A full copy would be circulated to committee members. DELEGATED APPLICATIONS: Pages 54 56 179 Members received and noted a list of applications delegated for determination by the Development Services Manager.

APPLICATIONS CATEGORY A : Pages 57-110 180 Planning applications, details of which are set out in appendix 1 to these minutes, were submitted, together with parish council s observations and the recommendations of the Development Services Manager. All representations received in respect of those applications were reported. RESOLVED 181 That the decision of the committee, in pursuance of the Town and Country Planning Act and the Town and County Planning General Development Orders, be as indicated in column (iii) of that appendix and the applications determined accordingly, provided that, where the decision cannot be accepted by the Director of Planning and Environment, the application be referred to Council and, subject to referral to the Secretary of State where appropriate. ENFORCEMENT 14a NURSERY GARDENS, BRIDPORT: Pages 111 114 182 The committee received a report of the Development Services Manager, which provided details of the breach of planning control in relation to the construction of an unauthorised dwelling at 24a Nursey Gardens, Bridport and considered recommended action. RESOLVED It was proposed by Mr R J Stoodley seconded by Mr R W Coatsworth. 183 (a) That, subject to the Legal Services Manager being satisfied with the evidence, formal enforcement proceedings be authorised to include the service of appropriate notices to ensure that the building is modified to reduce its height in accordance with the plans approved by the committee; (b) That, subject to the Legal Services Manager being satisfied with the evidence, criminal and/or civil proceedings and/or direct action be authorised in respect of non-compliance with any notice served in respect of the enforcement proceedings detailed above. QUESTIONS 184 There were no questions. URGENT ITEMS 185 The Chairman advised members that there were no items of urgent business. DATE OF SITE VISIT 186 Monday 16 th February 2004.

EXEMPT BUSINESS RESOLVED 187 That, under section 100A(4) of the Local Government Act 1972, the press and the public be excluded from the meeting for the following item of business on the ground that it involves the likely disclosure of exempt information as defined in paragraph 12 of part 1 of schedule 12A to the Act. LAND AT THISTLE FARM, GREENFORD LANE, FROME VAUCHURCH, MAIDEN NEWTON EXEMPT: Gold Pages 1 14 188 The Committee received a report of the Legal Services Manager, which provided both planning and legal background in relation to land at Thistle Farm, as requested at the meeting of the committee on 8 th January 2004. The meeting closed at 5.15 p.m.

APPENDIX 1 Page 1 DEVELOPMENT CONTROL WEST COMMITTEE 5 th February 2004 Category A Applications determined by committee Application no Applicant and description of development Resolution Mr R W Coatsworth indicated that in respect of the following application, he would leave the room during discussion and voting in respect of the application and would reserve his right to participate when the matter was discussed by Dorset County Council. 1/W/2001/000412 County matter Wych Farm, Burton Road, Bothenhampton Construct Waste Management Centre comprising civic amenity site and waste transfer facility. Construct new vehicular access Sita Products and Services Ltd That West Dorset District Council s observations on this application be as follows: (i) Despite the mitigation being offered in the accompanying environmental statement, the proposed development is still considered to have a detrimental impact upon the character of the AONB within which it is situated. West Dorset District Council believes that this is at odds with the prime objective of AONB designation, which is the conservation of the natural beauty of the landscape. Consequently, the proposal is in conflict with West Dorset District Local Plan policy CD1, Structure Plan Environment Policy G and the advice contained within Planning Policy Guidance Note 7 (PPG7). (ii) With regard to the technical considerations within the accompanying environmental statement transport and traffic management, noise and vibration, air quality etc. - West Dorset District Council acknowledges that no residual effects are predicted (subject to the recommended mitigation), but would ask that the assumptions and data upon which those conclusions are based be subject to rigorous scrutiny (iii) The district council recognise the urgent need to pursue the provision of a waste management centre in the western area but feel that this is an inappropriate location.

Recommend to the Secretary of State that consent be granted, subject to a condition with regard to approval of the natural stone. Recommend to the Secretary of State that approval be granted, subject to conditions: (i) Photographic recording, careful dismantling and storage of the gates, pillars, railings and garden shelter; (ii) Restoration of the gates, pillars and railings; (iii) Resiting of the garden shelter; (iv) Removal of material demolished in the overhead walkway (v) Works for remediation of the street frontage at No 14 Marine Parade to be agreed before its demolition takes place
