The Arab Republic of Egypt Ministry of Trade and Industry The Minister Registered in 186/2016 Decree No. 43 of 2016 of Minister of Trade and Industry on Amending Rules Regulating the Registration of Factories Qualified to Export the Products thereof to ARE Minister of Trade and Industry, Having reviewed law No. 118 of 1975 on import and export; Ministerial decree No. 770 of 2005 on the regulations of enforcing provisions of the mentioned Law No. 118 of 1975; Ministerial Decree No. 992 of 2015 on the rules organizing the registration of qualified factories to export products thereof to ARE, and; Upon the presentation of the sectors of commercial agreements and foreign trade; Article 1 Decides The General Organization For Export & Import Control shall establish a record for trade-mark factories and companies qualified to export to ARE the products stated in the attached description. Such products stated in the record may not be cleared with the purpose of trade unless they are products of the registered factories or imported from companies owners of the trademark or distribution centres registered in such record. The competent minister of foreign trade shall issue a decree on registration or erasure from such record and may exempt any/all from registration conditions in the cases that he/she determines.

Article 2 The conditions of registering in the aforementioned record are: First: for factories The registration application shall be presented by the legal representative of the factory or whom is delegated or the deputy thereof supported with the following approved documents: - A certificate on the legal entity of the factory and the permit thereof. - A description of the produced items and the trade-mark thereof. - The trade-mark of the product and the trade-marks produced under a permit from the owning entity. - A certificate proving that the factory applies a quality control system issued from an entity recognized by ILAC, IAF, a governmental authority or a foreign authority approved by the competent minister of foreign trade. Second: As regards the companies owning trade-marks A registration application shall be submitted by the legal representative of the company owning the trade-mark or whom is delegated or the deputy thereof supported with the following approved documents: - A certificate on the registration of the trade-mark and the products produced under the trade-mark. - A certificate from the company owning the trade-mark listing the distribution centres allowed to supply the items bearing such trade-mark. - A certificate proving that the company owning the trade-mark applies a quality control system issued from an entity recognized by ILAC, IAF, a governmental authority or a foreign authority approved by the competent minister of foreign trade. Third: In case of doubts regarding the correctness of the submitted documents, they won t be registered in the register unless they are verified. Upon request of the applicant it may be allowed to inspect the company or the factory to verify the correctness of the documents after the approval of Minister of Trade and Industry.

Article 3 All other provisions contradicting such decree shall be repealed. Article 4 The present decree shall be published in the official gazette and shall be effective post two months from the date of publication. Minister of Trade and Industry Engineer Tareq Qabeel
