Worden Managing Director, State Regulatory Operations March 1, 2016 ADVICE 3373-E (U 338-E) PUBLIC UTILITIES COMMISSION OF THE STATE OF CALIFORNIA ENERGY DIVISION SUBJECT: Implementation of the San Onofre Nuclear Generating Station Communications Tracking System in Accordance With Decision 15-12-016 PURPOSE In compliance with California Public Utilities Commnission (Commission) Decision (D.) 15-12-016, issued December 8, 2015, Southern California Edison Company (SCE) is filing this advice letter to confirm that SCE has implemented the publicly accessible San Onofre Nuclear Generating Station (SONGS) communications tracking system. BACKGROUND On December 8, 2015, the Commission issued D.15-12-016, which, among other things, ordered SCE to develop and implement an internal tracking system to prospectively capture and make public the existence of non-public, individual oral and written communications regarding the SONGS Order Instituting Investigation (SONGS OII) and consolidated proceedings, as follows: a) SCE shall begin collecting information for the public about all non-public individual communications where both SCE and one or more Commissioners, and/or their advisors, and/or CPUC decision makers (per Rule 8.1(b)) are present. b) SCE shall promptly develop an internal tracking system, dating from the date this decision is issued, which results in a public log that must include the identity of all participants, general subject matter, the relevant SONGS OII or consolidated proceeding(s), meeting date, length of time, location, whether written materials were used, if an ex parte notice was filed, and if not, then an explanation. ADVICE 3373-E (U 338-E) - 2 - March 1, 2016 c) In no case shall the log disclose the content of a communication by a decision maker or a Commissioner s personal advisor as prohibited by Rule 8.4(c). d) SCE shall post the communications log with the identified information on its website. SCE shall keep the log current throughout the remainder of the SONGS OII and consolidated proceedings, unless superseded by future Commission action or order. e) SCE is ordered by the Commission to file a Tier 1 Advice Letter by no later than March 1, 2016, which describes the features of the system, the public accessibility, and the internal mechanisms to ensure accuracy. SONGS OII COMMUNICATION TRACKING & PUBLIC ACCESSIBILITY In compliance with D.15-12-016, SCE has developed an internal tracking system for non-public, individual oral and written communications regarding the SONGS OII and consolidated proceedings where both SCE and one or more Commissioners, and/or their advisors, and/or CPUC decision makers are present. The system was placed in service on December 18, 2015, but is capable of capturing responsive communications, if any, that occurred on and after December 8, 2015, the date D. 15-12-016 was issued. Additionally, all SCE and Edison International personnel who hold positions that might be involved in the type of communications specified in D. 15-12-016 have been advised of the logging requirements of the Decision and of the establishment of the tracking system. An SCE employee who is present during or participates in a non-public, individual communication with any CPUC commissioners, advisors and/or decision makers regarding the SONGS OII and consolidated proceedings, must update an electronic log maintained on SCE s internal intranet. (If more than one SCE employee is present or participates in the communication, at least one of the employees involved must update the log.) The employee accesses the system through the company s intranet, and is prompted to enter either the Proceeding Number (e.g., I.12-10-013) or the Proceeding Short Name (e.g. SONGS OII). After entering or selecting the proceeding information, the employee will complete the log entry by providing information for the following data fields: 1) principal attorney assigned to the proceeding; 2) subject of the communication; 3) date the communication took place; 4) location of the communication; 5) CPUC decision maker present during or participating in the communication;
ADVICE 3373-E (U 338-E) - 3 - March 1, 2016 6) other CPUC participants present during or participating in the communication not classified as a decision maker; 7) SCE participants present during or participating in the communication; 8) length of the communication; 9) whether written materials were used in the communication; 10) whether an Ex Parte Notice was filed; and 11) explanation if an Ex Parte Notice was not filed. Once the employee completes all the fields, the entry is saved in the tracking system. The tracking system will automatically confirm if the communication is related to the SONGS OII based upon the proceeding number entered. If the proceeding number is related to the SONGS OII, the entry will automatically move through the following process: (1) the system emails the assigned SCE attorney and the SCE Energy Regulation Compliance Program (ERCP) with notification of the new entry, including detailed instructions for completing the attorney review; (2) the attorney reviews the entry for accuracy and completeness; and (3) upon confirmation that the attorney s review has been completed, SCE s ERCP posts the updated communications report to SCE s public website, at: SCE.com>Corporate Links>Regulatory>CPUC Open Proceedings>SONGS OII Communications Log. SCE s target for posting the updated SONGS OII communications log is within three business days of a relevant communication. Attachment 1 provides screenshots showing how to access the SONGS communications log on sce.com. Attachment 2 provides the template for the SONGS OII communications report that will be posted on sce.com. Since there have been no postable communications since the issuance of D.15-12-016, there are currently no entries in the SONGS communications log. TIER DESIGNATION Under GO 96-B, Energy Industry Rule 5.1, this Advice Letter is submitted with a Tier 1 designation. EFFECTIVE DATE SCE requests this advice filing become effective on, March 1, 2016, the same date filed.
