Smart Pay Plan [1 Jan 30 June 2012] SMART PAY TERMS & CONDITIONS The terms and conditions herein are to apply in conjunction and read together with the CIMB Bank Berhad (13491-P) ( The Bank ) s Card Agreement. In the event of any discrepancy or inconsistency between these terms and conditions and the Card Agreement, the terms and conditions herein contained shall prevail in so far as they apply to the SPP. As used herein, words not specifically defined herein shall have the meaning as those defined in the Card Agreement. The word Card Agreement shall mean the credit card agreement between the Cardholder and the Bank whereby the Cardholder is issued with Card by the Bank upon the terms and conditions therein as well as the terms and conditions as contained in the Bank s application forms signed and submitted by the Cardholder to the Bank when applying for the issuance of a MasterCard and such other terms and conditions supplemented or amended from time to time. The word Account shall have the meaning as MasterCard, Visa or JCB Card Account as defined in the Card Agreement. The word Card means any MasterCard, Visa or JCB credit card issued by the Bank but shall exclude supplementary credit cards. The word Cardholder means the holder of the Card. The word SPP means the Smart Pay Plan made available to Cardholder to enable Cardholder to repay the amounts incurred for his/her purchase of goods and/or services from merchants approved by the Bank by way of Instalment repayments. 1. SPP is made available to the Cardholder whose Account is not in default and whose account has available credit limit at the time of application. For the purpose of clarification, only the amount incurred within the Cardholder s original credit limit can be converted to the SPP. The amount incurred for any purchase using any additional credit limit granted by the Bank to the Cardholder on a temporary basis at the point of purchase cannot be converted to the SPP. 2. Application for SPP shall be made to the Bank via telephone banking only or such other method as may be prescribed by The Bank from time to time. 3. The details of the purchase transaction which the Cardholder intends to pay by instalments under the SPP must be made known to The Bank at the time of application and the Bank reserves the rights to request for any supporting documents pertaining to the purchase. The Bank reserves the rights to reject or approve the application at its absolute discretion without having to assign any reason whatsoever to the Cardholder. SPP is only available for retail transactions charged to Card issued by The Bank. SPP is not available for cash advance, quasi cash and transactions with cash rebates or double Bonus Points, payment of instalment under other instalment payment facility provided by The Bank or any other banks or financial institutions, and settlement of any annual fee, outstanding balances or charges imposed by The Bank under and/or pursuant to the terms of the Card Agreement. 4. The SPP instalment tenure ( SPP Tenure ) shall be of either a 10, 20 or 30 months period or such other period as The Bank may specify at its absolute discretion from time to time. 5. A Cardholder can elect either a 10 months, 20 months or 30 months SPP Tenure or such other SPP Tenure specified by The Bank at its absolute discretion to pay the instalments. However, to qualify for a 10 months SPP Tenure the minimum amount must be at least RM500.00 subject to a maximum of RM30,000 per purchase transaction, to qualify for a 20 months SPP Tenure the minimum amount of purchase must be at least RM1,000.00 subject to a maximum of RM30,000 per purchase transaction and to qualify for a 30 months SPP Tenure the minimum amount of purchase must be at least RM3,000.00 subject to a maximum of RM30,000 per purchase transaction. The aforesaid limits may be varied by The Bank from time to time at its absolute discretion. The purchase price of the goods and/or services shall be referred to as the SPP Amount. 6. Subject to The Bank s approval, a purchase not precluded by any terms herein can be settled by instalments under the SPP ( SPP Instalments ) if: a. the purchase is charged to the Card from Jan 1, 2012 to June 30, 2012, both dates inclusive (i.e. transaction date Jan 1, 2012 to June 30, 2012); b. the Account has been debited with the purchase transaction; and c. the purchase transaction is reflected in the current monthly statement as part of the Current Balance due which has not passed the next monthly statement date at the time the purchase is converted into SPP Instalments. b) To illustrate with an example: The statement date is April 1, 2012. The purchase transaction date is April 3, 2012. The Cardholder must call The Bank via Phone Banking to apply for SPP between April 5, 2012 to April 30, 2012 before the next statement date (please allow 2 days for the transaction to be posted). The purchase transaction can only be converted by the Cardholder to SPP Instalments before May 1, 2012 (the next statement date), subject to The Bank s final approval. 7. A one-time upfront interest ( SPP Interest ) at 4% shall be charged for 10 months SPP Tenure, 6% shall be charged for 20 months SPP Tenure and 7% shall be charged for 30 months SPP Tenure on the whole SPP Amount for the duration of the selected SPP Tenure. The SPP Interest shall be billed on the next stamement date following The Bank s approval of the application. The SPP Interest rate is subject to change from time to time at The Bank s absolute discretion by giving adequate notice to the Cardholder. 8. The aggregate of the SPP Amount shall be payable by the Cardholder by way of equal monthly instalments ( SPP Monthly Instalment ) during the selected SPP Tenure without any deduction whatsoever. The selected SPP Tenure and the SPP Monthly Instalment cannot be altered without The Bank s consent. In the event The Bank consents to the Cardholder s request to alter the SPP Tenure and/or the SPP Monthly Instalment, the alteration of the SPP Tenure and/or the SPP Monthly Instalment is subject to the Cardholder s payment of an administrative fee of RM50.00 to the Bank. 9. The SPP Monthly Instalment is computed based on the following formula : SPP Amount SPP Tenure 10. Upon the Bank s approval of the Cardholder s application for the SPP, the credit limit of the Cardholder s Account will be reduced by the aggregate amount of the outstanding SPP Monthly Instalments due. As each SPP Monthly Instalment is repaid by the Cardholder, the amount equivalent to the SPP Monthly Instalment so repaid shall be restored to the Cardholder s credit limit. 11. The SPP Monthly Instalment shall be billed to the Cardholder on the next statement date following The Bank s approval of the application and every month thereafter until full settlement of all the SPP Monthly Instalments. 12. The Cardholder shall pay the SPP Interest and the SPP Monthly Instalment in addition to the 5% monthly minimum payment due on the rest of the balance outstanding (if any). In the event the SPP Interest and/or the SPP Monthly Instalment is not received by the Bank in full before the Payment Due Date, the applicable finance charges shall be levied on the unpaid balance of the SPP Interest and/or Monthly Instalment or part thereof remaining unpaid in accordance with the terms and conditions of the Card Agreement. 13. The Cardholder may participate more than once in the SPP subject to the Cardholder s eligibility for the SPP upon the terms and conditions herein contained. 14. Each of the following events shall constitute an event of default whereupon the happening of such event, all outstanding SPP Interest and/or SPP Monthly Instalments and all monies due thereunder shall immediately become due and payable by the Cardholder and without prejudice to the Bank s right to demand payment of all or any part of the outstanding SPP Interest and/or SPP Monthly Instalments and the monies due thereunder, the Bank shall be entitled to exercise its remedies under the Card Agreement : a. if the Cardholder defaults in any of his/her obligations stated herein or under the Card Agreement; b. if default is made in the payment of the SPP Interest and or SPP Monthly Instalment or any sums due thereunder or under the Account; c. if the SPP shall be terminated; d. if terms and conditions herein or any part hereof shall at any time for any reason cease to be in full force and effect or valid or shall be declared void, repudiated or frustrated; Smart Pay Plan [1 Jan 30 June 2012] Page 2 of 6

e. if it becomes impossible or unlawful for the Bank to make available or continue to make available the SPP to the Cardholder; f. if there shall occur any circumstances of any nature which in the Bank s opinion may cause the Bank to be unable to make available or continue to make available the SPP facility to the Cardholder; and/or g. the Card is cancelled or the Account is terminated. 15. If it becomes more expensive for the Bank to maintain the SPP by reason of any change in law or regulations which give rise to new or additional taxes, higher reserve requirement or similar acts or a significant change in the monetary situation or economic environment, the Cardholder agrees to bear such additional costs for maintaining the SPP. For this purpose, the Bank may at its absolute discretion either bill the Cardholder for the additional costs or correspondingly adjust the SPP Monthly Instalment before the selected SPP Tenure expires. 16. The Cardholder may at any time after the approval of the application cancel the SPP facility via telephone banking only or such other method as may be prescribed by the Bank from time to time. The Bank shall be entitled to charge and debit to the Cardholder s Account a cancellation fee of RM50.00 in the event of cancellation or early settlement of the SPP Amount and the SPP Interest. Upon the cancellation of the SPP facility, the total outstanding SPP Amount and the SPP Interest shall immediately become due and payable to the Bank. All such outstanding SPP Amount and the SPP Interest will be shown in the monthly statement and the Cardholder shall pay the same in accordance with the provisions of the Card Agreement in default of which, The Bank shall be entitled to exercise its rights under the Card Agreement. 17. The SPP is valid only up to the SPP Tenure or such other date as may be extended by the Bank. Nothing herein contained shall be construed as imposing an obligation on the Bank to extend the SPP Tenure and The Bank disclaims all liabilities in respect of any actions, claims, damages, costs, charges and expenses, which the Cardholder may suffer, sustain or incur by reason of his/her participation in the SPP. 18. The Bank shall not be responsible for any inadequate, damaged or defective merchandise or be concerned with any dispute between the Cardholder and the merchants. The Cardholder must at all times pay the SPP Monthly Instalments as prescribed by the terms herein. 19. Regardless of whether an event of default has occurred, the Bank shall be entitled at its absolute discretion at any time without having to assign any reason to the Cardholder to terminate the SPP made available to the Cardholder whereupon all outstanding SPP Monthly Instalments together with the SPP Interest shall immediately become due and payable upon the Bank s demand of the same notice in writing to the Cardholder. Upon termination of the SPP facility, the SPP Interest chargeable under clause 7 hereof remains payable and if paid shall not be refundable. All such outstanding SPP Monthly Instalments together with the SPP Interest will be shown in the monthly statement and the Cardholder shall pay the same in accordance with the provisions of the Card Agreement in default of which, the Bank shall be entitled to exercise its rights under the Card Agreement. 20. The Bank reserves the right to vary the terms and conditions herein contained at any time or any reason whatsoever by giving adequate notice to the Cardholder. Sekiranya terdapat apa-apa percanggahan atau tidak konsisten di antara terma-terma dan syarat-syarat dan Perjanjian Kad, maka terma-terma dan syarat-syarat di dalam ini akan mengatasi sekiranya terpakai untuk SPP. Seperti yang digunakan di sini, perkataan yang tidak didefinisikan di sini mempunyai maksud yang didefinisikan di dalam Perjanjian Kad. Perkataan Perjanjian Kad bermaksud perjanjian kad kredit di antara Pemegang Kad dan Bank di mana Bank mengeluarkan Kad kepada Pemegang Kad berdasarkan terma-terma dan syarat-syarat yang terkandung di dalam perjanjian bersama-sama dengan terma-terma dan syarat-syarat yang terkandung di dalam borang permohonan Bank yang ditandatangani dan diserahkan oleh Pemegang Kad kepada Bank apabila memohon untuk dikeluarkan MasterCard dan apa-apa terma-terma dan syarat-syarat lain yang ditambah atau diubah dari masa ke semasa. Perkataaan Akaun akan bermaksud seperti Akaun Kad MasterCard, Visa atau JCB seperti yang didefinisikan di dalam Perjanjian Kad. Perkataan Kad bermaksud apa-apa kad kredit MasterCard, Visa atau JCB yang dikeluarkan oleh Bank tetapi tidak termasuk kad kredit tambahan. Perkataan Pemegang Kad bermaksud pemegang kepada Kad. Perkataan SPP bermaksud Smart Pay Plan yang disediakan kepada Pemegang Kad supaya Pemegang Kad dapat membayar amaun yang dilaksanakan untuk pembelian barangan dan/atau perkhidmatan dari pedagang yang diluluskan oleh Bank secara pembayaran ansuran. 1. SPP yang disediakan untuk Pemegang Kad di mana Pemegang Kad tidak memungkiri Akaunnya dan mempunyai had kredit yang sedia ada semasa permohonan. Sebagai tujuan penjelasan, hanya amaun yang ditanggung di dalam had kredit asal Pemegang Kad boleh ditukarkan kepada SPP. Amaun yang ditanggung untuk apa-apa pembelian dengan menggunakan had kredit tambahan yang diberikan oleh Bank kepada Pemegang Kad untuk sementara waktu pada waktu pembelian tidak boleh ditukarkan kepada SPP. 2. Permohanan untuk SPP harus dibuat dengan Bank melalui pembankan telefon sahaja atau apaapa cara lain yang boleh ditentukan oleh Bank dari masa ke semasa. 3. Butir-butir transaksi pembelian di mana Pemegang Kad hendak membayar melalui ansuran di bawah SPP mesti diberitahu kepada Bank semasa permohonan dan Bank menyimpan haknya untuk meminta apa-apa dokumen sokongan berkenaan pembelian. Bank menyimpan haknya untuk menolak atau meluluskan permohonan di atas budi bicara mutlaknya tanpa memberikan sebarang alasan kepada Pemegang Kad. SPP hanya sedia ada untuk transaksi runcit yang dicajkan kepada Kad yang dikeluarkan oleh Bank. SPP tidak disediakan untuk pendahuluan tunai, kuasi-tunai dan transaksi rebat tunai atau Mata Bonus dua ganda, pembayaran ansuran di bawah kemudahan pembayaran ansuran yang lain yang disediakan oleh Bank atau apa-apa bank lain atau institusi kewangan dan pembayaran apa-apa yuran tahunan, baki tertunggak atau caj yang dikenakan oleh Bank di bawah dan/atau menurut kepada terma-terma Perjanjian Kad. 4. Tempoh ansuran SPP ( Tempoh SPP ) adalah samada 10, 20 atau 30 bulan atau apa-apa masa sepertimana Bank yang menentukan di atas budi bicara mutlaknya dari masa ke semasa. 5. Pemegang Kad boleh memilih Tempoh SPP samada 10 bulan, 20 bulan atau 30 bulan atau apaapa Tempoh SPP lain yang ditentukan oleh Bank atas budi bicaranya untuk pembayaran ansuran. Walau bagaimanapun, untuk melayak Tempoh SPP 10 bulan, amaun minimum mesti sekurang-kurangnya RM500.00 tertakluk kepada maksima RM30,000 setiap transaksi pembelian, untuk melayak Tempoh SPP 20 bulan, amaun minimum pembelian mesti sekurang-kurangnya RM1,000.00 tertakluk kepada maksima RM30,000 setiap transaksi pembelian dan untuk melayak Tempoh SPP 30 bulan, amaun minimum pembelian mesti sekurang-kurangnya RM3,000.00 tertakluk kepada maksima RM30,000 setiap transaksi pembelian. Had-had yang dinyatakan boleh diubah oleh Bank dari masa ke semasa atas budi bicara mutlaknya. Harga pembelian barangan dan/atau perkhidmatan dirujuk sebagai Amaun SPP. 6. Tertakluk kepada kelulusan Bank, pembelian yang tidak termasuk di dalam apa-apa terma di dalam ini boleh diselesaikan secara ansuran di bawah SPP ( Ansuran SPP ) sekiranya: Page 4 of 6

a) pembelian dicajkan kepada Kad dari Jan 1, 2012 ke June 30, 2012, termasuk kedua-dua tarikh (i.e. tarikh transaksi Jan 1, 2012 ke June 30, 2012); b) Akaun telah didebitkan dengan transaksi pembelian; dan c) transaksi pembelian ditunjukkan pada penyata bulanan masa kini sebagai sebahagian Baki Masakini yang perlu dibayar yang masih belum melepasi tarikh penyata bulanan yang akan datang semasa pembelian ditukarkan kepada Ansuran SPP. d) Sebagai contoh untuk menunjukkan ilustrasi: Tarikh penyata adalah April 1, 2012. Tarikh transaksi pembelian adalah April 3, 2012. Pemegang Kad mesti menelefon Bank melalui Pembankan Telefon untuk memohon SPP di antara April 5, 2012 ke April 30, 2012 sebelum tarikh penyata yang akan datang (sila memberikan 2 hari untuk transaksi diposkan). Transaksi pembelian hanya boleh ditukarkan oleh Pemegang Kad kepada Ansuran SPP sebelum May 1, 2012 (tarikh penyata yang akan datang), tertakluk kepada kelulusan mutlak Bank. 7. Satu kali faedah ( Faedah SPP ) pada 4% akan dikenakan untuk Tempoh SPP 10 bulan, 6% akan dikenakan untuk Tempoh SPP 20 bulan dan 7% akan dikenakan untuk Tempoh SPP 30 bulan di atas kesemua Amaun SPP pada jangkamasa Tempoh SPP yang dipilih. Faedah SPP akan dibilkan pada tarikh penyata yang akan datang berdasarkan kepada kelulusan permohonan. Kadar Faedah SPP adalah tertakluk kepada perubahan dari masa ke semasa atas budi bicara mutlak Bank dengan memberi notis secukupnya kepada Pemegang Kad. 8. Agregat Amaun SPP akan dibayar oleh Pemegang Kad secara ansuran bulanan sama ( Ansuran Bulanan SPP ) semasa pemilihan Tempoh SPP tanpa apa-apa penolakan. Tempoh SPP yang dipilih dan Ansuran Bulanan SPP tidak boleh diubah tanpa persetujuan Bank. Sekiranya Bank bersetuju dengan permintaan Pemegang Kad untuk mengubah Tempoh SPP dan/atau Ansuran Bulanan SPP, pengubahan Tempoh SPP dan/atau Ansuran Bulanan SPP adalah tertakluk kepada Pemegang Kad membayar yuran pentadbiran sebanyak RM50.00 kepada Bank. 9. Ansuran Bulanan SPP adalah dikira berdasarkan kepada formula berikut:- Amaun SPP Tempoh SPP 10. Apabila permohonan Pemegang Kad untuk SPP diluluskan oleh Bank, had kredit Akaun Pemegang Kad akan dikurangkan dengan amaun agregat Ansuran Bulanan SPP yang tertunggak yang perlu dibayar. Setiap Ansuran Bulanan SPP yang dibayar oleh Pemegang Kad, Amaun yang setara dengan Ansuran Bulanan SPP yang telah dibayar akan dikembalikan kepada had kredit Pemegang Kad. 11. Ansuran Bulanan SPP akan dibilkan kepada Pemegang Kad pada tarikh penyata yang akan datang menurut kelulusan Bank terhadap permohonan dan setiap bulan seterusnya sehingga penyelesaian sepenuhnya kesemua Ansuran Bulanan SPP. 12. Pemegang Kad akan membayar Faedah SPP dan Ansuran Bulanan SPP bersama-sama dengan pembayaran minimum 5% yang perlu dibayar di atas kesemua baki tertunggak (sekiranya ada). Sekiranya Kaedah SPP dan/atau Ansuran Bulanan SPP tidak diterima oleh Bank dengan sepenuhnya sebelum Tarikh Matang Pembayaran, caj kewangan akan dikenakan kepada baki Faedah SPP dan/atau Ansuran Bulanan atau mana-mana sebahagian yang belum dibayar menurut terma-terma dan syarat-syarat Penjanjian Kad. 13. Pemegang Kad boleh menyertai lebih dari satu dalam SPP tertakluk kepada kelayakan Pemegang Kad untuk SPP di atas terma-terma dan syarat-syarat di dalam ini. 14. Setiap peristiwa berikut akan merupakan peristiwa kemungkiran dan apabila berlakunya peristiwa sedemikian, semua Faedah SPP dan/atau Ansuran Bulanan SPP yang masih tertunggak dan semua wang yang perlu dibayar akan dengan serta-merta patut dibayar oleh Pemegang Kad dan tanpa prejudis kepada hak Bank untuk menuntut pembayaran untuk kesemua atau mana-mana sebahagian Faedah SPP dan/atau Ansuran Bulanan SPP yang tertunggak dan semua wang yang perlu dibayar, Bank boleh melaksanakan remedinya di bawah Perjanjian Kad: Smart Pay Plan [1 Jan 30 June 2012] Page 5 of 6

a. sekiranya Pemegang Kad memungkiri mana-mana obligasinya yang tertera di sini atau di bawah Perjanjian Kad; b. sekiranya kemungkiran pembayaran pada Faedah SPP dan atau Ansuran Bulanan SPP atau apa-apa jumlah yang perlu dibayar atau di bawah Akaun; c. sekiranya SPP dibatalkan; d. sekiranya terma-terma dan syarat-syarat di dalam ini atau mana-mana sebahagian akan pada bila-bila masa atas apa-apa sebab dihentikan daripada pelaksanaan penuh dan terikat atau sah atau akan diisytiharkan dibatal, ditolak atau terkecewa; e. sekiranya ianya menjadi mustahil atau tidak sah bagi Bank menyediakan atau meneruskan menyediakan SPP kepada Pemegang Kad; f. sekiranya berlaku apa-apa situasi dalam apa cara di mana pada pendapat Bank menyebabkan Bank tidak dapat menyediakan atau meneruskan menyediakan kemudahan SPP kepada Pemegang Kad; dan/atau g. Kad dibatalkan atau Akaun ditamatkan. 15. Sekiranya ia menjadi lebih mahal bagi Bank untuk mengekalkan SPP dengan alasan apa-apa perubahan kepada undang-undang atau peraturan yang menyebabkan cukai baru atau tambahan, keperluan rizab yang tinggi atau perkara serupa atau perubahan penting di dalam situasi kewangan atau persekitaran ekonomi, Pemegang Kad bersetuju untuk membayar kos tambahan untuk mengekalkan SPP. Untuk tujuan ini, Bank boleh atas budi bicaranya memberikan bil kepada Pemegang Kad untuk kos tambahan atau secara pos mengubah Ansuran Bulanan SPP sebelum Tempoh SPP tamat tempohnya. 16. Pemegang Kad boleh pada bila-bila masa selepas permohonan diluluskan, membatalkan kemudahan SPP dengan pembankan telefon sahaja atau apa-apa cara lain yang boleh ditentukan oleh Bank dari masa ke semasa. Bank boleh mencajkan dan mendebitkan Akaun Pemegang Kad dengan yuran pembatalan sebanyak RM50.00 sekiranya pembatalan atau pembayaran awal Amaun SPP dan Faedah SPP. Apabila kemudahan SPP dibatalkan, jumlah Amaun SPP dan Faedah SPP yang masih tertunggak akan perlu dibayar kepada Bank dengan serta-merta. Semua Amaun SPP dan Faedah SPP yang tertunggak akan dinyatakan pada penyata bulanan dan Pemegang Kad akan membayar menurut peruntukan-peruntukan di dalam Perjanjian Kad dan sekiranya Pemegang Kad memungkiri, Bank boleh melaksanakan haknya di bawah Perjanjian Kad. 17. SPP hanya sah sehingga Tempoh SPP atau apa-apa tarikh lain yang boleh dilanjutkan oleh Bank. Tidak ada apa-apa di dalam ini yang boleh ditafsirkan sebagai memberikan obligasi terhadap Bank untuk melanjutkan Tempoh SPP dan Bank menolak semua laibiliti terhadap apaapa tindakan, tuntutan, ganti rugi, kos, caj dan perbelanjaan di mana Pemegang Kad mungkin alami atau menanggung di atas sebab penyertaannya di dalam SPP. 18. Bank tidak akan bertanggungjawab untuk apa-apa kekurangan, kerosakan atau kecacatan barangan atau apa-apa pertelingkahan di antara Pemegang Kad dan pedagang. Pemegang Kad mesti pada setiap masa membayar Ansuran Bulanan SPP seperti yang dinyatakan di dalam terma-terma ini. 19. Tidak kira samada peristiwa kemungkiran telah berlaku, Bank boleh pada budi bicaranya pada bila-bila masa tanpa memberikan sebarang alasan kepada Pemegang Kad membatalkan SPP yang disediakan kepada Pemegang Kad di mana kesemua Ansuran Bulanan SPP yang tertunggak bersama-sama dengan Faedah SPP akan dengan serta-merta harus dibayar apabila dituntut oleh Bank dengan memberikan notis bertulis kepada Pemegang Kad. Apabila kemudahan SPP dibatalkan, Faedah SPP yang dikenakan di bawah klausa 7 di dalam ini akan kena dibayar dan sekiranya telah dibayar, tidak akan dibayar balik. Semua Ansuran Bulanan SPP yang masih tertunggak bersama-sama dengan Faedah SPP akan dinyatakan di dalam penyata bulanan dan Pemegang Kad akan membayar menurut peruntukan Kad Perjanjian dan sekiranya Pemegang Kad memungkiri, Bank boleh melaksanakan haknya di bawah Perjanjian Kad. 20. Bank menyimpan haknya untuk mengubah terma-terma dan syarat-syarat di dalam ini pada bilabila masa dengan memberi notis secukupnya kepada Pemegang Kad atau apa-apa alasan. Kemudahan SPP boleh digantikan kesemuanya atau sebahagian darinya dengan program lain atas budi bicara Bank. Smart Pay Plan [1 Jan 30 June 2012] Page 6 of 6
