1 MidPenn Legal Services Civil Legal Aid: Critical Help for Critical Moments MISSION MidPenn Legal Services is a legal emergency room for the poor. We are a non-profit law firm providing free civil legal aid to low-income families in crisis.

3 Executive Director s Message In just over three years we will celebrate the 50th year of legal aid in Central Pennsylvania. While much has changed over the past four and half decades, one thing has not changed: our commitment to provide the highest quality of civil legal services to those facing critical problems. Issues involving families, personal safety, housing, access to income and health care are critical matters faced by those who come to our offices seeking help. Despite limited resources we have implemented new and effective methods of solving problems in addition to the traditional legal model. Our Medical Legal Partnership was noted this year in the Journal of the American Medical Association as an innovative way to serve clients. Our Expungement Clinics are helping people clear up old criminal records that prevent them from getting jobs. Our Low-Income Taxpayer Clinic assists clients with IRS tax problems. The MidPenn Telephone Advice Projects gives many in rural areas access to the legal system. This report showcases some of the work that we did in the past fiscal year in which we handled over 11,000 cases that benefitted 24,724 persons across Central Pennsylvania. With all that we do, legal aid can t do it alone and we offer a sincere thank-you to all the donors, volunteer attorneys, paralegals and law students for their efforts in assisting us in helping low-income families improve their lives. Executive Director President s Message Many of you may not know that I serve not only as President of MidPenn Legal Services, your civil legal aid provider in Central Pennsylvania, but also as the President of Pennsylvania Legal Aid Network, our statewide umbrella organization, and Chair of the Dauphin County Bar Association Public Service Committee, which oversees the pro bono program in Dauphin County. In these varied positions, I have the opportunity to see the benefits of legal aid at a front line provider of legal services, a funder, and a pro bono partner. I also get to the see the benefits across our Commonwealth. The good that is done by civil legal aid programs is significant. Lives of families, and particularly lives of children, are improved every day when your legal aid advocates go to work. Our challenge is to keep our legal aid advocates working. In order to do that, civil legal aid needs funding. As our advocates are in the trenches every day improving lives, our staff and board are working to provide the resources needed to keep the services flowing to our clients. 4 Breaking the Crisis Cycle After a Health Crisis, One Thing Led to Another For Charmaine Eckert, severe difficulties in handling stress led to obstacle after obstacle. She had grown up on a farm but with extraordinary effort rose to become the east coast sales manager for Uncle Ben s Rice. But decades in the high pressure corporate world had impacted her health. Always proud of her independence, she was reluctant to reach out for help. She limped from one crisis to the next. Charmaine came to MidPenn immediately after a hospital stay. She had an eviction hearing scheduled for the very next day. An attorney secured a continuance and negotiated an affordable repayment agreement to preserve her housing but it was just the tip of the iceberg. It was mid-summer yet her electricity had been off for two months. She was struggling to make her social security disability check cover her basic living expenses. Bill collectors were a constant source of pressure. MidPenn advocates connected her with a local organization that would help her manage her bill payments through a representative payee. Her electricity was reconnected. A power of attorney document was executed to assist her in the event of another hospitalization. Charmaine will continue to face her health challenges but her life is significantly more stable. Going to the MidPenn office was one of the best decisions I ve ever made, she said.

5 Trouble With The IRS Saving The Nest Frank and Susan Meter lived in their modest home for over 20 years. As the sole proprietor of Frank s Painting & Drywall he was mainly a sub-contractor on construction jobs. In 2005 a dramatic decrease in demand for this work led to him missing his quarterly tax payments. At the same time Susan began experiencing severe anxiety attacks and he needed to take time to care for her. Frank had to close up shop and take a job as a maintenance man for an apartment complex. Within a year he was hospitalized with double pneumonia and diagnosed with chronic obstructive pulmonary disease (COPD), unable to return to work. Their income was limited to Social Security Disability but at least they had a place to live. They were deeply shaken when in 2013 the IRS filed a tax lien against the home for $15,320 in back taxes. The home was the only thing they owned. The MidPenn Low- Income Tax Clinic submitted an Offer in Compromise and requested the IRS accept a single cash payment of $500 to release the lien, noting that the couple had insufficient income to obtain a loan to pay off the debt. The IRS accepted the offer on the basis of efficient tax administration. We were worried to death. We can just barely meet our bills. There was no way we could have taken care of this ourselves. We are so grateful for the help of our MidPenn attorney, said Frank.

6 Suddenly Cut Off From Her Son Back Home Again With Mom Jessica Torres-Rivera and the father of their son went their separate ways seven years ago. Caleb, now 10, always lived with Mom but would have summer visits with Dad who had moved to Cleveland. Last year at the end of summer Mom was suddenly unable to reach Caleb who was due back home for school. Dad was angry that Mom had a boyfriend. Jessica drove to Cleveland wild with worry but Dad wouldn t let her see or talk with Caleb. She called the police but they said she needed a custody order. Thanks to a MidPenn Family Law Attorney Caleb is back home with Jessica and safe and sound. But it took over a month and Jessica struggled emotionally until Caleb was back. She found it hard to focus at her dental technician job at which she excelled. She would lock herself in the bathroom at work and cry. She thought about harming herself. Caleb is back and doing well in school and a big sports fan. Mom s work is again going well. Dad gets a summer visit with Caleb but now there is a court order. A child snatch case like this takes more work that some others. But a great majority of all family law cases settle before a court hearing. The average cost per case is $800.

7 Getting People Back to Work A 30 year Old Summary Offense Was Blotting Her Record Kelley Jackson Bair was frustrated. Her prior job ended through no fault of her own and she was vigorously looking for new work. She was pleased to land a data entry position with a large health care system. But a few weeks into her orientation period she was terminated when a background check revealed a summary conviction that occurred when she was a teenager. I thought this is ridiculous, I m almost 50 now and I ve never had a problem getting work. The employer agreed to have her back if she could eliminate this from her record. Her MidPenn attorney is preparing the appropriate paperwork. MidPenn Expungement Clinics are able to help remove these barriers to work in most cases. Pennsylvania expungement law allows for the expungement of summary convictions after five years have passed and the person is conviction free. I like my new job and I m looking forward to leaving the past behind.

8 Desperately Seeking Employment Battling Bureaucracy While Trying To Get Ahead Lakichia Carrier is over qualified. She has two bachelor degrees as well as a masters. She wants the best for her 15 year old son who has a learning disability. Her life is a constant job hunt. She last worked for UPS coordinating their delivery programs but layoffs affected the last to come on board. No amount of schooling could help her understand the Earned Income Disregard program of the Harrisburg Housing Authority. The program was to be a bridge toward self-sufficiency allowing her to retain more of her earnings. Lakichia worked through numerous temp agencies while looking for permanent employment. Misunderstandings over rent adjustments led to endless confusion and frustration. An eviction threat loomed over the family. A MidPenn attorney along with a social worker met with management to review the complex ledger in detail. Not only was the program finally explained clearly, a correction was made indicating that no back payments were actually due. She and her son get to stay in their home as she seeks a new job and there are some recent glimmers of hope on the horizon. I have to keep on striving for both my boy and myself.

9 Preserving a Home Through Hard Work Mom Does Construction Labor to Save Her Family s Home Martha Lemme was crestfallen when the bank filed to foreclose on her home. Though no fault of her own she had lost her job and had been unable to locate employment that would pay enough to allow her to keep the home. She fell behind in her mortgage payments for the home where she and her four children had lived for 15 years. Martha came to MidPenn through a mortgage foreclosure diversion project. MidPenn attorneys fought long and hard for her and she received a mortgage modification that allowed her family to remain in the home. Her monthly payment was reduced from $911 to $577. Martha is now part of a construction crew for a company that helps build residential housing and decks. She is a laborer and hauling cement blocks is a common chore. She drives over two hours a day to get back and forth to work. Martha recently completed a three month trial period and the final mortgage modification has been approved. It was such a relief to finally get this weight off my chest. Now she is hard at work installing hardwood floors and fixing up the basement.
