While buying or selling of ships, wind or other power plants, real estate and further material or immaterial economic goods as well or investments of each nature, our broker s commission is subject to divergent written agreement and comes to 6,0% of the purchase price with the latter up to the amount of ,-- US$, but 4,5% from the item which exceeds an amount of ,-- US$, though 3,0% from the item which exceeds an amount of ,-- US$, though 1,9% from the item which exceeds an amount of ,-- US$, though 1,25% from the item which exceeds an amount of ,-- US$. 3. The claim to commission plus the legitimate Value Added Tax arises as soon as a contract will take place as a result of evidences provided by us or by our mediation. The same claim arises from contract extensions, completions or additions which are in economical connection with the original contract version. This claim arises from all further deals as well which will be done or developed by our mediation or by our nomination of one contract partner, or with his representatives, customers or other partners. 4. The claim to commission remains undiminished valid also in case if the created contract will expire as a result of annulling conditions, will be cancelled as a result of existing right of the customer for the escape clause, or will be rescinded or not carried out for other reasons. In case the contract will be successfully contested our customer is liable for indemnification if he was causally the reason for the challenge. 5. The customer is obliged to nominate us during the negotiations as a causally active agent, to participate us in each contract conclusion and to leave duplicates of the signed contracts to us. The agent may also work for the other parties as well. 9. Deviated agreements require the written form without exception. Place of jurisdiction and fulfilment is Berlin.
