How to sell your shared ownership home This guide applies to you if you are the shared owner of a Southern Home Ownership or Southern Housing Group Ltd property. It explains what you need to do and who does what, when you plan to sell your home. Deciding to sell You can sell your share of your home at any time for whatever reason. Start by phoning the Service Centre. Most of our shared ownership leases give us the right to nominate a buyer, so that the property remains available for low-cost home ownership. We will charge you 1% + VAT of the selling price of your equity Please note that you cannot sell your share for more than the valuation price, and if you sell 100% of the equity at more than the valuation price, your lease may give the Group the right to claim any difference between the valuation price and the sale price achieved from your purchaser. as a nomination fee, in accordance with the terms of your lease. Outright owner? If you decide to move after staircasing to 100% ownership of your flat, your lease may require that you offer us the option to buy back your home or find a purchaser for you. This applies to owners who have bought from Southern Housing Group since 2006. Call the Service Centre if you are not sure whether this applies to you. 2

Sale price and valuation The sale price of your share will be based on an open market valuation, including any improvements you have made. We will arrange for this valuation to be carried out by an independent Chartered Surveyor in the same way as when the property was first sold for shared ownership. You will have to pay the costs. If you wish to instruct your own surveyor to undertake the open market valuation, you may do so, but please note they must be qualified and accredited by the Royal Institution of Chartered Surveyors. Please contact the Leasehold Team for a copy of the guidelines that must be used to produce the valuation. In cases where the valuation needs to be extended to allow the transaction to complete, you will be responsible for arranging this. If you disagree with the valuation, we will ask you to provide evidence to support your view that the valuation is wrong, including giving us the prices that similar properties have sold for recently. We will refer this back to the valuer and ask them to reconsider. When you confirm you wish to sell, we will advertise the property on the local Help to Buy Agent s website. They provide a web-based service for people looking for low-cost home ownership. Please note that we require a copy of your energy performance certificate within 28 days of us starting to market your property. Potential buyers may pay a registration fee so they can register their details and carry out comprehensive searches. This means you will be sure they are really interested. 3

We may also request a referrals list of people who are registered as being interested in your type of property, and contact them to advise that your property is available. In helping you to sell your home, we will: advertise the property on the Help to Buy Agent s website and provide suitable candidates with your contact details (you will need to show them around) require applicants to provide a mortgage in principle certificate early in the process though this is not a guarantee they will get a mortgage allocate the property to the most eligible applicant communicate with both the vendor and purchaser write to all the solicitors involved and monitor the entire process to completion. Your sale Once you have a potential buyer, you will need a solicitor. Your solicitor will: provide information about your property to your purchaser s solicitor agree a date for exchange and completion with your purchaser s solicitor. If you need to move quickly, make sure your solicitor is aware of this arrange the apportionment of any service charges provide any legal advice to you as necessary. 4

Our solicitor will: contact your solicitor and your purchaser s solicitor to give details of the sales process prepare the consent to assign (sell) your leasehold interest liaise with us and ensure there are no outstanding arrears at the time of completion. We will: answer queries from you or your purchaser s solicitors, charging a set fee for providing standard information we reserve the right to charge more if the queries are complex if the Group are not the freeholders, queries will have to be raised with the external management agent. You will: complete and return the questionnaire we send with our letter confirm with us any payments you make to external management agents, so that this information can be given to potential purchasers give us your solicitor s contact details keep in touch with your solicitor to check progress respond quickly to questions about your property from your purchaser s solicitor ensure that any charges payable for your property to us or any other agency (for example your local authority) are up to date 5

allow your purchaser s mortgage valuer access, if needed agree a mutually convenient completion date with your purchaser, via your solicitor. This should be within three months of the valuation. Your costs Valuation 125 plus VAT Our solicitor s fee up to 550 plus VAT + disbursements Nomination fee 1% of value of sold equity, plus VAT Your solicitor s fee as agreed Pre-assignment enquiries approximately 100, plus VAT These figures were correct at the time of going to press, but they may change. Using an estate agent If we fail to nominate a purchaser for your property within the nomination period, we will write to advise that the period has expired and that you are free to market the property on the open market via an estate agent of your choice. You would no longer be liable for our 1% nomination fee, but would be responsible for paying your estate agent s fees. If just your equity share is to be sold, any prospective buyer must comply with the eligibility criteria for shared ownership and be registered with the relevant Help to Buy agent. Please ensure that your estate agent is aware of this and ask them to contact Southern Housing to request an application form for completion by any prospective purchaser. 6

For flats, a sale board can usually be displayed in a window of your property, but not fixed to the exterior or any part of the communal grounds. On selling your share, you cannot sell for more than the current valid valuation. It is important that you ensure your estate agent is aware of this. Stamp Duty Land Tax Please refer to your solicitor for advice on Stamp Duty Land Tax. Buying another shared ownership property If you want to purchase another shared ownership property, please register with the Help to Buy Agent for the area in which you are looking to purchase. All New Build and Resale properties from Southern Housing Group and other housing associations are advertised on this website.
