2 WARRANTIES There are two types of warranty that you can place on your animal to reassure potential buyers. These are as follows: 1) General Warranty Unless the horse is to be sold "without warranty", all lots must be free from vice, quiet in the stable, to catch, load and shoe unless otherwise declared. Latent defects must be declared i.e. crib biting, wind sucking, head shaking, sarcoids and sarcoid like lesions, un-nerving and it must also be stated if a horse has been fired, tubed or hobdayed unless the animal is sold without warranty. Complaints as to patent physical defects such as splints, curbs, sidebones etc, will not be entertained unless they cause the horse to be lame. Sweet itch, being a condition is not covered by the general warranty. 2) Soundness Warranty A horse/pony warranted as sound in wind, eyes and action must be free from any medical conditions and healthy in all ways. Recent previous medical conditions must be stated even if resolved. Unbroken ponies and foals can be warranted sound. 3) Suitability Warranties This can be given in addition to the Soundness Warranty on animals reserved at 300 or more only. The following suitability warranties can be offered: A) Horse / Pony Warranted as a Hunter must be quiet to ride in traffic, have been hunted and capable of being hunted. B) Horse / Pony Warranted as a Hack must be quiet to ride and quiet in traffic and be capable of being ridden as a Hack. C) Horse / Pony Warranted as Quiet to ride must be quiet in traffic and be capable of being ridden. D) Horse / Pony Warranted as Quiet to drive must be quiet in traffic and be capable of being driven. A Horse / Pony Warranted as a Hunter, a Hack, Quite to Ride or Quiet to Drive must be capable of being managed and ridden /driven by a reasonably experienced person of an age, size, weight and strength appropriate to the size of the Horse/Pony. 4) Warranty Period The purchaser of your Horse/Pony has until 12 noon on the Monday following the sale to contact Hobbs Parker Auctioneers LLP to notify us that the Warranty/Warranties placed on their purchase has not been met. If there is a breach of Warranty of Soundness then the purchaser must supply a vet's report/certificate to verify the breach. 5) Additional Information Affecting Warranties A) Horses that are wind-suckers, weavers, rigs and those that have been tubed, unnerved or operated upon for unsoundness of any kind must be so described. B) Any Horse that is a wind-sucker (i.e. habitually swallows air whether in association with grasping objects with incisor teeth or not) must be so described. C) A crib-biter need only be described if the crib-biting is associated with wind-sucking. D) Any Thoroughbred animal that is on the forfeit list with Wetherbys / The Jockey Club or that has run at an unrecognised race meeting must be so described. E) Any Horse/Pony that is in foal or believed to be in foal at the time of the sale must be so described. If not so described and is subsequently found to be in foal within 56 days then it is returnable. F) The general description of each Horse/Pony and details of age, height and colour do not constitute a warranty. However, details of age given must correspond with any passport or registration certificate that may apply to the Horse/Pony. 6) Horse Sold Without Warranty - 'Sold As Seen' If you do not wish to place any warranty on your Horse/Pony then you must state on the entry form that it is being Sold as Seen, which means that the buyer has no comeback against you as vendor under the terms of the auction warranty. (Animals that are offered with a warranty usually achieve better prices than those offered as Sold as Seen.) 7) Head Collar / Water / Forage. Vendors must supply a serviceable Head Collar with each animal which will remain with the Horse/Pony following the Sale. (Purchasers to supply the Lead Rope) Please ensure that all animals have access to water whilst they are in the market, a water tap is available for your use although it is your responsibility to provide your own bucket / container. You can also bring your own hay in a Hay Net. 8) Sale Ring Vendors are responsible for bringing their own Horse / Pony into the sale ring. 9) Passports All animals must be accompanied to market by their DEFRA approved passport. No horse/pony or foal regardless of age can be brought into Ashford Market without an appropriate Passport. 10) Micro-Chips Animals born after 1st July 2009 must have a readable micro-chip. Micro-Chipped animals will be scanned on arrival at the market and must match the details in their passport in order to be offered for sale.
