Complaint Investigation and Illegal Dump Worksheet Attachment Location: Rhoades Lane County: Pulaski Inspector: Ken Burks Date: 09/16/05 Follow-Up Investigation PDS ID: 2717 Access ID: Comments: 10/06/05 Mr. McCoy attempted to contact me on this date but I was unavailable. Subsequent attempts by Mr. McCoy and myself to contact each other were unsuccessful, however, I left a message on Mr. McCoy s answering_ machine advising him to either take the wood waste to a permitted disposal facility or find some beneficial use for the waste. Complaint Investigation and Illegal Dump Worksheet Attachment Location: Rhoades Lane County: Pulaski Inspector: Ken Burks Date: 09/16/05 Follow-Up Investigation PDS ID: 2717 Access ID: Comments: 09/16/05 I entered the site at 1020 and could not make contact with Mr. McCoy. I noted an area approimately 100 yards long in a ditch net to Rhoads Lane where wood chips had been deposited. A small area of the chips were on smoldering at the time. It is not a violation of the Solid Waste Management Act to use wood chips, stumps, tree trunks or limbs as fill material or soil amendments, therefore this_ complaint is invalid. However, the burning of wood waste is against Air Division regulations if the wood does not originate from the property where the burning is occurring. 09/22/05 - I spoke with the complainant and he said that Mr. McCoy had set the wood waste on fire several times in the last year or so and the North Pulaski Fire District had responded to etinguish the fires. With this information, I will_ need to contact Mr. McCoy by letter in order to ascertain whether the wood waste is being brought to this property for disposal. At this time, the complaint validity is now UNKNOWN. FURTHER ACTION TAKEN/TO BE TAKEN: The complainant needs to contact ADEQ Air Division to address the burning issue. 09/26/05 A letter will be mailed on this date. September 28, 2005 Mr. Bill McCoy 5107 Rhoads Lane North Little Rock, AR 72120 Document ID # - 002717-comp Dear Mr. McCoy: On September 16, 2005, I performed an investigation of your property located on Rhoads Lane in Pulaski County. This investigation was in response to a complaint alleging Illegal dumping and burning of waste. My investigation revealed that you are in violation of the Arkansas Air Pollution Control Code A.C.A. '8-4-310, and the Arkansas Solid Waste Management Act, A.C.A. '8-6-205. Specifically, I found the following violation(s): 1. Operation of an unpermitted solid waste disposal facility, which is in violation of '8-6-205 (a)(2), (3), and (5). The waste dumped at this site consists of yard waste. "No person shall dispose of solid waste at any disposal site or facility other than a disposal site or facility for which a permit has been issued by the Department." 2. Open burning of this waste which is in violation of the Arkansas Air Pollution Control Code, A.C.A. ' 8-4-310(a)(1)(2), and (3). By law anyone who violates any provision of the Solid Waste Management Act may be subject to criminal, administrative and civil penalties up to $10,000. You should immediately cease the activity described and undertake measures to correct the above violation. You should notify me, in writing, at the address below or call (501)682-0581 within 20 days of the date of this letter with a plan of action for correcting these violations. Please be advised, that failure to make contact with me in regard to this notification may warrant formal enforcement action. Your cooperation is appreciated.
