THE 1349 TENANTS CORPORATION HOUSE RULES SUPERINTENDENT The building superintendent is a full-time employee of 1349 Tenants Corporation. He is responsible for the daily operation, maintenance and security of the building. He reports to. ilnd is under the supervision of the managing agent Barry Benami of the Argo Corporation, 50 West 17'h Street, New York, NY 10010 ((212)896-8600). As an employee of 1349 Tenants Corporation, he is expected to treat alj shareholders courteously and respectfully. However, he is not obligated to perform special favors or do work that is not outlined in his Jist of duties and responsibilities. The sllperintendent is expected to: Supervise the staff. Ensure that all building operations are functioning efficiently, routinely inspect all building equipment, and be alert to any possible problems. Be responsible for the cleaning and physical appearance of all public areas and the exterior of the building. A routine schedule of cleaning is to be followed. Conduct weekly inspection of all parts of the building, both interior and exterior, and be aware if anything needs special cleaning or repair. Be available at all times to arrange for emergency repairs to any part ofthe bvilding.

At times when he is away from the premises, he is expected to assign someone to handle emergencies in his absence. Make simple repairs to building equipment. EMERGENCIES Any emergency should be reported immediately to the superintendent first. He can be reached by calling the doorman on the intercom or dialing the lobby ((212)722-7700), and he will be contacted. If there is a water or gas problem, he can tum it off, as necessary, to avoid further damage. If he is not available, The Argo Corporation has a 24-hour answering service telephone number, i.e., (212)896-8600. They will contact the appropriate party to handle your emergency a.) Heating: The superintendent and the staff will inspect faulty radiators and detelmine what repairs are required. Repairs and/or removal of old radiators are the responsibility of the shareholder, as is the purchase and installation of new radiators. b.) Plllmbing: The superintendent and the staff will: Respond to emergency problems immediately If the problem is in the building support lines, the building will correct it or engage a plumber at building expense. If the problem is in the exterior plumbing, that is, plumbing outside the walls and inside apartments, the repair is the responsibility of the shareholder. c.) Electrical: The superintendent and the staff will respond to emergency problems immediately and recommend steps to assure the safety of the building. However, all major electrical work is to be done by a licensed electrician engaged by the shareholder. 2

SECURITY Daytime telephone numbers are to be kept in the door log for use in possible emergencies. Keys to ali apartments must be retained by the superintendent, who keeps them in a secure, locked cabinet for use in possible emergencies. You may also wish to keep a key in the locked cabinet in the l1lailroom. PERSONAL WORK Shareholders may hire staffmembers to do personal work, but onlv outside the staff member's ordinary working hams, that is, during off-hours, on weekends, or coffee and lunch breaks. The staff may not do such work (this would include cleaning, moving of tllrniture or other objects, painting, light construction work, animal care and other duties rhat are considered the responsibility of the shareholder) during ordinary working hours. Moreover, the superintendent must be informed when any staff member will be in the building outside of his normal working hours. Shareholders must understand that the staff has daily duties and that requests to clo personal work during normal hours adversely affect the functioning of the building. The sllperinrenclent, who is on the building's call twenty-four (24) hours it day, may do a limited amount of personal work for shareholders during his working hours, but slich work must not interfere in any way with his primary duties as the operations manager of the building. If personal work is to be done, the shareholder and the person who is to perform the work should agree before-hand upon the fee to be paid. 3

APARTMENT ALTERATIONS If you are planning renovations, contact the management firm. They will provide a package of materials and instructions to guide the Board approval process. Prior to allowing the renovation, the shareholder must submit the following: 1.) Completed renovation agreement. 2.) A deposit check for $1,000.00 to be held in escrow, payable to 1349 Tenants Corporation, against possible damage to the building. 3.) Certificate ofinsl1rance indemnifying both 1349 Tenants Corporation and its management firm as additional insureds. 4.) Detailed outline of work to be done. 5.) Sketch or plans of work proposed. 6.) If required, set of approved, stamped Building Department plans should.be furnished for the file. 7.) If applicable, letter(s) from architect or engineer stating that no load bearing walls will be removed. The management firm will review the application and plans with an engineer if applicable, which will be paid for by the shareholder, to make recommendations to the Board of Directors. MOVE-IN/MOVE-OUT POLICY Eesidents ltiovina inlout of the building must notify the superintendent at least a week in b, advance. Moving is limited to the hours of 9:00a.m. to 5:00p.m. from Monday through Friday There is a $500.00 move-in/move-out charge. 4

MAINTENANCE Maintenance charges are due on the first day of each month. Maintenance charges not received by the 15'" day of the month will be subject to a late fee. ROOF ACCESS Shareholder access to our roofis available i'om Monday through Saturday between 9:00 a.m. and 6:00 p.rn. and on Sundays from 10:00 a.m. to 5:00 p.m after 6:00 p.m. Monday Saturday and Sunday after 5:00 p.m., weather permitting, 'you can obtain key from doorman. Otherwise, the roof door is alarmed. GARBAGE, RECYCLABLES, AND TRASH Garbage and recyciables shall be placed in the container located next to the service elevator on each floor onlv when the service elevator is in operation, i.c., between the hours of 8:00 a.m. and 6:00 p.m. from Monday through Friday and between 10:00 a.m. and 5:00 p.m. on Sundays. Please be sure to ring the bell to notify the porter. All garbage must be enclosed in secure plastic bags. Clean recyclables must be bagged. Newspap3ers, magazines, and other recyclable paper must be neatly bundled. Please DO NOT place refuse outside the bins unless discarded items are oversized. COMMON HALLWAY DECORATION Subject to approval by the Board of Directors, a majority of shareholders on each floor may agree to decorate and carpet the common hallways, and assess the cost of sllch carpeting and 5

decoration among themselves. The building staff will maintain lighting fixtures, vacuum the carpeting, clean the t100rs and dust common hallway furnishings, but will not be responsible for watering plants or otherwise maintaining individualized decorations. AP ARTMENT FLOOR COVERING In order to deaden sound transfer between floors, shareholders are required to carpet 80% of their apartments, excluding kitchens and bathrooms, and must use padding underneath the carpeting. LAUNDRY ROOM The l,llllldry room is open from Monday through Sunday becween the hours 0[8:00 a.ill. ilnd 6:00 p.m. and on Sundays from 10:00 a.m. to 5:00 p.m. The building leases four (4) washing machines at a cost of$1.00 per load and three (3) dryers at a cost of $1.00 for thirty minutes of drying. STORAGE BINS Each apartment is assigned a basement storage bin. Access to your bin may be had during the hours that the service elevator is in operation, i.e., from Monday through Saturday between 8:00 a.m. and 6:00 p.m. and Sundays between 10:00 a.m. and 5:00 p.m. Only non flammable items may be stored, which means that you may NOT store upholstered furniture. Any clothing you wish to store must be packed in metal steamer trunks. 6

BICYCLE STORAGE Use of bicycles and roller blades is prohibited in the lobby. Bicycles may be removed between 8:00 a.m. and 6:00 p.m. on Monday through Saturday and between 10:00 a.m. and. " 5:00 p.m. on Sundays. Residents must use the second (2"d) elevator only_ Please notify the sliperintendent if you wish to store your bicycle(s). GUEST POLICY From time to time, shareholders who are absent from the building for extended periods of time allow guests to stay in their apartments. OUf doormen do not always know how long a guest is to stay in the building. There have been occasions where guests have invited other guests into the building. Some shareholders have, in their absence, also invited guests ta' stay for extended periods of time, which may, in reality, have constituted an unapproved sublet. In the interest of security, the Board of Directors believes that a clear guest policy is / beneficial to the shareholders. The board has therefore adopted the following guest policy, which seeks to balance the safety and concerns of the entire building with the desires of ilbsent shareholders who wish to permit guests to occasionally use their apartments: 1.) A shareholder may have guests stay in the shareholder's apartment when the shareholder is present in the building either by verbally authorizing the doorman by intercom to admit the guest or by personally escorting the guest to the shareholder's apartment. 2.) A shareholder may authorize the doorman to admit guests to the sharehoider's apartment when the shareholder is temporarily absent from the building (for a 24- hour period or less) by leaving a note with the doorman stating the name of each guest and the date of the expected visit and departure. 3.) If a shareholder is absent fi'om the building for more than a 24-hour period, the. shareholder may authorize a guest to use the shareholder's apartment only upon the following terms and conditions: 7

a.) b.) c.) d.) Tbe shareholder shall complete and leave with the doorman duplicate copies of the guest form, which is available at the doorman's station, containing the following information I. The telephone number at which the shareholder can be reached at all times while the guest is staying at the shareholder's apartment U. The name of each guest who will be staying at the shareholder's apartment; and III. The length oftime that the guest will be staying at the shareholder's apartment, which shall not exceed thirty (30) days during the time that the shareholder is absent from the building. The shareholder shall provide each guest with a copy of the 1349 Tenant, Corporation House Rules. A shareholder who is absent from the building will not be permitted to have a guest or guests stay in the absent shareholder's apartment for more than thirty (30) days in a 12-month period. If a shareholder fails to comply with these procedures, or the guest fails to abide by the House Rules, 1349 Tenants Corporation reserves all rights, including the right to refuse to permit the guest into the building. DELIVERIES No deliveries to apartments are permitted after 6:00 p.m. For deliveries after 6:00 p.m., properiy attired shareholders must pick up their deliveries in the lobby. 8
