2 Introduction The rapidly evolving global economy characterised by the constant emergence and expansion of markets presents a unique set of challenges and opportunities to businesses.this has given rise to significant increase in foreign direct investment (FDI) and cross-border transactions involving M&A and Asset Acquisitions. Complex legal questions arise in cross border business and transactions, particularly in view of the various differing legal frameworks, as well as the push towards legislative harmonisation in the European Union.
