5 Preface Who? How? What? Questions and answers on the recognition of foreign professional qualifications In this little booklet, you will find answers to different questions about the recognition act in Germany and an overview of the competent authorities for the recognition of qualifications in Schleswig-Holstein. Information on which documents will be needed for the assessment of the equivalence of foreign qualifications is provided, as well. Furthermore, the options available if equivalence is refused or only granted partially are discussed. In our counseling practice, the following questions are asked again and again: When should an equivalency assessment be sought? When will my academic or school-leaving qualification be recognized? Whom should I contact? Where can I receive further information? In the jungle of different authorities in charge of the recognition of foreign qualifications, we would like to provide all parties concerned and seeking advice with this little booklet with texts in plain language, which we have developed from our counseling practice. It supplies you with a brief outline of the recognition of professional and school-leaving qualifications and how to obtain it in concise form. Due to the wealth of information, we cannot rule out that errors or ambiguities have slipped in which we could not account for. Therefore, we are grateful for feedback and information contributing to the completeness and correctness of this booklet. 5
6 1. Why do I need recognition of my professional and school-leaving qualifications? You need recognition if you have a qualification in a regulated profession and want to work in this profession. Apart from that, you need recognition if you wish to obtain a school-leaving qualification, vocational training, or study at a university, if you wish to become self-employed in a trade for which an official license is required, wish to attend further education or vocational retraining programs. 2. What is a regulated profession? A profession is said to be regulated when, due to legal and administrative regulations, access and exercise are subject to the possession of specific professional qualifications and skills. 3. Which professions are regulated? In Germany, there are approx. 60 professions which are regulated, e. g. medical doctors, architects, midwives, dentists and veterinarians, nurses, pharmacists, physiotherapists and other professions such as driving instructors etc. 6
7 Professions such as teachers at state schools are regulated, as well. Are there also professions not requiring recognition? Yes. The so-called non-regulated professions in the academic field as well as professions of the dual system of vocational training (except for master craftsmen). For these, official recognition is not necessarily needed. With your foreign qualification, you can directly apply for jobs on the German labor market (also see No. 5). You will find a list of all recognized trained occupations (non-regulated) in the German dual system of vocational training under: 5. Is applying for recognition recommended for nonregulated professions? Yes. Here, an assessment of your foreign qualification makes sense, as well, because it will enable your future employer to better assess your qualification. For this reason, it is always recommendable to apply for recognition or an as- 7
8 sessment of equivalency with the competent authority for non-regulated professions, as well. For persons holding a foreign academic degree, the Central Office for Foreign Education (Zentralstelle für ausländisches Bildungswesen, ZAB) will, upon application, issue an individual assessment of the certificate. Especially migrants who wish to work in Germany can benefit from this service. For applying for an assessment of your certificate, you have to fill out a questionnaire form online: After having registered with this questionnaire, you will receive the application form by . Please fill out the application completely, print it out and then, together with the required documents (see link), send it to the address below. 9 6. What has improved or changed for me since the recognition act has come into effect? If you or your final qualification come/s from one of the third countries (states outside of the EU / EEA) or states with bilateral treaties - Austria, France, or Switzerland, please note the following changes: You are legally entitled to an assessment of equivalency of your qualifications regardless of your nationality, origin, and residency status. Your professional experience and further qualifications pertaining to your qualification are taken into consideration. Previously, this was not possible for all migrant groups. In the assessment of your qualifications, the determination of substantial differences by the competent authority responsible for your profession is crucial. The competent authority will examine whether your professional qualification from abroad is equivalent to the German professional qualification. Contents and duration of the qualification are examined. Furthermore, the competent recognition authority will decide within three months (if all necessary documents provided) if your qualification is equivalent to the respective German qualification. For this, all docu- 9
10 ments required must have been submitted completely. You also have the opportunity to apply for an assessment of equivalency of your qualification from abroad. 7. What is the first step in obtaining recognition for my qualification? First, you must find out which category of professions your qualification belongs to. Is the profession regulated or not regulated? It is also important to know whether you wish to work or study in this field. Then, you need to find out which ministry, chamber or other authority is responsible for the recognition of your qualification. If you wish to work in Schleswig-Holstein and have your qualification recognized, you can get support from our counselors in Schleswig-Holstein. 11 8. Which certificates or documents do I have to submit along with the application for recognition? Which documents are required for the recognition procedure for an academic degree or vocational training? The documents required vary depending on the competent recognition authority. Generally, however, you will need the following documents: Proof of identity (ID or passport evidence of name, date, and place of birth) Proof of the qualification acquired abroad Other qualification certificates (e. g. of further education or vocational retraining), as far as these are necessary for the assessment of equivalency. For further information, please consult the websites of the competent recognition authorities. You can find the appropriate recognition authority in the recognition finder at the recognition portal: (also see No. 13) 11
12 9. Do I have to have my documents translated? As a rule, the documents must be translated into German. The competent authority may waive translations, if the documents are in Spanish, English, or French. It is recommended to contact the competent recognition authority before applying or having the documents translated. The translations have to be executed by certified translators. For finding a suitable translator, we recommend the database: What are the costs of the recognition procedure? Recognition fees vary depending on professional qualification, competent authority and Land. Generally, the recognition procedure can cost up to 600. You also have to take the costs for certifications, translations, copies, etc. into account. Additionally, costs for exams (e. g. German language exam, aptitude test) and for compensation measures may accrue. For information on costs, please contact the competent recognition authority or the IQ counseling centers. 12
13 If you can provide evidence that you are registered as unemployed or seeking employment (corresponding notification from the Agentur für Arbeit or the Jobcenter), the costs may be reimbursed under certain conditions. 11. Is evidence of my residence status and work permit required for the recognition? No. 12. Is it possible to apply from abroad? Is there an authority in Germany where I can get information on this? The application can also be sent from abroad. However, you have to present proof that you wish to work in Germany. Information on this is provided by the German representatives, e. g. the German embassy in your home country. Information on applying from abroad is provided by the Federal Office for Migration and Refugees (BAMF) under hotline +49 (0) or the IQ counseling centers ( 13
14 13. Which authorities are in charge of recognition? Which recognition authority is responsible depends on the German reference profession. It also depends on your place of residence in Germany. In each Land (16 Länder) there are different recognition authorities for the respective qualifications and professions. You can also contact the counseling centers of the IQ network in the respective Land (see Below, you will find a list of the most important competent authorities for the recognition of foreign qualifications in Schleswig Holstein: Skilled crafts and trades (e. g. cook, hairdresser): Handwerkskammer Flensburg: (Chamber of Trades and Crafts): Handwerkskammer Lübeck: For commercial occupations as well as professions covered by the Chambers of Commerce and Industry (e. g. shop assistant, office management assistant), the IHK FOSA (central office for all Länder) is responsible: 14

Furthermore, an explanation is provided for each profession as to whether a recognition procedure is required (i. e. whether it is a regulated profession) or not. In addition, the portal provides an abundance of further information, among others on the recognition process as well as the legal basis of the recognition of educational and professional qualifications. 15
16 14. What are my options after receiving a negative recognition notification? You have the possibility of filing an objection against the decision within certain periods (normally four weeks). Relevant information is provided by the IQ counseling centers in Schleswig-Holstein When is a qualification equivalent? Which criteria are applied? Training programs are compared with regard to contents and duration. The status of the profession in your home country will be examined, as well. The possibilities available to you in your home country due to your qualification will be examined. It will be examined in which capacity you worked with your qualification in your home country. 16
17 16. What is a substantial difference? When is a substantial difference ascertained? Equivalency is not established if substantial differences are determined, e. g.: The duration of the training program is at least one year shorter than that required by the host country. If the professional knowledge and skills acquired abroad differ substantially. If professional activities are required in the host country which are not required in the country the training was received in. 17. What are my options if my school-leaving qualifications are not recognized? You can catch up and obtain a school-leaving qualification, e. g. - at a vocational college ( Berufsfachschule ), - at an evening school, - in a correspondence course (with external examination), - at educational providers (e. g. adult education centers). 17
18 You can have the vocational training you completed abroad and several years of work experience documented for a school-leaving qualification. You have the possibility of obtaining a school-leaving qualification by taking an exam for external candidates. Here, evidence of a successfully completed vocational training program in a recognized trained occupation of at least two years as the equivalent of a Erster allgemeinbildender Schulabschluss certificate must be provided. Completed vocational training or three years of employment open up the possibility of obtaining the general university entrance qualification (Abitur). 18. Which possibilities do I have with my nonregulated professional qualification? You have the following possibilities: You can have academic professions assessed by the ZAB (Central Office for Foreign Education): or apply directly with prospective employers. 18

20 Foreign Skills Approval Competence Centre IHK-FOSA: Vocational qualifications portal: What is the EU Blue Card?: Qualified third country nationals wishing to work in Germany can apply for a Blue Card under the following conditions: A recognized academic degree An employment contract providing for a minimum annual compensation of Or an employment contract in shortage occupations such as scientists, engineers, mathematicians, medical doctors, and IT professionals with evidence of an annual compensation of The application for the Blue Card must be submitted before entering Germany. If all requirements have been met, you will be issued a residence permit for the purpose of employment acc. to 19a Abs. 6 Aufenthaltsgesetz. Initially, the Blue Card is valid for four years. If the employ-ment contract covers a period of less than 4 years, it will be valid for the duration of the 20
21 working contract. After 33 months of qualified employment, you may apply for a settlement permit (unlimited residence permit). If you can prove German language skills at level B1, you can already be issued a settlement permit after 21 months. Family members of EU Blue Card owners may work in Germany without restriction and delay. Immigration for spousal reunion does not depend on the evidence of language skills or other integration measures. Even basic knowledge of the German language is not required for spouses, but is advisable for the person him/herself for easier integration.
