Address of Agent (if any): [A] Convictions The Licensing Authority can take into account any conviction against you in determining whether or not you are a fit and proper person. This includes any conviction that would normally be considered spent under the Rehabilitation of Offenders legislation. Please answer to any question if you have ever been convicted of an offence, be it a civil matter or criminal matter, a road traffic offence or other offence. You do not have to provide details of the actual conviction. The existence of convictions will not mean an automatic refusal of your application. It is likely, however that your application will be referred to the Licensing Sub-Committee for determination. You will be notified of date, time and place of the hearing in those circumstances. If you are not sure if something is a conviction or not, you should take advice on the matter or contact the relevant licensing office to discuss how to complete the question, before completing the application form. If you fail to answer this section correctly, you may commit an offence (see [B] below, and the Licensing Authority may conclude you have deliberately tried to conceal information from them, which will be taken into account when determining whether or not you are a fit and proper person to hold a licence. [B] Warning Any person who makes any statement in this application or in connection with it which he/she knows to be false or recklessly makes any statement which is false in a material particular shall be guilty of an offence and liable on summary conviction to a fine not exceeding 2,500. The licence must clearly state that the licence is authorising them to drive a motor vehicle issued under the Road Traffic Acts or a licence which would at the time of the application entitle them to such a licence without taking a test. Please note that a driver who is the holder of a Public Service Vehicle (PSV) licence is not exempt from licensing requirements if he wishes to drive Taxis or Private Hire Cars. Photographs The Licensing Authority requires TWO passport sized photographs of the Applicant. One will be affixed to the Licence (if granted); one to the identity badge. Medical Examination The Licensing Authority may at any time require a driver to submit to a medical examination so that it may be satisfied that the driver is physically fit for the purpose of obtaining a licence. It should be noted that failure to disclose the appropriate medical details on the application form may have adverse consequences. Driver aged 70 and over Any driver aged 70 and over will require to produce a medical certificate from a General Practitioner (G.P.) certifying that the driver continues to be medically fit to drive for the purpose of obtaining a licence. This will be done at their own expense. The Licensing Authority may further require that the driver undergo a medical examination with the Authority s approved medical examiner so that the licensing authority may be satisfied that the person is fit for the purpose of obtaining a licence. Please request a Medical Certificate form for completion by your G.P. if one is not already attached to the application. Taxi Drivers Licences (Carrying of Guide Dogs and Hearing Dogs)(Scotland) Regulations 2002 Please read the attached advice sheet for Taxi Drivers. If you have a medical condition, are al lergic to or have a chronic phobia of dogs, you should answer to question (f) in Section 2. Thereafter, the licensing authority will forward an application form for an exemption to the 2002 Regulations. A medical certificate attaching to the exemption application will require to be completed by your General Practitioner. The completed application and medical certificate should then be submitted to the licensing authority as soon as possible. Duration of Licences Licences will come into effect on the date specified in the Licence. Driver s Licences will normally be granted for a period of THREE years, unless a shorter period is specified.. Your application will be forwarded to the following consultee(s) while your application is being processed: Police Scotland The fee for a Taxi/Private Hire Car Driver s Licence is 40. The fee is non-refundable. Cheques/postal orders should be made payable to Aberdeenshire Council. The following documents require to be submitted with your application :- Completed Application Form Cheque or postal order for passport sized photographs Driver s age 70 or over a Medical Certificate form completed by a G.P. 6 TAXI/PRIVATE HIRE CAR VEHICLES Duration of Licences Licences will come into effect on the date specified on the Licence. Vehicle Licences will normally be granted for ONE year, unless a shorter period is specified.. Your application will be forwarded to the following consultee(s) while your application is being processed: Police Scotland The fee for a Taxi/Private Hire Car Vehicle Licence is 150. The fee is non-refundable. Cheques/postal orders should be made payable to Aberdeenshire Council The following documents require to be submitted with your application:- Completed Application Form Cheque or postal order for 150. A copy of insurance SIX MONTH VEHICLE TEST There is no fee for a Six Month Vehicle Test The following documents require to be submitted with your application:- Completed Application Form SUBSTITUTION OF A TAXI/PRIVATE HIRE CAR VEHICLE Duration of Licences Licences will come into effect on the date specified on the Licence. Vehicle Licences will have effect up until the expiry date of the original vehicle licence. The fee for Substitution of a Taxi/Private Hire Car Vehicle is per plate required. Cheques/postal orders should be made payable to Aberdeenshire Council The following documents require to be submitted with your application:- Completed Application Form Cheque or postal order for 60 (taxi) or 70 (private hire). 7 ADVICE SHEET FOR TAXI/PRIVATE HIRE CAR DRIVERS CARRIAGE OF GUIDE, HEARING AND OTHER ASSISTANCE DOGS IN TAXIS/PRIVATE HIRE CARS DUTIES ON TAXI/PRIVATE HIRE CAR DRIVERS Under the Taxi Drivers Licences (Carrying of Guide Dogs and Hearing Dogs) (Scotland) Regulations 2003 and the Private Hire Car Drivers Licences (Carrying of Guide Dogs and Hearing Dogs) (Scotland) Regulations 2004 licensed taxi/private hire car drivers are required to carry guide, hearing and other assistance dogs accompanying disabled people, and to do so at no extra charge. The dog must also be allowed to remain with the passenger. To enable drivers, who have a medical condition that would be aggravated by carrying dogs to continue to drive taxis/private hire cars, the Regulations also allow licensing authorities to issue a notice which exempts them from such a requirement. TYPES OF DOG COVERED A guide dog trained to guide a blind person. Such dogs normally wear a harness. A hearing dog trained to assist a deaf person. Such dogs normally wear a jacket with the name of the charity. Any other assistance dog trained by a charity to assist a disabled person with a physical impairment which consists of epilepsy, or which otherwise impairs a person s ability to carry out routine daily tasks - the dog must be wearing a jacket inscribed with the name of the charity. In the event that a taxi driver has any doubt over entitlement, the owners of these dogs should be able to produce an identity card showing the name of the relevant charity that trained the dog. It is important to remember that all of these dogs are highly trained and will remain on the floor of your vehicle. They are very unlikely to damage or dirty it. FAILURE TO COMPLY WITH DUTY By failing to comply with a condition of licence a taxi/private hire car driver will (unless exempt from the requirement) be guilty of an offence under Section 7(2) of the Civic Government (Scotland) Act 1982 and will be liable on conviction to a fine of up to 1,000. It would also be open to the local authority to consider suspending your licence. EXEMPTIONS FROM THE REQUIREMENT TO CARRY DOGS Exemption from these duties can be sought on medical grounds only. It is anticipated that the number of taxi/private hire car drivers whose medical condition is so serious that they cannot carry dogs in their taxi/private hire car will be extremely small. If you have a medical condition, such as severe asthma, which is aggravated by contact with dogs, or if you are allergic to, or have a chronic phobia of dogs, it may be possible for you to qualify for an exemption. Application for an exemption should be made to your licensing authority. When considering your application for an exemption, the licensing authority will require details of your medical condition and may require you to undergo a medical examination and/or permission to contact your GP. If your application for exemption is successful you will be issued with a notice of exemption which will specify the vehicle or types of vehicle to which the exemption applies. You must display the notice of exemption by fixing it in a prominent position on the dashboard facing upwards or on the windscreen of the taxi/private hire car facing outwards. The exemption notice must only be displayed when the person named on the notice is driving the taxi/private hire car. APPEALS In the event that a licensing authority turns down your application for an exemption, it is open to you to obtain reasons for the licensing authority s refusal and to appeal to a Sheriff against the decision if you consider it appropriate to do so.
