1 Section 5 Independent Educational Evaluation Criteria and Procedures Under the Individuals with Disabilities Education Act (IDEA), parents may request an independent educational evaluation (IEE) at the Portland School District s expense if the parents disagree with the results of an evaluation conducted by the district. An IEE is only available in areas in which the district has completed an assessment. The district may pay for an IEE if the evaluation meets the criteria listed below. Or, the district may refuse to pay for the evaluation and initiate a due process hearing to show that the district s evaluation is appropriate or that the evaluation obtained by the parents does not meet the district s criteria. If parents request an IEE, the following procedures will be followed: 1. The staff person receiving the request will notify the Special Education Program Administrator. 2. The Program Administrator will provide the parent with a copy of the district s IEE criteria and procedures and a list of IEE providers. The Program Administrator may ask the parent why the parent disagrees with the district s evaluation, but may not require the parent to provide an explanation. The Program Administrator may offer to conduct additional assessment. 3. The district will decide whether to approve the IEE or to request a due process hearing to show that the district s evaluation is appropriate. 4. The parent will select the IEE provider and notify the Program administrator. The district does not need to conduct an evaluation planning meeting or get parent consent for the IEE. The parent is not required to select a provider from the list. 5. If the district approves the IEE, the Program Administrator will get written Authorization for Release of Information from the parent to allow the IEE provider to release the report directly to the district. The district will not pay for the IEE if the parent refuses or revokes consent to release the report directly to the district. 6. The district will enter into a contract with the IEE provider that specifies the following: Sec 5 Independent Educational Evaluations Page 1

2 a. The independent evaluator will agree to release the evaluation report (or results) directly to the district before the district pays for services (with written parent consent); b. The district will pay for the evaluation if it meets the district s IEE criteria; c. The cost of the evaluation (consistent with the district s IEE criteria); d. The evaluations to be completed (as requested by the parent and consistent with the district s IEE criteria). 7. The parent is responsible for scheduling the IEE directly with the IEE provider. If parents request reimbursement for a completed IEE, the following procedures will be followed: 1. The staff person receiving the request will notify the Special Education Program Administrator. 2. The Program Administrator will provide the parent with a copy of the district s IEE criteria and procedures. The Program Administrator may ask the parent why the parent disagrees with the district s evaluation, but may not require the parent to provide an explanation. 3. The Program Administrator may offer to conduct additional assessment. If the parent agrees to the district conducting additional assessment in lieu of an IEE, this is considered a reevaluation, and requires an evaluation planning meeting and written parent consent. 4. The parent will provide a copy of the IEE results to the Program Administrator, or, if requested, sign Authorization for Release of Information to allow the IEE provider to release the report directly to the district. 5. The district will decide whether to approve the IEE, if it meets district criteria, or to request a due process hearing to show that the district s evaluation is appropriate. Additional Procedures 1. The results of the IEE will be considered in making educational decisions for the student, as required by the IDEA. 2. The parent may only request one publicly funded independent evaluation for each evaluation completed by the district. A review of existing records is not considered an evaluation for purposes of an IEE. Sec 5 Independent Educational Evaluations Page 2

Location Criteria Evaluators must be located within the greater Portland area, including: Multnomah, Clackamas and Washington counties in Oregon; the Washington School for the Blind in Vancouver, Washington; the Oregon School for the Deaf in Salem, Oregon; or Western Oregon University in Monmouth, Oregon. Evaluators outside of this area will be approved only on a case-by-case basis, providing the parents can demonstrate the necessity of using personnel outside the specified area. II. Minimum Qualifications for Evaluators Independent evaluators must have current credentials that meet the qualifications listed below for the type of assessment. Evaluators with credentials other than those listed below will not be approved unless the parents can demonstrate the appropriateness of using an evaluator meeting other qualifications. Cost Criteria An independent multidisciplinary evaluation will be limited to a total cost of $1,000. Single disciplinary evaluations will be limited to the following schedule of costs. The specified cost for each discipline includes consultation with the parent, the administration and scoring of the assessment tool(s), the completion of a written report and explaining the results to parents. 5 Autism $ Cognitive $ Functional Behavior Assessment $ $1,000 Health $ Motor $ Psychological $1000 Speech and Language $200 - $400 Social/Emotional/Behavioral $ Vision $ Functional Vision $ Transition Services $ Costs above these maximal amounts will not be approved unless the parents can demonstrate that such costs reflect a reasonable and customary rate for such evaluative services or if the parents can demonstrate that there are other factors that make the extraordinary costs necessary. When private insurance will cover all or partial costs of the independent evaluation, the District will request that the parents voluntarily have their insurance pay the independent evaluation costs covered by their insurance. However, parents will not be asked to have insurance cover an independent evaluation if such action would result in a financial cost to the parents including, but not limited to, the following: 1. A decrease in available lifetime coverage or any other benefit under an insurance policy, 2. An increase in premiums or the discontinuance of the policy or 3. An out-of-pocket expense such as payment of a deductible amount incurred in filing a claim. Sec 5 Independent Educational Evaluations Page 5
