All persons age eighteen (18) years of age and older must submit a Rental Application and qualify individually as a Resident. All Applicants are required to provide either a social security number or individual taxpayer identification number issued by the U.S. Internal Revenue Service in accordance with Section 55-248.4 of the Virginia Residential Landlord and Tenant Act. Management complies with all federal, state and local laws including fair housing laws which prohibit discrimination based on race, creed, color, religion, national origin, familial status, sex, elderliness, handicap, or any other protected status. The following requirements must be met to live in our community: INCOME: Applicants must have gross monthly income, less any garnishments or other deductions, in excess of three (3) times the monthly rent on the unit selected. Income for roommates may be combined to meet the income standard. Applicants cannot exceed the HUD Maximum allowable income limits determined by household size on an annual basis. This program is designated to facilitate the housing needs of moderate and low-income households, which requires that the applicant meet certain qualifying standards established under Section 42 Low Income Housing Tax Credit guideline. All income must be verified through Applicant s employer. A signed release from Applicant may be necessary to obtain this information. We participate in the Rental Partnership Program. Military households must meet a minimum income of three (3) times the rental rate. A Letter of Eligibility must be presented with the rental application. CREDIT: A credit check through a local credit agency is performed on all Applicants. A history of good credit must be established. Evidence of a history of poor or delinquent credit, absence of credit, absence of gainful employment or income to meet income requirements may be grounds for disapproval. Judgments or collections that appear on the report may be cause for rejection of Applicant. Any Applicant with a bankruptcy must show a discharge more than one year ago and have established new credit with a positive rating with at least one account. In the discretion of the Managing Agent, hospital related debt may not disqualify you if you have entered into a written payment plan and you are current with your obligation under the payment plan. EMPLOYMENT VERIFICATION: Applicant must provide at least six (6) month of stable employment and/ or verifiable income. Employment income is verified directly with the employer. Overtime, commission, bonuses, tips, shift differential and projected increases are considered in determining the applicant s gross income for the upcoming twelve (12) months. Self Employed applicants must complete an affidavit and provide one of the following in order to determine gross anticipated income for the upcoming twelve (12) months: A) Previous year s tax return B) A statement from an Accountant/Bookkeeper projecting business income. Applicant must have good credit history, rental reference, and current or new employment must be verifiable. RENTAL HISTORY: Two references are obtained from previous landlords, if possible, relative to payment history, length of rental agreement, amount of rent, damages, and violation history. If Applicant is breaking an existing rental agreement, it must be determined what liability the Applicant has under the current rental agreement, which may affect the Applicant s ability to pay current rent. Any adverse information relating to these areas is grounds for rejection of an Applicant. An Applicant may be rejected for a poor prior rental history, for example if you have a history of late payments, previous non-compliances with a rental agreement or rules and regulations, have any unsatisfied judgment from a prior landlord or have been evicted from prior housing, or have a record of inadequate housekeeping. AGE: All persons age 18 and older must complete a Rental Application, and qualify individually as a Resident. No person over age 18 or older may reside in the apartment without being approved as a Resident, and listed as a Resident on the Lease. INFORMATION VERIFICATION: Applicant will be asked to provide verifiable information or documentation to support application items. These may include, but are not limited to, Leave & Earnings Statements, pay stubs, child support, student status, evidence of taxes paid in past years, personal identification, or notarized confirmation of employment. Failure to provide such documentation may be grounds to reject an Applicant. OCCUPANCY REQUIREMENTS: A maximum of two (2) people may occupy each bedroom in the Dwelling Unit, provided that each bedroom shall contain at least 100 square feet of floor area. Resident must notify Landlord of any change in the household composition (such as the birth of an infant) during the term of the Lease, within fifteen (15) days of such change. If such change in household composition causes Resident to exceed the occupancy limit described above, then Resident may apply to transfer to another unit within the community that would meet the occupancy standards, if such a unit is available, no later than the applicable notice period set forth in
the Lease for the end of the Lease term. The preceding sentence shall not be construed to allow any exceptions to these Rental Selection Criteria. CATEGORIES OF DISAPPROVAL: The following by any occupant of a household shall be grounds for disapproval of Applicant: A. Rental Selection Criteria: Applicant s failure to meet any of the criteria set forth herein will be cause for disapproval. B. Violent or disruptive behavior. A history of violent or disruptive behavior of such a type that would endanger fellow tenants, staff, or visitors, result in damage to property, or disrupt the quiet enjoyment of property by residents. Any Applicant who is subject to any sex offender registration requirement will also be denied. C. Criminal Convictions: A criminal check through a local agency may be performed on all Applicants with approved credit. An Applicant will be denied if any crime of moral turpitude or which poses a direct to threat to the health or safety of others appears in a criminal check within the past seven (7) years, which shall include without limitation: 1. Any felony conviction; 2. Any crime involving the use of a firearm, other weapon or explosives; 3. Any arson; 4. Any robbery or theft; 5. Any terrorism-related conviction; 6. Any drug-related conviction; 7. Any prostitution-related conviction; 8. Any kidnapping or abduction; 9. Any cruelty to animals-related conviction; 10. Any misdemeanor conviction involving a crime against persons or property; and 11. The active status on probation or parole resulting from any of the above convictions. D. Drug or Alcohol Use: Any current use of an illegal drug will be grounds for rejection of an Applicant. Any evidence of alcohol abuse that manifests conduct that poses a threat to health or safety of other residents will be grounds for rejection of application. Any report of having sold or used a controlled substance will result in disapproval. E. Misrepresentation. Supplying false, misleading, or inaccurate information, or omitting information shall be grounds for disapproval. FULLTIME STUDENT STATUS: An applicant s unit cannot be entirely occupied by fulltime students or applicants who have or will be a student for five (5) months or more out of the current or upcoming calendar year. A fulltime student is defined as a person who is carrying a subject load that is considered fulltime under the standards and practices of the education institution attended. An education institution includes; public or private elementary, middle/junior, senior high schools, colleges, universities, technical, trade or mechanical schools. The exceptions to the rule are as follows: a. The students are married and entitled to file a joint tax return. b. The household consist of at least one student receiving Temporary Assistance to Needy Families.
(TANF) c. The household is comprised of at least one single parent with child (ren) and this parent is not a dependent of someone else and the child (ren) is/are not dependents of someone other than a parent. d. The household consist of at least one student who participates in a program receiving assistance under the Job Training Partnership Act, Workforce Investment Act or under other similar federal, state or local law. e. The household consist of at least one student who was previously under foster care. PETS: We allow one (1) pet per apartment home. A $500 Non- refundable pet fee is required. Additionally, a monthly pet rent fee of $35.00 is due with the monthly rental expenses. Resident agrees to provide Management with a current shot record and a photo of pet prior to move in. Aggressive breeds will not be permitted on the property. APPLICATION FEE/SECURITY DEPOSITS: A Non Refundable application fee of $35.00 per adult applicant or per married couple is required at the time the application is submitted. This fee is only accepted in the form of money order or certified funds. Security Deposits start at $500 and will not exceed two (2) times the monthly rent. The security deposit is due at the time of application to secure an available unit for residency. In the event that applicant withdraws application, prior to the execution of a Lease contract, applicant may be held responsible for Landlord s actual damages. Landlord s damages will be deducted from the Security deposit and the remaining funds (if any) will be refunded within 45 days from the date of cancellation.
