13 ELD and nature conservation 2001: European Commission referred to what would become the ELD as a liability instrument to cover damage to biodiversity, considering it an important additional step forward proposed limiting scope of the liability system in a first instance to natural resources that are already protected by the Birds and Habitats directives because liability for preventing and remedying damage to natural resources was basically new to the EU Friday, December 14, Stevens & Bolton.
