APPENDIX 11 Guaranteed Maximum Electricity Utilization and Demand 11.1 PURPOSE This Appendix sets forth the Guaranteed Maximum Electricity Utilization (GMEU) and the Guaranteed Maximum Electricity Demand (GMED) for components of the Project. The applicable GMEU and GMED will be used by the Agency, as part of the Annual Settlement Process (Section 12.10 of the Service Contract), to calculate the Guaranteed Maximum Annual Electricity Costs, in accordance with Section 12.10(B) (Annual Settlement of Electricity Costs) of the Service Contract. Additionally, the applicable GMEU and GMED will be used by the Agency to determine the Net Present Value of the DBO Contractor s Proposal. This Appendix also sets forth the method for calculating the Electrical Savings Element (ESE) for Contract Years in which the Actual Annual Electricity Costs are less than the Guaranteed Maximum Annual Electricity Costs. 11.2 GUARANTEED MAXIMUM ELECTRICITY UTILIZATION The GMEU represents the maximum amount of electricity in kilowatt-hours (kwh) that will be used by components of the Project per million gallons (MG) of Finished Water delivered to the Water System. The GMEU for the Raw Water Intake Agency Facility is set forth in Attachment 11A. The GMEU for the Facility is set forth in Attachment 11B. The GMEU for the Woodland Finished Water Pumping Station is set forth in Attachment 11C. [The GMEU for the Davis Finished Water Pumping Station is set forth in Attachment 11D.] 11.3 GUARANTEED MAXIMUM ELECTRICITY DEMAND The GMED represents the maximum rate of electricity usage in kilowatts (kw) that will be used by components of the Project. The GMED for the Raw Water Intake Agency Facility is set forth in Attachment 11A. The GMED for the Facility is set forth in Attachment 11B. The DBO Contractor need not provide a GMED for the Woodland [or Davis] Finished Water Pumping Stations. 11.4 DETERMINATION OF ELECTRICITY SAVINGS ELEMENT In the event that the Actual Annual Electricity Costs are less than 95 percent of the Guaranteed Maximum Annual Electricity Costs, the ESE shall be the product of (1) the annual average electricity unit cost, and (2) applicable electricity savings, defined in Section 12.10(B) of the Service Contract as 50 percent of the difference between 95 percent of the Guaranteed Maximum Annual Electricity Costs and the Actual Annual Electricity Costs, notwithstanding restrictions defined in Section 12.10(B) of the Service Contract. The ESE shall be determined separately for the Raw Water Intake Agency Facility, the Facility, the Woodland Finished Water Pumping Station [and the Davis Finished Water Pumping Station]. Section 11 Guaranteed Maximum Electricity Utilization and Demand 11.4.1 Annual Average Electricity Unit Cost The annual average electricity unit cost for a given facility shall be determined by dividing the sum of the actual electricity costs to the Agency for that facility over the Contract Year by the sum of the actual electricity utilized by the Agency for that facility throughout the Contract Year in kwh. The electrical costs to the Agency shall reflect actual utility provider rates in effect during the Contract Year. 11.4.2 Guaranteed Maximum Annual Electricity Costs The Guaranteed Maximum Annual Electricity Costs for a given facility shall be the product of (1) the annual average electricity unit cost for that facility and (2) the GMEU for that facility at the Annual Finished Water Demand Level. 11.4.3 Example ESE Calculations Electrical savings for a given facility shall be calculated in accordance with Section 12.10(B) of the Service Contract. An example is provided below for the calculation of the ESE for the Raw Water Intake Agency Facilities. The calculation is based on the following assumptions: The Annual Finished Water Demand Level for the Contract Year in question is 24 million gallons per day (MGD). The sum of the electricity costs to the Agency for the Raw Water Intake Agency Facilities during the Contract Year was $400,000. The sum of the electricity utilized by the Agency for the Raw Water Intake Agency Facilities during the Contract Year was 4,425,000 kwh. The GMEUs for the Raw Water Intake Agency Facilities at levels of 20 and 25 MGD are 5,500,000 kwh and 6,000,000, respectively.
