Responsibilities Ownership passes on payment and endorsement of documents To deliver contract goods to the ship Risk of loss or damage to goods passes at the ship s rail. Variations : Classic fob (seller arranges shipment on vessel nominated by buyer) and classic fob with additional duties (seller arranges shipment and insurance). Buyer responsible to nominate vessel. The C Group of sales contracts where the seller provides transport. Confirming Bank Payment and Endorsement of Documents Issuing Bank Seller Contract of Sale cif etc Buyer Contract of Carriage : Only the seller and the carrier are privy to the contract of carriage The buyer relies on the carrier to take care of and deliver his goods. Risk passes to buyer on delivery at named place. Buyer responsible for post delivery costs and expenses. Ownership passes to buyer on payment and endorsement of documents The D Group of sales contracts where the seller provides transport. Confirming Bank Issuing Bank Payment and Endorsement of Documents Seller Contract of Sale ex-ship etc Buyer Contract of Carriage : Only the seller and the carrier are privy to the contract of carriage Carrier The buyer relies on the seller to take care of and deliver the goods. There is no common law privity between the buyer and carrier The buyer exercises no rights of suit against the carrier. The seller bears all risks of damage to goods and responsibilities for delivery of goods to the delivery point at named destination. The E Group of sales contracts where the buyer provides transport. Buyer Contract of Sale ex warehouse Seller Contract of Carriage : Only the buyer and the carrier are privy to the contract of carriage Carrier The seller has no interest in what happens to the goods after they leave his premises.
