Department of Finance Tel (914) 654-2072 515 North Avenue Fax (914) 654-2057 New Rochelle, NY 10801 Howard Rattner Commissioner City of New Rochelle New York REQUEST FOR PROPOSALS SPEC. # 4995 NEW RO WORKS! a CONSTRUCTION TRAINING PROGRAM The City of New Rochelle is seeking proposals for a provider to design and operate a oneyear Construction Training Program, entitled NEW RO WORKS! for New Rochelle adults (18 years and over) which will provide the following: 1.Participant Management: Provider will be responsible for providing a construction industry-specific orientation; providing participants in constructing Individual Career Plans upon their entry into the Program; identifying educational skills required for career choice, career interests, leadership development and aptitudes; fostering a peer-to-peer network; identifying potential careers; resume preparation and assistance with job applications. The City will require reporting on placement of graduates into employment. As a measure of performance for consideration for contract renewal, providers are urged to attain a placement percentage higher than 70%. Finally, providers will be required to establish a follow-up service for 90 days for graduates. 2.Construction Skills Training: Construction skills training to include providing the program participants with on-the-job construction training and other vocational/occupational training within New Rochelle. Construction training may include demolition and tear-down, recycling and reusing of materials and building and repairing systems such as mechanical, electrical and plumbing. The training shall also include basic trade competencies such as carpentry, drywall, framing, roofing and siding, tile flooring and finish millwork. All training must lead to certification or industry-recognized credentials with 90% of participants receiving certification.
Proposal Format and Content Providers should include in their proposal the following: 1. A narrative description fully describing the Program. The narrative must fully-address the two sections outlined above Participant Management and Construction Skills Training. 2. Demonstration of prior experience with similar programs 3. Demonstration of previously providing training, career guidance and occupational services to an underemployed or unemployed population who are 18 years old or older and who hold a GED or at least a 9 th Grade reading and math proficiency 4. Proof of certification under the National Center for Construction Education and Research (NCCER) and the Homebuilders Institute (HBI). 5. A budget for the one-year Program; the budget should clearly outline the costs of all services. The City will accept proposals for $38,750 or less for this program. 6. If provider is not incorporated in the State of New York, the provider must supply a Certificate to do Business in the State of New York from the NY Secretary of State prior to entering into an agreement with the City. The City is not responsible for any internal or external delivery delays that may cause the proposer s submittal to arrive beyond the deadline. Requests for Clarification All requests for clarification must be submitted, as set forth below, no later than 3:00 pm on August 2, 2013 via email to jmccalli@newrochelleny.com. Formal, written responses will be posted on the City s website no later than noon, August 7, 2013. No communications of any kind will be binding against the City except for the formal, written responses to any request for clarification posted on the website. Proposers must visit the website after the above mentioned date to view clarifications if any; the city will not notify each interested party directly. 2
Evaluation Criteria The City of New Rochelle reserves the right to award the contract generated from this RFP to the respondent who presents a proposal that best meets the requirements as listed herein and represents the most beneficial procurement as determined by the City. The award will be made by the City s RFP Evaluation Committee and shall be based on the respondent s qualifications including, but not limited to the following: references, knowledge and interpretation of the City s needs, experience with similar projects. Proposals will be evaluated and scored on the basis of the following criteria: 30 points for Participant Management: development of individual career plans, peer-topeer network, leadership development, etc. 30 points for Construction Skills Training: apprenticeship opportunities, providing on-the-job opportunities, construction training, etc. 20 points for competitive pricing to deliver the program 20 points for past experience in delivering similar programs Providers should be prepared to present their proposal to the evaluation committee if requested. General Requirements Labor Laws: The awarded firm will be required to comply with all applicable laws, including but not limited to labor laws, prevailing wage rates and workers compensation. Liability Requirements: Errors and Omissions Policy: the successful company shall apply and maintain insurance which indemnifies and holds harmless the City, its officers, employees and agents from and against any and all liability, damages, claims, demands, costs, judgments, fees, attorney s fees or loss arising directly out of acts or omissions hereunder by the contractor or third party under the direction or control of the contractor in an amount not less than $1,000,000. Other required insurances that must be furnished prior to commencement of work: Workers Compensation New York State Disability Coverage General Liability/Property Damage Automobile Liability Statutory Requirements Statutory Requirements $2,000,000 combined single limit $2,000,000 per occurrence Insurance certificates shall name the City of New Rochelle as Additional Insured Party and shall be primary over any insurance held by the City. The City of New Rochelle is named as an additional insured party for all general and excess liability coverage based on the contractual liability of the named insured. Such general and excess liability coverage shall be primary to any other coverage carried by the 3
City of New Rochelle with respects to acts or omissions of the named insured. It is intended by the parties hereto that the general and excess liability insurance provided by the contractor shall be primary to any other coverage carried by the City of New Rochelle with respect to liability coverage arising out of any act or omissions by the contractor. The City of New Rochelle will be named as an additional insured. Nothing contained herein shall be construed as making said general and excess liability insurance primary insurance for acts or omissions of the City of New Rochelle. New York Law and Venue. This contract shall be construed under the laws of the State of New York. All claims, actions, proceedings, and lawsuits brought in connection with, arising out of, related to, or seeking enforcement of this contract shall be brought in the Supreme Court of the State of New York, Westchester County. In addition, all City contractors not incorporated in the State of New York shall produce a Certificate to Do Business in the State of New York from the New York Secretary of State prior to executing their contract with the City. Resolution 205: Respondents must agree to employ best efforts to ensure minority and female participation in accordance with the attached Nondiscrimination Policy adopted by the New Rochelle City Council ( Resolution 205 ). Proprietary Information: The New York State Freedom of Information Law, Public Officers Law, Article 6, provides for public access to information. Public Officers Law, Section 87(d)(2) provides for exceptions to disclosure for records or portions thereof that are trade secrets or are submitted to an agency by a commercial enterprise or derived from information obtained from a commercial enterprise and which if disclose3d would cause substantial injury to the competitive position of the subject enterprise. Information that the proposer wishes to have treated as proprietary and confidential trade information should be identified and labeled Confidential or Proprietary on each page at the time of submittal. This information should include a written request to except it from disclosure, including a written statement of the reasons why the information should be excepted. Right to Reject Proposals: This RFP does not commit the City to award a contract, pay any cost incurred in the preparation of a proposal in response to this RFP or to procure or contract for services. The City intends to award a contract on the basis of the best interest and advantage to the City, and reserves the right to accept or reject any or all proposals received as a result of this request, to negotiate with all qualified proposers or to cancel this RFP in part or in its entirety, if it is in the best interest of the City to do so. 4
Cancellation Clauses: Any violation of the terms, conditions, requirements and/or non-performance of the agreement resulting from this RFP shall result in immediate cancellation. The agreement may be cancelled by the City of New Rochelle for any other reason(s) upon 30 days written notice. Venue: This contract shall be construed under the laws of the State of New York. All claims, actions, proceedings and lawsuits brought in connection with, arising out of, related to, or seeking enforcement of this contract shall be brought in the Supreme Court of the State of New York, Westchester County. The successful respondent must comply with all federal, state and city of New Rochelle statues and codes as may be applicable to the scope of work detailed herein, including all labor laws.
