Injury & Negligence HAVE I GOT A CLAIM? Your employer has a legal obligation to maintain certain health and safety standards to minimise the risk of workplace accidents. If your accident was caused because your employer failed to maintain these standards, you may have a claim. WHAT SHOULD I DO AFTER AN ACCIDENT AT WORK? Report the accident to your employer and make sure it goes in the accident book Report the accident to the Health and Safety Representative, if you have one Get the names and addresses of any witnesses Seek medical advice for your injuries WHAT WILL MY SOLICITOR DO? We will initially take a detailed account of your accident and your injuries. If we think you have grounds to make a claim, we will then obtain medical evidence on your behalf to proceed with your claim. Where the employer admits fault, it may be possible to get you an interim payment to help with the cost of treatment.
WHAT CAN I RECOVER IF MY CLAIM IS SUCCESSFUL? Compensation is awarded for pain and suffering. The award will reflect the nature and severity of the condition and its effects on your everyday life and activities. We are also able to claim other expenses which you may have incurred, such as:- Loss of income caused by your accident Private treatment costs Loss of pension caused by your accident Cost of medication and/or aids and equipment incurred as a result of your accident Nursing care costs Travelling expenses incurred as a result of your accident WHAT IF I THINK I M PARTLY TO BLAME FOR MY ACCIDENT? You can claim compensation even if you think that you may have been partly to blame. It is important to know where you stand so please call us to put your mind at ease. I have much appreciation for my solicitors continued guidance and persistence in obtaining such a wonderful result. I cannot thank them enough. I really enjoy seeing my clients benefit from getting a good result Natasha Ross, Associate, Personal Injury Investigation For your case to succeed, we have to prove that your accident was the fault of another person. We will work with you to gather the evidence to support your claim. Supporting your case In certain cases we can apply for an interim payment of compensation while the investigation into the overall value of your claim continues. Interim payments can help with rehabilitation and pay for adapted accommodation, equipment, professional care and in some cases pay for private medical treatment or counselling. Time Limits You must make your claim within 3 years of the date of the accident, if it occurred in the UK. If you leave it longer than this, you may lose the right to make a claim. Different time limits may apply if it happened abroad. 07
Injury & Negligence WHAT WILL IT COST? We understand that the cost of legal advice can be a worry, but if you do have a claim there are a number of options available to fund your case, including no win, no fee. You may have legal expense insurance under an existing insurance policy which will entitle you to free representation. We will check this for you. If you do not have legal expense insurance under an existing policy, we will represent you under a No Win, No Fee Agreement. This means if your case fails, you do not have to pay anything. For further information on funding, please refer to our funding booklet. STATE BENEFITS As well as making a compensation claim you may be able to claim state benefits. We have a specialist Disability Rights Advisor who can advise you on what you are entitled to. Don t worry that any compensation you receive will affect your means tested benefits. Our dedicated Trusts Department can provide you with specialist advice to ensure that any compensation you receive does not affect your benefits income.
