The ordinance requires providers of local exchange service or exchange access to bill telephone subscribers for the fee, to collect the fee and to remit collected fees with remittance reports to the County. Santa Clara County Emergency Response and Disaster Preparedness (ERDP) Fee Service Suppliers FAQs What is the Emergency Response and Disaster Preparedness (ERDP) Fee? It is a fee imposed on subscribers of local telephone service in Santa Clara County, who have direct or indirect access to the County s 911 communications system or disaster preparedness services. The fee recovers a portion of the County s cost for operating and maintaining its 911 communications system, and for activities to prepare for, mitigate and deal with emergency/disaster situations. How is the fee billed? Fees are collected and remitted in accordance with Santa Clara County Code Chapter XVI, Sections A14-92 through A14-112, established by County of Santa Clara Ordinance No. NS-300.788. Each month service suppliers providing access, through the use of any technology, to local telephone services in Santa Clara County shall bill customers for the Santa Clara County Emergency Response and Disaster Preparedness Fee. For wireless service, the fee shall apply to subscribers of wireless telephone service with a location within Santa Clara County as its place of primary use as defined in U.S.C. Section 124(8). When does fee billing begin? Billing for fees shall begin May 1, 2008. How much is the fee? Fee rates differ for single access lines, trunk lines and high-capacity trunk lines based on the relative levels of access. In addition, fees vary by corporate jurisdiction proportionate to the benefit provided to the jurisdiction through operation of the County s 911 communications system. Does the fee apply to all customers? Fees shall not be assessed on services for the following: A Lifeline services customer of a Service Supplier Coin-operated telephones A non-profit hospital which is exempt from federal income tax under Section 501(a) of the United States Code A non-profit educational organization which is exempt from income tax under Section 501(a) of the United States Code Any person, agency or organization, when imposition of such fee upon that person, agency or organization would violate the Constitution of the United States, the Constitution of the State of California, or preemptive federal or state law A government entity A Service Supplier. What if a telephone service supplier s existing billing system is not capable of billing for the fee as required by Santa Clara County Code Chapter XVI, Sections A14-92 through A14-112? Service suppliers may apply for consideration of establishing an administrative agreement with the County to recover the service supplier s one-time cost for a reasonable modification to the billing system in order to comply with requirements for fee billing. Fee revenues are submitted on or before the last day of the month following the month in which the fees were collected, together with monthly reports for access lines, trunk lines and high-capacity trunk lines. Forms are available on the http://www.sccgov.org/portal/site/fin website. Service suppliers may deduct an administrative charge from ERDP fees collected to cover the cost of collecting the ERDP fee, up to 1/8 of 1% of fees collected. Fee revenues and reports shall be submitted monthly to: County of Santa Clara Communications Dept. Finance Director 2700 Carol Drive San Jose, CA 95125 Can service suppliers submit fee revenues electronically to the County? At present, electronic remittance is not available, but is being considered for the future. Is a Service Supplier responsible for submitting fees that are not collected? No, as long as a service supplier charges for and makes good faith effort to collect applicable fees. If a service supplier receives a partial payment for a monthly bill from a subscriber, the amount received shall first be applied to the payment due the Service Supplier for providing communications service. When a subscriber refuses or fails to pay the fee for four or more billing periods, the service supplier shall provide subscriber s name and address.
