SECTION I: INVITATION FOR Application (IFA) 1. Bihar State Electronics Development Limited, Patna (BSEDC) invites Online Application for Selection and empanelment of suitable skilled manpower as a member of technical resource group in information technology (IT) domain with BSEDC for e-governance Projects assignments for Verification/Support of different IT/Non-IT infrastructure at all districts and Blocks level. 2. Only Individual can participate in this empanelment process. 3. The EOI includes the following documents: Section I - Invitation for Application (IFA) Section II - Instruction to Candidates (ITC) Section III - General Conditions of Contract (GCC) Section IV - Scope of Work (SOW) 4. The Expression of Interest is available on the website www.beltron.in for free download. 5. Online Application can be submitted only through online on Beltron website up to 23:59 HRS on 30.04.2015. 6. 1. Definitions Unless the context otherwise requires, the following terms whenever used in this EOI and Contract have the following meanings: a) Applicable Law means the laws and any other instruments having the force of law in India as they may be issued and in force from time to time. b) Application means online form submitted in different categories as Diploma with CCNA/MCSE / Graduates in Computer Science /IT,Engineers(B.E,B.Tech),MCA or equivalent in response to the EOI issued by BSEDC for empanelment Process. c) Competent Authority means the Managing Director, Patna for Promotion of Information Technology, Patna. d) Committee means committee constituted by MD, BSEDC, Patna for empanelment process. e) Contract means the Contract signed by the parties for empanelment along with the entire documentation specified in the EOI. f) Day means Calendar day g) Effective date means the date on which the contract comes into force and effect. h) GCC means General Conditions of Contract, specified in Section III of EOI. i) ITC means Instructions to Candidates, specified in Section II of EOI. j) IFP means Invitation for Proposals, specified in Section I of EOI. k) Government means State Government of Bihar. l) BSEDC means Bihar State Electronics Development Limited for Promotion of Information Technology ( BSEDC), first Floor, Beltron Bhawan,Shastri Nagar,Patna-800023 4
m) SOW means Scope of Work for the Candidates, specified in Section IV of EOI n) Services means the work to be performed by the Selected/Empanelled Candidates and to the contract to be signed by the parties in pursuance of any specific assignment awarded to them by BSEDC. 2. Introduction The implementation of the National e-governance Plan (NeGP) by the Government of India, has provided prime moving effort for of e-governance and initiatives in the country. The State Governments have been enthused by its prospects and success as well as their priority of good governance has also embarked upon planning and implanting e-governance projects. By creating the right governance and institutional mechanisms, setting up core infrastructure and policies, and implementing a number of Mission Mode Projects. Environment for good governance. The State Government has identified and nominated its public sector unit Bihar State Electronics Development Corporation as the Nodal Agnecy for effort and endeavors are governance. Bihar State Electronics Development limited (BSEDC) has been playing a key role in the activities relating to strategic planning and implementation of NeGP, by providing appropriate advice and inputs to the various departments and institutions of Bihar Government. The State Government Departments and organizations engage BSEDC for specific computerisation and e-governance assignments. BSEDC has to its credit implementation of SWAN, SecLAN, CTMIS, VATMIS, BRAIN Data Centre, e-procurement,e-pds, modernization of prisons, RTI-Jankari, Solar PV projects, Finance and Commercial taxes MMPs etc. The success of efforts in this direction has necessitated capacity expansion as well as quality delivery. In the context, BSEDC intends to empanel Graduate Engineers(B.E,B.Tech),MCA or equivalent and engage them for case to case basis like IT infrastructure verification & Supports etc.. 2.1 Right to accept 5
BSEDC reserves the right to accept or reject any Application, and to annul the Empanelment process and reject all Application at any time prior to award of contract. 2. 2 Fraud and Corruption BSEDC requires that the eligible candidates empanelled through this EOI must observe the highest standards of ethics during the performance and execution of such contract. In pursuance of this policy, BSEDC: (a) Defines, for the purposes of this provision, the terms set forth as follows: (i) (ii) "Corrupt practice" means the offering, giving, receiving or soliciting of any thing of value to influence the action of BSEDC or any personnel in contract executions. "Fraudulent practice" means a mis-presentation of facts, in order to influence a procurement process or the execution of a contract, to BSEDC. (iii) Unfair trade practices means supply of services different from what is ordered on, or change in the Scope of Work / Assignment which was given by the BSEDC in Section IV. (iv) Coercive practices means harming or threatening to harm, directly or indirectly, persons or their property to influence their participation in the execution of contract. (b) Will reject a proposal for award, if it determines that the Candidates recommended for award, has been determined by BSEDC to having been engaged in corrupt, fraudulent or unfair trade practices. 6
3. Process for Empanelment BSEDC intends to have a panel of Technical Resource Group as a member of technical resource group in different categories Group Categories Work Details Essential Qualification A. CCNA/MCSE will be preferable. C Hardware Maintenance Knowledge of configuration and maintenance of all type of Computer Hardware and associated peripherals. Diploma in Hardware Engineering The scope of engagement for Category A,Band C are explained below. 1. Services will be taken on case to case basis or as per requirement by BSEDC. 2 Must have knowledge of Ms Office and basic Computers operations with relevant experience in allotted assignments for support and verification of IT /Non IT components at District / Block levels. 7
4. Honorarium a. Honorarium: Rs.1500/- Per Day for Category A &B and Rs. 1000/-Per Day for Category C. b. T.A.- Entitlement of Travelling: Bus,Train(3AC) c. D.A as per BSEDC Norms. 5. Request for Empanelment The individual is expected to examine all the instructions, guidelines, terms and condition and formats in the EOI. Failure to furnish all the necessary information as required by the EOI on submission of an application not substantially responsive to all the aspects of the EOI shall be at their own risk and may be liable for rejection. Deadline for submission of Online Application Form Online Application Form, complete in all respects must be submitted as time and date mentioned below: Last Date for Submission of Online Form: 30.04.2015 Deadline for submission: 23.59 Hrs. 7. Scan copy of Signature. 7.1 Form IV: Contract Agreement Draft Contract Agreement for Empanelment of Technical Resource Group will be signed with individuals. 8
8. Evaluation of Online Application Forms BSEDC will form a Evaluation Committee to evaluate the applications submitted by individuals as per categories for a detailed scrutiny. After short listing of eligible candidates, a committee will be constituted for interviewing of eligible candidates for final selection/empanelment. SECTION III: GENERAL CONDITIONS OF CONTRACT (GCC) 1. Application These general conditions shall apply to the extent that provisions in other parts of the Contract do not supersede them. For interpretation of any clause in the EOI or Contract Agreement, the interpretation of the BSEDC shall be final and binding on the Firms. 2. Relationship between the Parties There will be no relationship of employer-employee between BSEDC and all individuals empanelled as technical resource Group. 3. Applicable Law Applicable Law means the laws and any other instruments having the force of law in India as they may be issued and in force from time to time. The Contract shall be interpreted in accordance with the laws of the Union of India. 4. Governing Language The Contract shall be written in English Language. English version of the Contract shall govern its interpretation. All correspondences and other documents pertaining to the contract, which are exchanged between the parties, shall be written in the English Language. 9
5. Termination of association with BSEDC The empanelled individual as a technical resource Group association with BSEDC will terminate in following two ways: i. The term of Contract expires ii. Termination of Contract by BSEDC due to non-performance during the execution of Project a. Performance is below expected level b. Non adherence to the timelines of the Task c. Quality of work is not satisfactory 6. Resolution of Disputes Any dispute between the parties as to matters arising pursuant to this contract, which cannot be settled amicably within thirty (30) days after receipt by one party of the other party s request for such amicable settlement, may be submitted by either party for settlement. if the dispute(s) is not resolved amicably then it shall be referred to arbitration and shall be dealt as per the provisions of the Bihar Public Works Contract Arbitration & Tribunal Act 2008 by a sole Arbitrator. 11. Legal Jurisdiction All legal disputes between the parties shall be subject to the jurisdiction of the Courts situated in Patna only. 10
SECTION IV: SCOPE OF WORK (SOW) 1. Background This section deals with the selection of a panel of Firms who would be involved to undertake the following categories of assignments in association with BSEDC, and in relation to specific projects that BSEDC undertakes as part of its business. 2. About BSEDC Bihar State Electronics Development Corporation Limited was established as under Indian company act 1956, 1978 to function in accordance with the stipulated Regulations in furtherance of the following objectives: (i) (ii) (iii) To provide IT inputs to government departments/agencies and to assist them in computerisation and networking. To facilitate Human Resource Development in the field of IT in the Government; To undertake any other function(s) as may be assigned by the State Government. BSEDC aspires to be among the e-government thought leaders in the country and believes that e-government can be successful only by combining the immense potential and resources of the private sector with the principles of accountability and transparency of the public sector. It is to this effect that BSEDC engages in collaborations and partnerships to facilitate application of public and private resources to e-governance and thus achieve a factor enhancement in the quality and pace of implementation of e-government initiatives in India. Reference No. BSEDC/ CONTRACT AGREEMENT THIS AGREEMENT is made on the... day of...2015 between Bihar State Electronics Development Limited (hereinafter called "BSEDC") on one part and.... (Name of Candidates ) (hereinafter called "the Second Party") of the other part: WHEREAS a) The BSEDC is desirous that the empanelled person should execute the Project under following categories: i)verification and Monitoring of IT/Non-IT infrastructure under different projects. ii) The Individual, having represented to the BSEDC that he has the required professional skills and technical qualification, has agreed to provide the services on the terms and conditions set forth in this contract; NOW THIS AGREEMENT WITNESSETH AS FOLLOWS: 1) In this Agreement words and expressions shall have the same meanings as are respectively assigned to them in the EOI. 2) The following documents in relation with Request For Empanelment issued for selection of individual in different categories for Empanelment shall be deemed to form and be read and construed as part of this Agreement viz: a) Invitation of Application b) Instructions to Candidates c) The General Conditions of Contract d) Scope of Work 3) The contract shall begin from the date of signing of the contract as and when the Project would be assigned to BSEDC. Terms of Reference / Expression of Interest would be issued to adequate number of categories specific empanelled individual for providing their services in the specific project. 4) The mutual rights and obligations of the BSEDC and the individual empanelled as technical resource group shall be as set forth in the Contract, in particular: a) the candidate shall carry out the services in accordance with the provisions of the Contracts; and b) the BSEDC shall make payments to the candidates in accordance with the provisions of the Contract. 13
c) Individual/Candidates can t make a right to full time assignment with BSEDC during his/her assignments.
