1 PERSONNEL COMMISSION LYNWOOD UNIFIED SCHOOL DISTRICT MINUTES for the SPECIAL MEETING on June 12, 2013, 2013 at 5:30 p.m. held in Conference Room B, 2 nd Floor at Bullis Road, Lynwood, California COMMISSIONERS PRESENT: OTHER STAFF PRESENT: Barbara Battle, Chairperson Jacqueline Espinoza, Vice-Chairperson Maria Quinonez, Member Kristin Olson, Director of Classified Personnel I. CALL TO ORDER/FLAG SALUTE/SILENT REFLECTION/ROLL CALL OF COMMISSIONERS The Commission of the Lynwood Unified School District met for a Special Meeting on June 12, The meeting was held at the Education Center of the District Office Conference Room B, 2 nd Floor. Ms. Barbara Battle, Chairperson, called the meeting to order at 5:32 p.m. Confirmation that the Agenda was properly posted in conformance with legal requirements: YES NO Ms. Jacqueline Espinoza, Vice-Chairperson led the Pledge of Allegiance. Ms. Maria Quinonez, Member, led the silent reflection. Roll Call Chairperson, Barbara Battle Present Absent Vice-Chairperson, Jacqueline Espinoza Present Absent Member, Maria Quinonez Present Absent II. APPROVAL OF AGENDA Special Personnel Commission Meeting Agenda June 12, 2013 Special Meeting Espinoza, and unanimously carried, the Commission approved the Agenda for the Special Personnel Commission Meeting for June 12, 2013, as submitted. Ms. Maria Quinonez, Member requested that items 11.G through 11.K be tabled before commencing the Personnel Commission Meeting and proceeded to the motion. Espinoza, and unanimously carried, the Commission agreed to table items, 11.G - Approval of Establishing the Classification of Human Resources Coordinator, 11.H - Recommendation of Salary Range for Classification of Human Resources Coordinator, 11.I - Recommendation of Salary Range for Personnel Specialist II, 11.J - Approval of Establishing the Classification of Personnel Director and 11.K - Recommendation of Salary Range for Personnel Director. 2 III. COMMENTS FROM COMMISSIONERS: Ms. Barbara Battle, Chairperson stated that she noticed that the Personnel Director had moved the recess to closed session at the very top of the agenda. Ms. Battle further stated that with the consensus of the Commissioners she would like to move to the request to speak section prior to going into closed session in order to give those individuals in attendance the opportunity to speak because the Commission did not know how long they would be in returning into open session and did not want to have everyone waiting in case anyone had to leave. IV. COMMUNICATIONS & REPORTS A. Ms. Konigar-Macklin stated she did not have any comments but looked forward to speaking to the Commission about a few items. Ms. Linda Vaughan, CSEA President, stated she did have some concerns about several of the positions listed on the Personnel Commission Agenda. Ms. Vaughan further stated she did not have any problem with the the Instructional Assistant Culinary Science position. The concern with establishing the Classification of Computer Security Analyst is that the position should be a management position. Upon reading further down in to the description it states that it is management. Ms. Vaughan stated she could not see how a classified position could manage another classified position placing classified against classified, because of what that position is asking for like monitoring the computer systems. Ms. Vaughan stated that she would like clarification on what happened to the Classified Personnel Director s job description that the Commission already has? Ms. Vaughan further stated that the job description that is set on the agenda today appeared to her as if the District or the Director is trying to be a two-hatter. CSEA is already concerned that the Director that is in place now is already been more of a twohatter than she is working for the Personnel Commission and it appears that she is the Director over the Commission instead of the Commission being a Director to her. Ms. Vaughan stated that CSEA has come to the Commission with numerous concerns about the Director and her way of handling things which is in violation of the Personnel Commission Rules and Regulations per whatever Lynwood s rules were and the state and some of the Education Code. 3 Ms. Vaughan stated that she does not know if the meeting was set 24-hours ahead of time because Ms. Vaughan stated she received the agenda this morning. Ms. Vaughan further stated that she had called around in the building to see if the agenda had been posted and no one had seen it posted. Ms. Vaughan stated that she would like to know where the agenda was posted within the building. Ms. Vaughan stated that this may be in violation of the Brown Act. Ms. Vaughan also stated that CSEA would like to request that the Personnel Commission take some action as to the way the Commission and the department is going. Ms. Vaughan stated that she attended a Skelly Hearing last week. Prior to attending the Skelly Hearing, CSEA asked that Ms. Olson excuse herself from the meeting but she did not. Ms. Vaughan further stated that any other District that files charges against an employee is filed by Human Resources because the employee appeals to the Commission. Ms. Vaughan stated that she would hope that the Director would give some direction or suggestions to the Commission. Ms. Vaughan further stated that in this case she would have to call the Director who has already heard the case, presented the case against the employee and hears the appeal. Ms. Vaughan also stated that something is wrong with that picture and knows a little bit about the Personnel Commission and that is wrong of the Director to do. Ms. Vaughan stated that she is asking for the Personnel Commission to do something about this and do something about the Classified Personnel Director s position because there was no faith and no trust in the Classified Personnel Director because everything that is being done is in favor of what the District wants. Ms. Vaughan stated that just by looking at the job description on the agenda it shows that the District is targeting classified employees. It is not fair and is in violation of the rules. Ms. Vaughan also stated that everytime CSEA comes to the Commission with a concern things have gotten worse, not better. Ms. Vaughan stated that the Personnel Commission goes into closed session and say you will deal with it, and she did not expect for the Commission to explain how they have dealt with things, but what she can see is that things have gotten worse. Ms. Vaughan Prior to some of the current Commissioners, the Personnel Commission had Mr. Battle on the Commission and things were a bit more stable. Unfortunately Mr. Battle fell ill and things became a bit worse. Mr. Morton was a Commissioner, but it seemed that whatever the Director said he seemed to be fine with and did not even know if Mr. Morton would look to see if some of the items were right or wrong. Ms. Vaughan also stated that ever since Mr. Morton left, it seems that now everyone was in the gutter. Ms. Vaughan stated that this was not just what CSEA felt, but was also why SEIU was not happy with the Commission as well. Ms. Vaughan stated that there was a need for a Classified Personnel Director that was going to run the Personnel Commission and be fair to the Classified Employees and to the District. Ms. Vaughan stated that the Commission is here to make sure that the District has the employees that they need to run the District. Questions and concerns have been brought up with regards to the testing that is done for a lot of positions. Ms. Vaughan further stated that it was her opinion that the positions recruited for should have been promotional only. Ms. Vaughan stated that there has been grant money awarded to the District for a term of 2 years, and instead of making the positions created for the grant promotional only, the recruitment made it open to the public. The individual selected for one of the positions was hired, later released from the position because it was found out that the individual falsified information on his application and the recruitment had to be done all over again. 4 Ms. Vaughan stated that individuals working in this District are not incompetent. If there are incompetent employees it is the fault of the Administrators because they should have done their job, (not necessarily the Commission). Ms. Vaughan once again reiterated that something has to be done about the Classified Personnel Director one way or the other because she is not for classified employees. Ms. Vaughan further stated that maybe the Director wants to go be an attorney or maybe she wants to change the job description so she can walk out the door and leave the Personnel Commission holding the bag. Mr. Manny Rangel, SEIU/Local 99 Representative stated that his concern was when employees voice their concerns regarding lack of security or the need for more security or more custodians at the schools it seems like nothing happens, but when upper level management or the Classified Personnel Director brings positions before the Commission, they are approved. Mr. Rangel stated that SEIU sees a desperate need and there is a big disconnect between the employees and the Commission. Mr. Rangel further stated that he was present tonight because he would like to mend that and stated that he wanted SEIU and CSEA to be heard and respected and want the issues that are out there to be resolved. Ms. Rangel also stated that employees are coming to upper level management, the District or Board of Trustees meetings to keep the public and Board Members informed on the needs that are being requested and nothing happens. Mr. Rangel also stated that he wanted to make sure their voices were heard when they say that there is a need for security and want to work with the District to try to formulate a plan to bring back employees that have been laid off; that it actually happens. Mr. Rangel further stated that so far what SEIU has seen is that new positions are coming before the Commission and need to be funded and approved and still have not seen any laid off custodians or laid off security officers back to permanent positions. Mr. Rangel stated that SEIU was going to hold the Personnel Commission accountable and thanked the Commission for their time. Mr. William Gideon, Acting Director of Research and Evaluation, thanked the Commission for allowing him to speak and stated that he wanted to speak in regards to two positions listed on the agenda. The first was a new position. Mr. Gideon further stated that with the nature of technology changing, there was a need to support security personnel with measures that allow the ability to enforce safety by having a position that brought certain skill-sets that are not just the duties of a security officer. Mr. Gideon stated that what the Commission had before them was critical to assisting and implementing a system where we can eliminate the need to have to call outside contractors. This position would serve to help support existing staff and initiatives in security for the District. Mr. Gideon stated that the second position is extremely critical with the way the state has changed the way it records and looks at student information. The state now does everything electronically. All information provided in paper in the past are instantaneously checked and has greater ramifications on the District. Mr. Gideon further stated that the position has been modified so that the District is competitive with peers. Mr. Gideon also stated that what the District currently has on the table does not put the District in the position to be competitive and have the kind of talent and maintain that talent needed to keep the District moving forward. Mr. Gideon stated he appreciated the Commission taking the time to hear him tonight and helping take care of the District. Ms. Battle asked if Mr. Gideon could please give the Commission the title of the two positions he was speaking on. Page 4 of 7

5 Mr. Gideon stated that the first position was item 11.A Approval of Establishing the Classification of Computer Security Analyst which he stated was not so much monitoring of employees, but more of monitoring of District systems overall. Mr. Gideon stated that there is a network set up with approximately three hundred cameras along with all kind of cyber attacks happening and there is not enough staff at this moment to address these issues. The second position was 11.C Approval of Revising the Classification for Information Systems Specialist and that is more in line with what is out there throughout the District and the State of California. Putting it in current terms, it is required in that position. V. RECESS TO CLOSED SESSION On the motion of Vice-Chairperson, Jacqueline Espinoza, and seconded by Member, Maria Quinonez, and unanimously carried, the Commission approved to adjourn to closed session at 5:51 p.m. to discuss: PUBLIC EMPLOYEE PERFORMANCE EVALUATION Title: Director of Classified Personnel Espinoza, and unanimously carried, the Commission approved to reconvene in to open session at 7:54 p.m. and reported: that effective immediately the Director of Classified Personnel has been placed on Paid Administrative Leave. VI. INFORMATION/DISCUSSION/APPROVAL/RATIFICATION Approval of Establishing the Classification of Computer Security Analyst Espinoza, and unanimously carried, the Commission approved establishing the classification of Computer Security Analyst and approved the associated classification specification, in accordance with Education Code Section 45267, as submitted. Recommendation of Salary Range for the Computer Security Analyst Espinoza, and unanimously carried, the Commission approved recommending to the Governing Board the pay range for the following classification, as attached, and in accordance with Education Code Section 45268, as submitted. Computer Security Analyst: Range 331 (Ewing Classification Study) of the Non- Represented salary schedule, at: $4,585.00/mth-$5,572.00/mth Approval of Revising the Classification for Information Systems Specialist Espinoza, and unanimously carried, the Commission approved revising the classification for Information Systems Specialist, in accordance with Education Code Section 45267, as submitted. 6 Ms. Maria Quinonez, stated that she would like the record to reflect that the Classification of Information System Specialist is being changed to Data Analyst. Recommendation of Salary Range for Data Analyst Espinoza, and unanimously carried, the Commission approved recommending to the Governing Board the pay range for the following classification, as attached, and in accordance with Education Code Section 45268, as submitted. Data Analyst: Range 135 (Ewing Classification Study) of the CSEA salary schedule, at: $3,776.00/mth-$4,600.00/mth Ms. Maria Quinonez, stated that she would like the record to reflect that the Classification of Data Analyst was reclassified from Information Systems Specialist. Approval of Establishing the Classification of Instructional Assistant Culinary Sciences Espinoza, and unanimously carried, the Commission approved establishing the classification of Instructional Assistant Culinary Sciences and approved the associated classification specification, in accordance with Education Code Section 45267, as submitted. Recommendation of Salary Range for the Instructional Assistant Culinary Sciences Espinoza, and unanimously carried, the Commission approved recommending to the Governing Board the pay range for the following classification, as attached, and in accordance with Education Code Section 45268, as submitted. Instructional Assistant Culinary Sciences: Range 120 (Ewing Classification Study) of the CSEA salary schedule, at: $ /hrly-$ /hrly Approval of Establishing the Classification of Human Resources Coordinator Espinoza, and unanimously carried, the Commission agreed to table item 11.G - Approval of Establishing the Classification of Human Resources Coordinator for further discussion. Recommendation of Salary Range for Classification of Human Resources Coordinator Espinoza, and unanimously carried, the Commission agreed to table item 11.H - Recommendation of Salary Range for Classification of Human Resources Coordinator for further discussion. Ms. Battle stated that she would like the record to reflect that the Commission agreed to table items, 11.G - Approval of Establishing the Classification of Human Resources Coordinator, 11.H - Recommendation of Salary Range for Classification of Human Resources Coordinator, 11.I - Recommendation of Salary Range for Personnel Specialist II, 11.J - Approval of Establishing the Classification of Personnel Director and 11.K - Recommendation of Salary Range for Personnel Director have been pulled and tabled for further discussion.
