REPORT ON THE IMPLEMENTATION OF THE EPBD >> Energy performance certification of buildings and inspections of systems << BOSNIA AND HERZEGOVINA (Entity, REPUBLIKA SRPSKA) 1. Energy performance certificate 1. 2. Main steps/activities Requirement to lay down necessary measures to establish a system for certification of the energy performance of buildings as required by the EPBD included into appropriate national law, and necessary resources and funds for its development allocated or secured Development of Regulation on Energy Performance Certification of buildings, incl. national values for each class (A, B, C, etc.) System established through Law on physical planning and construction (Official Gazette of RS, no. 40/13). More details will be provided in rulebooks. Draft Rulebook on energy audit, Rulebook on methodology for calculation of energy performance of buildings and Rulebook on minimum requirements for energy performance of buildings have been prepared. Draft rulebooks are published on the Ministry s internet site for public to review them and submit comments. Training and educational program for energy audit have been designed by the Fund for environment protection and energy efficiency and submitted to the Ministry for review and approval. It is planned to finance licensing of legal entities through fees for issuing of licenses, while trainings and education and issuing of energy certificates will be financed from fees defined in Law and secondary legislation for these activities. Energy audit will be financed by the owner of a building, who will hire a firm to perform energy audit. The Law includes preparation of Rulebook on energy audit. Draft text has been prepared and published on the Ministry s internet site for public to review it and submit comments. 3. Description of organisational model for the energy certification system (development of EPC, issue, control, information, training and Law on physical planning and construction reads that investor, i.e. owner of a building hires legal entity to perform energy audit. Energy audit can be performed only by legal entity with license for energy audit issued by Ministry of physical planning, civil engineering and ecology of Republic of Srpska, and one of conditions to receive license is to complete training organized by Fund for environment protection and energy 1
accreditation of experts, reporting, evaluation, etc.), efficiency of Republic of Srpska. After completing energy audit, legal entity will prepare report including recommendation for energy rating and submit it to the Fund, which will, based on these facts, issue energy certificate. Data base on issued energy certificates will be installed and maintained by the Fund. Energy certificate will be valid for 10 years, and after every 10 issued certificates Fund will conduct independent control, based on random sample. Control of certificates will also be performed after received reports/claims. 4. Development of Guidelines for energy performance certification of buildings Energy audit procedure is defined by the Law and secondary legislation. After secondary legislation is adopted, short guidelines and manuals for individuals and firms will probably be prepared. 5. Development of Certification Tool (Issue, statistics, information dissemination, reporting) Fund for environment protection and energy efficiency of Republic of Srpska will issue energy certificate based on a report and recommendation for energy rating prepared by a firm. Fund will install and maintain data base on energy efficiency in buildings and issued energy certificates, and will conduct independent control based on random sample, and control of issued certificates after received reports/claims. 6. Training, examination and accreditation of experts Training and education for energy audits will be organized by Fund for environment protection and energy efficiency of Republic of Srpska. The Fund will prepare training curriculum addressing training requirements (field of training, lectures, examination.. ) Energy audit license will be issued by the Ministry pursuant to Rulebook on issuing and voidance of license for participants in the construction process. In addition to level of education and working experience, one of conditions for energy audit license will be to complete training organized by the Fund. 7. Establishment of Independent Control System 1 and Registry (system and institution) combined with the control system for inspections if applicable. Fund for environment protection and energy efficiency of Republic of Srpska pursuant to Law and Rulebook will conduct independent control based on random sample, and control of issued certificates based on reports/claims. 2. Inspection of heating and airconditioning systems Main steps/activities 8. Requirement to lay down necessary measures to establish regular inspection of heating and airconditioning systems as required by the EPBD included into appropriate national law, and necessary resources and funds for its development allocated or secured During energy audit of heating and airconditioning systems, legal entity conducting energy audit of a building is required to prepare written recommendations for economically feasible measures to increase the system s energy efficiency. However, neither Law on physical planning and construction nor associated rulebooks include stipulations on regular control of these systems. Discussions with Ministry of industry, energy and mining are underway to have the MIEM regulate this area in their secondary regulation or to include it in one of these three rulebooks prepared pursuant to Law on physical planning and construction. Energy certificates will be issued for period of 10 years, control will conducted for every 10 energy certificates based on random sample. 18. License for energy audit will be paid pursuant to the Regulation on license fees (Official Gazette of Republic of Srpska, no. 99/13), and costs of energy certificate will be defined by Fund for environment protection and energy efficiency of Republic of Srpska. Law on physical planning and construction stipulates that public sector institution using buildings with usage area over 500m 2 shall introduce energy management system pursuant to energy efficiency regulations. 20. Recommendations included in the energy performance certificate picked up from standard list or selected individually by qualified experts? Certificate will determine measures; energy efficiency auditor can also recommend other measures. 21. 22. Does review of implementation impact exists? How training and examination is implemented in practice? Fund for environment protection and energy efficiency of Republic of Srpska will install and maintain data base on energy efficiency in buildings and issued energy certificates including all public records, and will prepare reports pursuant to energy efficiency regulations. Pursuant to Law and secondary legislation, Fund for environment protection and energy efficiency of Republic of Srpska will organize training and education for energy audits. Training curriculum defines areas for which training and education will be conducted, and Ministry approves curriculum. Program defines how training is going to be implemented, who to hire as lecturers, examination, evaluation of candidates. To pass training, each candidate will have to score minimum 71 points out of 100 and will receive certificate, which is one of conditions for license for energy audit. 23. Implementation of quality assurance of energy performance certificates and of the inspection of heating and airconditioning systems give an overview of the existing (or developing) approaches regarding quality assessment schemes and structures used in your country: Process and actors Central data base Existence of automatic checks in database (register) Cost structure, etc. Energy efficiency regulations stipulate system of control of energy certificates, but it cannot be established until rulebooks are adopted. 4
24. Is there a system of grants and incentive schemes in place to inspection and certification? No, activities to find and receive grants and incentives are underway 25. Information campaigns to owners or tenants of buildings on the different methods and practices that serve to enhance energy performance, incl. purpose and objectives of energy certification and inspections? During public procedures for putting in place energy efficiency regulations in buildings, general public and owners of buildings have been informed about effects of enhanced energy performance and energy efficiency measures. It is planned to have more intensive information distribution after secondary legislation is adopted and legal framework finally defined, because energy certificate in particular will be precondition for usage permit for majority of new buildings. 26. Rules on penalties for infringements of the national provisions on certification and inspections adopted and included into relevant laws/regulations? What are possible sanctions if quality is too low? Legal system of Republic of Srpska recognizes penalties within laws and regulations, but not within rulebooks as type of secondary legislation. In Law on physical planning and construction, penalties are stipulated for infringements by investors if they fail to sign contract with authorized legal entity for energy audit. For buildings failing to ensure required minimum level of energy efficiency and required energy class, issuing of usage permit will be in question. 4.
