8 *DOCUMENTS: Needed for issuing of location permit: Excerpt form cadastral plan 3 copies of preliminary project design, Statement by architect/consultant that the preliminary design is in accordance with Spatial Planning, based on which the location permit will be issued Written report and validation statement for preliminary project if the project is drafted in accordance with foreign rules Proof of legal interest by applicant ** NOTES: Conceptual designs created in accordance with spatial plan based on which the Permit and Special conditions of construction are issued make an integral part of location permit Location permit is issued for all buildings, except for buildings that are not bigger than 400 m2, for buildings that soly intended for agricultural activity (not bigger than 60 m2) and simple buildings and constructions (NG No. 101/07) One cannot begin to build based only on location permit. It is necessary to receive the main project verification or construction permit (if the location permit is issued by the relevant administrative body, Administrative department for spatial planning and construction), or the building permit (if the location permit is issued by the Ministry of Construction and Physical Planning). During the process of verification of the main project it is necessary to submit a proof of payed communal and water contribution in accordance with special regulations.

10 Building whose total surface is not bigger than 400 m2 and building whose purpose is only agricultural activity (not bigger than 600 m2) NECESSARY: A final decision on building conditions issued by Administrative department for spatial planning and construction. Buildings for which the Ministry of Construction and Physical Planning has issued a valid building permit can be put into operation with the decision to carry out activities under a special law after the Ministry of Environmental protection, Physical planning and construction issued for that building USE PERMIT. Buildings for which the competent administrative body has issued the main project verification can be put into operation and it can be issued a decision to carry out activities under a special law after the Administrative department for spatial planning and construction SMC issues USE PERMIT DOCUMENTS: With application for use permit it is necessary to provide: 1) Copy of final construction permit 2) Information s about construction partners 3) Written statement of the builder about works and maintenance of the building 4) Final report of building supervisor

11 PHASE 3b CONSTRUCTION VERIFICATION Nn BROJ 76/07 Demand for Construction verification issuing *DOCUMENTS: Excerpt from cadastral plan 3 copies of preliminary project design Statement by architect/consultant Written report on Main project control Geotechnical study Cultural assets conditions about protection Written report and validation verification Proof of legality for existing building (for the reconstruction) Proof of construction right Before issuing of construction solutions following documents are needed: Municipal contribution payment Water contribution payment Construction fee payment Construction solution is issued 45 days from starting the procedure. **2,70 EUR Fee

12 *DOCUMENTS: Excerpt from cadastral plan 3 copies of the main project Written report of the architect that the preliminary design is made in accordance with spatial planning documents which are a base for issuing construction solution Written report on main project control if control is needed Geotechnical, technological, traffic and other researches (if they were used in making of the main project) Water protection, protection of cultural assets, environment protection studies Written report and validation if the main project is made by foreign regulations Proof of legality of existing building (in the case of reconstruction) Investors proof that he has the right to build on land or on the building FEE 270 EUR (duty stamp) Construction fee: 1. For the buildings of the gross surface to 1000 m2 0,50 from the price of construction 2. For the buildings of the gross surface from 1000 to 5000m2 0,35 from the price of construction 3. For the buildings of the gross surface from 5000 m2 0,25 from the price of construction 4. All other buildings 0,25 from the price of construction

13 PHASE 4 BUILD OF THE OBJECT Nn BROJ 76/07 Before of the beginning of construction REGISTER THE START OF THE BUILDING WORKS * Registration in writing 8 days before start of building or extensions of work ** OBLIGATIONS DURING THE CONSTRUCTION: Building should be done in accordance with approved documentation Should a need for modification arise it is necessary to request changes of final construction decision

14 * Application is submitted in writing to the body that issued a permit, and also to construction inspection and labour inspection 8 days before beginning of construction or extensions of works if the works were stopped longer than three months. This obligation is set by the Article 249 of ZPUG. ** OBLIGATION DURING THE CONSTRUCTION: Construction must be carried out in accordance with the approved documentation, which was approved by a decision on conditions for construction or main project approved by confirmation of the main project. If during the construction there is intention to make changes to the approved project, it is necessary to seek the amendment of the decision on conditions for construction or modification of confirmed main project. Proceedings conducted in case of changes during construction are given in Article 233, 234 and 235 of Building Act. If during the construction the investor is changed, it is necessary to request the change of investor s name. New investor shall submit proof that he has right to build (based on a document which has given him the right of ownership or building).
