RENTAL AGREEMENT: The undersigned individual applies to lease a room at Wolf Village. He/she acknowledges and agrees that the apartment will be leased to one, two, three, or four residents on co-rental basis. The undersigned may move into his/her assigned room, beginning 8 am on the lease start date listed at the top of this page. No resident will be allowed occupancy until all amounts due at the time of move in are brought current. Notice in writing and manager s written approval is required of any intention by lessee to move in prior to the lease start date. There may be a charge for early move in. Early move in does not change the lease end date. The lessee provides such furnishings as bedding and towels. The lessee agrees to pay in advance, additional rent in the amount of $50.00 each day or portion thereof that they or their belongings are in the apartment after 5 pm on the lease end date. Residents who sign a new contract may elect to pay rent at the new contract rate for the extra days between the contract periods, upon management approval. You must be a student in a university, community college, college, or trade school to lease a room. In addition, you must be under the age of 30 years to lease a room. UTILITIES: All utilities are included in the rent (electricity, natural gas, water, basic cable, high speed internet, trash). Basic cable and high speed internet is available in every bedroom. Telephone wiring is provided but no telephone service is provided. USE OF ROOM AND LEASE ASSIGNMENTS: The undersigned agrees that use of the room and other facilities are only for the designated lessee contracting the said room. Unauthorized use of the undersigned s room accommodations will impose a $25.00 per day charge per person for each occurrence. Any overnight guest must be registered at the office to avoid the charge. No guest may stay longer than three (3) days without written permission of management. Guests are the responsibility of the undersigned, and shall not inconvenience, disturb or annoy other occupants of the premises. The undersigned agrees that he/she shall have no right to sublet any portion of the premises rented hereunder nor allow any person to occupy same, nor assign (transfer) this contract without prior written consent of management. Lessee understands it is their sole responsibility to find their own applicant in the event they wish to assign this agreement. Lessee must execute Assignor s Form and new applicant must execute Assignee s Form before contract may be assigned. Roommates have no voice or control over the right of the undersigned to assign this contract. There is a $200.00 charge to the lessee if this contract is assigned. LEASE TERMINATION: Management reserves the right, but is not obligated to change room assignments in the interest of health, discipline or the general welfare of the residents. Management also reserves the right, but is not obligated to terminate this contract upon violation or breach of the contract on the part of the lessee. If lessee fails to pay rent when due to Wolf Village, or if lessee defaults in any other covenant or agreement set forth herein, Wolf Village shall have the right to give notice to the lessee allowing three (3) days for the curing of such default. If rent is not paid, or other default cured, within said three day period, Wolf Village shall have the right to immediate possession of the premises. If lessee fails to deliver possession of the premises to Wolf Village, lessee shall be deemed guilty of an unlawful occupancy and subject to eviction. Upon lessee s default, even if Wolf Village recovers possession of the premises and otherwise terminates this agreement, it is agreed that lessee shall remain liable for the balance of rent set forth herein through the expiration of the term of this agreement or until the space is re-rented, whichever occurs first. KEYS AND LOCKOUTS: Lessee agrees that the keys issued are to be used only by the person to whom they were issued and shall not be duplicated. The undersigned further agrees that he/she will be charged $5.00 for a lost key. Lock outs after 11:00 pm are subject to a charge of $20.00 for each occurrence payable at the time in cash. For lockouts after hours, please go to the manager on duty. All room keys must be returned at the end of the contract (or assignment date), to avoid a lock-changing charge. Lock charges are as follows: $45.00 for front door and $5.00 for every additional door with a keyed lock. Lessee shall not change locks or place any additional locks on the premises without prior written consent of Wolf Village; violators shall be subject to appropriate lock-changing charge for each such unauthorized lock. 2

PETS: Lessee agrees that no pets of any kind, shall be permitted in or about the premises and that if any pet (visiting or stray) is found in the possession of lessee(s), or in the lessee s apartment, the lessee agrees to pay additional rent in the amount of $100.00 each day or portion thereof that such pet is found in the possession of the lessee or lessee s apartment, until such pet is removed. The lessee further agrees to pay the cost of fumigation, and all damages resulting from the keeping of the pet. Nothing in this paragraph should be construed as a waiver of lessor prohibition against lessee retaining any pets and lessor right to collect additional rent is in addition to any other remedies available to lessor. CEILINGS: No hanging fixtures of any kind may be nailed to, screwed into or attached to the ceilings in any way. If the ceilings are damaged, the cost of repairing the ceiling will be the responsibility of the resident(s) of the apartment. HEALTH, SAFETY, AND RESIDENT CONDUCT: Lessee agrees that firearms (including bb/pellet and paintball guns), knives (longer than 6 ), swords or weapons of any kind, fireworks, explosives, flammable materials, (including gasoline, solvents, spray paint, etc.), possession of illegal drugs and possession of alcoholic beverages by minors are not permitted in or around the apartment or premises. Open alcoholic and/or glass containers are not permitted outside the apartment unless they are at a management authorized event. Kegs are not allowed in apartments or on the premises. Lessee is fully responsible for the action of his/her guests. No apartment shall contain more than 12 persons at any one time. Lessee and his/her guests are not to interfere with Security Officers or Managers in the performance of their duties. Lessee also agrees to abide by the following rules and regulations as part of the terms and conditions of this contract. A. Each resident, in the use and occupancy of his/her apartment shall avoid disturbing, annoying, endangering or inconveniencing other residents and shall abide by all laws and ordinances regulating the use and occupancy of apartment dwellings. Wolf Village assumes no responsibility for disputes among co-occupants of a unit. In the event such disputes disturb other residents in the apartment complex, all of the disputing occupants of a unit shall be subject to eviction. It is recommended that disputing co-occupants seek independent mediation of their disputes. B. Lessee agrees not to make any excessive noise or nuisance such as will disturb the peace and quiet of the apartment complex. Quiet hours begin at 10:00 pm Sunday-Thursday and at 2 am Saturday and Sunday. C. No hookahs, similar smoking devices, or gas lamps that utilize an open flame or burning material of any type are to be used in the apartment. D. Lessee must be present and responsible when they have children or guests in Wolf Village facilities. Lessee agrees to abide by all posted rules and regulations when using a Wolf Village facility. E. Wolf Village does not authorize parties. Lessee is cautioned that excessive noise, excessive alcohol or more than 12 people in an apartment is a violation of the lease and could result in eviction. Lessee is warned that activities causing involvement by law enforcement may result in a citation from law enforcement (fines up to $1,000) and will be grounds for immediate eviction. F. Lessee is responsible for and will take good care of the premises and furnishings in their bedroom and common areas. Lessee will not remove any of the building s property or perform repairs, painting, wall papering, electrical changes or other alteration (other than for small nail holes in sheet rock for hanging pictures) of the premises without prior written consent of management. Lessee is cautioned that they should complete a maintenance request form, in the office or online, for management s assessment prior to calling any professional, including any telecommunications company. Any charges incurred by not following these procedures will be the responsibility of the Lessee(s). G. Motorcycles, bicycles and mopeds must not be ridden on the lawns, locked to trees, light posts, hand rails, building structures or parked on sidewalks or porches. Please lock both wheels and frame to bike rack with a high quality security lock. Vandalized or abandoned bicycles (locked or not) will be removed by management at the end of the lease and disposed of after 30 days. Motorcycles and mopeds must be registered and parked in their designated areas, not inside the apartment. Lessee agrees to pay for any 3

and all damages to apartment resulting from the motorcycle or moped being in the unit. H. All trash must be placed in appropriate areas. Please flatten cardboard boxes before placing them in the trash bins. I. No aluminum foil or similar window coverings are to be visible in glass areas. This includes signs, beer cans, bottles, etc. J. Lessee herby consents that the manager may enter the apartment during normal business hours to show, inspect, repair or clean the premises or for any other lawful purpose, including the implementation of cold weather precautions. Extreme emergencies require no such notice. K. No brooms, mops, laundry, trash, etc. shall be placed outside apartments (this includes porches). L. Apartments must be maintained in a clean and sanitary condition. If, upon management s inspection the apartment is found to need work, the lessee(s) will be notified. If the condition is not corrected, management will have the work completed at the lessee(s) expense. This includes trash on porches and the grounds adjacent to or below the unit. M. There is no smoking allowed inside any building. Cigarette butts must dispose of utilizing an appropriate container. Cigarette butts must not be discarded on the ground. Wolf Village reserves the right to impose appropriate fines for trash and cigarette butt removal. N. None of the furniture or furnishings provided by Wolf Village may be removed from the apartment. Special consideration will be given to unusual circumstances, but require written consent of the management. Only patio or lawn furniture will be allowed on porches. Unsightly or dilapidated furniture will not be allowed without the written permission of the management and proof of insurance prior to installation. O. No waterbeds are allowed without the written permission of the management and proof of insurance to installation. P. Portable hibachis or Bar-B-Q s are allowed to be used and must be stored on the porch of the premises. Q. No exterior radio or television antenna may be installed except where applicable by law. Climbing or walking on roofs is prohibited. R. Lessee agrees that no window screen is to be removed except for cleaning. Windows are not to be used as entrances or exits, except in emergencies. Removal or damage to any screen will result in a charge for repair and/or replacement. S. Office hours are Monday-Friday 8am to 8pm, Saturday & Sunday 1pm to 8pm. After office hours, management personnel may be reached by calling 248-4958, after 10:00 pm, only calls of an emergency nature will be put through. T. Wolf Village will not be responsible for loss or damage of lessee s belongings through theft or otherwise. This also applies to laundry rooms, patios, parking lots or any other area of the premises. Lessee should be sure to have adequate personal and rental insurance coverage. U. It is understood that the phone and cable jacks are the property of Wolf Village. No phone or cable jack is to be removed, replaced or serviced without the permission of the manager. V. COLD WEATHER RESPONSIBILITES: Lessee agrees and understands that it is the responsibility of the occupant(s) of the apartment to maintain a reasonable heat level during cold weather, regardless of absence during vacations, holidays or otherwise. Lessee agrees to implement the following precautions during extremely cold weather to keep water pipes from bursting and understands that they could be held liable for the damages incurred as a result of these precautions not being followed: Keep apartment to a minimum of 65 degrees. W. These RULES AND REGULATIONS are subject to amendment and modification from time to time as the owner/manager shall determine. Copies of all amendments and modifications shall be delivered to each apartment but do not have to be acknowledged by Lessee s signature. X. In addition to the above rules and regulations, the lessee is under the CSU-Pueblo student code of conduct rules and will be subject to all provisions of the code. In the case where there is a conflict of rules between this agreement and the student code of conduct this agreement will prevail. 4

CLEANING AND SECURITY DEPOSIT: Lessee understands that the full $200.00 cleaning and security deposit is due at lease signing. The $200.00 deposit will be returned less cleaning costs, breakage, damage to apartment, loss of keys, smoke detectors, phone jacks, additional rent charges and any other charge(s) against the undersigned lessee within sixty (60) days after the termination or expiration of lessee s tenancy and after all roommates have vacated said apartment, turning in keys to the office. Lessee understands that the deposits are pooled with other residents of the apartment when dealing with the common living areas. Pooling is done in the following manner: deposits are applied to the common living areas first and then the bedroom area last. Lessee s deposit will not be applied to damages to a roommate s bedroom area. All roommates are responsible for maintaining the common living areas in good conditions, ordinary wear and tear accepted. Failure to comply with the prescribed checkout procedures could result in the deposit being forfeited. RESTORATION FEE AND PROCESSING FEE: Lessee understands that there is a nonrefundable restoration fee of $100.00 per person to cover the costs of inspections, routine carpet cleaning and minor painting at move-out to restore the unit to move-in condition. The $100.00 restoration fee is due at lease signing. A $50.00 non-refundable processing fee is also due at lease signing. PAYMENTS: Due the 1 st of each month unless otherwise indicated on the first page of this lease agreement. Make checks payable to Wolf Village. Payments may be brought directly to the office during regular business hours, may be placed in the rent drop slot located in the main office door 24 hours a day, or may be mailed to: 200 W. 1 st Street Suite 200, Pueblo, CO 81003. Acceptable payment methods are personal checks, money orders, travelers or cashier s checks and credit card. Wolf Village does not accept cash as a payment for rents. At our option and without notice to lessee, any money that we receive can be applied first to lessee s non-rent obligations and then to rent (any past rent being paid first), regardless of whether or not lessee had made notations on checks or money orders and regardless of when the obligation came about. LATE PAYMENTS: Lessee agrees that a $50.00 Late Fee will be assessed for payments received after the 6 th of the month in which they are due and will accrue an additional charge of $5.00 per day starting on the 11 th of the month and continuing until the full rental amount is paid. No personal checks will be accepted from the lessee after the 10 th of the month. In the event of a default herein requiring a non-defaulting party to bring legal or equitable action, the prevailing party shall be entitled to recover its costs and reasonable attorney s fees from the losing party. RETURNED ITEMS (NSF): If the lessee presents a personal check which is not honored by the issuing bank, rent will be considered unpaid, and constitute a default under this agreement. The lessee will be charged a returned item (NSF) fee of $50.00, in addition to any late fees that may have accrued as a result. After one (1) returned check, Wolf Village reserves the right to require all remaining payments to be paid by a money order or cashier s check. CO-SIGNOR GUARANTOR REQUIREMENT: Wolf Village may require as a condition of the possible acceptance of the below named lessee, that a Wolf Village Co-Signor Guaranty Form be properly completed. Wolf Village shall have the option of canceling the lease in the event a Wolf Village Co-Signor Guaranty Form is not properly completed and returned to the Agent within fifteen (15) days from the date of execution of this lease by lessee, or if such guaranty is not fully executed and returned to the Agent prior to occupancy, whichever time period is less. It is understood that the Wolf Village Co-Signor Guaranty Form must be obtained directly from the parent or sponsor and that Wolf Village reserves all rights, both civil and criminal, for any false execution or forgery of such guaranty. Foreign students who do not have a co-signor living in the United States or any other student who does not want to have a co-signor must pay for the semester in full prior to move in. 5

PARKING: Parking at Wolf Village is restricted to Wolf Village Lessees only. A. Each lessee may park one (1) operating vehicle only, in the Wolf Village parking lots. Lessee must first provide proof of ownership of said vehicle. Vehicle must be registered to the lessee or relative of the lessee. To protect your rights, all non-registered vehicles will be towed without warning. B. All parking is on a first come, first served basis only. Vehicles parked in red zones, blue handicapped spaces, office parking, fire access lanes, in front of trash enclosures or any other unauthorized location are subject to towing and/or citing by the fire or police department. C. Vehicles must be in running condition. Repairs of any type are not to be performed on the premises, including the changing of oil. Vehicles with excessive leakage of oil or other fluids must be removed from the premises until they are repaired. Failure to correct the leaks could result in denial of parking privileges on Wolf Village property. D. PLEASE! Do not dump ashtrays or garbage in the parking lot. Bins are available for garbage, please use them. E. Wolf Village is not responsible for notifying any person(s) before towing any illegally parked vehicle and assumes no responsibility for where a vehicle is parked. Wolf Village assumes no responsibility for any damage, vandalism, theft, etc. for any vehicle while parked at Wolf Village or when towed. F. Lessee is cautioned that excessive speed, reckless driving, loud engine or stereo noise is not permitted on the premises and could result in parking privileges being revoked. The speed limit in all parking lots is 15 mph. I understand that violation of said rules may result in my vehicle being towed away at my expense and/or the denial of parking privileges at Wolf Village. I agree to pay a tow-away charge if such action is taken. I also acknowledge that the permit issued to me is only valid until the end of my lease term. Parking permits are changed annually. This agreement is made on the express condition that Wolf Village is to be free from all liability and claim damages by reason of any injury to any person or persons, including residents or family of residents, guests or property of any kind from any cause or causes whatsoever. Lessee agrees to indemnify and save and hold harmless Wolf Village from any liability, loss cost, attorney s fees or obligations on account of or arising out of any injury or loss. It shall be the sole responsibility of lessee to procure rental insurance coverage on his/her own personal property.
