2 James R Aymann PO Box Las Vegas, NV [email protected] Please See Episode 12 Las Vegas Judge Michael P. Villani For Michael P Villani Las Vegas judge This is an open letter currently on the Internet with links attached. I have posted a website titled, One Man s fight against Corruption, currently on the internet. This website was first posted several years ago. Episode 12 of my website is titled, The corruption and cover-up involving Freeman Exposition Inc., OSHA of Nevada, Workers Compensation of Nevada and the Teamsters Union Local 631. This 81 page Episode speaks for itself in detail.
3 Episode 12 does include your involvement in your participation of the corruption and cover-up involving the crushing injury to my left foot! Mister, I know you for the trickster, cheat and liar that you are and I know the judicial system in the State of Nevada for the tricksters, cheats and liars that they are! First of all, this ORDER DENYING PETITIONER S PETITION FOR JUDICIAL REVIEW was conducted covertly behind closed doors! I submit that my constitutional rights were severely violated! There is not a jury in this country that would not have supported all my claims when they were presented with all the facts that were submitted to this court! As an exhibit with my PETITION FOR JUDICIAL REVIEW was included a five page AFFIDAVIT OF PLAINTIFF described as, a combined statement of facts, in response to DECISION AND ORDER AND SWORN AFFIDAVIT. In the heading of this affidavit I state, I will referred to the findings of fact in the decision and order by number. This bogus DECISION AND ORDER submitted by Appeals Ofc. Gregory a Krohn, was riddled with fraudulent statements! This AFFIDAVIT OF PLAINTIFF countered these fraudulent statements point for point! Did you even bother to look at my AFFIDAVIT OF PLAINTIFF? In your bogus ORDER DENYING PETITIONER you state, If there was any claim that the original determination was incomplete or that the scope of the claim was improper by accepting the settlement/determination he waived the same.
4 This is an outright lie and a bogus statement and you know it! A Claimant in a Workmen s Compensation Injury Case has the right to reopen his Case for life! In this bogus COURT ORDER you further state, At no time did the Petitioner file an appeal or request clarification of the scope of his claim to include his ankle. That issue was addressed numerous times in my AFFIDAVIT OF PLAINTIFF that was submitted to you a year and a half earlier. My left ankle was never an issue! I never complained of pain in my left ankle! The only treatments I ever received were from Dr. Carl Smith, who administered cortisone injections into the talus of my left foot! The talus is adjacent to the metatarsal bones that were fractured! Two weeks later, Dr. Carl Smith prescribed an MRI with the accompanying Radiologist report and 12 weeks of physical therapy for my left foot MAGNETIC RESONANCE IMAGING (MRI) may show problems that cannot be seen with other imaging methods, to include x-rays! An MRI is actually done more commonly than other tests to check for bone and joint problems including x-rays! Why did Dr. Raissi lie to me when he indicated that Workmen s Compensation does not cover MRIs????? The Radiologist report described additional injury to the talar region or talus of my left foot! This was supported by both Dr. Carl Smith and Dr. Michael Federico who were both provided with the Radiologist report!
5 In this bogus COURT ORDER you state, furthermore, the appeals officer found that Drs. Smith and Federico s attempts to establish causation were not credible. I find it disgusting and contemptible that a corrupt government official, a corrupt lawyer and a corrupt judge are labeling two Las Vegas physicians that I admire as liars! Who the hell do you people think you think you are! Another fraudulent statement in your bogus COURT ORDER states, Additionally, Dr. Raissi who was in the best position to know what injuries were and were not industrially related stated that the Petitioner was medically stable and released from care. I am going to be blunt, Dr. Raissi is a quack, plain and simple! I was released from Dr. Raissi s care without the essential benefit of a Radiologist s Report as to the true extent of the injuries to my left foot and before my physical therapy was completed! The same can be said of out-of-state Dr. Dickman who submitted a PPD evaluation without the benefit of a Radiologist s Report, In fact during the evaluation Dr. Dickman had no medical records to refer to at all! I submit that Gregory A. Krohn s, DECISION AND ORDER was in fact arbitrary, capricious and categorized by an abuse of discretion! Your bogus COURT ORDER concludes with The court finds that the Appeals Officer s decision and order was based upon substantial evidence and therefore was not arbitrary capricious or an abuse of discretion. Therefore, court ordered, PETITION for judicial review is denied.
6 Mister, this bogus COURT ORDER is not worth the paper that it is written on! The RESPONDENTS ANSWERING BRIEF submitted by opposing attorney Daniel L Schwartz was riddled with fraudulent statements and entries! This constitutes repetitive acts of FRAUD UPON THE COURT. FRAUD UPON THE COURT is considered an extremely serious criminal act! Consequently FRAUD UPON THE COURT has no statute of limitations! What has been transpiring is that I have been repeatedly confronted with trained and professional tricksters, cheats and liars like yourself! The Appeal Officer concludes that the credible evidence in the record supports a denial of reopening since claimant has not met his burden of proof by a preponderance of the credible medical evidence to show a change of circumstances and that the need for further care is primarily related to the work injury. This corrupt little man is essentially calling me a liar! I have stated many times in court documents and in articles that I have written that: Nevada government reeks of corruption and that corruption is rampant!
7 Mister, you are a prime example of that corruption! The intent of this open letter is to expose you for the trickster, cheat and liar that you are!
8 This description also applies to: Dr. Abdi Raissi Desert Orthopedic Workmen s Compensation Donald S Freeman Jr. Chairman and owner of Freeman Exposition Inc. 33 33 Based on the Provisions that the defending attorney cited to reopen a Workmen s Compensation Case, I have always clearly qualified for all three Provisions! Mister, you are a corrupt little man that makes his living using deceptive and outright fraudulent tactics to trick and cheat honest law-abiding citizens such as myself that simply want their rights. WORKMEN S COMPENSATION is not compensation from the get-go! Workers that are severely injured as a result of their employer s gross negligence have no recourse! They are precluded from being able to initiate a lawsuit against corrupt employers such as FREEMAN EXPOSITION INC. To culminate this charade, there was not even a hearing. There isn t a jury in this country that would not have agreed with my claims and saw right through you for what we know you are. August 10, 2015 James R. Aymann Michael P Villani You need to be removed!
