VOID WHERE PROHIBITED OR RESTRICTED BY LAW. 1) Eligibility: The Chevy Cobalt SS Drive One Home Giveaway (the "Sweepstakes") is open only to legal residents of Michigan, Ohio, and Ontario, Canada who are at least 18 years of age at the time of entry and have a valid driver s license. Employees of General Motors Corporation and its dealerships, Detroit Tigers, Inc., eprize, LLC, as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible. The Sweepstakes is subject to all applicable federal, state, provincial, and local laws and regulations. Void where prohibited or restricted by law. 2) Timing: The Sweepstakes begins on May 5, and ends on August 20, (the "Promotion Period"). 3) Agreement to Official Rules: By participating in the Sweepstakes, each entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of Administrator (identified below in Section 12), which are final and binding in all matters related to the Sweepstakes. 4) How to Enter the Sweepstakes: a. Detroit Area Chevy Dealer Pool Drawings: Visit a participating Detroit Area Chevy Dealer. Go to a kiosk and fill out an official entry form. Submit the completed entry form at the dealership. LIMIT: One (1) entry per person during the entire Promotion Period for those entering the Detroit Area Chevy Dealer Pool Drawings. Non-winning entries in the Detroit Area Chevy Dealer Pool Drawings are carried over to subsequent Detroit Area Chevy Dealer Pool Drawings. b. Detroit Tigers Game Pool Drawings: (i) Attend a Detroit Tigers Game on one of the sixteen (16) specified home games set forth below ( Relevant Games ). To be eligible to win, entrants must: (A) be present at the game and in their seats between the fourth and fifth inning (meaning the interval after the last out of the bottom of the third inning and before the first pitch of the top of the sixth inning) to be eligible to win; (B) enter the stadium before the final out of the third inning; (C) retain their ticket stubs; and (D) be sitting in the seats designated on their stubs. (ii) To Enter Detroit Tigers Game Pool Drawings By Mail Without Purchase: To enter by mail, handprint your name, address, day and 1
evening phone numbers, email address (if any), and age on a 3" x 5" piece of paper. Mail it in a hand-addressed, properly stamped envelope to "Chevy Cobalt SS Drive One Home Giveaway," c/o eprize, P.O. Box 1500, Royal Oak, MI 48068-1500. The entries must be postmarked and received by the dates listed in the table below. Only one (1) mailin entry per outer envelope. LIMIT: Sixteen (16) entries per person during entire Promotion Period for those attending Detroit Tigers games or entering free by mail. c. General Rules For All Methods of Entry 5) Drawings: No more than a total of seventeen (17) entries per person regardless of method of entry. All entries must be received during the Promotion Period. Use of any automated system to submit entries is prohibited and will result in disqualification. Sponsor is not responsible for late, lost, illegible, incomplete, stolen, or postage due entries, which will be disqualified. All entries become the property of Sponsor and none will be returned. All selected potential winners must comply with these Official Rules, and winning is contingent upon fulfilling all requirements. a. Detroit Area Chevy Dealer Pool Drawings: There will be sixteen (16) Detroit Area Chevy Dealer Pool Drawings. Administrator will randomly select two (2) potential Detroit Area Chevy Dealer Pool Drawing winners from all eligible entries received via that method of entry as of the applicable entry deadline date listed in the table below. Thus, there will be a total of thirty two (32) potential Detroit Area Chevy Dealer Pool Drawing winners over the entire Promotion Period. See special requirement for Detroit Area Chevy Dealer Pool Drawing winners for participation in the Grand Prize Drawing in Section 5(c), below. b. Detroit Tigers Pool Drawings: There will be sixteen (16) Detroit Tigers Pool Drawings, one (1) prior to each of the Relevant Games. Administrator will randomly select three (3) potential Detroit Tigers Pool Drawing winners from among Comerica Park seat numbers and eligible mail-in entries received as of the applicable entry deadline date listed in the table below. Administrator may use reasonable means to select potential Detroit Tigers Pool Drawing winners at Comerica Park, as determined in its sole discretion, in the event a standing room seat is identified as a potential Detroit Tigers Pool Drawing winner. c. Grand Prize Drawings: The two Detroit Area Chevy Dealer Pool Drawing potential winners and the three Detroit Tigers Pool Drawing potential winners (a total of five (5) potential winners for each Relevant Game, hereinafter referred to as Finalists ) are eligible for the Grand Prize Drawing. IMPORTANT INSTRUCTIONS FOR FINALISTS: Detroit Area Chevy Dealer Pool Drawing winners are required to go to, and meet the Administrator at, the Comerica Park Guest Services area (behind section 130 on the main concourse) thirty (30) minutes before the start time of the Relevant Game 2
for which they received tickets as detailed in Section 7(c), below. All Finalists must possess and present upon request their own valid driver s license. All Finalists must sign release and eligibility documentation prior to participation in a Grand Prize Drawing. Failure to possess, present, or execute requested documentation in a timely fashion; meet any eligibility requirement; or comply with any of the instructions herein will result in disqualification. Administrator may impose a time limit, in its sole discretion. For each of the Relevant Games, the Finalists will draw numbers out of a hat (numbers 1 through 5) prior to going on the field for determining the order of participation. The order for drawing from the hat will be determined in a random drawing. Sponsor (identified in Section 12 below) and Administrator will place an envelope on each of the four bases and the pitcher s mound. One (1) of the envelopes contains a golden key. Based on the order of selection determined by the random drawing from a hat described above, the Finalist who selects number 1 has the first choice of one of the four bases or the pitcher s mound. The Finalist who selects number 2 has the second choice, and so on until each of the five Finalists has selected a base or the mound. Administrator will randomly select the position of the golden key in its sole discretion. Opening their respective envelopes when instructed, the Finalists will discover whether they have won the Grand Prize or a First Prize, subject to verification and continued compliance with these Official Rules. Validation and Release of Liability: If a potential Grand Prize Drawing winner is a Canadian resident, he or she will be required to correctly answer a timelimited skill testing question without any assistance in order to be eligible to receive a prize. The potential winners of the Grand Prize Drawing must sign and return, no later than ten (10) days following the Relevant Game at which they participated in a Grand Prize Drawing, an affidavit of eligibility and liability/publicity release (or, if a Canadian resident, a Declaration of Compliance). To receive the Grand Prize, as described below, a potential winner must present his or her valid driver s license and proof of automotive insurance, as required by applicable law. If the potential Grand Prize winner does not have these documents, fails to sign and return the affidavit of eligibility or liability/publicity release (or Declaration of Compliance) within the time frame specified, is otherwise ineligible, or, as applicable, fails to correctly answer the skill testing question, he or she may be disqualified. In the event of a disqualification of the Grand Prize winner, Sponsor, through the Administrator, reserves the right to select at random from among the First Prize winners from the same Relevant Game, and award the Grand Prize to that selected First Prize winner. Sixteen (16) Grand Prizes (One (1) Grand Prize per each Relevant Game): One (1) Chevrolet Cobalt 2 door coupe SS supercharged. Approximate Retail Value ("ARV"): $24,135 USD. Winner will have the option to select a Chevrolet Cobalt 4 door Sedan LT instead of the Cobalt SS. ARV of the Sedan is 21,325. If the winner decides to accept the Sedan, he/she will not be able to accept the difference of the ARV. Choice of options, interior and exterior colors are at Sponsor's sole discretion and are subject to dealer availability. All expenses for the use of the vehicle, including without limitation, federal, state, local and other taxes, additional equipment, licensing, registration, insurance and title documentation, are not included and are solely the winner's responsibility. Delivery of vehicle will be at Sponsor's designated dealership and subject to manufacturer/distributor and dealer production and delivery schedules. Winner must present a valid driver's license and proof of legally required automotive insurance. Odds of winning are based on the number of eligible entries received, the selection order determined by a random drawing for the Grand Prize Drawing, and the 1 in 5 probability of finding the golden key. b. Sixty Four (64) First Prizes (Four (4) per each Relevant Game): One (1) Baseball Package. ARV: $165 USD. Each package will include two (2) outfield box tickets to a future Tigers Game (to be determined by Sponsor in its sole discretion), one (1) baseball autographed by a Tigers player or coach (player/coach to be determined by Sponsor in its sole discretion), golf shirt 4
and SSR model vehicle. Sponsor will determine all products, sizes, and other features in the package in its sole discretion. Odds of winning are based on the number of eligible entries received, the selection order determined by a random drawing for the Grand Prize Drawing, and the 4 in 5 probability of not finding the golden key. c. Thirty Two (32) Detroit Area Chevy Dealer Pool Drawing Prizes: Two (2) tickets to a Detroit Tigers home game, designated by Sponsor as a Relevant Game. Must be able to attend the game on the date specified by Sponsor or else the prize will be forfeited. ARV: $50 USD. Odds of winning are determined by the total amount of eligible entries received. d. Up to Forty Eight (48) Detroit Tigers Pool Drawing Prizes: Mail-in entrants who qualify for the Grand Prize Drawing receive two (2) tickets to the Detroit Tigers home game, designated by Sponsor as a Relevant Game. Must be able to attend the game on the date specified by Sponsor or else the prize will be forfeited. ARV: $50 USD. Odds of winning are determined by the total amount of eligible entries received and the total seat capacity at Comerica Park. 8) For All Prizes: Winners are solely responsible for all applicable federal, state, and local taxes and other fees associated with prize receipt and use (unless otherwise specified). Substitutions: No substitution, assignment or transfer of prizes is permitted, except by Sponsor, who reserves the right to substitute a prize with another prize of greater or equal value in the event that any prize is unavailable due to factors beyond Sponsor s reasonable control. General Conditions: Sponsor reserves the right to cancel or modify the Sweepstakes if fraud, technical failures, illicit activity, or any other factor beyond Sponsor's reasonable control impairs the integrity of the Sweepstakes, as determined by Sponsor in its sole discretion or if one or more Finalist for a Grand Prize Drawing is disqualified for any reason, and Administrator, in its sole discretion, determines that it is not practicable to select alternate Finalists during the Relevant Game. In the event of cancellation due to the inability to identify and select one or more alternate Finalists during the Relevant Game; or cancellation, postponement, or suspension of a Relevant Game for any reason; or a decision by the Detroit Tigers, umpires, or other baseball authorities to complete the Relevant Game but not permit the Grand Prize Drawing (all such contingencies being referred to collectively as Impaired Relevant Games ), Sponsor reserves the right to (i) award the Grand Prize and First Prizes for the Impaired Relevant Game at random to the identified Finalists for that Impaired Relevant Game in a manner designated by Administrator in its sole discretion; (ii) postpone the Grand Prize Drawing (the time and date of such rain date determined by Sponsor in its sole discretion) until such time as Administrator can identify and validate alternates for those Finalists who had been disqualified; or (iii) postpone the Grand Prize Drawing until such time as the impairing contingency has been removed. Tampering: Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or any other Promotion, or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil law, 5
and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. 9) Release and Limitations of Liability: By participating in the Sweepstakes, entrants agree to release and hold harmless General Motors, the Detroit Tigers, Inc., the Administrator, and their respective officers, directors, employees, and agents (the Released Parties ) from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) errors in the administration of the Sweepstakes or the processing of entries; (e) late, lost, or undeliverable mail; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant s participation in the Sweepstakes or receipt of any prize. Entrant further agrees that in any cause of action, the Released Parties liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall the Released Parties be liable for attorney s fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. 10) Disputes: In the event of a dispute regarding the rightful occupant of a seat, the holder of the ticket stub corresponding with the disputed seat shall be deemed the rightful occupant. Entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Oakland County, Michigan, U.S.A. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, entrant s rights and obligations, or the rights and obligations of the Sponsors in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of State of Michigan, without giving effect to any choice of law or conflict of law rules (whether of the State of Michigan, U.S.A. or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than State of Michigan, U.S.A. 11) Winners List: Sweepstakes results and/or a copy of these Official Rules may be obtained by sending a self-addressed, stamped envelope to Chevy Cobalt Drive One Home Sweepstakes Winners List/Rules Request, c/o eprize, LLC, P.O.
