OPERATING INSTRUCTIONS: All policies are to be issued in accordance with company and ISO rules and forms. The company is a subscriber/member of ISO and will utilize forms approved for use by that organization in this state and manual forms that have been approved by this state. This program is designed for all other General Liability class codes not currently used for our Small Contractor / Artisan Program. The company will adopt and utilize most current ISO loss costs editions and increased limit tables with a 1.45 multiplier to arrive at the base rates for those classes listed in this manual. In the Habitational / Mercantile General Liability program you have the ability to add Artisan classes, however Artisan minimum premiums, underwriting guidelines, and state approved rates and forms will apply. Any additional premium charges (i.e. additional insureds, waivers, etc.) are to be ADDED to the minimum premium charge. Credits do not apply to minimum premiums. Any and all additional premiums and/or surcharges outside our stated rate developed for any class are to be ADDED to the minimum premium or ADDED to the developed premium if above the minimum premium. RATE/QUOTE/BIND/POLICY ISSUANCE PROCEDURES: Only risks for which there is an acceptable classification in this Underwriting Guidelines can be rated and quoted utilizing the online software system. All other requests should be submitted on ACORD 125 and 126 and sent by e-mail to approve@tchcusa.com or fax to 954-308-1261. ADDITIONAL UNDERWRITING: Signed application by insured and agent due within 72 hours of binding Picture of property ( if required) Three (3) year loss history required on risks which develop a premium greater than $5,000 or at Company s request. SUBMIT all risks outside of the underwriting guidelines for these classes. SUBMIT risks that have annual payroll over $500,000, single risks that generate premium over $5,000, single risks with annual receipts over $2,000,000. Additional underwriting may be required and is at the discretion of the Company. POLICY TERMS: The terms of the policy shall not be for a period longer than twelve (12) months. POLICY FEE $25.00 policy fee for all new and renewal business. GENERAL LIABILITY LIMITS OF INSURANCE: Maximum Limits $1,000,000 Each Occurrence Limit $2,000,000 General Aggregate Limit $2,000,000 Products - Completed Operations Aggregate Limit $1,000,000 Personal Injury and Advertising Liability $100,000 Fire Damage Legal Liability $5,000 Medical Payment Expense CANCELLATIONS / NON-RENEWALS: No flat cancellations allowed unless initial payment from insured is a NSF check. If the insured requests cancellation, you must obtain the insured s signed written request for cancellation. All cancellations will be in accordance with state statute. If a policy is cancelled, we will send the First Named insured any premium refund due. If the Company cancels, the refund will be pro rata. If the Insured cancels, the refund will be calculated at short rate, which is.90 of pro-rata return premium. Cancellation requests by Finance Companies will be cancelled less than pro rata. The company may non-renew any policy for underwriting reasons. RENEWALS: All renewal policies must include a completed renewal questionnaire with updated risk information / coverage. Renewal discount of 10% applies and requires a copy of previous carrier declarations page within 72 hours of binding. FNIC HM UW Guidelines Edition 08 01 2012 3

AUDITS / INSPECTION REPORTS All risks are subject to an inspection and an audit. They are performed at the discretion of the company. A mandatory inspection will be required for the following class types within the first 30 days: Apartment buildings (all classes), Condominium Commercial, Bar- Taverns, Hotel & Motels, Dwellings and Restaurants. REINSTATEMENTS Charge $10.00 fully earned fee per each approved reinstatement. Reinstatements are to be processed through the online system. It is not the policy of the Company to reinstate or rewrite a policy after the second nonpayment of premium within the same policy period. Policies can be reinstated with no lapse in coverage up to 30 days as long as a no loss statement accompanies the request and prior approval is received from the Company. CERTIFICATES OF INSURANCE: The producing agent is authorized to issue Certificates on our behalf, through our online system. A copy of the Certificate must be provided to the Company. Any Certificate requiring special language must be sent to the Company for prior approval. Certificates may not be used to alter any agreements or clauses from that which appears in the policy. When issuing the Certificate of Insurance, the Written Notice of Cancellation must state ten (10) days, unless otherwise requested by the certificate holder and approved by the Company. PRIOR CARRIER INFORMATION Prior carrier information is required to be completed on the interactive application. A Prior Carrier credit of 10% will apply if the risk is new business and has had continuous coverage for 12 months or more. A Prior Carrier credit of 5% will apply if the new business risk has had continuous coverage for at least 6 months but less than 12 months. A copy of the previous carrier s declarations page is required within 72 hours of binding. If it is found the credit was given in error, the credit will be removed and the insured will receive an additional premium that will be due immediately. All credits related to prior carrier will be reviewed by the company. A Renewal credit and a Prior Carrier credit cannot be combined. CLAIMS HISTORY INFORMATION Claims history information is required to be completed on the interactive application. A Claims free credit of 10% will apply if the risk has been claims free for the last 36 months of continuous insurance coverage. Any lapse in coverage voids the applicable credit. Any new business venture with continuous coverage for more than 12 months but less than 36 months with no lapse in coverage and no claims, will also be able to receive a claims free credit of 5%. All credits related to claims history will be reviewed by the company. A hard copy of three (3) year loss runs will be required on all of these risks and must be submitted within 72 hours of binding. If it is found that the credit was given in error, the credit will be removed and the insured will receive an additional premium that will be due immediately. WAIVER OF TRANSFER OF RIGHTS OF RECOVERY AGAINST OTHERS TO US No prior approval required. Each waiver of subrogation (CG 24 04) cost is either $100 or 10% of the policy premium, whichever is greater. Blanket waivers are prohibited. Primary or non-contributory wording is allowed and available for a flat charge of $250. TERRORISM COVERAGE Form CG 21 70 (01 08) edition is available for an additional premium of 5% of the total policy premium. SCHEDULE RATING PROGRAM: Schedule rating is available at the Company s discretion. The manual premium must be at least $1000.00 before and after the application of schedule rating. Schedule rate modifications, which are applied to the base rates, are subject to Underwriting Manager or higher ranking officer approval. Overall pricing modifications may not exceed 25%. PAYMENT PLAN New Business Monthly (12 month term policies) 20% down; and Up to 9 remaining payments due at 1 month intervals Monthly (6 month term policies) 45% down; and Up to 4 remaining payments due at 1 month intervals A $10 set up fee applies to all new and renewal policies utilizing a payment plan. Remaining payments consist of all premium not previously received divided equally over the remaining number of payments (equal premium installments) plus the installment fee. A coupon with the payment amount will be sent to the insured 15 days prior to the next due date. A $10.00 Installment Fee will be charged on every monthly payment. Renewal Business The billing process is the same as New Business with one exception: the first payment option will be mailed to the insured 50 days in advance of the renewal date. Late Payment Charge Payments under any of the plans listed above must be received by the Company on or before the due date. If any payment is received five (5) or more days after the due date, it will be subject to a $10 late fee. Failure to timely remit the premium will result in a lapse of coverage. The Company, at its discretion, may reinstate coverage upon receipt of a late payment. If a payment is not made after the late fee is charged, the policy will be cancelled for non-payment. Underpayments If the insured makes a partial payment, the payment must be at least 90% of the amount due for it to roll forward to the next payment date. If the payment is less than 90% of the amount due, the policy will be cancelled for non-payment. Insufficient Funds Charge If any payment by the insured is not accepted for deposit or returned as insufficient, the Company will charge the insured an insufficient funds charge of $15 per occurrence. A late payment charge may also apply, if applicable. Reinstatement Fee Charge $10.00 fully earned fee per each approved reinstatement. Reinstatements are to be processed through the online system. CLAIMS PROCEDURES One of our goals is to provide prompt and courteous claims service. To help accomplish our goal, we ask that you follow these guidelines: All requests for the claims department must be in writing Notices of loss, suit papers and insurance department inquiries should be faxed or express mailed to the company. Backdating the effective date and / or pro-rating any additional insured premium charges is prohibited. No manuscript wording is allowed on any of the additional insured forms.
