add or remove any of the outlets at any time without prior notification. Arabian Automobiles will endeavour to advise you of any changes to outlets in advance. 8. Miles can only be earned when a Temporary Nissan Road Miles Membership Card, a Plastic Nissan Road Miles Membership Card or Membership Number is produced at the time of making the purchase. If none of these can be produced at the time of purchase, the Miles will not be credited to your account. No retrospective claims for the transactions made in the past will be entertained. 9. Miles earned will be available for redemption only after 14 days from the transaction date. 10. Nissan Road Miles cannot be earned in conjunction with any other programmes and co-marketing partnerships. REDEMPTION Redeeming your Nissan Road Miles is very easy. You can redeem 100 Nissan Road Miles for AED Nissan Road Miles earned are non-refundable and non-transferable; Members must show their Nissan Road Miles Membership Card at the time of redemption. 2. Nissan Road Miles Membership Card can be used only in the country of issuance. Nissan Road Miles can be redeemed in the country of issuance only. 3. Nissan Road Miles cannot be exchanged for cash, and no amount can be returned in cash for purchases made through redemption of Nissan Road Miles. 4. Nissan Road Miles can only be redeemed in multiples of AED Nissan Road Miles once used through redemption cannot be used again. 6. If the value of the purchase is more than the value of the Nissan Road Miles being redeemed, the balance amount must be paid by the member using a valid payment method. Arabian Automobiles reserves the right to modify, cancel or withdraw the terms and conditions at any point of time at Arabian Automobiles' own discretion.
