The Town of Windsor is requesting quotes for the construction of a drying bed located at the Windsor Water Treatment Plant waste lagoon site at 786 Windsor Back Rd. Sealed Quotations clearly marked as Drying Bed Construction, addressed to Todd Richard, Director of Public Works will be received by the Town of Windsor at 100 King Street, Windsor, Nova Scotia no later than 3:00pm local time on May 13, 2016. Quotes received after that time will be returned unopened. Any documents submitted with respect to this Quotation will be subject to Municipal Freedom of Information and Protection Act. INFORMATION AND INSTRUCTIONS Bid Form Quotations must be submitted on the attached Bid Form and enclosed in a sealed envelope supplied by the Bidder. Bidders are to affix the attached mailing label, which is the last page of these documents, using their own envelope. The Bids must be legible, written in ink or typewritten. Any form of erasure, strikeout or over-writing must be initialed by the Bidder s authorized signing officer. The Bid Form must be signed and witnessed in the spaces provided on the form, with the signature of the Bidder or responsible official of a firm bidding. Successful Bidder will be required to supply Worker s Compensation, Clearance Letter, Nova Scotia Construction Safety Association, certification or equivalent and a copy of General Liability and Vehicle Insurance Coverage naming Town of Windsor as co-insured, prior to starting work.
SUBMISSIONS OF BIDS Submissions shall not be made by e-mail or facsimile. Adjustment by e-mail, facsimile, letter or otherwise to a Bid already submitted is not permitted. A Bidder will be permitted to withdraw his/her Bid unopened after it has been deposited, if such request is received in writing by the Director of Public Works prior to the time specified for the opening of Quotations TERMS OF PAYMENT Pricing must be in Canadian Funds, quoted separately for each item stipulated. All prices Quoted are to be met and to be firm until completion of the work. However, if Bidders are unable to Quote firm prices, they must complete the application blanks on the Form of Quotation stating the maximum percentage increase for the work or materials Quoted. In this case, invoices must not exceed the total amount of the net price plus the maximum percentage increase. All prices Quoted are to show all applicable tax extra unless it is noted on the Form of Quotation that a portion is exempt. EVALUATION OF SUBMISSIONS Intent of Description It is the intent of the description to briefly describe the work involved in this Bid. It is the responsibility of the Bidder to be familiar with job described. Any omission to the description as provided will be up to the Bidder to confirm. Any alterations or deletions to the specifications as provided will be priced and added to the bid prices prior to ranking. Disputes In cases of dispute as to whether or not an item Quoted or Delivered meets specifications, the decision of the Director of Public Works shall be final and binding on both parties.
Improper Bids Bids which are incomplete, conditional or obscure, or which contain erasures, alterations, or additions not called for, or irregularities of any kind, may be rejected as improper. The Town of Windsor reserves the right to waive irregularities. Right of Town to Accept or Reject Bids The Town of Windsor reserves the right to accept or reject any or all Bids for any reason whatsoever, and to accept any Bid if considered to be in the best interest to the Town of Windsor. The lowest or any Bid will not necessary be accepted. Criteria including best overall value, other than price alone may be considered when evaluating Bids. ACCEPTANCE OF AWARD This Bid submission is irrevocable and open for acceptance by the Town of Windsor until sixty (60) days after the closing date of Quotation. Award of these Bids will be subject to Town of Windsor approval, as per purchasing/tender policy. No announcement concerning the successful bidder will be made until a complete report is prepared by the Director of Public Works and approved by Town council (if necessary). The successful bidder agrees to be bound by the terms and conditions of this Quotation document. The Quotation form and Quotation submitted become part of the contract document. The successful bidder must accept a Purchase Order of Contract from the Town of Windsor which will supersede all other contracts. Supply of any work or material by the successful bidder that does not conform to the completed Quotation document as accepted by the Town from the bidder or failure to deliver any item shall be just cause for the Town to take appropriate action to provide satisfactory remedy. The successful bidder will not, without the written consent of the Town of Windsor, make any assignment or any sub contract for the execution of any product herby Quoted.
STATED TIME AND DATES Starting and completion dates must be stated on the Form of Quotation. By specifying dates, the successful bidder agrees to be bound by those dates. Failure to meet stated delivery time(s) by the successful bidder shall be just cause for the Town to take appropriate action that shall be in the best interest of the Town. The Town shall exercise due diligence and fairness in seeking any remedy and shall take into consideration such factors as delays by weather or material suppliers. However, notwithstanding these circumstances, the order may be cancelled at the option of, and without recourse to the Town of Windsor. Pending full and satisfactory supply of all items described in this Quotation, a hold back of the value of the said deficiencies will be exercised. Failure to comply with all terms, specifications, requirement, conditions and general provisions of this Quotation, to the satisfaction of the Town of Windsor shall be just cause for the cancellation of the contract award. The Town of Windsor shall then have the right to award this contract to any other bidder or to re-issue the Quotation. The Town of Windsor shall assess against the Bidder, any damage whatsoever as a result of the failure to perform. DRYING BED CONSTRUCTION Work will consist of preparing, grading and finishing an approximate 0.62acre drying bed. The area has been grubbed and is clear of stumps and large rocks. Price to include: Leveling and grading Sloping area approximately 2% towards east side ditch If any excess material is left, place and compact in the northwest corner of the waste lagoon site Supply, place, roll and compact 4-6 of medium to coarse sand over bed area
GENERAL REQUIREMENTS Entrance to the site must be arranged ahead of time with the Water Treatment Plant Personnel. All work to be done in accordance with; 1. Appendix 4a, Mill Lakes Watershed Best Practices ~ Road construction & Maintenance 2. Appendix 4b, Mill Lakes Watershed Best Practices ~ Forestry WARRANTY All work to be guaranteed by the bidder for a period of one calendar year after substantial completion.
