ALCOHOL LICENSING AT LAX Alcohol Sales at Los Angeles International Airport (LAX) Local and state regulations that apply to a local restaurant or liquor store in Los Angeles also apply to a business operating at Los Angeles International Airport (LAX). The following presentation briefly explains the procedures required to serve alcohol at LAX. 1
City of Los Angeles: Master Conditional Use Permit for Alcohol (MCUP) The MCUP is the approval with the City of Los Angeles that grants the Sale of Alcohol Cost for Entitlement- The fees to process one permit are approximately $10,000 including case filing, mailing notification, etc. as required by the Department of City Planning (DCP). Time- For the first step, it takes 8 to 12 weeks to get an approval from the DCP. Steps following may take up to an additional 4 weeks, on average, depending on the availability of additional documents, as needed. Public Hearing- A public hearing is typically waived. Resources- Los Angeles World Airports Environmental and Land Use Planning staff is available to assist the Applicant with filing, processing and effectuating the permit. 2
Which Government Agencies are involved when applying for Alcohol Licenses? To obtain an alcohol license at Los Angeles International Airport (LAX) you will be applying with the following agencies. State of California Alcoholic Beverage Control (ABC) This agency controls issuance of an Alcohol License. You cannot serve alcohol without this license. City of Los Angeles Department of City Planning (DCP) This agency will review the request to serve alcohol within the City of Los Angeles. It will issue an entitlement approval and when approved will inform the ABC they are clear to issue the alcohol license. City of Los Angeles Department of Building & Safety (LADBS) This agency will issue building permits for the establishment. These permits may include rights to serve alcohol and will be required to be completed before DCP will issue approval. On a case to case basis other government agencies will be involved, as necessary. 3
State of California Department of Alcoholic Beverage Control (ABC) ABC licensing representatives will be able to direct you on what type of license is needed and what is required by their agency. An Applicant wishing to obtain an alcoholic beverage license for use at Los Angeles International Airport should apply directly with the Los Angeles Metro office of the Department of Alcoholic Beverage Control. Starting the Process with Los Angeles World Airports To start the approval process LAWA requires the Applicant submit the following: Application Floor Plan Drawings submit 1 set (24x36 minimum size) and 7 sets (11x17 reductions) Elevation Drawings if required, submit 1 set (24x36 minimum size) and 7 sets (11x17 reductions) Renderings submit 1 set (8-1/2x11 minimum size) of Drawings, Digital Mock-ups of the establishment, etc. Photographs with an Index Map submit 7 sets (8-1/2x11 minimum size) Menu submit 1 set (8-1/2x11 minimum size) Fees submit checks to with the required total fees listed on the application Digital Files submit digital files (pdf, jpg, etc.) of the documents on a CD, DVD, Flash Drive, etc. 5
Requirement: The Application The application contains the basic information LAWA uses to file your case with the Department of City Planning. Complete the application with the appropriate information. Your Business Relationship Manager can help with information regarding your lease space. Your expediter for alcohol permits or general contractor can help with the code and service questions on page 3 of the application. Requirement: Floor Plan Drawings with Numbered Seats Submit Drawings: Submit one (1) large set and seven (7) reduced sized sets. Floor plans are a variation of the plans that are submitted to the Department of Building and Safety. Standards are listed on page 6 of the application or on the Department of City Planning website (www.cityplanning.lacity.org). These standard are required for a complete floor plan. Requirement: Elevation Drawings Submit Drawings: Submit one (1) large set and seven (7) reduced sized sets. Elevations are required when the establishment has multiple levels, such as a mezzanine or an elevated dining area. If the establishment is entirely on one level then these drawings are not required. Requirement: Renderings Submit Renderings: Submit one (1) copy of each rendering (8-1/2 x 11 minimum). Drawings that depict the idea and vision of the establishment are required for submittal. These renderings assist the Department of City Planning to understand the concept of the establishment. 9
Requirement: Photographs with Index Map Submit Photographs with Index Map: Submit four (4) copies of each index map and photographs (8-1/2 x 11 ). Photographs of the existing conditions (even if the establishment is under construction) and a small map indicating where each photograph was taken is required. This requirement allows the Department of City Planning to understand the layout of the establishment and its surroundings. Each image is labeled with the position it was photographed from on the index map. 10
Requirement: Menu Submit Menu: One (1) copy of the menu (8-1/2 x 11 ). A menu is required with the forms Los Angeles World Airports prepares for the submittal to the Department of City Planning (DCP). This requirement allows DCP to confirm that the establishment is not only serving alcohol which is discouraged under the grant. The menu should provide a general list of the food offerings All alcohol listed should provide a general overview Establishments that will provide incidental off-site sales should provide a list of products that will be sold. 11
Requirement: Fees for the Initial Filing Three (3) fees required at the time of submittal: City of Los Angeles Initial Filing Fee BTC Public Noticing Fee Los Angeles County Registrar-Recorder/County Clerk Fee $6,904.80 to the City of Los Angeles to process the Plan Approval entitlement and render a decision. $395.72 to BTC for the Public Noticing legal requirement that is required of the submittal to the Dept. of City Planning. $18.00 to Los Angeles County Registrar- Recorder / County Clerk is used to record the required Covenant & Agreement document. Requirement: Digital Files When all requirements have been assembled, a digital record of each requirement needs to be submitted LAWA on a commonly used digital media (such as a CD, DVD, Flash Drive, etc.). The Department of City Planning (DCP) requires digital files for all submittals. Submit to LAWA When all documents and drawings are compiled mail the package to LAWA. Once the package is received LAWA will contact DCP to set up an appointment to file the case. Submittal Package When a submittal package is received by Los Angeles World Airports (LAWA) it is reviewed for completeness. LAWA will contact the Applicant if there are any missing documents of information. LAWA will compile and draft documents, findings and drawings required for filing as follows: Documents: Master Land-use Application (and Notarize) Community Planning Referral Form ZIMAS Reports Previous Case information Mailing labels Perjury Statements Property maps Findings: Supplemental Findings Written Findings Drawings: Plot Plans Terminal Exhibits 14
Submittal Process After an application has been deemed complete Los Angeles World Airports will file the application with the Department of City Planning. LAWA assembles the submittal package for filing. LAWA files the Public Notice Requirement with BTC (Better Technology Corporation, Inc.). LAWA will pay noticing fees of $395.72 using the initial required fees for the public notice requirement. This is a legal requirement and is not waived. BTC will issue a receipt that is required at the time of filing with DCP. LAWA files the submittal application with DCP. LAWA will pay filing fees of $6,904.80 using the initial required fees for submittal for a Plan Approval case (PA). DCP will issue a receipt that provides a case number. 15
How long for a Decision? After filing an application, LAWA Environmental and Land Use Planning staff is available to clarify and answers any questions of the Office of Zoning Administration. A Letter of Decision is rendered to LAWA by the Department of City Planning usually between 8 to 12 weeks. 8 TO 12 WEEKS The more prepared the tenant is to clear these next steps, will determine the efficiency of gaining an Alcoholic Beverage Control License in a timely manner. After an Letter of Decision is issued by DCP, there is a 15 day appeal period until the permit is active. 15 DAY APPEAL PERIOD 16
Post Decision: Requirements The following is a list of requirements that are necessary to clear the conditions of the Letter of Determination (LOD): Permit Sign-off / ZA Clearance Fee A $2,066.40 dollar check made out to the City of Los Angeles is required to clear the conditions. No Effect Determination Fee A $75.00 dollar check made out to the County of Los Angeles is required to file for the California Environmental Quality Act No Effect Determination under the State of California Department of Fish & Wildlife. Construction Drawings (Stamped Set) submit the set of construction drawings from the City of Los Angeles Department of Building & Safety (LADBS). Building Permits submit all building permits issued by the LADBS for the project to LAWA Plot Plan Update LAWA will prepare the master plot plan update. Covenant & Agreement LAWA will prepare and record the required Covenant & Agreement. 17
Post Decision: Fees (Applicant) Two fees are required after the Letter of Determination is issued and the Appeal period ends: Los Angeles County Clerks Office No Effect Determination Fee City of Los Angeles Permit Sign-off / ZA Clearance Fee Fee in the amount of $75.00 dollars made out to the Los Angeles County Clerks Office Fee in the amount of $2,066.40 dollars made out to the City of Los Angeles Note: All fees are subject to change. 18

Post Decision: Effectuation Requirement - Building Permits The City of Los Angeles Department of Building and Safety will issue permits to the Applicant to begin construction on their establishment. Copies of these permits should be submitted to LAWA and included with the Effectuation submittal. Department of City Planning requires these permits to confirm that alcohol sales and consumption is not restricted on the site. 22
Post Decision: Effectuation Requirement ABC Pending License Application The Applicant should have filed for a license for the consumption of alcohol from the State of California Department of Alcoholic Beverage Control and license number should have been assigned. License Number * Please submit the ABC license number as required by Effectuation Clearance. * Also please submit the name of the licensing representative or officer as required by Effectuation Clearance. Post Decision: Effectuation Clearance (LAWA) Dept. of City Planning will issue a receipt for the Clearance fee and LAWA will provide a copy to the tenant. Items assembled by LAWA staff: Permit Sign-off / ZA Clearance Fee Construction Drawings (Stamped Set) Building Permits Plot Plan Update Covenant & Agreement ABC License Number LAWA files the submittal with the Dept. of City Planning. Drawings and documents submitted will be reviewed and stamped with approvals. The Code Compliance Unit will email the ABC that the grant has been approved. Case is reviewed for completeness by the Code Compliance Unit Important Note: After full approval from the City of Los Angeles, an establishment is still not able to sell or serve alcohol until they obtain their license from the State of California Department of Alcoholic Beverage Control (ABC). The ABC has its own set of requirements that the tenant must meet and apply for separately. LAWA will be able to assist a tenant with their ABC requirements (drafting letters pertaining to occupancy, escorting ABC representatives on site visits, etc.) but is not responsible for the application process. The submittal application will be delivered to the Code Compliance unit for final review. 24
Licensing: Alcoholic Beverage Control (ABC) License When all of their requirements have been met and the establishment s license is ACTIVE as determined by the ABC, then a license will be issued. The Applicant is responsible for complying with the conditions set forth by the State (ABC) and the City (Letter of Determination). License Number These include but is not limited to: Rules for sales involving on-site and off-site consumption. The number of seats the establishment may have available. Post License Requirements: Standardized Training for Alcohol Retailers (STAR) Tenants must send all their employees who serve alcohol to STAR training.
