2 Proposals to Metropolitan Community College (MCC) for an Electronic Curriculum Development and Management Tool will be received by the Board of Governors in the Purchasing Department, Fort Omaha Campus, 30 th & Fort Streets, Building 30, Omaha, Nebraska until 2:00pm, local time on January 29, Please send an indicating your intent to submit a proposal to Rich Hanneman at: [email protected] by 5:00 pm, local time on January 13, 2015, or as soon thereafter as possible. All questions with respect to this Request for Proposals (RFP) should also be sent to [email protected]. MCC will treat all proposals as proprietary and confidential information and, therefore, not subject to public disclosure, until the execution of any resulting agreement with a successful proposer, or until all proposals are rejected, at which time they may be considered public information and subject to State of Nebraska public records laws. All proposals must be valid for a period of 120 days from the submission deadline date. Proposals must be signed and dated by an authorized official to bind the proposer to its provisions. No ed or facsimile proposals will be accepted. MCC reserves the right to conduct discussions with any or all firms/individuals who respond to this RFP for the purpose of clarification and modification. Discussion and negotiation may include, but is not limited to, details of the conveyance, characteristics of the property, zoning, schedule, pricing, and economic information. MCC will not be responsible for any costs incurred in the preparation or submission of the proposal. MCC reserves the right to reject any and all proposals, wholly or in part, to waive any technicalities, informalities, or irregularities in any proposals which do not materially affect the integrity or effectiveness of the competitive proposal process, and, unless otherwise specified by the proposer in their proposal, to accept any item or group of items in the proposal. MCC further reserves the right to analyze proposals in detail and award contracts which it, in the exercise of reasonable discretion, believe(s) to be in its best interest.

3 By submission of an RFP, the proposer certifies that he/she/it agrees to the general conditions and specifications as stated herein in their entirety. Upon acceptance by MCC, this RFP and, to the extent agreed to by MCC, proposer s response, shall constitute terms of the contract between the successful proposer and MCC. Any exceptions by the proposer shall be clearly noted in the RFP response. 4 SCOPE OF WORK MCC is seeking proposals for an electronic curriculum development and management tool that includes features to promote and support performance based learning and assessment. The tool must support the ability to develop and demonstrate alignment among industry standards, measurable instructional objectives, assessments, and student outcomes. The tool will support the development and delivery of competency based education (CBE), allowing for both direct assessment and CBE delivered within traditional time-based models. The tool will support backward design wherein performance outcomes and assessments guide course content and design. The tool will support mapping of course outcomes, objectives, and content across modules or units, courses, and entire programs. The tool will enable consistency, integrity, and management of course and program content. Support must include accessible resources for quick start-up, such as online tutorials or webinars. Responses will demonstrate cost-effective solutions for more limited year one implementation (such as courses across two program areas), scaling to include courses in multiple program areas in years two and three. Responses must include year one start-up costs for licensing and resources, as well as information on the costs for licensing and resources for year two and beyond. If costs for data integration with Colleague are included in your response, they must be listed separately from the cost of licensing, as MCC does not have immediate plans for Colleague integration. In your response, please separate the costs of licensing with any optional fee-for-service such as fees for hosting, maintenance, automatic upgrades, training, or other support.

5 METROPOLITAN COMMUNITY COLLEGE PURCHASING DEPARTMENT OMAHA, NEBRASKA STANDARD CONDITIONS AND TERMS OF PROPOSAL SUBMISSION AND ACCEPTANCE SCOPE These standard conditions and terms of proposal submission and acceptance apply in like force to this inquiry and to any subsequent contract resulting herefrom. PRICES Prices quoted shall be inclusive of ALL discounts. Cash discount terms of less than twenty days will not be considered as part of the proposal. Cash discount periods will be computed from the date of receipt of a properly executed claim voucher or the date of completion of delivery of all terms in a satisfactory condition, whichever is later. COLLUSIVE BIDDING The proposer s signature on this proposal is a guarantee that the prices quoted have been arrived at without collusion with other eligible proposers and without effort to preclude the College from obtaining the lowest possible competitive price. TAXES Purchases made by the College are exempt from the payment of Federal Excise Taxes and Nebraska Sales and Use Taxes. Tax exemption certificates will be furnished upon request. AWARD The College reserves the right to reject any or all proposals, wholly or in part, to waive any technicality or requirement in any proposal, to make awards in a manner deemed in the best interest of the College, which may or may not be the low proposal and, unless otherwise conspicuously specified by the proposer, to accept any item in the proposal. TERMINATION FOR CAUSE The College may terminate the contract(s) resulting from this RFP at any time if the proposer fails to satisfactorily fulfill the terms, or fails to make substantial progress toward the fulfillment of terms, as specified in this document and resulting contract documents. In such an event, the College shall provide the proposer with a thirty (30) day written notice of conditions which endanger contract performance. If, after such notice, the proposer fails to remedy the listed conditions, the College may issue an order to the proposer for immediate cancellation of the contract(s). SUBCONTRACTING Proposer shall notify College of all intended subcontractors in advance of execution of subcontract(s) and shall discuss and resolve to College s satisfaction any College objections to the use of said subcontractor(s).

6 CONTRACT ASSIGNMENT Contracts established as a result of this RFP shall not be transferred or assigned without prior written consent of the College. GOVERNING LAW All contracts arising out of this RFP shall be governed in all respects by the laws of the State of Nebraska and the venue for any litigation with respect thereto shall be in the state or federal courts in Omaha, Douglas County, Nebraska. Nothing in this section shall prevent the parties from agreeing to settle any dispute arising between them through arbitration or mediation. PREVIOUS AGREEMENTS This RFP and any resulting purchase order/contract(s) cancels and supersedes any prior understandings or agreements between the parties relating to the subject matter hereof. The purchase order/contract(s), and the contained provisions incorporated by reference herein, express the complete and final understanding of the parties with respect thereto, and may not be changed in any way except by an instrument in writing signed by both parties. NONDISCRIMINATION The proposer, and any subcontractor of the proposer, represents and agrees that (i) it is complying with and, if awarded a contract regarding the Project, it will continue to comply with fair labor standards and the Nebraska Fair Employment Practice Act in its business and performance under the Contract, (ii) it will comply with section 503 of the Rehabilitation Act of 1973, section 402 of the Vietnam Era Veterans Readjustment Assistance Act of 1974, and implementing regulations in 41 CFR Parts 60-1 through , (iii) like the College, it shall abide by the requirements of 41 CFR (a), (a) and (a). (These regulations prohibit discrimination against qualified individuals based on their status as protected veterans or individuals with disabilities, and prohibit discrimination against all individuals based on their race, color, religion, sex, or national origin. Moreover, these regulations require that covered prime contractors and subcontractors take affirmative action to employ and advance in employment individuals without regard to race, color, religion, sex, national origin, protected veteran status or disability), (iv) it will comply with all other applicable federal, state and local laws, rules, orders, and regulations, and (v) the foregoing requirements shall apply to, and a similar provision will be incorporated into, any agreement with a subcontractor resulting from this Agreement. NEW EMPLOYEE WORK ELIGIBILITY STATUS Pursuant to Neb. Rev. Stat through 4-114, proposer is required, and hereby agrees, to use a federal immigration verification system to determine the work eligibility status of new employees physically performing services within the State of Nebraska. proposer is further required, and hereby agrees, to require that all subcontractors on the Project, if any, use a federal immigration verification system to determine the work eligibility status of new employees physically performing services within the State of Nebraska. Federal immigration verification system means the electronic verification of the work authorization program of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996, 8 U.S.C. 1324a, known as the E-Verify Program, or an equivalent federal program designated by the United States

7 Department of Homeland Security or other federal agency authorized to verify the work eligibility status of a newly hired employee pursuant to the Immigration Reform and Control Act of CLASSIFICATION OF WORKERS Proposer, and all lower-tiered subcontractors under proposer on the project, if any, shall properly classify all workers as either employees of proposer or of the lower-tiered subcontractor or as independent contractors according to applicable law, and shall treat them accordingly for purposes of workers compensation insurance coverage, unemployment taxes, Social Security and Medicare taxes, income tax withholding, and any and all other payments or benefits incident to or affected by such status. Proposer, and all lower-tiered subcontractors under proposer on the project, if any, utilizing the services of workers who are properly and according to applicable law not classified as employees under this subsection, shall provide written notice to said workers of their status as independent contractors. Said notice shall include a provision advising said workers that they are not eligible for workers compensation insurance coverage, payment of unemployment taxes, Social Security and Medicare taxes, income tax withholding and any and all other payments or benefits incident to or affected by such status, from proposer or lower-tiered subcontractor(s). Copies of such notices shall be made available to College upon request. Failure by the proposer, or any lower-tiered subcontractor engaged by the proposer, to fully comply with the terms of this provision shall be considered and treated by College as a material breach of any contract awarded respecting the project. EXECUTION Proposals must be signed by the proposer and all quotations must be typewritten or in ink. Erasures and alterations must be initialed by the proposer in ink. Failure to comply with these provisions may result in the rejection of the proposal.
