PHALA Attorneys ( Phala Attorneys ) is a 100% black-owned law firm established in 1997 by Mr Motladi Raymond Phala, an admitted attorney of the High Court of South Africa. During 1998 Mr Kubane Bophelo Malapela joined the Firm as a Professional Assistant and in 2001 he became a Director. The firm has a staff compliment of three professional staff (all admitted to practice as attorneys), two candidate attorneys, two legal secretary, two administrative secretaries, filing clerk and one messenger. OUR SER VICES We offer the following services to our client: Labour law Sport Law We represent our clients at the CCMA, Arbitration, labour courts as well as other administrative tribunals in respect of all labour related matters. The provision of legal advice and opinion in respect of labour related matters is ancillary to the offered in this field. The increasing commercialisation of sport has given rise to a need for quality, specialised legal advice in this area. Sport lawyers must combine technical knowledge with an appreciation of the impact that a highly competitive and rapidly changing environment requires of advisors. Our firm represents and advises sport club and sportsperson. Bankruptcy and insolvency Liquidations are no longer just about companies that cannot pay their debts, as it has become sophisticated tool of strategising and restructuring and the need for legal advice is important and will increase with the introduction of the Business Rescue dispensation. The Bankruptcy and Insolvency practice covers all aspects of liquidation and insolvency, both corporate and personal, and ranging from applications to liquidate companies, sequestrations and voluntary surrender of an individual `s estate. We have litigation experience in liquidation and sequestration and can advise clients on the most expedient method of corporate recovery (such as liquidation or sequestration). Forensic Investigation The investigation of economic crimes such as a fraud, corruption, money laundering and financial misconduct (in terms of the Public Finance Management Act) requires specialised forensic legal skills as well as an understanding of the criminal justice system and relevant legislation. Our approach to forensic investigations aims to reduce, control and prevent business related or white collar crime like fraud and false pretences, theft, breach of trust, offences against the government, corruption of public officials, counterfeiting and the insolvency process. Our team has the experience and knowledge in the applicable law of evidence and investigative legal procedures and possess the necessary interrogation and litigation not only to investigate but also to institute civil, disciplinary or criminal proceedings and to recover whatever losses may be sustained.

OUR SER VICES Litigation Constitutional and Administrative Litigation Our litigation department is a full service department covering all areas of litigation. Our Attorneys have the right to appear in the High Court of South Africa. We represent clients in litigation at arbitrations, the Magistrate s Court, the High Court and Labour Court. We have established considerable relations with a number of advocates in chambers for purposes of representation and we negotiate pricing with the latter with the aim to provide our clients with quality services at affordable prices. The commitment that we give our clients is to identify and pursue the most effective means possible of avoiding or resolving disputes. Our team of lawyers are well placed to analyse commercial litigation disputes and identify creative solutions, which wherever possible, to prevent disputes from escalating to the point where they have to be resolved by a court. If court-based litigation is ultimately unavoidable, our approach remains to attempt to resolve any dispute in a cost-effective manner aimed at generating results which are commercially relevant to our clients` needs. South African law has been transformed since the transition to democracy and the introduction of the new Constitution and its Bill of Rights. Our lawyers are equipped in advising corporate clients and other bodies on the interpretation and application of laws and administrative actions. Administration of Estates Our Administration of Estate lawyers are equipped into administering the deceased estate in terms of the Administration of Estates Act, 1965, drafting of Wills and Testament and safe keeping them on behalf our clients.

OUR DIREC TORS Mr. Motladi Raymond Phala Mr. Kubane Bophelo Malapela Motladi, a qualified Attorney, obtained his B.Proc and LLB degrees from the University of the North (now University of Limpopo). He served his article of clerkship with T.P. Moloto & Co. Ltd, employed as a Legal Advisor with Legal Wise and as a PA with F.J. Smuts Attorneys. Bophelo, a qualified Attorney, obtained a B.Proc and LLB from the University of the North. He served his article of clerkship with Raphael Kurganoff Attorneys. He continued to establish the firm in 1997. Motladi is a member of Black Lawyers Association and is actively involved in the organisation. He previously served as the member of the Legal Aid Committee in the East Rand (Ekurhuleni) overseeing seven towns. He is the former chairperson of Benoni Attorneys Association. He is a member of the SADC Lawyers Association and a member of CLA (Commonwealth Lawyers Association). He is currently the First President of Benoni Chamber of Commerce and Industries (BCCI), an Executive Board member of the Professional Board for Psychology of the Health Professions Council of South Africa (HPCSA), a Executive member of Mopani Village Body Cooperate in Benoni and a board member of School Governing Body of Rynfield Primary School in Benoni. Motladi specialises in personal injury law, commercial, Civil and criminal law and litigation. After being admitted as attorney in 1997, Bophelo was employed at Raphael Kurgenoff Attorney as Professional Assistant until he joined Phala Attorneys in 1998. He is also a member of Black Lawyers Association. Bophelo has been on the panel of Commissioner of the Small Claims Court for the Magistrate of Benoni and Daveyton since 2008 to date. He is a member of SADC Lawyers Association and a member CLA. He is the current deputy chairperson of the Benoni Attorneys` Association. He also serves on the current Task Team of the Ipelegeng Community Centre.
