See attached list of others in attendance. PLEDGE OF ALLEGIANCE: APPROVAL OF MINUTES: A motion was made by Sova, seconded by Schank to approve the minutes of the January 22,2013 meeting as submitted. ALL YES. MOTION CARRIED. APPROVAL OF AGENDA: A motion was made by Howell, seconded by Sova to approve the Agenda as submitted. ALL YES. MOTION CARRIED. NEW BUSINESS: MINING PERMIT GROVELAND SAND & GRAVEL, SEC. 34. OAKHILL AND WILDWOOD ROADS. HOLLY. Chairwoman Sevigny asked Township Engineer Wehner to review his March 13, 2013 letter. Engineer Wehner stated that the gross land area consists of acres; a site inspection was conducted on March 12, 2013; and, an aerial photograph was flown on December 26, Currently, there is no mining being conducted in the north area. In the east area excavation, removal and hauling, and processing operations were continued. All mining setback distances have been maintained to date and there was no final reclamation during the permit year. Stockpiles will be replenished during the mining year depending on market conditions and demands. At the present time, Engineer Wehner recommends engineering approval of the mining permit request and, based on last year's reclamation cost calculations, recommends no change of the $470, bond requirement.
2 PlANNNG COMMISSION PAGE -2- Planner lacoangeli reviewed his letter dated March 6, 2013 stating that the entire acres will come under development once all mining has been completed as the entire parcel is presently zoned RE/F (Rural Estate/Farm) The future land use proposes residential single-family detached homes on individual lots or condominium sites. At that time and subsequent to all mining and reclamation being completed, a detailed development plan will need to be submitted that meets both the State Land Division Act and Township Zoning Code requirements. After discussion, a motion was made by Sova, seconded by Schank to approve the reclamation plan and bond request of $470, for the MINING PERMIT GROVELAND SAND & GRAVEL. SEC. 34. OAKHlll AND WilDWOOD ROADS. HOllY based upon the recommendations of the Township Engineer and Planner in their respective March 13, 2013 and March 6, 2013 letters and recommend to the Township Board they approve the mining permit. ROll CAll VOTE. YES - CHRISTOPHER, HOWEll MASON, SEVIGNY, SCHANK, SHERIDAN AND SOVA. NO -0. MOTION CARRIED. MINING PERMIT KURTZ GRAVEL CO., SEC. 30. HAWLEY AND WORDEN ROADS. HOllY Chairwoman Sevigny asked Township Engineer Wehner to review his March 6, Engineer Wehner stated the parcel consists of acres. The latest aerial photograph was conducted on November 28, 2013 and operational coordination was done with Mr. Dale Sawyer of the Levy Company. Due to the slow economy, operations of the current and proposed mining and reclamation conditions remain unchanged from the previous year. The site is open on a limited basis and loading and hauling out of stockpiles is based on demand. Currently, business for Kurtz Gravel Co is the slowest of the three Edw. Levy sites. As a result, the bond requirement will not be increased from the previous year and will remain at $400, Planner lacoangeli Engineer stated the parcel is currently zoned E-1, and upon completion of mining and reclamation, the Master Plan for Future Land Use recommends that the parcel be zoned RE/F (Rural Estate/Farm). Mining has been completed on 23 acres and 58 acres are proposed for mining in If present conditions continue, reclamation should be included in the permit year review. Planner lacoangeli also requests that in the future, Dave Wardin from Kieft
3 PAGE -3- Engineering, provide more detailed plans showing how the property is to be used, i.e. large lot residential. After discussion, a motion was made by Sova, seconded by Mason to approve the reclamation plan and bond request of $400,000 based upon the recommendations of the Township Engineer and Planner in their respective March 13, 2013 and March 6, 2013 letters and recommend to the Township Board they approve the mining permit for MINING PERMIT KURTZ GRAVEL CO., SEC. 30, HAWLEY AND WORDEN ROADS, HOllY based upon the recommendations of the Township Engineer and Planner in their respective March 18,2013 and March 6, 2013 letters and recommend to the Township Board they approve the mining permit.. ROLL CALL VOTE. YES - CHRISTOPHER, HOWELL MASON, SEVIGNY, SCHANK, SHERIDAN AND SOVA. NO -0. MOTION CARRIED. SP-080 FOOD CASTLE. STEVE NANNOSHI, DIXIE HWY., DAVISBURG. At Chairwoman Sevigny's request, Planner lacoangeli reviewed his most recent review letter dated March 25, The applicant is proposing to renovate the existing Food Castle grocery story by adding a restaurant with an outdoor patio serving area. There have been several reviews of the project subsequent to the preliminary site plan meeting on March 6, 2013 with all principals present. At that time ordinance requirements were discussed and outstanding issues were to be addressed prior to this evening's meeting. At the present time, there are still many outstanding issues to be resolved. Some items yet to be resolved include parking: 94 spaces are required, however, due to varied hours of operation overlap between the grocery store and restaurant, it was determined that 72 spaces would be acceptable. The current plans show that not all of the parking spaces provided are 9" x 19' as required by Township Ordinance. Grading will need to be shown on the plans as Oakhill will be undergoing resurfacing in the near future and the two entrances/exits will need to have matching grades. There is no landscaping provided on the plans and no water irrigation has been provided. The Fire Department will need to approve the size of the existing well as no changes are currently proposed. In addition, there are no modifications proposed for the existing septic system and this will also need to be approved by the Oakland County Health Department.
4 PAGE -4- Engineer Brass reviewed his March 25, 2013 letter and reiterated that many outstanding engineering items still need to be addressed: a pavement cross-section shall be provided; location and/or removal of all light poles; indicate the location of any and all utility structures; all existing and proposed grading including grades at barrier free parking stalls shall be provided; location of sanitary lead from building and septic field shall be provided; complete storm water system shall be provided; and, right-ofway for Oakhill and Dixie shall be indicated. Due to traffic, Commissioner Mason asked if bumper posts would be required around the patio area. Planner lacoangeli stated the Michigan Liquor Control may require bumper posts in this area. Supervisor DePalma was present and stated that the Township is trying to Township, understanding that the Planning Commission meets only once every other month, and this being the beginning of the building season, the Township will try to expedite this matter; however, ALL DEFICIENCES MUST be met prior to any building permit being issued. After lengthy discussion, a motion was made by Sova, seconded by Mason to approve SP-080 FOOD CASTLE. STEVE NANNOSHI, DIXIE HWY., DAVISBURG contingent upon all outstanding issues discussed being fully satisfied after review by the Township Engineer and Planner, including, but not limited to the following: all deficiencies outlined in Planner lacoangeli's and Nicholas Brass's March 25, 2013 letters, including a waiver of parking space requirements, due to overlapping times of operation, to allow 74 spaces, all of which shall be 9' x 19', and coordination with the Road Commission for Oakland County for the proposed 2014 road resurfacing. ROLL CALL VOTE. YES - CHRISTOPHER, HOWELL MASON, SEVIGNY, SCHANK, SHERIDAN AND SOVA. NO -0. MOTION CARRIED. OLD BUSINESS: LD , PAUL BREAKIE, 4770 GROVELAND ROAD, ORTONVILLE, The Applicant, Mr. Breakie was present and stated his variance request was approved at the February 12, 2013 meeting. He also submitted a new drawing of the proposed land division showing that the drain field will be included in the parcel with the house and barn. However, the drawing indicates the deed strip to be approximately 775' and ordinance requirements limit the length to 600'.
5 PAGE -5- After lengthy discussion it was determined that Mr. Breakie could go back to the BZA and ask for a variance to extend the deed strip an additional 175', due to the nonconforming nature of the property. While the Planning Commission cannot speak for the BZA, after discussion, a motion was made by Mason, seconded by Schank to approve the proposed LD , PAUL BREAKIE, 4770 GROVELAND ROAD, ORTONVILLE, subject to approval of the BZA variance request to increase the length of the deed trip and obtain a certified survey of the property providing the legal description and showing the deminision(s) and locations of all existing buildings from shared property lines as well as the location of the septic field. ROLL CALL VOTE. YES - CHRISTOPHER, HOWELL MASON, SEVIGNY, SCHANK, SHERIDAN AND SOVA. NO -0. MOTION CARRIED. REVISIT PROPOSED ORDINANCE #193: FIREWORKS: There has been no complaints made to the Township office, and therefore, it was the consensus of the Commissioners to place the matter on the July 2013 Agenda. There being no further business to come before the Planning Commission, a motion was made by Schank, seconded by Sova to adjourn at 8:50 p.m. ALL YES. MOTION CARRIED.
