Below are bills (proposed legislation) that C.A.B.E. has either taken a position on or is monitoring. I. English Learners AB 1935 (Kim) Local Control and Accountability Plans: Posting in Different languages. Introduced: Feb. 12, 2016. Position: Support as Introduced Summary: Current law provides that, when 15% or more of the pupils enrolled in a public school speak a single primary language other than English, all notices, reports, statements, or records sent to the parent or guardian of any such pupil by the school or school district shall, in addition to English, be written in their primary language, and may be responded to either in English or their primary language. This bill would require these multilingual notice requirements to apply to a local control and accountability plan or update or revision posted to the Internet Web site of a school district, a county of office of education, or the Superintendent of Pubic Instruction. AB 2091 (Lopez) Special Education: IEP-Translation Services. Introduced: Feb. 17, 2016. Position: Support as Introduced Summary: Current law requires a local educational agency to take any action necessary to ensure that the parent or guardian understands the proceedings at a meeting, including arranging for an interpreter for parents or guardians with deafness or whose native language is a language other than English. This bill would require a local educational agency to also provide translation services for a pupil's parent, guardian, or educational rights holder, as specified. 1
AB 2248 (Holden) Out-State-Teachers: Credentialing-English Learners. Introduced: Feb. 18, 2016. Position: Support with Amendments Summary: Existing law requires the Commission on Teacher Credentialing (CTC) to issue a clear teacher credential to an out-of-state prepared applicant who satisfies specified requirements, including verifying 2 or more years of teaching experience. This bill would require CTC to issue these teaching credentials within 30 days of receiving all required documentation. Existing law also requires CTC to issue authorizations for a teacher to provide services to pupils who are English Learners, if specified requirements are met. This bill would require CTC, within 30 days of receiving the required documentation, to issue these authorizations to a teacher who: a) holds a valid teaching credential, 2) or is applying for a certain teaching credential as an outof-state prepared teacher and is able to present a valid out-of-state credential or certificate that authorizes the equivalent level of instruction of English Learners. AB 2350 (O Donnell) English Learners: English Language Proficiency Assessments. Introduced: Feb. 18, 2016. Position: Support as Amended Summary: This bill would: 1) define the terms designated English language development and integrated English language development for purposes of the English Language Arts/English Development Framework adopted by the state board, as specified, 2) state that a middle or high school pupil who is enrolled in an English language development course or is classified as an English learner shall not be prevented from enrolling in specified other courses required for graduation or in courses that meet specified college admission standards, and would require credit toward graduation to be conferred for courses designed for long-term English learners; 3) require the State Department of Education to contract for the development of a video series demonstrating best practices for implementing designated and integrated English language development, and to make the video series available for use by local educational agencies and charter schools; 4) revise the definition of specially designed content instruction delivered in English for purposes of specified teacher credentialing provisions and 5) provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to these statutory provisions. AB 2353 (McCarty) Teacher Professional Development: Culturally Responsive Instruction. Introduced: Feb. 18, 2016. Position: Watch Summary: Would require the State Department of Education to develop a curriculum for professional development in covering culturally responsive instruction and make this curriculum available as part of its continuing education and professional development programs for teachers. The bill would state 2
legislative findings and declarations relating to the importance of culturally responsive teaching. AB 2785 (O Donnell) Special Education: English Learners Amended April 7, 2016 Position: Support as Amended Summary: This bill would: 1) require the State Department of Education, on or before July 1, 2018, to develop a manual providing guidance to local educational agencies on identifying and supporting English learners who qualify for special education services, as specified, with the goal of providing state guidance to educators on the identification and support of English learners with disabilities; and 2) promote a collaborative approach among teachers, school administrators, other personnel, and parents in determining the most appropriate academic placements and supports for these pupils. In developing the manual, the bill would: 1) require the department to review manuals produced on this topic by other states and 2) to establish and consult with a stakeholder group comprised of specified experts and practitioners. As part of implementing these provisions, the bill would: 1) require the department, with input from the stakeholder group, to develop a plan for dissemination of the manual including providing professional development on the content of the manual, as specified, and 2) require the department to submit the plan to the State Board of Education, the Department of Finance, the Legislative Analyst s Office, and the appropriate policy and fiscal committees of the Legislature on or before July 1, 2018. Lastly, the bill also states the intent of the Legislature that its provisions be funded with federal funds, to the extent permissible. SB 1384 (Liu) Children: Migrant Education: Child Development Services. Introduction: Feb. 19, 2016. Position: Watch Summary: Current law requires the children of migrant agricultural worker families to be enrolled in child development programs on the basis of specified priorities, including priority to children whose family moves from place to place. This bill, beginning July 1, 2017, would instead define "migrant agricultural worker family" as a family with at least one parent who has earned at least 50 percent of his or her income from employment in fishing, agriculture, or agriculturally related work during the 12-month period immediately preceding the date of application for child care and development services. II. Accountability AB 2527 (Weber) School Accountability: Model Surveys Introduced: Feb. 19, 2016. Position: Watch Summary: Current law requires the governing boards of school districts and county offices of education to each establish a parent advisory committee to 3
provide advice to the governing board of the school district or the county office of education regarding the requirements of local control and accountability plans. This bill would require the Superintendent of Public Instruction to convene an advisory committee consisting of representatives from the state board, public schools, governing boards of school districts, local educational agencies, parent groups, parent and youth-serving community-based organizations, and advocacy organizations to provide general guidance on, and to make recommendations relating to, the creation of model survey questions. AB 2548 (Weber) School Accountability: Statewide Accountability System. Introduced: Feb. 19, 2016. Position: Support with Amendments Summary: Would, for purposes of a statewide accountability system and to ensure alignment and fidelity with the state priorities and federal law, require the State Board of Education to adopt a statewide accountability system. The bill would require the system to satisfy the accountability requirements of specified federal law, rely upon data from key indicators established by the evaluation rubrics adopted by the state board, and, working in concert with the collaborative, utilize a multitiered system of review, support, collaboration, and intervention, aligning the level of support to the needs of the local educational agency or individual school. AB 2645 (Mayes) School Intervention: Parent Empowerment. Introduced: Feb. 19, 2016. Position: Watch Summary: Current law requires a local educational agency to implement one of several specified interventions for a school not identified as a persistently lowestachieving school that, after one full school year, is subject to corrective action, as specified, and fails to meet specified criteria and has a specified percentage of parents and legal guardians of pupils sign a petition requesting the local educational agency to implement at least one of 5 specified interventions. This bill would make non-substantive changes by updating cross-references and reorganizing language. AB 2698 (Weber) Local Accountability and Control Plans. Introduced: Feb. 19, 2016. Position: Watch Summary: Current law requires the governing board of each school district to adopt a local control and accountability plan using a template adopted by the State Board of Education. This bill would make non-substantive changes to that provision. 4
SB 871 (Liu) California Collaborative for Educational Excellence: Professional Development Training-Pilot Program. Introduced: January 14, 2016. Position: Watch Summary: Would require the California Collaborative for Educational Excellence, commencing with the 2016-17 fiscal year, to establish a statewide infrastructure to provide professional development training to school districts, county offices of education, and charter schools for the purpose of successfully implementing the evaluation rubrics adopted by the State Board of Education. This bill contains other related provisions. SB 1050 (de Leon) Elementary and Secondary Education: Achievement Gap: Teachers. Introduction: Feb. 9, 2016. Position: Watch Summary: Would state the intent of the Legislature to enact legislation that would close the achievement gap, ensure an adequate supply of well-trained teachers, expand access to quality support services, and ensure access for all pupils to a rich course of study in both academic and career-related subjects. SB 1156 (Huff) School Accountability: Academic Performance Index. Introduced: Feb. 18, 2016. Position: Watch Summary: Current law requires the Superintendent of Public Instruction, with approval of the State Board of Education, to develop an Academic Performance Index, to measure the performance of schools and school districts, especially the academic performance of pupils. This bill would make non-substantive changes to that provision. III. Assessments SB 1145 (Hueso) Language Arts: Reading-Assessments and plans. Introduced: Feb. 18, 2016. Position: Seek Amendments Summary: Would require the State Board of Education, on or before December 31, 2017, to develop a reading assessment that can be used by the public schools to assess pupils in grades 1 to 3, inclusive, in their ability to read proficiently by the end of grade 3. The bill would require public schools that enroll 5
pupils in these grades, on or before the start of the 2018-19 school year, to ensure that each pupil's reading competency is measured using the reading assessment. IV. Curriculum AB 2290 (Santiago) Pupil Instruction: Foreign Language. Amended April 13, 2016 Position: Support as Amended Summary: This bill would: 1) authorize the Superintendent to recommend revisions to the World Language Content Standards for California Public Schools, adopted pursuant to the state board and meeting specified requirements, 2) require the state board to adopt, reject, or modify the recommendations on or before July 31,2018; 3) require the state board to explain, in writing, to the Governor and the Legislature the reasons for modifying the recommended revised content standards; 4) require the Superintendent, in consultation with the state board, to select a group of experts for purposes of assisting the Superintendent in developing the recommendations; 5) require the Superintendent to hold a minimum of 2 public hearings in order for the public to provide input on the Superintendent s recommendations; 6) require the state board to adopt, reject, or modify the recommendations at a subsequent public meeting; 7) require that revision to the World Language Content Standards for California Public Schools be incorporated into the curriculum framework 8) and the evaluation criteria for world languages for purposes of adopting instructional materials. AB 2393 (McCarty) Teacher Professional Development: Cultural Responsive Instruction. Introduced: Feb. 18, 2016. Position: Watch Summary: Would require the State Department of Education to develop a curriculum for professional development in covering culturally responsive instruction and make this curriculum available as part of its continuing education and professional development programs for teachers. The bill would state legislative findings and declarations relating to the importance of culturally responsive teaching. AB 2864 (Chau) Pupil Instruction: Chinese Exclusion Act of 1882 and Geary Act of 1892. Introduced: Feb. 19, 2016. Position: Support Summary: Would encourage all state and local professional development activities to provide teachers with content background and resources to assist 6
them in teaching about the Chinese Exclusion Act of 1882, the Geary Act of 1892, and other specified laws relating to the discrimination against, and mistreatment of, Chinese and other minority groups. The bill would require those laws be considered in the next cycle in which the history-social science curriculum framework and its accompanying instructional materials are adopted. V. Early Childhood Education/Pre-School AB 2410 (Bonta) Early Learning: Local Control School Readiness Act of 2016. Introduction: Feb. 19,2016. Position: Watch Summary: Would enact the Local Control School Readiness Act of 2016. The bill would require the State Department of Education to develop pre-kindergarten learning development guidelines, focused on preparing 4- and 5-year-old children for kindergarten, based on current science that reflects how publicly funded programs can close the school readiness gap. AB 2660 (McCarty) Early Education: Three-Year Plan. Introduction: Feb. 19, 2016. Position: Support Summary: Would require the State Department of Education, in consultation with the State Board of Education and the State Advisory Council on Early Learning and Care, on or before July 1, 2017, to submit to the Legislature and the Department of Finance a plan that provides a 3-year plan for providing access to income eligible children to high-quality pre-kindergarten programs for a minimum of one year before enrollment in kindergarten and a 3-year plan for ensuring that publicly funded pre-kindergarten programs focus on certain areas. VI. Parent Engagement AB 2297 (Garcia) Migrant Children: Parent Advisory Councils. Introduced: Feb. 18, 2016. Position: Watch Summary: Current law specifies the responsibilities of parent advisory councils at the district, regional, and state levels, and of school districts or other agencies operating programs for migrant pupils, and requires the responsibilities of the state board and the department to be set forth in the master plan. This bill would make non-substantive changes to this provision. 7
AB 2680 (Bonilla) Parent, pupil and family engagement support and services: plans. Introduced: Feb. 19, 2016. Position: Support with Amendments Summary: Would, subject to funding being provided for purposes of this act in the annual Budget Act, require local educational agencies, including county offices of education, charter schools, alternative education programs and schools, state special schools, and state subsidized preschools and child development programs, that elect to participate in family, parent, and pupil engagement support and services to develop a plan that addresses at least one specified parent, pupil, and family engagement elements relating to active and meaningful participation and training. VII. Teachers AB 2122 (McCarty) California Classified School Employee: Teacher Credentialing Program. Introduced: Feb. 17, 2016. Position: Support Summary: The Wildman-Keeley-Solis Exemplary Teacher Training Act of 1997 establishes the California School Paraprofessional Teacher Training Program for the purpose of recruiting paraprofessionals to participate in a program designed to encourage them to enroll in teacher training programs and to provide instructional service as teachers in the public schools. This bill would substantially revise those provisions to instead establish the California Classified School Employee Teacher Credentialing Program for the purpose of recruiting classified school employees to participate in a program designed to encourage them to enroll in teacher training programs and to provide instructional service as teachers in the public schools. AB 2200 (Thurmond) Teachers: Recruitment and Retention. Introduced: Feb. 17, 2016. Position: Watch Summary: Current law establishes various programs for the recruitment of teachers. This bill would state the intent of the Legislature to enact legislation that would guarantee that every pupil has access to high-quality educators by ensuring that pupils' educators are able to live in the communities in which they serve. The bill would also state legislative findings and declarations relating to that purpose. 8
AB 2264 (Jones-Sawyer) Teachers: Training and Support. Introduced: Feb. 18, 2016. Position: Watch Summary: Current law establishes the California Beginning Teacher Support and Assessment System to, among other things, provide an effective transition into the teaching career for first-year and 2nd-year teachers. This bill would express the Legislature's intent to enact legislation that would support the development of a professional system of training and support for new and current teachers focused on creating and maintaining effective environments for pupil learning and that would ensure the training is aligned with certain performance expectations. AB 2336 Teacher Credentialing: Emergency Substitute Teacher Permits. Introduced: Feb. 18, 2016. Position: Watch Summary: Would, until January 1, 2022, require the Commission on Teacher Credentialing to issue Emergency Substitute Teaching Permits authorizing the holder to substitute teach, limited each school year to up to 60 days for any one teacher in a general education classroom or 40 days for any one teacher in a special education classroom. AB 2401 (O Donnell) Teachers: BTSA Program. Introduced: Feb 18, 2016. Position: Watch Summary: Current law establishes the California Beginning Teacher Support and Assessment System, to be administered jointly by the Commission on Teacher Credentialing and the Superintendent of Public Instruction for specified purposes, including providing an effective transition into the teaching career for first-year and 2nd-year teachers in California. This bill would make legislative findings and declarations regarding the teacher shortage in the state and the California Beginning Teacher Support and Assessment System. This bill contains other related provisions. SB 915 (Liu) Teacher Recruitment: California Center on Teaching Careers. Introduced: Jan. 26, 2016. Position: Support with Amendments Summary: Would establish the California Center on Teaching Careers for the purposes of recruiting qualified and capable individuals into the teaching profession. From funds appropriated for that purpose, the Superintendent of Public Instruction would be required to contract with a local educational agency to establish and administer the center with the concurrence, as defined, of representatives of the Commission on Teacher Credentialing, the University of 9
California, the California State University, and independent institutions of higher education, as defined. SB 916 (Allen) Teacher Credentialing. Introduced: Jan. 27, 2016. Position: Support Summary: Current law authorizes the Commission on Teacher Credentialing to issue single subject teaching credentials only in specific subjects. This bill would add dance and theatre to the list of authorized subjects. This bill contains other related provisions and other current laws. SB 933 (Allen) Teachers: California Teacher Corps Act of 2016: teacher residency programs. Introduced: Feb. 2, 2016. Support with Amendments Summary: Would establish the California Teacher Corps Act of 2016, under which the Superintendent of Public Instruction would make grants to applicant high-need local educational agencies and high-need consortium of local educational agencies, as defined, to assist these agencies in establishing and maintaining teacher residency programs, as defined. The teacher residency programs established by the bill would be defined as school-based teacher preparation programs in which a prospective teacher would teach alongside an experienced mentor teacher, as defined, while also receiving teacher training instruction in a teacher credentialing program in a qualified institution of higher education. VIII. School Finance AB 2587 (Wilk) School Funding: ADA Calculation. Introduced: Feb. 18, 2016. Position: Watch Summary: Current law establishes a public school system that requires state funding for school districts and charter schools to be calculated pursuant to a local control funding formula, as specified. Current law requires the local control funding formula, in part, to be based on average daily attendance, as defined. This bill would provide that, for the purposes of funding, the average daily 10
attendance for a school district or charter school that has an average daily attendance calculated to be 94% or higher shall be considered 100%. SB 963 (Anderson) Education Finance: local control funding formula: supplemental and concentration grants. Introduced: Feb. 8, 2016. Position: Watch Summary: Current law requires funding pursuant to the local control funding formula to include, in addition to a base grant, supplemental and concentration grant add-ons that are based on the percentage of pupils who are English learners, foster youth, or eligible for free or reduced-price meals, as specified, served by the county superintendent of schools, school district, or charter school. Current law requires the State Board of Education to adopt regulations that govern the expenditure of funds apportioned pursuant to the supplemental and concentration grant add-ons. This bill would make non-substantive changes to the provision requiring the state board to adopt regulations that govern the expenditure of funds apportioned pursuant to the supplemental and concentration grant add-ons. IX. Other AB 2072 (Chang) S.T.E.M. State Seal. Introduced: Feb. 17, 2016. Position: Support Summary: Current law establishes the Golden State Seal Merit Diploma for the purpose of recognizing pupils who have mastered the high school curriculum. Current law also establishes the State Seal of Biliteracy to recognize high school graduates who have attained a high level of proficiency in speaking, reading, and writing in one or more languages in addition to English. This bill would express the Legislature's intent to enact legislation that would establish a State Science, Technology, Engineering, and Mathematics (STEM) Seal. 11
