CORRUPTION IN THE OFFICE OF ALTERNATIVE DISPUTE RESOLUTION. (ADR) SPECIFICALLY, COMMISSIONER CHRIS A BEECROFT JR. No Picture Available James R Aymann (Jim) is a 70-year-old combat veteran of the Vietnam War with a 70% service-connected disability. En route to his car parked in his driveway, Jim was brutally attacked by Robert Parry White at the behest of his sister Alana Geneva Peterson. Jim was left lying unconscious in his driveway Ultimately, Jim was taken to the hospital in an ambulance. Jim called 911, then called 911 again when no one showed up!

4 Alana Geneva Peterson also called 911. In this communication with the Las Vegas Metropolitan Police Department, she repeatedly referred to the assailant as a friend! Less than one hour later she described the assailant as a stranger! Jim ultimately hired a lawyer Paul C Ray of the law firm of John Peter Lee Ltd. and Las Vegas lawyer Paul C Ray proved to be a despicable trickster, cheat and liar throughout his relationship with Jim. 4 *Conversation with Paul C. Ray LAS VEGAS LAWYER PAUL C RAY John Peter Lee also proved to be a despicable trickster, cheat and liar! LAS VEGAS LAWYER JOHN PETER LEE In the Arbitration Rules Forms and Directions, it clearly states Attorney s fees awarded by the Arbitrator may not exceed $3000, unless the

5 compensation of an attorney is governed by an agreement between the parties allowind a greater award. Las Vegas lawyer Paul C Ray and his boss Las Vegas lawyer John Peter Lee, ran Jim s bill to $58,000. Jim paid over $16,000, $4000 more than he had agreed! At no time was Jim informed by anyone in this law firm that the most he would be able to recoup in Arbitration for attorney s fees is $3000! At no time did the ADR Commissioner Chris a Beecroft, Jr. inform Jim that he would not be able to recoup more than $3000 in attorney s fees if he were to prevail in his Arbitration! Jim considers this a complete lack of responsibility and disregard for the rights of clients that are taken advantage of by unscrupulous, dishonest and greedy lawyers. Las Vegas is a cesspool of corrupt lawyers such as Paul C Ray and his former boss John Peter Lee! Overpaid government officials such as Chris a Beecroft, Jr. are disregarding their duty to ensure that clients are not taken advantage of by these greedy and unscrupulous lawyers. This is one more example of government officials not doing their job to protect the general population of Las Vegas Nevada from the rampant and wholesale trickery and misrepresentation of unscrupulous lawyers! Please note, Paul C Ray was fired by John Peter Lee on August 20, days before the Arbitration ruling. To date, the reason for the termination of Paul C Ray has been an ongoing cover-up by the entire law firm of John Peter Lee Ltd. and Paul C Ray and the State Bar of Nevada! Also note Jim prevailed at this Arbitration, but was only awarded $2500 in attorney s fees! The law firm of John Peter Lee is still attempting to collect over $50,000 in attorney s fees from Jim! 5

6 Please note, Las Vegas lawyer Paul C Ray intentionally and unnecessarily ran up this bill to over $58,000 without ever telling Jim that the maximum amount that he would be able to recover in attorney s fees is $3000 and he would owe the law firm the remainder! The last few weeks before he was fired, Las Vegas lawyer Paul C Ray ran up Jim s bill an additional $17,000! To be blunt Las Vegas lawyer Paul C Ray is a lowlife and a scumbag and will take you hook, line and sinker! John Peter Lee and his law firm are low lifes and scumbags and will take their clients hook, line and sinker! The complexity of this lawsuit should have remained in litigation and should never have been placed in the ADR office as an Arbitration. Jim was never informed by Paul C Ray or anyone at the law firm of John Peter Lee that this case would in fact be placed in Arbitration. This is criminal, but in Las Vegas, Nevada lawyers get away with it! Jim fired the law firm of John Peter Lee! Jim decided to take on the case himself Jim submitted 10 interrogatories and a request for a first set of production of documents. By law, the Defendants have 30 days to comply in writing to these requests. 30, 60, 90, 120, 150 days went by without any contact by the Defendants or their lawyer, Alexander Mazzia. Jim contact them in writing through their lawyer no less than five separate occasions and informed him after a hearing at the courthouse in person. Still no responses. Las Vegas Lawyer Alexander Mazzia is a trickster, a cheat and a liar! Jim filed a Motion to Compel and finally received answers to his requests by mail. 6

7 Now the problem was that each of the answers by the Defendants were either fraudulent, evasive or incomplete. In the meantime, the law firm of John Peter Lee through their attorney Yvette Freedman were trying to collect an additional 50+ thousand dollars from Jim. In this process Yvette Freedman repeatedly lied in court and submitted documents riddled with false statements. This constitutes Fraud upon the Court, which in actuality is a very serious crime and yet the presiding judge chose to completely ignore Yvette Freedman s attempts to sway the case with contemptible tactics and untruths! 7 LAS VEGAS LAWYER YVETTE FREEDMAN Please note, these fraudulent documents were all signed by her boss John Peter Lee and his name appeared along with Yvette Freedman on the masthead of each document! Jim repeatedly complained to Judge Joanna S Kishner of Yvette Freedman s tactics and lack of honesty. To prove his point Jim filed Plaintiff s Affidavit with Supplemental Exhibits. Anyone reading this document would concede that Yvette Freedman and her boss John Peter Lee were at the very least less than honest. In the courtroom Judge Joanna S Kishner actually admonished Plaintiff James R Aymann (Jim) for casting aspersions upon Las Vegas lawyer Yvette Freedman.

8 A complete display of a corrupt judge disregarding her obligations as a judicial officer was occurring in force. To date Judge Joanna S Kishner has not referred to and has completely ignored Plaintiff s Affidavit with Supplemental Exhibits and the content of Jim s motion to disqualify this judge! Jim was clearly not being treated fairly by any stretch of the imagination by this corrupt judge. Jim filed a Motion to Disqualify/Recuse Judge Joanna S Kishner. This judge filed an affidavit in response to this motion that was riddled with untruths. Judge Joanna S Kishner is a habitual liar! Jim responded to this diatribe of untruths with a point for point response. This response correctly addressed every fraudulent point made by this judge. It is Jim s opinion that this judge s decision to remain on this case was a complete discredit to her and a gross violation to Jim s rights to be able to conduct a trial in its entirety before a jury of his peers, and then proceed with the remainder of his life! Of course the Motion to Disqualify was denied by Presiding Judge Jennifer P Togliatti. Jim has said it before and he will say it again. Jennifer P Togliatti s record indicates a very strong bias toward women. Joanna S Kishner is a female judge. Presiding Judge Jennifer P Togliatti completely ignored Plaintiff s Affidavit with Supplemental Exhibits and Plaintiffs Motion to Disqulify Judge Joanna S Kishner and Plaintiffs Response to Kishner s untruthful and unfounded affidavit! 8

9 This denial of Jim s Motion to Disqualify Judge Joanna S Kishner was nothing more or less than a despicable act of cronyism, which is rampant in the court system of Clark County, Nevada! Jim s rights to proceed in an unimpeded fashion on a level playing field were severely violated by these grossly corrupt judges! Under the circumstances and as a result of the undeniable facts and information concerning and regarding acts of Fraud upon the Court to include acts by Judge Joanna S Kishner, herself is a clear and repeated violation of the civil rights of Plaintiff James R Aymann. Jim was present at the hearing for his Motion to Compel Discovery Commissioner Chris a Beecroft was presiding. 9 LAS VEGAS LAWYER ALEXANDER MAZZIA Alexander Mazzia the opposing attorney for the Defendants, volunteered that Jim had filed a notice of appeal to the Supreme Court of Nevada and that Beecroft had no jurisdiction over Jim s Motion to Compel. Las Vegas lawyer Alexander Mazzia was continuing his efforts to shield the truth and the misrepresentations expressed by the Defendants. On February 23, 2012, Jim filed a Plaintiff s Objection to Discovery Commissioner s Report Jim requested in writing that this hearing be held before Presiding Judge Jennifer P Togliatti. Such was not the case.

10 Once again, the hearing was held before Discovery Commissioner Chris A Beecroft, Jr. Jim was in Thousand Oaks, California with his parents. Jim s father was refusing treatments for cancer and was dying. Jim made a telephonic appearance from California on March 26, The actual hearing lasted a few seconds and Jim s motion was immediately denied by Discovery Commissioner Chris a Beecroft, Jr. Jim s father died a few weeks later. On August 21, 2012, the Supreme Court of the State of Nevada filed an Order Dismissing Appeal 10 DOUGLAS GIBBONS PARRAGUIRRE This Order Dismissing Appeal was signed by Justices Michael L Douglas, Mark Gibbons and Ron D Parraguirre. This document essentially states that the denial of a motion to disqualify a judge based on legitimate reasons as expressed in the Canons of Judicial Conduct is not appealable in the State of Nevada. James R Aymann (Jim) has repeatedly submitted that the legal and judicial system in the State of Nevada reeks of corruption and this corruption extends to these three Justices!

12 12 SECOND MOTION TO DISQUALIFY JUDGE JOANNA S KISHNER LAS VEGAS JUDGE JOANNA S KISHNER Jim has experienced the full gamut of individuals in his 70 years. Early on as an adolescent, he befriended several homeless men. This experience was truly remarkable and extremely educational. Later on as a combat leader during the Vietnam War, Jim and his men befriended a group of villagers near Chu Lai. These wonderful people were truly remarkable and unforgettable. On the other end of the spectrum were members of another platoon that were homicidal psychotics. Jim feels that he has pretty much seen it all. Jim feels fortunate in that it was not until he reached his sixties before he met the most despicable and depraved individuals imaginable. Defendant Alana Geneva Peterson of Torrance, California. Las Vegas lawyer Paul C. Ray. Las Vegas Judge Joanna S Kishner. These individuals are collectively incapable of telling the truth.

13 13 Jim had a court date of January 21 for a trial date and the Defendants had still not a fully complied with discovery. Jim still had another Motion to Compel. To be heard by discovery Commissioner Chris a Beecroft Jr. The hearing for the Motion to Compel. Lasted about one minute discovery Commissioner Chris a Beecroft Jr ordered that Alexander Mazzia and Jim hold a conference. What did Beecroft think was going to be resolved? Once again Defense lawyer Alexander Mazzia stipulated that he would be forthcoming with the necessary information via telephone. This was a crock, Mazzia never returned a call as usual. When Alana Geneva Peterson was making her 911 telephone call, she was simultaneously talking on her cell phone. Jim wanted to know who she was talking to and any other individuals that she may have been talking to on her cell phone, because she changed her story from a friend attacking Jim to a complete stranger that mysteriously disappeared in her written report. Through her lawyer, with the help of Chris A Beecroft Jr. and a dysfunctional and corrupt court system, she successfully concealed that information There are several other matters including Alana Geneva Peterson s involvement on the attack on Jim s person and the underhanded manner in which she conducted herself during real estate transactions that were successfully kept hidden from Jim. Thanks to Chris A Beecroft Jr. At no time did Defendants Alana Geneva Peterson and Elaina Peterson and their lawyer Alexander Mazzia face any sanctions or pay any fines! The bottom line is that Alana Geneva Peterson is a lowlife. Trash.

14 The manner in which Chris a Beecroft conducted himself as ADR Commissioner and Discovery Commissioner is a complete and utter disgrace. Jim has seen him in action. He is rude and full of himself and clearly does not resolve serious issues involving discovery. This Discovery Commissioner is charged to resolve any problems that arise from District Court pretrial disputes involving discovery in civil cases. The Commissioner is appointed by and responsible to the full complement of District Court judges. Pertaining to Case number # 09A Commissioner of Alternative Dispute Resolution and Discovery Commissioner Chris a Beecroft Jr. failed miserably! Why is this individual wearing two completely separate hats? Chris A Beecroft Jr. needs to be replaced! 14 Many years ago, in Newport Beach, California. A friend owed Jim $100. Jim s friend was having a Monday Night Football party. Jim s friend placed a $100 bill in Jim s hand and a glass of Kahlua in the other. It was half time and everyone was partying in the backyard. Jim had been surfing for several hours by the wedge and was tired. When the game started, everyone came back into the TV room. The Chargers were ahead Jim hooked up with one of the girls. It was a big come back, the Raiders ended up winning Everyone was pretty drunk and these two big lawyers started telling their lawyer stories.

15 15 lives. The party got rowdy. Jim interceded and the two lawyers were lucky to get away with their Like cops, lawyers should learn to socialize only with each other.
