1 Europen Trety Series - No. 193 Europen Convention for the Protection of Animls during Interntionl Trnsport (Revised) * Chişinu, 6.XI.2003 The memer Sttes of the Council of Europe, signtory hereto, Considering tht the im of the Council of Europe is to chieve greter unity etween its memers for the purpose of sfegurding nd relising the idels nd principles which re their common heritge; Awre tht every person hs morl oligtion to respect ll nimls nd to hve due considertion for their cpcity for suffering; Motivted y the desire to sfegurd the welfre of nimls during trnsport; Convinced tht interntionl trnsport is comptile with the welfre of the nimls, provided tht the requirements of niml welfre re met; Considering, therefore, tht where the welfre requirements of the nimls cnnot e met n lterntive to the trnsport of live nimls shll e implemented; Considering, however, tht in generl, for resons of niml welfre the period during which nimls, including nimls for slughter, re trnsported should e reduced s fr s possile; Considering tht loding nd unloding re ctivities during which injuries nd stress re most likely to occur; Considering tht progress in this respect my e chieved through the doption of common provisions regrding the interntionl trnsport of nimls, Hve greed s follows: (*) The Trety of Lison mending the Trety on Europen Union nd the Trety estlishing the Europen Community entered into force on 1 Decemer As consequence, s from tht dte, ny reference to the Europen Economic Community shll e red s the Europen Union.

2 Generl principles Article 1 Definitions 1 "Interntionl trnsport" mens ny movement from one country to nother, ut excludes, however, journeys of less thn 50 km nd movements etween memer Sttes of the Europen Community. 2 An "uthorised veterinrin" mens veterinrin nominted y the competent uthority. 3 "Person responsile for the trnsport of the nimls" mens the person with overll control over the orgnistion, crrying out nd completion of the whole journey, regrdless of whether duties re sucontrcted to other prties during trnsport. Such person is usully the person who plns, mkes rrngements for nd defines the conditions to e met y other prties. 4 "Person in chrge of the welfre of the nimls" mens the person who hs direct physicl responsiility for the cre of the nimls during trnsport. Such person my e the ttendnt or the driver of vehicle if fulfilling the sme role. 5 "Continer" mens ny crte, ox, receptcle or other rigid continer used for the trnsport of nimls which is not self-propelled nd is not prt (whether detchle or not) of mens of trnsport. 6 "Trnsporter" mens nturl or legl person trnsporting nimls, either on his own ccount or for third prty. Article 2 Species 1 This Convention pplies to the interntionl trnsport of ll verterte nimls. 2 With the exception of Article 4, prgrph 1, nd Article 9, prgrphs 1 nd 2 nd c, the provisions of this Convention do not pply: where single niml is ccompnied y the person who is responsile for it during trnsport; to the trnsport of pet nimls ccompnying their owner if not for commercil purposes. Article 3 Appliction of the Convention 1 Ech Prty shll pply the provisions governing the interntionl trnsport of nimls contined in this Convention nd e responsile for effective control nd supervision. 2 Ech Prty shll tke the necessry steps to ensure n effective system of trining tking into ccount the provisions of the present Convention. 3 Ech Prty shll endevour to pply the relevnt provisions in this Convention to nimls eing trnsported within its territory. 4 The Prties shll provide mutul ssistnce in pplying the provisions of the Convention, in prticulr y exchnging informtion, discussing interprettion nd notifying prolems. Article 4 Min principles of the Convention 1 Animls shll e trnsported in wy which sfegurds their welfre, including helth. 2

3 2 As fr s possile, nimls shll e trnsported without dely to their plce of destintion. 3 At control points, priority shll e given to consignments of nimls. 4 Animls shll only e detined where this is strictly necessry for their welfre or for disese control purposes. If nimls re detined, pproprite rrngements shll e mde for their cre nd, where necessry, their unloding nd ccommodtion. 5 Ech Prty shll tke the necessry mesures to void or reduce to minimum the suffering of nimls in cses where strikes or other unforeseele circumstnces impede the strict ppliction of the provisions of this Convention in its territory. It will e guided for this purpose y the principles set out in this Convention. 6 Nothing in this Convention shll ffect the implementtion of other instruments concerning snitry nd veterinry control. 7 Nothing in this Convention shll ffect the lierty of the Prties to dopt stricter mesures for the protection of nimls during interntionl trnsport. Article 5 Authoristion of trnsporters 1 Ech Prty shll ensure tht trnsporters trnsporting nimls for commercil purposes re: registered in mnner enling the competent uthority to identify them rpidly in the event of filure to comply with the requirements of this Convention; covered y n uthoristion vlid for interntionl trnsport grnted y the competent uthority of the Prty in which the trnsporters re estlished. 2 Ech Prty shll ensure tht the uthoristion is grnted to trnsporters who entrust the trnsport of nimls only to personnel who hve received proper trining on the provisions of this Convention. 3 Ech Prty shll ensure tht the ove-mentioned uthoristion my e suspended or withdrwn where the competent uthorities tht grnted the uthoristion re informed tht the trnsporter hs repetedly or seriously violted the provisions of this Convention. 4 Where Prty hs oserved n infringement of this Convention y trnsporter registered in nother Prty to this Convention, the former Prty shll communicte detils of the infringement oserved to the ltter. Design nd construction Article 6 Design nd construction 1 Mens of trnsport, continers nd their fittings shll e constructed, mintined nd operted so s to void injury nd suffering nd to ensure the sfety of the nimls during trnsport. 2 The mens of trnsport or continer shll e designed nd constructed so s to provide nimls with dequte spce to stnd in their nturl position, except for poultry other thn dy-old chicks. 3 The mens of trnsport or continer shll e designed nd constructed so s to ensure: 3

4 sufficient cler spce ove the nimls in their nturl stnding position for effective ir circultion; ir qulity nd quntity pproprite to the species trnsported cn e mintined, in prticulr where nimls re crried in fully enclosed spce. 4 Mens of trnsport, continers, fittings, etc., shll e strong enough to contin the nimls' weight, to prevent them escping or flling out, to withstnd stress due to movement nd, where necessry, to contin prtitions to protect nimls from the motion of the mens of trnsport. Fittings shll e designed for quick nd esy opertion. 5 Prtitions shll e of rigid construction, strong enough to withstnd the weight of nimls eing pushed ginst them nd designed so tht they do not impede ir circultion. 6 The mens of trnsport or continers shll e constructed nd operted so s to protect nimls ginst inclement wether nd dverse chnges in wether conditions. In prticulr, the externl roof directly ove the nimls shll minimise sorption nd conduction of solr het. 7 The floor of the mens of trnsport or continer shll e nti-slip. Floors shll e designed, constructed nd mintined to void discomfort, distress nd injury to the nimls nd minimise lekge of urine nd feces. Mterils used for floor construction shll e selected so s to minimise corrosion. 8 The mens of trnsport or continer shll e so designed nd constructed s to provide ccess to the nimls to llow them to e inspected, nd if necessry wtered, fed nd cred for. 9 When nimls need to e tied, pproprite equipment shll e provided in the mens of trnsport. 10 Continers in which nimls re trnsported shll e clerly nd visily mrked to indicte the presence of live nimls, with sign indicting the top of the continer. 11 Mens of trnsport, continers nd their fittings shll e designed nd constructed to llow esy clening nd disinfection. Preprtion for trnsport Article 7 Plnning 1 For ech journey, the person responsile for the trnsport of the nimls shll e identified so tht informtion on the orgnistion, crrying out nd completion of the trnsport cn e otined t ny time during the journey. 2 Where the intended journey time exceeds eight hours for the trnsport of domestic solipeds nd domestic nimls of the ovine, ovine, cprine nd porcine species, the person responsile for the trnsport shll drw up document specifying the rrngements foreseen for the journey nd in prticulr the following detils: identifiction of the trnsporter nd mens of trnsport; identifiction of the consignment nd ccompnying documents (niml species, numer of nimls, veterinry certifictes); 4

5 c the plce nd country of deprture, plces of trnsfer, plces where nimls re to e unloded nd rested nd the plce nd country of destintion. 3 The person responsile for the trnsport shll ensure tht the intended journey complies with the respective rules of the countries of deprture, trnsit nd destintion. 4 The person in chrge of the welfre of the nimls shll immeditely record in the document mentioned in prgrph 2 the times nd plces t which the nimls trnsported hve een fed, wtered nd rested during the journey. This document shll e mde ville to the competent uthority upon request. 5 No niml shll e trnsported unless suitle provisions re mde in dvnce y the person responsile for the trnsport to sfegurd its welfre throughout the journey. Where pproprite, rrngements shll e mde to provide wter, feed nd rest, nd ny necessry cre during the journey nd on rrivl t the plce of destintion, nd to tht end, pproprite notifiction shll e given in dvnce. 6 To void ny dely, consignments of nimls shll e ccompnied y pproprite documenttion nd, t posts where importtion nd trnsit formlities hve to e completed, n pproprite person shll e notified s erly s possile. 7 The person responsile for the trnsport shll ensure tht responsiility for the welfre of the nimls during trnsport is clerly defined, from the time of deprture to rrivl t the point of destintion, including loding nd unloding. Article 8 Attendnts 1 In order to ensure the necessry cre of the nimls throughout the journey, consignments shll e ccompnied y n ttendnt who is in chrge of the welfre of the nimls. The driver cn perform the functions of ttendnt. 2 The ttendnt shll hve received specific nd pproprite trining or hve equivlent prcticl experience qulifying him/her to hndle, trnsport nd tke cre of nimls, including in cses of emergency. 3 Exceptions to the provisions of prgrph 1 my e mde in the following cses: where the person responsile for the trnsport of nimls hs ppointed n gent to cre for the nimls t pproprite rest, wter nd feed points; where nimls re trnsported in continers which re securely fstened, dequtely ventilted nd, where necessry, contining enough wter nd feed, in dispensers which cnnot e tipped over, for journey of twice the nticipted time. Article 9 Fitness for trnsport 1 No niml shll e trnsported unless it is fit for the intended journey. 2 Ill or injured nimls shll not e considered fit for trnsport. However, this provision shll not pply to: slightly injured or ill nimls whose trnsport would not cuse dditionl suffering; nimls trnsported for experimentl or other scientific purposes pproved y the relevnt competent uthority, if the illness or injury is prt of the reserch progrmme; 5

6 c the trnsport of nimls under veterinry supervision for or following emergency tretment 3 Specil cre shll e tken with the trnsport of nimls in dvnced stges of pregnncy, those hving recently given irth nd very young nimls: pregnnt femle mmmls shll not e trnsported during period t lest equl to 10% of the length of gesttion efore giving irth, nor during t lest one week fter giving irth; very young mmmls shll not e trnsported efore the nvel is completely heled. If ll necessry precutions hve een tken, under veterinry dvice nd on cse-y-cse sis, exception cn e mde y the competent uthority for registered mres with fol t foot going to the stllion fter foling. 4 Sedtives shll not e used unless strictly necessry to ensure the welfre of the nimls nd shll only e used following veterinry dvice, in ccordnce with ntionl legisltion. Article 10 Inspection/Certificte 1 Before nimls re loded for interntionl trnsport they shll e inspected y n uthorised veterinrin of the country where the journey strts, who shll ensure tht they re fit for the journey. 2 The uthorised veterinrin shll issue certificte which identifies the nimls, sttes tht they re fit for the intended journey nd, where possile, records the registrtion numer or, where pproprite, the nme or other mens of identifying the mens of trnsport nd the type of trnsport used. 3 In certin cses determined y greement etween the Prties concerned, the provisions of this rticle need not pply. Article 11 Rest, wter nd feed prior to loding 1 Animls shll e prepred for the intended journey, e ccustomed to the feed to e provided nd e le to use the delivery systems for wter nd feed. They shll e provided with wter, feed nd rest period s pproprite. 2 In order to reduce the stress of trnsport, due regrd shll e pid to the need of certin ctegories of nimls, such s wild nimls, to ecome cclimtised to the mode of trnsport prior to the proposed journey. 3 Mixing of nimls tht hve not een rised together or re not ccustomed to one nother shll e voided s fr s possile. Loding nd unloding Article 12 Principles 1 Animls shll e loded nd unloded in such wy s to ensure tht they re not cused injury or suffering. 2 Animls shll e loded so s to ensure tht spce llownces (floor re nd height) nd seprtion requirements re met in ccordnce with Article 17. 6

7 3 Animls shll e loded s close s possile to the time of deprture from the plce of disptch. 4 On rrivl t their destintion, the nimls shll e unloded s soon s possile, offered n dequte quntity of wter nd, if necessry, e fed nd llowed to rest. Article 13 Equipment nd procedures 1 Loding nd unloding shll tke plce using properly designed nd constructed rmp, lift or loding y except where nimls re to e loded nd unloded in purpose-uilt continers. Mnul lifting is permissile if the nimls re smll enough, nd even desirle in the cse of young nimls which might hve difficulty in negotiting rmp. All loding nd unloding fcilities shll e suitle for their purpose, stle nd mintined in good stte of repir. 2 All rmps nd surfces on which nimls wlk shll e designed nd mintined so s to prevent slipping nd their slope shll e minimised s fr s possile. Where their slope is steeper thn 10, they shll e fitted with system, such s provided y foot ttens, which ensures tht the nimls clim or go down without risks or difficulties. The equipment shll e provided with side rriers if necessry. 3 The interior of the trnsport unit shll e well-lit t loding so tht the nimls cn see where they re going, depending upon the specific requirements of the species. 4 Animls shll e loded only into mens of trnsport which hs een thoroughly clened nd, where pproprite, disinfected. 5 Goods which re eing trnsported in the sme mens of trnsport s nimls shll e positioned so tht they do not cuse injury, suffering or distress to the nimls. 6 When continers loded with nimls re plced one on top of the other on the mens of trnsport, the necessry precutions shll e tken to void urine nd feces flling on the nimls plced underneth. Article 14 Hndling 1 Animls shll e hndled clmly nd gently in order to reduce unrest nd gittion to minimum, nd in order to protect the nimls from voidle pin, distress nd injury. 2 Noise, hrssment nd the use of excessive force during loding nd unloding shll e voided. Animls shll not e struck, nor shll pressure e pplied to ny prticulrly sensitive prt of the ody. In prticulr, nimls' tils shll not e crushed, twisted or roken nd their eyes shll not e grsped. Animls shll not e punched or kicked. 3 Animls themselves shll not e suspended y mechnicl mens, lifted or drgged y the hed, ers, horns, ntlers, legs, til or fleece, or in ny other pinful wy. 4 Instruments intended for guiding nimls shll e used on nimls solely for tht purpose. The use of instruments which dminister electric shocks shll e voided s fr s possile. In ny cse, these instruments shll only e used for dult ovine nimls nd dult pigs which refuse to move, nd only when they hve room hed of them in which to move. Shocks shll lst no longer thn one second, e dequtely spced, nd shll only e pplied to the muscles of the hindqurters. Shocks shll not e used repetedly if the niml fils to respond. 7

8 5 Persons hndling nimls shll not use prods or other implements with pointed ends. Sticks or other implements intended for guiding nimls shll only e used provided they cn e pplied to the ody of n niml without cusing it injury or suffering. Article 15 Seprtion 1 Animls shll e seprted during trnsport where injury or suffering is likely to occur if they re mixed. This shll pply in prticulr to: c d e nimls of different species; nimls hostile to ech other; nimls of significntly different sizes or ges; uncstrted dult mles; tied nd untied nimls. 2 The provisions of prgrph 1 shll not pply where the nimls hve een rised in comptile groups, re ccustomed to ech other, where seprtion will cuse distress or where femles re ccompnied y dependent young. Trnsport prctices Article 16 Floors nd edding The floor surfces of mens of trnsport or continers shll e mintined so s to minimise the risk of slipping nd lekge of urine nd feces. An pproprite edding which sors urine nd feces nd which provides n dequte resting mteril shll cover the floor of the mens of trnsport or continers, unless n lterntive method is used tht provides t lest the sme dvntges to the nimls. Article 17 Spce llownces (floor re nd height) 1 Animls shll e provided with dequte spce to stnd in their nturl position in the mens of trnsport or continer. Spce to lie down t the sme time shll e provided unless the technicl protocol or specil conditions for the protection of nimls require otherwise. A technicl protocol, drwn up in ccordnce with Article 34 of this Convention, shll determine the minimum spce llownces for nimls. 2 To prevent injury y excessive movement, prtitions shll e used to su-divide lrge groups of nimls or sudivide pen which contins fewer nimls thn its norml cpcity, which otherwise would hve too much spce. 3 Prtitions shll e pproprite to the size nd species of the nimls, nd shll e positioned, secured nd mintined so s to prevent injury or suffering to the nimls. Article 18 Tying of nimls When nimls re tied, the ropes, the tethers or other mens used shll e strong enough not to rek during norml trnsport conditions, nd long enough to llow the nimls, if necessry, to lie down nd to et nd drink. They shll e designed in such wy s to eliminte ny dnger of strngultion or injury. Animls shll not e tied y the horns, ntlers, legs, nose-rings nor e trnsported hving their legs tied together. Animls shll e tied only with devices llowing them to e quickly relesed. 8

9 Article 19 Ventiltion nd temperture 1 Sufficient ventiltion shll e provided to ensure tht the needs of the nimls re fully met, tking into ccount in prticulr the numer nd type of the nimls to e trnsported nd the expected wether conditions during the journey. 2 Continers shll e stowed in wy which does not impede their ventiltion. 3 Where nimls re to e trnsported in dverse conditions of temperture nd humidity, suitle rrngements shll e tken to sfegurd their welfre. Article 20 Wter, feed nd rest 1 During trnsport, nimls shll e offered wter, feed nd the opportunity to rest s pproprite to their species nd ge, t suitle intervls. 2 A technicl protocol, drwn up in ccordnce with Article 34 of this Convention, will determine the mximum trvelling times nd minimum wtering nd feeding intervls nd resting periods. 3 Wter nd feed shll e of good qulity nd presented to the nimls in wy which minimises contmintion. Article 21 Femles in lcttion Lctting femles not ccompnied y their offspring shll not e trnsported for long periods. However, where this is unvoidle, they shll e milked shortly efore loding nd t intervls of not more thn twelve hours during the course of journey. Article 22 Lighting The mens of trnsport shll e equipped with mens of lighting, fixed or portle, sufficient for generl inspection of the nimls nd where this is necessry during trnsport nd for wtering nd feeding. Article 23 Continers 1 During trnsport nd hndling, continers shll lwys e kept upright nd severe jolts or shking shll e minimised. 2 Continers shll e secured so s to prevent their displcement y the motion of the mens of trnsport. Article 24 Cre during trnsport The person in chrge of the welfre of the nimls shll tke every opportunity to check them nd to dminister, if necessry, the pproprite cre. Article 25 Emergency nd csulty cre during trnsport Animls tht fll ill or re injured during trnsport shll receive first-id cre s soon s possile; if necessry, they shll e given pproprite veterinry tretment or e killed in wy which does not cuse them ny dditionl suffering. 9

10 Specil provisions Article 26 Specil provisions for trnsport y ril 1 Any rilwy wgon used in the trnsport of nimls shll e mrked to indicte the presence of live nimls. Unless the nimls re trnsported in continers, the inside wlls of the rilwy wgon shll e of suitle mteril, completely smooth nd fitted with rings or rs, t suitle height, to which the nimls my e ttched. 2 Where they re not trnsported in individul oxes, solipeds shll e tied in such wy tht they re ll fcing the sme side of the rilwy wgon or tied fcing ech other. However, fols nd unroken nimls shll not e tied. 3 Lrge nimls shll e loded in such wy s to llow n ttendnt to move etween them. 4 When ssemling trins nd during ll other movement of rilwy wgons every precution shll e tken to void jolting wgon contining nimls. 5 Every opportunity shll e tken to check the nimls, s provided for in Article 24 of this Convention, whenever the rilwy wgons stop or wether conditions chnge. Article 27 Specil provisions for trnsport y rod 1 Vehicles in which nimls re trnsported shll e clerly nd visily mrked to indicte the presence of live nimls. 2 Vehicles shll e driven in wy which ensures smooth ccelertion, decelertion nd turning. 3 Vehicles shll crry suitle equipment for loding nd unloding in complince with Article 13 of this Convention. 4 Every opportunity shll e tken to check the nimls in the vehicle, s provided for in Article 24 of this Convention, whenever the vehicle stops or wether conditions chnge. Article 28 Specil provisions for trnsport y wter (except roll-on/roll-off vessels) 1 So s to ensure tht the welfre requirements of the nimls trnsported re met, the competent uthority of the country where loding tkes plce shll inspect efore loding is llowed: purpose-uilt or converted livestock vessels; rrngements on other vessels where the nimls re to e trnsported. 2 An lrm shll e fitted to detect ny power filure in the forced ventiltion system. An dequte secondry source of power, clerly seprted from the primry source, shll e provided to ensure tht pproprite forced ventiltion is mintined. 3 Animls shll not e trnsported on open decks unless in continers or other structures, giving dequte protection from se wter. 4 Where nimls re wlked on nd off the vessel, suitle gngwys, rmps nd wlkwys shll e provided etween the quyside nd the vessel's livestock decks. 10

11 5 Loding nd unloding of nimls onto or off livestock vessels shll e supervised y n uthorised veterinrin. 6 Animl ccommodtion, rmps nd pssgewys shll e dequtely lit t loding nd unloding so tht the nimls cn see where they re going, depending upon the specific requirements of the species. 7 All pens, stlls nd continers shll e directly ccessile for oth the nimls nd ttendnts. 8 Pssgewys for nimls shll e pproprite for the species to e trnsported, in prticulr they shll not hve shrp edges, nd shrp corners nd protrusions shll e minimised. 9 All prts of the vessel where nimls re ccommodted shll e provided with fcilities which ensure effective dringe nd shll e kept in good snitry condition. 10 Supplies of clen fresh wter, wholesome feed nd pproprite edding, sufficient for the nimls needs nd considering the length of the se journey, shll e crried on the vessel. 11 Reserve supplies of wter, nd in the cse of long journeys, feed nd edding for the nimls shll e crried in cse of unforeseen delys. 12 Supplies of feed nd edding shll e stored so s to ensure tht they re kept in dry stte, nd protected from the wether nd the se. The storge of feed nd edding shll not interfere with ventiltion, lighting nd dringe systems, or pssgewys. 13 Drinking nd feeding equipment pproprite to the numer, size nd species of the nimls shll e provided. 14 Provisions shll e mde for isolting nimls which ecome ill or injured during the journey. 15 In cse of emergency, it shll e possile to kill n niml in ccordnce with the provisions lid down in Article 25 of this Convention. To tht end, mens of killing suitle to the species shll e ville. Article 29 Specil provisions for trnsport in rod vehicles or ril wgons on rollon/roll-off vessels 1 Where nimls re trnsported in rod vehicles or ril wgons on ord roll-on/roll-off vessels, especilly in the enclosed decks, specil cre shll e tken to ensure tht sufficient ventiltion is provided for the nimls throughout the journey. Rod vehicles nd ril wgons shll e stowed so tht the nimls otin mximum enefit from fresh ir inlets. 2 The person in chrge of the welfre of the nimls shll hve ccess to them so tht they cn e inspected nd, if necessry, cred for, wtered nd fed during the journey. 3 Rod vehicles, ril wgons nd continers shll e equipped with sufficient numer of dequtely designed, positioned nd mintined securing points enling them to e securely fstened to the vessel. Rod vehicles, ril wgons nd continers shll e secured to the ship efore the strt of the se journey to prevent them eing displced y the motion of the vessel. 4 Rod vehicles nd ril wgons contining nimls shll only e trnsported on the open deck of vessel in position tht provides dequte protection from se wter, tking ccount of the protection which the rod vehicle or ril wgon itself provides. 11

12 5 An lrm shll e fitted to detect ny power filure in the forced ventiltion system of the vessel. An dequte secondry source of power shll e provided to ensure tht pproprite forced ventiltion is mintined. 6 Arrngements shll e mde to supply the nimls with fresh wter nd feed in cse of unforeseen delys or if otherwise necessry. 7 In cse of emergency, if trnsport lsts more thn two hours, it shll e possile to kill n niml in ccordnce with the provisions lid down in Article 25 of this Convention. To tht end, mens of killing suitle to the species shll e ville. Article 30 Specil provisions for trnsport y ir 1 No nimls shll e trnsported in conditions where ir qulity, temperture nd pressure cnnot e mintined within n pproprite rnge during the entire journey. 2 The commnder shll e dvised of the species, loction nd quntity of ll live nimls ord the ircrft, together with ny ction required. Multilterl consulttions Article 31 Multilterl consulttions 1 The Prties shll, within five yers from the entry into force of this Convention nd every five yers therefter, or more frequently if mjority of the Prties should so request, hold multilterl consulttions within the Council of Europe. 2 These consulttions shll tke plce t meetings convened y the Secretry Generl of the Council of Europe. 3 Ech Prty shll hve the right to ppoint one or more representtives to prticipte in these consulttions. The Prties shll communicte the nme(s) of their representtive(s) to the Secretry Generl of the Council of Europe t lest one month efore ech meeting. Ech Prty shll hve the right to vote. Ech Stte which is Prty to the Convention shll hve one vote. 4 Within the res of its competence, the Europen Community, on ecoming Prty to the Convention, shll exercise its right to vote with numer of votes equl to the numer of its memer Sttes which re Prties to this Convention; the Europen Community shll not exercise its right to vote in cses where the memer Sttes concerned exercise theirs, nd conversely. 12

13 5 The Prties my seek the dvice of experts. They my, on their own inititive or t the request of the ody concerned, invite ny interntionl or ntionl, governmentl or non-governmentl ody techniclly qulified in the fields covered y this Convention to e represented y n oserver t one or prt of one of its consulttions. The decision to invite such experts or odies shll e tken y mjority of two-third of the votes cst. 6 After ech consulttion, the Prties shll sumit to the Committee of Ministers of the Council of Europe report on the consulttion nd the functioning of the Convention. 7 Suject to the provisions of this Convention, the Prties shll drw up the rules of procedure for the consulttions. Article 32 Functions of multilterl consulttions Within the frmework of multilterl consulttions, the Prties shll e responsile for following the ppliction of this Convention. They my in prticulr: c d prepre technicl protocols to this Convention in ccordnce with the provisions of Article 34; suggest ny necessry modifictions to this Convention nd exmine those proposed in ccordnce with the provisions of Article 35; exmine, t the request of one or more Prties, questions concerning the interprettion of this Convention; mke recommendtions to the Committee of Ministers concerning Sttes to e invited to ccede to this Convention. Technicl protocols Article 33 Oject The Prties shll dopt technicl protocols to this Convention concerning spce llownces (Article 17) nd wter, feed nd rest (Article 20). They my lso dopt other technicl protocols with view to estlishing technicl norms for the implementtion of the provisions contined in this Convention. Article 34 Adoption nd entry into force 1 A technicl protocol shll e dopted y two-thirds mjority of the votes cst, nd then forwrded to the Committee of Ministers for pprovl. After its pprovl, this text shll e forwrded to the Prties for cceptnce. 2 A technicl protocol shll enter into force, in respect of those Prties which hve ccepted it, on the first dy of the month following the expirtion of period of one month fter the dte on which three Prties, including t lest two memer Sttes of the Council of Europe, hve informed the Secretry Generl tht they hve ccepted it. In respect of ny Prty which susequently ccepts it, the protocol shll enter into force on the first dy of the month following the expirtion of period of one month fter the dte on which tht Prty hs informed the Secretry Generl of its cceptnce. 3 For the purpose of prepring technicl protocols, the Prties shll follow developments in scientific reserch nd new methods in niml trnsport. 13

14 Article 35 Amendments 1 Any mendment to technicl protocol to this Convention, proposed y Prty or y the Committee of Ministers, shll e communicted to the Secretry Generl of the Council of Europe nd forwrded y him or her to the memer Sttes of the Council of Europe, to the Europen Community nd to ny non-memer Stte which hs cceded to, or hs een invited to ccede to this Convention in ccordnce with the provisions of Article Any mendment proposed in ccordnce with the provisions of the preceding prgrph shll e exmined not less thn six months fter the dte of forwrding y the Secretry Generl t multilterl consulttion, where it my e dopted y two-thirds mjority of the Prties. The text dopted shll e forwrded to the Prties. 3 On the first dy of the month following the expirtion of period of eighteen months fter its doption y the multilterl consulttion, unless more thn one-third of the Prties hve notified ojections, ny mendment shll enter into force for those Prties which hve not notified ojections. Settlement of disputes Article 36 Settlement of disputes 1 In cse of dispute regrding the interprettion or the ppliction of the provisions of this Convention, the competent uthorities of the Prties concerned shll consult with ech other. Ech Prty shll communicte to the Secretry Generl of the Council of Europe the nmes nd ddresses of their competent uthorities. 2 If the dispute hs not een settled y this mens, it shll, t the request of one or other of the prties to the dispute, e referred to ritrtion. Ech prty shll nominte n ritrtor nd the two ritrtors shll nominte referee. If one of the two prties to the dispute hs not nominted its ritrtor within the three months following the request for ritrtion, he shll e nominted t the request of the other prty to the dispute y the President of the Europen Court of Humn Rights. If the ltter is ntionl of one of the prties to the dispute, this duty shll e crried out y the Vice-President of the Court or, if the Vice-President is ntionl of one of the prties to the dispute, y the most senior judge of the Court not eing ntionl of one of the prties to the dispute. The sme procedure shll e oserved if the ritrtors cnnot gree on the choice of referee. In the event of dispute etween two Prties, one of which is memer Stte of the Europen Community, the ltter itself eing Prty, the other Prty shll ddress the request for ritrtion oth to the memer Stte nd to the Community, which jointly shll notify it, within three months of receipt of the request, whether the memer Stte or the Community, or the memer Stte nd the Community jointly, shll e prty to the dispute. In the sence of such notifiction within the sid time limit, the memer Stte nd the Community shll e considered s eing one nd the sme prty to the dispute for the purposes of the ppliction of the provisions governing the constitution nd procedure of the ritrtion triunl. The sme shll pply when the memer Stte nd the Community jointly present themselves s prty to the dispute. 3 The ritrtion triunl shll ly down its own procedure. Its decisions shll e tken y mjority vote. Its wrd, which shll e sed on this Convention, shll e finl. 4 The procedure for the settlement of disputes shll not pply to disputes relting to questions within the competence of the Europen Community or to the definition of the scope of tht competence etween Prties which re memers of the Europen Community or etween such memers nd the Community. 14

15 Finl cluses Article 37 Signture, rtifiction, cceptnce, pprovl 1 This Convention shll e open for signture y the memer Sttes of the Council of Europe nd the Europen Community. It is suject to rtifiction, cceptnce or pprovl. Instruments of rtifiction, cceptnce or pprovl shll e deposited with the Secretry Generl of the Council of Europe. 2 No Stte Prty to the Europen Convention on the Protection of Animls during Interntionl Trnsport, opened for signture in Pris on 13 Decemer 1968, my deposit its instrument of rtifiction, cceptnce or pprovl unless it hs lredy denounced the sid Convention or denounces it simultneously. 3 This Convention shll enter into force six months fter the dte on which four Sttes hve expressed their consent to e ound y this Convention in ccordnce with the provisions of the preceding prgrphs. 4 Whenever, in ppliction of the preceding two prgrphs, the denuncition of the Convention of 13 Decemer 1968 would not ecome effective simultneously with the entry into force of this Convention, Contrcting Stte or the Europen Community my, when depositing its instrument of rtifiction, cceptnce or pprovl, declre tht it will continue to pply the Convention of 13 Decemer 1968 until the entry into force of this Convention. 5 In respect of ny signtory Stte or the Europen Community which susequently expresses its consent to e ound y it, this Convention shll enter into force six months fter the dte of the deposit of the instrument of rtifiction, cceptnce or pprovl. Article 38 Accession of non-memer Sttes 1 After the entry into force of this Convention, the Committee of Ministers of the Council of Europe my invite ny other non-memer Stte of the Council to ccede to this Convention y decision tken y the mjority provided for in Article 20.d of the Sttute of the Council of Europe nd y the unnimous vote of the representtives of the Contrcting Sttes entitled to sit on the Committee. 2 In respect of ny cceding Stte, this Convention shll enter into force six months fter the dte of deposit of the instrument of ccession with the Secretry Generl of the Council of Europe. Article 39 Territoril cluse 1 Any Stte or the Europen Community my, t the time of signture or when depositing its instrument of rtifiction, cceptnce, pprovl or ccession, specify the territory or territories to which this Convention shll pply. 2 Any Stte or the Europen Community my t ny lter dte, y declrtion ddressed to the Secretry Generl of the Council of Europe, extend the ppliction of this Convention to ny other territory specified in the declrtion. In respect of such territory this Convention shll enter into force six months fter the dte of receipt of such declrtion y the Secretry Generl. 3 Any declrtion mde under the two preceding prgrphs my, in respect of ny territory specified in such declrtion, e withdrwn y notifiction ddressed to the Secretry Generl. The withdrwl shll ecome effective six months fter the dte of receipt of such notifiction y the Secretry Generl. 15

Article 41 Notifictions The Secretry Generl of the Council of Europe shll notify the memer Sttes of the Council of Europe, the Europen Community nd ny Stte which hs cceded or hs een invited to ccede to this Convention of: ny signture; the deposit of ny instrument of rtifiction, cceptnce, pprovl or ccession; c ny dte of entry into force of this Convention in ccordnce with Articles 37 nd 38; d ny other ct, notifiction or communiction relting to this Convention.
