Click the FILE & SERVE link for all case types and venues, including Construction Defect and JCCP cases in San Diego 3
Please select either: Subsequent Filing - if you are starting to work on an open case, or Case Initiation if you are filing a new case as plaintiff (see New Cases guide) Recent Cases : Start a New Order available for cases in which you've recently filed 4
Choosing either option allows you to select the court venue. Select Subsequent Filing Continue by selecting San Diego under the Choose the court menu You will select 330 W. Broadway (Central) (for Construction defect and JCCP cases) under the Choose the court location menu 5
Choosing the court location allows you to search for a case by Number or Title Click Select for the case you want to file in Verify Case Information and click Next to begin your transaction Client Billing Code is optional use for your internal file number, matter number, etc. only. If entered, it will be referenced on your invoice 6
Note the addition of a new menu ribbon starting with the Information tab. Please select the Attorney of Record It is a requirement that all Attorneys of Record be registered users under your account. Note that the attorney might never actually log in and place transactions, but he or she must be registered Ask your account administrator or see our Add Users to Existing Account guide for reference Use this section to communicate any time sensitive or case specific details directly to the court clerks Contact for Questions would be yourself, unless you will not be available if the court has any questions with this transaction. This person will also be the one who receives Filed-Endorsed copies (which can also be accessed under Order Status in the top menu) Click Next to continue to Case Participants tab 8
1. If you are adding a new party such as a Cross-Defendant, the court requires that you use the Add Party feature. Search for your party first. BE SURE to search for your party first TO ENSURE YOU ARE NOT ADDING DUPLICATE PARTIES TO THE COURT'S DATABASE 2. If your firm is counsel for a party with no Representation listed below, you may need to use the Add Attorney feature. The court requires you to add the Primary Attorney only 3. The case s current Parties and their Role and Representation are listed here 9
Clicking Add Party will direct you to Search Party from the Court s database After the Search, or if the search does not return a result, you will need to enter your party manually or modify the given details 1. Choose whether you are adding an organization or a person Note: Do not add parties such as Does, Roes, etc. 2. Select the Role and Type (for organization only) 3. Fill in the party name 4. If the party is known by an alternate name (i.e. DBA, AKA, etc.), enter that information by clicking the gray plus sign in the ALTERNATE NAME area 5. Click Add when finished 10
Clicking Add Attorney will direct you to Search Party from the Court s database The Add Attorney feature will ask you to search first. Here we searched by random Bar # 99999. 1. If the search was successful click Select next to the attorney s name After the Search, or if the search does not return a result, you might need to manually update the information 1. The only available option here is Attorney because the San Diego court wants the lead attorney s info 2. The court requires the lead attorney s email address to be entered here also 3. Click Add when finished 11
The newly added Party to Case and Attorney would now be displayed. Click the trash can icon to delete or the pencil icon to edit Continue adding as necessary. Remember that the court will reject transactions if all your parties are not added here Click Next to continue to Documents tab Note: The San Diego Superior Court recognizes Representation by the Lead Attorneys personal names rather than by their firm names 12
The Court requires Bookmarking and combining Exhibits - guides and training are available from One Legal Click the blue plus sign to begin adding a document (the Search panel will appear) There is no restriction to the number of documents that can be uploaded 1. Begin by typing out the document type 2. The application will begin making suggestions 3. Clicking a suggestion and then the Search button will generate a list of options Hint: Select the closest document type if in doubt 13
1. You may leave the Document Title as-is if the Type matches correctly 2. Courtesy Copy delivery is checked by default. Please consult with Requirements and Department rules 3. Select delivery Service level and indicate the Department 4. If you have a hearing within 48 hours, courtesy copies are required 5. Browse and Upload your document 14
1. Designate the most important and/or time sensitive document as the lead 2. Select the party on behalf of whom you are filing the transaction then select Confirm Hint: Use the Quick Search drop down menu to select all parties with a particular role, e.g. all Plaintiffs or all Defendants Click Next to continue to the Review tab 3. Whenever appropriate, select and Link with the document to which you may be responding. E.G. if you are filing an answer you would want to link it to a complaint 15
Hint: If any changes need to be made, click the appropriate light blue tab. Please do not use the back button on your browser Verify all entered information Review the files you uploaded Note that the eservice tab was skipped from the tabs ribbon - Click Next to continue with eservice using the new CaseLink application 16
Files you ve uploaded will be listed here. Also, these documents will be auto saved in the Document Repository If you have any additional documents for eservice you may click UPLOAD DOCUMENTS to add them The message entered here is included in the eservice email notification. It goes to whomever you selected to receive eservice for the transaction Click NEXT to continue to the SELECT RECIPIENTS tab 17
You may choose to serve All recipients on the to-serve list by either Fax, Mail, or eservice Alternatively, you may choose to serve all Defendants or all Plaintiffs by either Fax, Mail, or eservice As you are setting up filing and service in this case, you might want to choose to VIEW ALL PARTIES/CUSTOM SELECT and utilize one or more methods of service for each recipient 18
