The use of the loan whih may be granted by the Lender under this appliation is subjet to the terms and onditions of the Master Mortgage Insurane Poliy (the Poliy ) whih the Lender has entered into with the HKMC (or the Insurer, where appliable) for the Lender s own protetion, interest and benefit. Notwithstanding that the Obligor(s) is/are required to pay the Lender an amount equal to the premium payable by the Lender for the mortgage insurane over provided to the Lender by the HKMC (or the Insurer, where appliable) pursuant to the Poliy, the Poliy is for the sole and exlusive benefit of the Lender, and that none of the Obligors shall be deemed to be a party to it, or a benefiiary of it, and that no payment made under the Poliy to the Lender shall affet or redue the Lender s rights of remedy against any of the Obligors in the event of default of the loan. 13. Eah of the Obligors (other than Obligor 1 if it is a shelf ompany) hereby authorises the HKMC (or the Insurer, where appliable): (a) to obtain, on his/her behalf and within 90 days from the day of signing of this Appliation Form by the relevant Obligor, a opy of his/her redit report from the CRA for the purposes of mortgage insurane over to be granted by the HKMC (or the Insurer, where appliable) relating to the Property and other related purposes, and any other purposes in onnetion with the mortgage related business of the HKMC (or the Insurer, where appliable), inluding without limitation the purhase of mortgage portfolio by the HKMC (or the Insurer, where appliable) and the administration thereof, and in this onnetion onsents to and authorises the CRA to provide a opy of the redit report diretly to the HKMC (or the Insurer, where appliable) without having first sent him/her a opy for review; and (b) to use any personal data and other information relating to him/her whih have been lawfully olleted by the HKMC (or the Insurer, where appliable) or otherwise made available to it for the purpose of verifying any information provided by him/her in onnetion with this appliation. 14. Eah of the Obligors shall keep the Lender informed of any hange of fats or irumstanes whih may render any information, statements, representations and/or partiulars given hereunder, inorret or untrue before the drawdown and eah of the Obligors understands the non-dislosure of any suh fats or irumstanes may amount to making intentional or negligent misrepresentation(s) and/or providing fraudulent information as mentioned in paragraph 19 above. 21. In ase the Obligor(s) has/have applied or the Obligor(s) later deide(s) to apply for additional finane seured by the Property from the Developer or other Lending Institution or entity, the Obligor(s) undertake(s) to notify the Lender in writing immediately of the details of suh finane inluding but not limited to any ash rebate or other disount offer. Eah of the Obligors understands that any loan offer made by the Lender may be revised following suh notifiation. 22. Eah of the Obligors aknowledges that the Lender may deline: (i)his/her/its/their appliation in its entirety; or (ii) if the Obligor(s) has/ have applied for more than one produt or servie in his/her/its/their appliation, any partiular produt or servie, without giving the Obligor(s) any reason for doing so. If this happens, no ontratual relationship arises between the Lender and the Obligor(s) in respet of any produt or servie requested in his/her/its/ their appliation whih the Lender has delined to provide. 23. Eah of the Obligors shall be subjet to redit re-assessment if any detail or information he/she/they has/have provided under this appliation or reord hanges subsequent to submission of this Mortgage Loan Servie Appliation and before loan drawdown. The Bank may vary or withdraw any loan approval based on the results of the suh redit re-assessment. 24. Eah of the Obligors aknowledges and agrees that: (i) the following terms & onditions have been provided and made available to him/her/it/them at any of the Lender s branhes and/or on website at http://www.s.om/hk: (a) the Mortgage Faility Terms; (b) Additional Terms and Conditions where part of the Faility is insured under Mortgage Insurane Programme Relating to Residential Mortgage, Equitable Mortgage and Relevant Legal Charge; () Client Terms and the appliable douments referred to in Part A thereof (banking agreement); and (d) If the Obligor(s) is/are applying for the Home BonusPak, Home BonusPak Terms and Conditions, the Priority Banking / Personal Banking Privileged Plan / Easy Banking Terms and Conditions (inluding Important Notes on Appliation), the Credit Card Terms and the Terms and Conditions for Standard Chartered Credit Card Appliation and Highlights of Credit Card Terms. If I/we fail to do so, the Bank will arrange fire insurane on my/our behalf and will debit the insurane premium from my/our aount diretly. d) By seleting bank arrangement, I/we onsent to and hereby authorise the Bank to send all relevant data to the insurer for the purpose of proessing the fire insurane appliation and the poliy will be automatially renewed on annual basis. Notwithstanding the above, the Bank is not liable to me/ us for any loss I/we suffer in onnetion with any lapse in insurane over or failure to renew. e) Provision of insurane over is at the sole disretion of the insurer. If insurane over is provided, a ontrat of insurane between me/us and the insurer will be provided to me/us by the insurer and I/we will be bound by and have rights granted to me/us by that ontrat in aordane with its terms and onditions. f) Whilst the Bank will not be a party to any ontrat of insurane, the Bank must be noted on the ontrat of insurane as a benefiiary and/or interested party. If the Bank ask, I/we must give the Bank a opy of the poliy. g) I/We understand that I/we may hoose to take out a fire insurane poliy (from an insurane ompany on the Bank s approved list or not), or to adopt the master fire insurane poliy of the property (where this is aeptable to the Bank). If I/we wish to employ an insurane ompany not on the Bank s approved list, I/we understand that I/we have to follow the Bank s proedures involved and the minimum riteria to be fulfilled by the insurane ompany. h) I/We understand that I/we an hoose the original loan value, the urrent loan value (if higher than the reinstatement value) or the reinstatement value as the sum insured. If I/we hoose the reinstatement value, an annual valuation report from one of the Bank s approved surveyors will be required. An administration fee of HK$1000 per year will be harged if I/we wish the Bank to obtain a valuation report on my/our behalf. 26. For the appointment of soliitor(s), I /we aknowledge that: (i) I/we have to pay for the legal expense of both the soliitor who represents myself/ourselves and the soliitor who represents the Bank to prepare the mortgage faility; (ii) the Bank employs only a soliitor on the Bank s panel to represent the Bank; (iii) I/We have the right to engage my/our own soliitor, but where a panel firm is available, I/we may be required to engage a firm on the Bank s panel. If I/we engage a soliitor not on the Bank s panel, I/we may inur inreased osts and/or delay in the doumentation and disbursement proess for additional work on the doumentation review. The Bank will not be liable for losses or damages whih I/we may inur or sustain in onnetion with me/us engaging my/our own soliitor. 27. I/We understand that if I/we anel this appliation or do not drawdown the mortgage loan within the speified period as stated on the Letter of Confirmation ( LOC ) after signing of LOC, a proessing fee as shown in the Key Fats Statement and/or LOC will be harged by the Bank. 28. Eah of the Obligors authorizes the Lender to notify on his/her/their appliation status and related information via SMS to his/her/their mobile phone(s) when the Lender see fits. 29. Eah of the Obligors understand that sales staff of the Bank reeives remuneration with referene to the performane of the relevant staff for promoting various banking and related servies that provided by the Bank. The following applies to appliations with guarantor(s) or provider(s) of seurity: 30. Eah of the Obligors hereby gives onsent to the Lender to provide the following information and/or douments relating to the Obligor(s) to (1) any oborrower, guarantor or provider of seurity in respet of any loan or redit failities extended to the Obligor(s) and/or (2) any soliitor ating for suh oborrower, guarantor or provider of seurity: (a) any finanial information onerning the Obligor(s); (b) a opy of the ontrat and opies of the ontrats from time to time evidening the obligations to be guaranteed or seured or a summary thereof; () a opy of any formal demand for overdue payment whih is sent to the Obligor(s), if any Obligor(s) has/have failed to settle any overdue amount following a ustomary reminder; and (d) from time to time on request by any suh o-borrower, guarantor or provider of seurity, a opy of the latest statement of aount provided to the Obligor(s) 31. Not Proteted under Deposit Protetion Sheme The Bank gives me/us notie, and I/we understand and aknowledge that, sum of money in the MortgageOne Aount is NOT an alternative to ordinary saving or time deposit, and is NOT a proteted deposit and NOT being proteted under the Deposit Protetion Sheme in Hong Kong. 32. Additional Delaration and Undertaking in relation to a Non Ower-Oupied Property Loan (where appliable) In respet of a Non Owner-Oupied Property Loan and where Obligor 1 is a shelf ompany, eah of the Obligors hereby agrees, delares, onfirms, aknowledges and undertakes that: (a) Obligor 1 is not and will not at the time of drawdown of the loan be engaged in any business ativities other than the holding of the Property and the letting thereof; and (b) the relevant mortgage will be registered with the Hong Kong Companies Registry (for Hong Kong inorporated ompany) or that other similar registration will be ompleted (for foreign inorporated ompany) within the appliable time limit, and doumentary evidene of any suh registration shall be provided to the Lender and/or the HKMC (or the Insurer, where appliable), within a reasonable time. Additional Delaration and Undertaking in Handling of Personal Data Eah of the Obligors (other than Obligor 1 if it is a shelf ompany) has read and understood the ontents of the Notie to Customers and Other Individuals relating to the Personal Data (Privay) Ordinane ( Ordinane ) and the Code of Pratie on Consumer Credit Data ( Notie ) (whih aompany this Appliation Form or whih have previously been provided by the Lender to any suh Obligor(s)) and hereby onsents to the Lender for its use, dislosure and/or transfer of eah suh Obligor s personal data in the manner set out in the Notie from time to time before, during or after this appliation. In addition to the above, eah of the Obligors (other than Obligor 1 if it is a shelf ompany) hereby aknowledges and agrees that: (a) the Lender may use, dislose and/or transfer eah suh Obligor s personal data, redit data (whih inludes redit data obtained from a CRA) and other information in relation to the loan under this appliation to the HKMC (or the Insurer, where appliable) for the purpose of mortgage insurane over to be granted by the HKMC (or the Insurer, where appliable) relating to the Property and other related purposes, and any other purposes in onnetion with the mortgage related business of the HKMC (or the Insurer, where appliable) inluding, without limitation, the purhase of mortgage portfolio by the HKMC (or the Insurer, where appliable) and the administration thereof, whether suh use, dislosure and/or transfer is within or outside Hong Kong; and (b) the HKMC (or the Insurer, where appliable) may use any suh personal data, redit data (whih inludes redit data obtained from a CRA) and information for the purposes stated in (a) above, and dislose and/or transfer any suh personal data, redit data (whih inludes redit data obtained from a CRA) and information reeived or held by it to the relevant mortgage reinsurers (inluding any re-reinsurers of suh reinsurers), and their respetive related bodies for the purposes of the relevant mortgage insurane/reinsurane overs and other related purposes, whether suh use, dislosure and/or transfer is within or outside Hong Kong. (e) Data the Bank holds relating to a data subjet is kept onfidential but the Bank may provide, transfer or dislose suh data or information to any one or more of the following parties (whether within or outside Hong Kong*) for the purposes set out in paragraph (d):- (i) any agent, ontrator or third party servie provider who provides administrative, teleommuniations, omputer, payment or seurities learing or other servies to the Bank in onnetion with the establishment, operation, maintenane or provision of Failities, Produts and Servies; (ii) any other person under a duty of onfidentiality to the Bank inluding any other member of the Standard Chartered Group whih has undertaken to keep suh information onfidential; (iii) the drawee bank providing a opy of a paid heque (whih may ontain information about the payee) to the drawer; (iv) redit referene agenies and, in the event of default, to debt olletion agenies; (v) any person or entity to whom the Bank or any other member of the Standard Chartered Group is under an obligation or otherwise required to make dislosure under the requirements of any law or regulation binding on or applying to the Bank or any other member of the Standard Chartered Group, or any dislosure under and for the purposes of any guidelines, guidane, diretives, rules, odes, irulars or other similar douments issued or given by any legal, regulatory, governmental, tax, law enforement or other authorities, or self-regulatory or industry bodies or assoiations of finanial servies providers with whih the Bank or any other member of the Standard Chartered Group is expeted to omply, or any dislosure pursuant to any ontratual or other ommitment of the Bank or any other member of the Standard Chartered Group with loal or foreign legal, regulatory, governmental, tax, law enforement or other authorities, or self-regulatory or industry bodies or assoiations of finanial servies providers, all of whih may be within or outside Hong Kong and may be existing urrently and in the future; Page 19 of 22

(vi) any finanial institution and merhant aquiring ompany with whih a data subjet has or proposes to have dealings; (vii) any atual or proposed assignee of all or any part of the business and/or asset of the Bank or partiipant or sub-partiipant or transferee of the Bank s rights in respet of the data subjets; (viii) any party giving or proposing to give a guarantee or third party seurity to guarantee or seure the data subjet s obligations; and/or (ix) (1) any member of the Standard Chartered Group; (2) third party finanial institutions, insurers, redit ard ompanies, seurities and investment servies providers; (3) third party reward, loyalty, o-branding and privileges programme providers; (4) o-branding partners of the Bank and/or any member of the Standard Chartered Group (the names of suh o-branding partners an be found in the appliation form(s) for the relevant servies and produts, as the ase may be); (5) haritable or non-profit making organisations; and (6) external servie providers (inluding but not limited to mailing houses, teleommuniation ompanies, telemarketing and diret sales agents, all entres, data proessing ompanies and information tehnology ompanies) that the Bank engages for the purposes set out in paragraph (d)(ix) above. * Please refer to the Bank s website (www.s.om/hk) for the list of ountries where suh parties may be loated. (f) (i) With respet to data in onnetion with mortgages applied by a data subjet (in any apaity) on or after 1 April 2011, the following data relating to the data subjet (inluding any updated data of any of the following data from time to time) may be provided by the Bank, on its own behalf and/or as agent, to a redit referene ageny:- (1) full name; (2) apaity in respet of eah mortgage (as borrower, mortgagor or guarantor, and whether in the data subjet s sole name or in joint names with others); (3) Hong Kong Identity Card Number or travel doument number; (4) date of birth; (5) orrespondene address; (6) mortgage aount number in respet of eah mortgage; (7) type of the faility in respet of eah mortgage; (8) mortgage aount status in respet of eah mortgage (e.g., ative, losed, write-off (other than due to a bankrupty order), write-off due to a bankrupty order); and (9) if any, mortgage aount losed date in respet of eah mortgage. (ii) The redit referene ageny will use the above data supplied by the Bank for the purposes of ompiling a ount of the number of mortgages from time to time held by the data subjet with redit providers in Hong Kong, as borrower, mortgagor or guarantor respetively and whether in the data subjet s sole name or in joint names with others, for sharing in the onsumer redit database of the redit referene ageny by redit providers (subjet to the requirements of the Code of Pratie on Consumer Credit Data approved and issued under the Ordinane). (iii) The Bank may from time to time aess the mortgage ount held by the redit referene ageny in the ourse of:- (1) onsidering mortgage loan appliation(s) made by the data subjet (in any apaity); (2) reviewing any redit faility (inluding mortgage loan) granted or to be granted to the data subjet (in any apaity) whih is in default for a period of more than 60 days with a view to putting in plae any debt restruturing, resheduling or other modifiation of the terms of suh redit faility by the Bank; (3) reviewing any redit faility (inluding mortgage loan) granted or to be granted to the data subjet (in any apaity), where there is in plae any debt restruturing, resheduling or other modifiation of the terms of suh redit faility between the Bank and the data subjet onsequent upon a default in the repayment of suh redit faility for implementing suh arrangement, and/or (4) reviewing any redit faility (inluding mortgage loan) granted or to be granted to the data subjet (in any apaity), with a view to putting in plae any debt restruturing, resheduling or other modifiation of the terms of any redit faility initiated by the request of the data subjet. (iv) The Bank may from time to time aess the mortgage ount held by the redit referene ageny in the ourse of (after 31 Marh 2013):- (1) reviewing and renewing mortgage loans granted or to be granted to the data subjet (in any apaity); and/or (2) onsidering the appliation for redit faility (other than mortgage loan) by the data subjet (in any apaity other than mortgagor) and/or reviewing or renewing any faility (other than mortgage loan) granted or to be granted to the data subjet (in any apaity other than mortgagor), in eah ase where suh faility is in an amount not less than suh level or to be determined by a mehanism as presribed or approved by the Privay Commissioner for Personal Data from time to time. (g) USE OF DATA IN DIRECT MARKETING The Bank intends to use a data subjet s data in diret marketing and the Bank requires the data subjet s onsent (whih inludes an indiation of no objetion) for that purpose. In this onnetion, please note that:- (i) the name, ontat details, produts and servies portfolio information, transation pattern and behaviour, finanial bakground and demographi data of a data subjet held by the Bank from time to time may be used by the Bank in diret marketing; (ii) the following lasses of servies, produts and subjets may be marketed:- (1) finanial, insurane, fiduiary, investment servies, redit ard, seurities, investment, banking and related servies and produts; (2) reward, loyalty or privileges programmes and related servies and produts; (3) servies and produts offered by the Bank s o-branding partners (the names of suh o-branding partners an be found in the appliation form(s) for the relevant servies and produts, as the ase may be); and (4) donations and ontributions for haritable and/or non-profit making purposes; (iii) the above servies, produts and subjets may be provided or (in the ase of donations and ontributions) soliited by the Bank and/or:- (1) any member of the Standard Chartered Group; (2) third party finanial institutions, insurers, redit ard ompanies, seurities and investment servies providers; (3) third party reward, loyalty, o-branding or privileges programme providers; (4) o-branding partners of the Bank and/or any member of the Standard Chartered Group (the names of suh o-branding partners an be found in the appliation form(s) for the relevant servies and produts, as the ase may be); and (5) haritable or non-profit making organisations; (iv) in addition to marketing the above servies, produts and subjets itself, the Bank also intends to provide the data desribed in paragraph (g)(i) above to all or any of the persons desribed in paragraph (g)(iii) above for use by them in marketing those servies, produts and subjets, and the Bank requires the data subjet s written onsent (whih inludes an indiation of no objetion) for that purpose; Page 20 of 22

(v) the Bank may reeive money or other property in return for providing the data to the other persons in paragraph (g)(iv) above and, when requesting the data subjet s onsent or no objetion as desribed in paragraph (g)(iv) above, the Bank will inform the data subjet if it will reeive any money or other property in return for providing the data to the other persons. If a data subjet does not wish the Bank to use or provide to other persons his/her data for use in diret marketing as desribed above, the data subjet may exerise his/her opt-out right by notifying the Bank. (h) Under and in aordane with the terms of the Ordinane and the Code of Pratie on Consumer Credit Data approved and issued under the Ordinane, any data subjet has the right:- (i) to hek whether the Bank holds data about him and/or aess to suh data; (ii) to require the Bank to orret any data relating to him whih is inaurate; (iii) to asertain the Bank s poliies and proedures in relation to data and to be informed of the kind of personal data held by the Bank and/or he/she has aess to; (iv) to be informed on request whih items of data are routinely dislosed to redit referene agenies or debt olletion agenies, and be provided with further information to enable the making of an aess or orretion request to the relevant redit referene ageny or debt olletion ageny; and (v) in relation to any aount data (inluding, for the avoidane of doubt, any aount repayment data) whih has been provided by the Bank to a redit referene ageny, to instrut the Bank, upon termination of the aount by full repayment, to make a request to the redit referene ageny to delete suh aount data from its database, as long as the instrution is given within five years of termination and at no time was there any default of payment in relation to the aount, lasting in exess of 60 days within five years immediately before aount termination. Aount repayment data inludes amount last due, amount of payment made during the last reporting period (being a period not exeeding 31 days immediately preeding the last ontribution of aount data by the Bank to a redit referene ageny), remaining available redit or outstanding balane and default data (being amount past due and number of days past due, date of settlement of amount past due, and date of final settlement of amount in default lasting in exess of 60 days (if any)). (i) (j) In the event of any default of payment relating to an aount, unless the amount in default is fully repaid or written off (other than due to a bankrupty order) before the expiry of 60 days from the date suh default ourred, the aount repayment data (as defined in paragraph (h)(v) above) may be retained by the redit referene ageny until the expiry of five years from the date of final settlement of the amount in default. In the event any amount in an aount is written-off due to a bankrupty order being made against a data subjet, the aount repayment data (as defined in paragraph (h)(v) above) may be retained by the redit referene ageny, regardless of whether the aount repayment data reveal any default of payment lasting in exess of 60 days, until the expiry of five years from the date of final settlement of the amount in default or the expiry of five years from the date of disharge from a bankrupty as notified by the data subjet with evidene to the redit referene ageny, whihever is earlier. (k) Without limiting the generality of the foregoing, the Bank may from time to time aess the personal and aount information or reords of a data subjet held by the redit referene ageny for the purpose of reviewing any of the following matters in relation to the existing redit failities granted to a data subjet or a third party whose obligations are guaranteed by a data subjet:- (i) an inrease in the redit amount; (ii) the urtailing of redit (inluding the anellation of redit or a derease in the redit amount); and (iii) the putting in plae or the implementation of a sheme of arrangement with the data subjet or the third party. (l) The Bank may have obtained a redit report on a data subjet from a redit referene ageny in onsidering any appliation for redit. In the event a data subjet wishes to aess the redit report, the Bank will advise the ontat details of the relevant redit referene ageny. (m) Data of a data subjet may be proessed, kept and transferred or dislosed in and to any ountry as the Bank or any person who has obtained suh data from the Bank referred to in (e) above onsiders appropriate. Suh data may also be proessed, kept, transferred or dislosed in aordane with the loal praties and laws, rules and regulations (inluding any governmental ats and orders) in suh ountry. (n) In aordane with the terms of the Ordinane, the Bank has the right to harge a reasonable fee for the proessing of any data aess request.
