1 Applicable fees for of s to thirdcountry s 1. INTRODUCTION ence s are authorisations by the authorities of a Member State allowing thirdcountry s to reside legally in its territory. 1 This EMN Inform provides an overview of the applicable fees for of s to third-country s (TCNs) as of September It is based on information collected from 24 EU Member States and Norway 2. The Inform particularly examines fees under a number of EU s, which are outlined in Section 4. Please note that Denmark, Ireland and the United Kingdom have not opted into the s stated in this Inform. 2. KEY POINTS TO NOTE The fees that apply for the of s vary significantly across Member States. The methodology for the composition of fees is usually dependent on the cost incurred in the processing, manufacturing and issuing of the s. With regard to the overall fee levels, the highest fees are in place in Greece (up to 900), the Netherlands (up to 861) and Finland (up to 540), while the lowest overall levels are reported in Hungary (ca. 33), Luxembourg () and 1 EMN Glossary V Ad-Hoc Query No on Fees for of s to third-country s launched by LU EMN NCP and COM on 18th March 2014 and Ad-Hoc Query No on Applicable fees for s launched on by NL NCP on 20 March 2014 Estonia ( 63.91). In Belgium, overall levels are low as well (basic fee amounts at ~ 15); however the amounts provided represent manufacturing costs only, which may be complemented by local taxes 3 applied by certain municipalities. In Belgium, the same basic fee applies for the of all s, regardless of the type. In 8 Member States, first fees are higher than fees for renewal of s (DE, FI, FR, HU, LT, MT, PT, SK). is available in five Member States for a higher fee (BE, BG, LV, LT, SI). Reduced fees are in place in the majority of Member States and Norway for children, students or pensioners. Some Member States have made efforts to cut red-tape. For example, in France, a one-stopshop procedure 4 was introduced to speed up and simplify the process of issuing a to labour migrants who are not subject to market tests. 3 The Law concerning taxes on for foreigners do not allow taxes which are not comparable to those requested from Belgian s for the of. 4 Please note that the Single Permit (2011/98/EU) introduces a single application procedure for issuing a single for thirdcountry s to reside for the purpose of work in the territory of a Member State, in order to simplify the procedures for their admission and to facilitate the control of their status;

2 A number of EMN NCPs have confirmed that the fee levels do not differ depending on the duration of the (BE, CZ, EE, ES, HU, LV, LT, LU, NL, PT, SK). In the Netherlands, for example, fees are not related to the lenght of the s. For instance, a for family reunification is granted to a maximum of 5 years and fees amount to 228 ( 53 in case of a minor), regardless of whether the period of validity is 1 year or 5 years. In contrast, fees can differ depending on the duration of the in EL, DE and FR. In Greece, initial fees and renewal fees range depending on the number of years of validity of the. Similarly in Germany, fees can slightly vary depending whether the is issued for one or more years. In France, higher fees are in place for renewal of some s depending on the duration of the extension (one or several years). 5 However, the period of validity of s may vary across countries, which could limits the comparability of the fees. For example, in the Netherlands, s for students are granted for the duration of the entire study. Only fees for s are part of this Inform. Additional costs, such as fees for visa to enter the Member State and for civic integration are not included. 3. OVERVIEW OF RESIDENCE PERMITS ISSUED IN 2013 The of s varies considerably by duration and reason in Member States, depending on the migration patterns and trends experienced. The total number of all valid s that were held by TCNs at the end of 2013 was over 18 million 8, the largest number of which were in Italy (3,885,497), followed by Germany (3,542,944) and Spain (2,705,144). The United Kingdom does not operate a system of s. The Home Office data on passenger arrivals, visas, extensions and asylum processes is used to compile data for the UK s equivalent systems 9. Based on this, in 2012, the United Kingdom issued 631,940 s. Furthermore, the total number of valid s held by TCNs in the United Kingdom was 1,630,322 at the end of In terms of s issued to specific categories of TCNs, the total number issued with a long-term status in 2012 was 7,153,323. While in 2013, a total number of 12,850 EU Blue Cards have been issued this figure amounted at 3,664 EU Blue Cards in Denmark, Ireland and United Kingdom do not issue EU Blue Cards. 4. FEES FOR ISSUANCE OF RESIDENCE PERMITS PROVIDED FOR IN THE EU ACQUIS The EU acquis contains provisions for the of s to a number of categories of thirdcountry s, as outlined below. 8 Eurostat, [migr_resvalid] 9 For further information see the UK s User Guide on Immigration Statistics: 10 Eurostat, [migr_resbc1] a. EU long-term s Council 2003/109/EC concerning the status of third-country s who are longterm residents determines the terms for issuing and withdrawing long-term resident status granted by a Member State in relation to third-country s legally residing in its territory and the rights pertaining thereto. In particular, Article 8.2 of the foresees that Member States issue s to long-term residents, valid for at least five years and if required, upon application, automatically renewed on expiry. Annex 1 shows that the lowest fees for issuing an EU long-term are in place in Belgium, where the basic fee for the is ~ 15 and in Hungary (~ 33), Spain ( 41.62), Luxembourg (), Estonia ( 63.91) and Romania ( 88). In most of the (Member) States under review, the fees range between 100 and 200 (DE, MT, NL, PL, SK, SI and SE). The highest fees are in place in Greece ( depending on the duration of the ), Bulgaria (~0), Portugal ( ) and Italy ( ). b. Permits issued in accordance with 2003/86/EC (family reunification) Council 2003/86/EC on the right to family reunification determines the conditions under which family reunification is granted, as well as the rights of the family members concerned. In particular, article 13.2 of the foresees that Member States issue a renewable to family members of at least one year. Article 15.1 of the foresees that after five years of, and if no has been granted for other reasons, Member States must issue, upon application, an autonomous, independent of the sponsor, to the spouse or unmarried partner and to a child who has reached majority. Member States are allowed to levy charges for the of such s. As shown in Annex 1, fees for such s again vary significantly across Member States. The lowest costs are in place in Belgium (~ 15) and Malta ( 25), while Norway ( 632), Greece ( ), Bulgaria (~ 272) and France ( 260) have the highest fees. In a number of Member States, the fees are in the range (DE, IT, PT, RO, SE and SK). In Cyprus, the fee for family reunification is 200 per application irrespective of the number of persons it covers. 3

Temporary issued to victims of trafficking in human beings and, when applicable, persons subject to facilitation of irregular immigration, in accordance with 2004/81/EC Council 2004/81/EC defines the conditions for granting s of limited duration to non-european Union (EU) s who are victims of human trafficking or (optionally) subjects of an action relating to the smuggling of people and who cooperate in the fight against these crimes. The may be granted to non-eu s even if they have irregularly entered the territory of an EU country. Article 8 stipulates that the competent authorities are responsible for assessing whether the victim's presence is deemed necessary for the investigation or judicial proceedings, whether he/she has shown a clear intention to cooperate, and whether he/she has severed all relations with the suspected perpetrators. When these three conditions are fulfilled, and subject to public policy and security, a of limited duration will be issued. The is valid for at least six months and may be renewed if the relevant conditions continue to be satisfied. As presented in Annex 1, a number of Member States, s for victims of trafficking in human beings, and where applicable, persons subject to facilitation of irregular immigration, are issued exofficio with no fee (CZ, EE, EL, HU, LT, LV, NL, RO, SE, SK, NO). A number of Member States reported that fees are in place (BE, BG, ES, FR, DE, IT, LU, MT, PL). The lowest fees are applicable in Poland ( 12) and Belgium ( 15.20) for the of the only; Italy ( 16) and Malta ( 25), while fees are highest in France ( 260), Bulgaria ( 250) and Germany ( 100). (See Section 7 Conditions and criteria for exemptions from fees). d. Permits issued for the purpose of study, pupil exchange, unremunerated trainees and au pairs issued in accordance with 2004/114/EC Council 2004/114/EC determines the conditions of admission of third-country s for the purposes of studies, pupil exchange, unremunerated training or voluntary service. Only the rules for students are mandatory. The foresees a set of general conditions (Art. 6) as well as specific conditions for students (Art. 7). Article 12 determines that a for a student shall be issued for at least one year and be renewable if the general and specific conditions continue to be met. Art. 20 states that Member States may require applicants to pay fees for the processing of applications. As illustrated in Annex 1, fees pursuant to 2004/114/EC range considerably among Member States with the lowest fees in Slovenia ( 13 for pupils and volunteers and for trainees and students) and the highest in Norway ( 303 for all groups and 364 for apprentices) and the Netherlands ( 304 for students). In the Netherlands, s for students are granted for the duration of the study and thus, a renewal is not necessary during the studying period. Students applying for a temporary for the purpose of study are exempt from the administrative fee in the Slovak Republic. e. Permits issued for the purpose of research issued in accordance with 2005/71/EC Council 2005/71/EC creates a specific admission procedure for third-country s for the purposes of scientific research. The conditions for admission are laid down in Article 7, while Article 8 determines that the shall be issued for a period of at least one year if the conditions are met, and be renewable if the conditions continue to be met. Recital 21 states that Member States should have the right to charge applicants for the processing of applications. Fees applied to the of this category of s significantly vary across Member States, from in Belgium up to 304 in the Netherlands and 303 plus 36 cost of the in Norway. In some Member States the fees include the cost of a and other fees (BE,BG, EE, FR, DE, EL, HU, IT, LV, LU, MT, NL, PL, PT, RO, SK, SE) while a few others charge only administrative duties (RO). In Slovak Republic no fees are applied for the. In Germany and Greece the fees change depending on the duration of the. For example, in Germany the cost is 10% higher if the is issued with a validity of more than a year and Greece requires a fee of 150 per year of research contract of the applicant. f. EU Blue Cards, issued in accordance with 2009/50/EC, including for family members falling under the scope of this. Council 2009/50/EC on the conditions of entry and of third-country s for the purposes of highly qualified employment (the EU Blue Card ) facilitates access to the labour market and entitles holders to socio-economic rights and favourable conditions for family reunification and mobility within the EU. In particular, Article 7 of the foresees that a third-country who 4

5 has applied and fulfils the requirements set out in Art. 5 and for whom the competent authorities have taken a positive decision in accordance with Article 8 shall be issued with an EU Blue Card. Member States are allowed to levy charges for the of the EU Blue Card. Fees again vary widely, the lowest fees are provided in Belgium, where the basic fee for the is ~ 15, while the highest fees are in Bulgaria ( 480) and Netherlands ( 861). Medium values are, for example, in Slovenia and Hungary which apply a fee of 60; Czech Republic, Estonia 11, Poland and Germany around 100; finally, the fee in France, Italy, Portugal and Sweden is over 200. In some cases (e.g. HU and SK) the fees slightly vary depending on whether the application is made in the Member State or abroad, through a Diplomatic mission. g. Permits falling under the scope of "Single Permit" 2011/98/EU 2011/98/EU (so called Single Permit ) became operational in the Member States at the latest on 25 th December Article 10 refers to fees and states that "Member States may require applicants to pay fees, where appropriate, for handling applications in accordance with this. The level of such fees shall be proportionate and may be based on the services actually provided for the processing of applications and the of s." This applies to certain s issued under EU law (e.g. family members admitted under family reunification who have access to the labour market, students who have access to the labour market, researchers, EU Blue Card holders) as well as s giving access to the labour market, and excludes a number of specific categories of workers (such as posted workers, seasonal workers, intra corporate transferees, self-employed persons and EU long term residents). As illustrated in Annex 1, the lowest fees for issuing an EU long-term are in place in Luxembourg (), Hungary (~ 60) and Estonia ( 63.91). In most of the 22 Member States under review, the fees range between 100 and 200 (DE, FR, LV, MT, PL, SK). The highest fees are in place in Portugal (~ 300), Bulgaria (~0) and the Netherlands ( 760 for seasonal workers, 861 for all others). 5. FEES FOR RENEWAL AND REPLACEMENT OF RESIDENCE PERMITS While renewal involves the reissuing of an expired, replacement is the substitution of a lost or damaged. Fees for renewal/replacement also follow different rules in each Member State. Such rules usually apply to all kind of s, with very few exceptions. Some Member States require higher fees for renewal depending on the duration of the extension (DE, EL, FR); in others the amount to be paid is the same as for the first (EE, LU, PL, SE); finally, some Member States impose only administrative fees or lower fees than for the first (HU, PT,SK). Among Member States that apply a fee for the replacement of the where lost or destroyed, some apply the same costs and fees as for initial (LT, LU, PL, SE), while others apply lower fees (FR, HU, LV, NL, PT). In Poland, in the event of the wrongful loss or wrongful destruction of selected s 12, the fee for the replacement is increased up to 300%. In Slovak Republic, the fee changes according to when the replacement is requested and to the urgency of the procedure. In this regard, only 9 Member States provide for a fast-track procedure; of these, 5 apply a higher fee (BE, BG, EE, LT, LV) which ranges from twice (EE, LT) to 7 times the standard fee (BENL, SI, SE do not charge additional fees for a faster procedure. 6. FEES FOR ISSUANCE OF NATIONAL RESIDENCE PERMITS Fees of specific s were reported by 13 Member States (BG, EE, HU, IE, LT, LU, NL, PL, PT, RO, SK, SI, SE). The fees applied vary significantly from one Member State to the other. Lower fees reported are in Hungary for long-stay seasonal workers visa ( 40); Luxembourg applies the standard fee of for all kinds of s. For example, in the Netherlands, the fees for s for Turkish s exercising rights under the EEC-Turkey Association Agreement 11 In Estonia, for family members of EU Blue Card holder, cost euro. 12 These include the Polish ; Polish travel for a foreigner; Polish of a foreigner; certifying that the foreigner holds a for tolerated stay entitled for tolerated stay. 5

6 and their family members amount at 53. In Poland fees for temporary s amount to ~ 95 and those for permanent to ~ 168. Around 100 are the fees applying to study exchange and temporary visitors in Sweden. In Slovak Republic the lowest fees are for seasonal work ( 33). In Ireland, a fee of 300 is charged in respect of each immigration certificate of registration issued to third-country s. In addition, there are prescribed fees for investors ( 750), entrepreneurs ( 350) and atypical workers ( 250). Fees for longterm residency in Ireland amount to 0. Higher fees generally apply to entrepreneurs with a range going from ~140 to 1,266 (EE, LV, NL, SK, SE) with the top highest in Portugal, where they amount to 5, CONDITIONS AND CRITERIA FOR EXEMPTIONS FROM FEES Exemptions from fees are in place in a number of Member States (DE, EE, EL, HU, LT, LV, LU, NL, PL, PT, RO, SE, SK) and Norway. Beneficiaries of inter protection (DE, EE, HU, FI, IE, IT, LT, LU, NL, PL, PT, SE): In a number of (Member) States, beneficiaries of inter protection are exempt from fees. For example in Hungary, legislation specifies a number of categories of TCNs granted a on humanitarian grounds, including recognised stateless persons; person authorized based on the principle of non-refoulement 13 ; persons who have cooperated with the authorities in a crime investigation and have provided significant assistance to gather evidence; asylum applicants; unaccompanied minors and persons who was employed under exploitative work conditions. Persons who are unable to pay the state fee (EE) and persons dependent on public support (DE); Spouses, widows, widowers, civil partners and surviving civil partners of and spouses and dependants of EU s (IE); Third-country s who are under 18 years old of age at the time of registration (IE, IT, SK); On the basis of bilateral agreements (DE, FI, LT, PL, PT).
