WHY DO YOU NEED BusinessGUARD Plus PROTECTION The real risk to business today comes from regulation. Whether it is for employment disputes, VAT investigations or breaches of health and safety law, business owners are faced with a bewildering array of challenges. PROTECTING YOU, YOUR BUSINESS and YOUR EMPLOYEES from THE UNEXPECTED BusinessGUARD Plus protects your business in two ways: 1 Our panel of experts will advise you on business risks such as employment disputes, HMRC investigations and contract disputes, all backed up by 100,000 of insurance cover for each claim to a limit of 500,000 any one policy year + 2 BusinessGUARD Plus also protects your business from staff absence through accident or injury, paying 75% of their gross income back to you as a business. HMRC is investing 900M in extra investigators for tax and VAT enquiries (Source: HMRC) 1.44B extra VAT was collected from larger companies by HMRC from investigations in 2012/13 (Source: Pinsent Mason Accountants) There has been a 44% increase in VAT investigations in 2012/13 (Source: HMRC) The largest employment tribunal award in 2012/13 was 387,472 (Source: Ministry of Justice)
3 BusinessGUARD Plus protects Legal Expenses Legal Defence Expenses Cover: BusinessGuard Plus covers the costs of defending the employer, employees, directors or partners for prosecutions connected to normal business activities. If you face criminal prosecution for any act or omission, you will receive expert advice and representation both at the police station and in court. BusinessGuard Plus also protects you from Health & Safety, Food Safety, Consumer Protection and a range of other prosecutions including bribery, which you might face. You will also be given advice on how to manage the problem. Example: A crane operator was killed when the crane he was dismantling collapsed. The Health & Safety enquiry resulted in a Director facing criminal charges. Our experts were able to have the charges dropped after an extensive review of the case. Contracts Disputes There are around 1.1M reported Health & Safety incidents reported each year (Source: The HSE) Cover: Are you concerned about disputes with customers and suppliers? BusinessGuard Plus will provide for costs in relation to a dispute with a customer or supplier in respect of a contract for the sale, hire, supply or purchase of goods and services, you will also receive advice and representation where a dispute occurs. Excluding breach of professional duty, The first 10% of professional fees and Any claim less than 250. Example: A policyholder refused to settle an 18,000 bill from a decorator who was refitting their office because his work was so poor. We successfully defended the client and the case was dropped. Tax, Vat, Paye & Nic Investigations Cover: Tax investigations are on the increase. Being involved in one is likely to be stressful, time consuming and expensive. If HMRC begins an enquiry into your tax affairs, including aspect enquiries above 100 or about VAT, PAYE or NIC BusinessGuard Plus will cover professional fees and support you through the whole process. Excluding all claims within the first 60 days of the first period of insurance, Tax avoidance schemes, Claims which originate for any enquiry, investigation or dispute which existed before the period of insurance. Example: HMRC investigated a Tax Return submitted by a policyholder. We agreed to fund their accountant s costs to deal with the matter. The claim was successfully defended and the investigation closed. HMRC raised 12BN in tax and VAT from investigations in 2012 (Source: The HSE)
4 Employment Disputes, Awards, Representation Cover: Are you concerned about employee disputes for discrimination, unfair dismissal and theft of company property? Cover is provided in the event of a dispute with an employee over their contract of employment and any compensation awards relating to such a dispute. Cover is also provided to represent employees in dispute over their role as a trustee of a pension fund. BusinessGuard Plus covers the costs of defending these claims and gives you access to expert advice on how to manage the problem. Excluding any events arising within the first 90 days of the first period of insurance, Excluding any disputes with an employee who was subject to a formal or informal written or verbal warning within 180 days immediately before the first period of insurance, Excluding any events arising within the first 180 days of the first period of insurance for redundancy, alleged redundancy or unfair selection for redundancy. Example: An employee was dismissed for gross misconduct. The employee made a claim to an Employment Tribunal. Our insurers appointed a solicitor to defend the company; the solicitor was successful in having the claim struck out, without the business incurring any costs in the matter. Debt Recovery There were 739,600 employment tribunals in 2012 (Source: Ministry of Justice) Cover: Collecting money from customers is becoming more challenging; but with BusinessGuard Plus you can get advice you on how to deal with uncontested debts of over 250 and we will pay 90% of all the professional fees you have to pay to recover your money, including interest, due to you from another business. Example: A client sub-contracted a large printing contract to a local company. The quality of the work was so poor that another contractor had to reprint the whole order. The first sub-contractor refused to reimburse the costs incurred by the client, so legal proceedings were issued against them. Shortly after they paid the debt in full, plus all the legal costs up to that point. Data Protection Cover: BusinessGuard Plus will cover your defence if civil action or enforcement proceedings are brought against you in connection with your registration with the Information Commissioner. Example: An employee might, without your knowledge, misuse information the company holds on its customers. There have been a number of actions against companies where the owner was not aware that data was being misused and that the company was ultimately responsible. Property Protection Cover: You will receive advice and your legal fees will be covered if you need to pursue civil claims against others responsible for damage to your property or if there is a civil action between you and your landlord under the terms of the lease or tenancy agreement applying to your business premises. Excluding any claims arising in the first 90 days Disputes with local or Government authorities The EU is introducing tough new data regulations for all 500M citizens (Source: ICO) Example: A client had a wall badly damaged by a neighbouring company. After a claim against them failed they asked us for advice, we achieved a settlement allowing the wall to be rebuilt entirely at the cost of the neighbouring company.
5 Personal Injury Cover: This will meet the costs of pursuing a civil claim for damages in respect of death of or bodily injury to an insured person caused by the negligence of a third party but excluding any claim involving medical or clinical negligence or pharmaceutical related claims. Licence Protection Cover: BusinessGuard Plus will fund the costs of an appeal or representation to the relevant authority where your licence has been suspended, revoked or renewal has been refused and such licence is necessary for you to continue in your business. Example: A publican was refused a licence renewal because of claims about problem customers. Our experts gathered evidence and submitted it on behalf of the client, resulting in the licence being renewed. Jury Service & Attendance Cover: Loss of salary or wages to attend any court or tribunal in connection with a case covered by this insurance, or attending court for jury service (excluding the first 5 days) providing the amount shall not exceed 100 per person per day, up to a maximum of 1,000 per claim) Group Accident Cover We will cover all your staff (including directors), 24 hours a day, against any accident they have anywhere in the World. The company will be paid certain benefits to compensate the business for the costs it incurs in paying staff when away from work following an accident. In the event of any of the following we will pay the business the sums shown below: Accidental Death Loss of limb/s Loss of hearing Loss of sight Permanent Total Disablement Temporary Total Disablement 100% of their Annual Salary Up to 100% of their annual salary Up to 100% of their annual salary Up to 100% of their annual salary 100% of their annual salary If you or a staff member is injured (and unable to carry on their normal business duties) Business Guard Plus will pay the business 75% of their gross weekly wage (up to a maximum benefit of 2,000 per week for a period of up to 52 weeks). 6 Professional Advice BusinessGUARDplus does not just give you insurance protection. You will have access to extensive, free professional advice for many of the key issues your business may face. These are: Legal Advice Line you can call the advice line 24 hours a day, 365 days a year, to ask for advice on any legal issue that might affect you or your company. The service has huge value to SME businesses who face a range of complex legal issues each year. Tax Advice Line - available to you during working hours, the tax advice line will help you understand and deal with any tax issue, no matter how complex. Online Legal Resource we will give you free online access to a library of legal documents. These include extensive coverage of employment, health & safety and property contracts along with many others. This service has the potential to save your business 000 s in legal fees. Health, Medical and Counselling Service You and your staff have access to help and information from a Registered General Nurse. Not only can this help in everyday life, it is a useful employee benefit in the event of a staff member experiencing stress or trauma either at work or in their personal life. The service provides non-diagnostic advice and a qualified nurse to talk through any problems with you, including information about all types of surgical and medical procedures, health issues and information on over 400 medical conditions. The health advisers can offer assistance with anything from diet to exercise, reducing alcohol consumption and giving up smoking. Counselling including stress, anxiety, depression, health related issues, relationships breakdown and bereavement. IMPORTANT NOTE Like all insurance products there are certain exclusions and limits. The principle exclusions of the Business Guard Plus product are: Commercial Legal Expenses If you can demonstrate that your claim has a Reasonable Prospect of Success the insurers will take over the claim on your behalf and will appoint a specialist of their choice to act on your behalf. In most cases the legal expenses will only apply where you have a 51% or greater chance of success with your claim. You must give notification within 30 days of any circumstances which may give rise to any claim under this policy within the period of insurance. Any delay in reporting a claim could prejudice your claim or result in a claim being declined. You can only claim for problems that occurred after you bought the policy. The Legal Claims Notification and Advice Helpline is available 24/7 to ensure you receive prompt and correct advice. Any action you may take prior to consulting the Helpline will not automatically lead to the declinature of your claim providing it has not prejudiced your claim under this policy. All legal expenses claims are limited to 100,000 per claim, and 500,000 of claims costs in any one policy year. Geographical limits are restricted to United Kingdom, Channel Islands and Isle of Man. Group Personal Accident The deferment period - all weekly benefits will have a deferment period before claims will be paid. For businesses with up to 10 employees the deferment period is 14 days; for businesses with more than 10 employees the deferment period is 7 days for businesses Participation in hazardous activities (taking part or practising boxing, caving, climbing, horse racing, jet skiing, martial arts, mountaineering, winter sports, potholing, bungee jumping, hunting on horseback, parachuting, power boat racing, underwater diving, yacht racing or any race, trail or timed motor sport event). Injuries arising from, traceable to or caused by any gradually developing bodily deterioration, whatever the course of that deterioration.

We act as your agent when placing the insurance, providing ongoing services to you and when helping you with any claims. In sourcing a suitable policy we act as agent of the insurer. To access the insurance that most suits your needs, we will use another intermediary to help place the business and have chosen Ageas Insurance Limited as the insurer for this product. You are entitled, at any time, to request information regarding any commission which we may have received as a result of placing your insurance business. Your Responsibilities We would remind you that you have a duty to disclose all material facts and changes, at inception, renewal and throughout the life of the policy or any information which may influence the insurer in deciding premiums or terms, which have not previously been disclosed to insurers, as failure to do so could invalidate your policy or result in a claim not being paid. Complaints and Compensation We aim to provide you with a high level of customer service at all times. If you have a complaint please contact our Compliance Officer at the address stated above. When dealing with your complaint, we will follow our complaint handling procedures; a summary of these procedures is available on request. If you are still not satisfied, you may be entitled to refer the matter to the Financial Ombudsman Service (except in the case of a business employing 10 persons or more and with a turnover or annual balance sheet total exceeding 2 million, a charity with an annual income of 1m or more or trustees of a trust with a net asset value of 1m or more). We are covered by the Financial Services Compensation Scheme (FSCS). You may be entitled to compensation from the scheme if we cannot meet our obligations. This depends on the type of business and the circumstances of the claim. If you are eligible to claim from the FSCS, compensation is available for insurance advising and arranging for 90% of the claim, without any upper limit.
