2 ACCOMMODATION RULES of the Student dormitory Družba in Bratislava The management of the Student Dormitory Družba (hereafter referred to as the SDD) in cooperation with the Student Council of the SDD (hereafter referred to as the SC) and according to the Special Directive of the Comenius University in Bratislava (hereafter referred to as CU) publishes the ACCOMMODATION RULES of the SDD (hereafter referred to as the AR SDD). 1 The AR SDD in accordance with the Special Directive 1 of CU regulate rights and obligations (duties) of tenants, employees and other persons while ensuring the running and maintenance of the buildings of the SDD and its premises The SDD is a multiple functional organization (building complex) in the possession of CU in Bratislava. 2. The SDD carries out the function of accommodation, social and educational (pedagogical) complex. The mission of the SDD is the following: a) to offer accommodation in priority to students of full-time study, internal PhD students, students of Erasmus or other exchange programs, depending on possibilities to lecturers and employees of the SDD and CU. The hotel part of the SDD offers accommodation to guests of CU, to employees of other organizations and societies, to external students and to the public, b) to create conditions for successful individual study and relaxation of the students, c) to develop cultural, social and sport life and support activities in the interest of the students that are in compliance with moral principles and harmonic development of the personality and conditioned by economic possibilities of the SDD. 3 Management of the SDD 1. Following 2, the Director that is the head of the management of the SDD is accountable to the rector of CU. 2. The management of the SDD comprises the Director, chiefs of departments and the chairman of the SC and it holds meetings at least once a month and when necessary. During its internal meetings it discusses the topics of operation of the SDD, including the selection of the right methods when executing tasks and mission. 3. The Director of the SDD has the rights and authorization related to a final decision that results from 3, point 1. 1 Special Directive Štatút 2
3 4 Student Council SC 1. The SC is a collective authority of the SDD that is managed according to its Special Directive approved by the Academic Senate of CU (hereafter referred to as the AS CU). It consists of representatives of the faculties of CU that assign accommodation to at least 100 students in the SDD. The member of the SC becomes a student elected by the majority of 10% of the Tenants (students) of the faculty amongst all students living in the SDD for the period of one academic year. 2. The SC stands in for all students living in the SDD as an advisory institution cooperating with the Director in management of the SDD. It administers affairs concerning the Tenants/students, guides students activities and at the same time helps the Director in activities ensuring observance of the AR SDD. 3. The SC is brought to book for its activity to the AS CU. 4. A member of the SC, in cooperation with employees of the SDD, has the right to take part in the check of hygiene in the rooms of the students. 5 Accommodation 1. There is no legal right for accommodation in the SDD. It can be approved on the basis of a request that is submitted by a student to the faculty where they study in a set period. 2. Faculties in charge decide about the accommodation of their students under the terms of approved and assigned capacities by the AS CU. 3. The agenda concerning the accommodation of students in the SDD is realized, maintained and stored by the Students Department of the faculty and by the Accommodation Office of the SDD. 4. The SDD provides students with accommodation in accordance with lodging lists with an exception of the students who were excluded from the accommodation with the validity for the whole period of their studies at CU. 5. The SDD stipulates the right to refuse accommodation in the new academic year to students who in the past were subject to disciplinary proceeding cancellation of Accommodation - or they did not cover relevant contract fines in an accommodation facility of CU, even if the faculty reserved accommodation for them. 6. Accommodation in the SDD is given to students for the period of one academic year from the 1 st September to the 30 th June of the relevant year or for one semester only. In summer during holiday time the SDD can provide students with accommodation according to a current price list of the SDD. 7. If the student does not occupy an assigned place in the SDD until the settled term by the AS CU, the faculty loses the right for this place and the Director of the SDD decides about its occupation. 8. The student who has the accommodation in agreement with defined terms and conditions will receive the lodging card that enables them to enter the building of the SDD. The lodging card is not transferable. 6 Other arrangements 1. The Tenant can move from the assigned room into another only in the term and under conditions determined by the Director of the SDD. 2. The Director of the SDD reserves the right to move the Tenant into another room for security, hygienic and operational reasons, or for the purpose of effective housing of Tenants. 3
4 3. During the academic year the Tenant can have an overnight guest who is a university student up to a maximum of 5 nights on the condition that they have a free bed in their room. The following conditions must be fulfilled: a) The Tenant is obliged to pick up the guest and sign them in between 6 pm and 11:30 pm at the reception desk of the SDD. The following details should be written down: - name and surname of the guest, - number of the room and the name of the Tenant who accepts the guest - faculty and University of the guest according to their student card - number of the ID card of the guest or another valid document with a photograph that confirms their identity, - duration of the stay in the SDD (the number of nights) b) Persons who were excluded from accommodation in any accommodation facility of CU will not be accepted as overnight guests. c) Payment for the whole period of stay is made before accommodation of the guest. Guests will be allowed to stay overnight provided that this does not annoy other occupants of the SDD. The receptionist - employee of the SDD will give the guest a bill to prove the realization of their payment. The guest is obliged to keep the bill until check-out. The guest will get clean bed linen. d) The overnight guest is obliged to check out by 10am. Tenants are responsible for their guests from the time the guest is signed in up to the time they leave. The responsibility includes keeping the AR SDD and being liable for any damage caused by the guest. 7 Termination of accommodation 1. The accommodation expires by the lapse of the contract period. 2. The student loses the right of accommodation if they do not accept the accommodation in accordance with the time schedule for the relevant academic year approved by the AS CU. 3. The accommodation of the Tenant terminates: a) by the exclusion from university studies, by interruption or abandonment of studies, by the transfer of the student to another university or faculty that does not have assigned places in the SDD, b) if the student violates the Accommodation Contract (hereafter referred to as the Contract) or the AR SDD by a major offence or a repeated minor offence. 4. Major Offences: a) unauthorised accommodation in the SDD of guests who do not have a valid approval of the management of the SDD for accommodation, b) receiving guests outside visiting hours, c) making a copy or falsifying the lodging card, lending it to persons in order to enable them unauthorized entry into the SDD, d) committing crime in the premises of the SDD, e) damaging or polluting the property of the SDD including other forms of vandalism, 4
5 f) breach of safety, anti-fire and hygiene regulations, g) physical or oral assailment of the staff of the SDD or another Tenant, h) threatening the staff of the SDD or another Tenant physically or orally, i) anti-social behaviour, j) failure to cover the residence fees in the way defined in the Contract, if the Accommodation Provider does not come to agreement with the Tenant on a different way, k) failure to pay the costs incurred to repair damages in the full amount and in the period set by the management of the SDD, l) performing any commercial activities without the agreement of the Director of the SDD, m) distribution, keeping or using any narcotics or being under their influence, n) founding, promotion or supporting extremist movements or sects, o) keeping or hiding any weapons (guns etc.), p) throwing out rubbish or any other objects out of windows or balconies of the SDD and thus threatening people s life and health, q) interference in any kind of installation, r) smoking in the premises of the SDD including balconies or allowing a visitor to smoke, s) repeated bringing, using or storing alcoholic drinks in the premises of the SDD, t) repeated disturbance of quiet hours between 10pm till 6am, u) breach of standards of hygiene in the apartment, v) repeated breach of the Safety and fire regulations of the SDD, w) repeated breach of other rules of the AR SDD. 5. Minor Offences: a) disturbing quiet hours between 10pm till 6am, b) bringing, using or storing alcoholic drinks in the premises of the SDD, c) polluting the building or the area of the SDD, d) using banned electric appliances (see Annexe No. 2), e) using the hot plate in a different place from the designated one, f) taking away cutlery or plates out of the student s canteen, g) keeping any pets or exotic animals in the room, h) taking out mattresses or furniture to the balcony, i) using a temporary lodging card longer than 5 days from the day of its issue, j) failure to pick up the visitor at the reception desk, k) failure to check out the visitor by 11pm, l) leaving the visitor in the premises of the SDD without the Tenant s company, m) using roller skates in the premises of the SDD, n) moving arbitrarily from the assigned room to another, moving or decomposing the inventory of the SDD. 6. If the Tenant does not agree with the accommodation of other students in their room their accommodation will be cancelled immediately and they have to leave the SDD without being provided with other alternative accommodation. 7. After the exclusion from the university studies, by interruption or abandonment of studies or successful termination of the studies: a) a foreign student (EU non-resident) can stay in the SDD no longer than one month from the date of termination of their study, b) a Slovak student and EU resident must vacate the accommodation by the day of termination of their study. 5
6 8. If the accommodation is cancelled by the management of the SDD according to 8, point 3b of the AR SDD, the Tenant is obliged to vacate the SDD by the date of the decision about the cancellation. 9. If the student does not move out of the SDD by the determined deadline, the Director will adopt steps to their immediate displacement. 10. The SDD informs the relevant faculty about the cancellation of the accommodation of the student. 11. If the accommodation is cancelled by the management of the SDD according to 8, point 3b of the AR SDD the student loses the right of accommodation during the whole period of their studies at CU. 12. The Tenant is required to hand over their room, keys, lodging card and bed linen to the Accommodation Provider upon ending of their accommodation at the latest. 13. The Tenant is responsible for clearing all personal belongings from the accommodation before returning room keys to the Accommodation provider. Property left behind, which has no obvious value (i.e. clothing, shoes, CD s, videos, books etc.) will be disposed of. 1. The tenant has these rights: 8 Rights and obligations of the Tenant a) to receive basic equipment in the room (bed, chair, desk, duvet, pillow, bed linen) and to be provided with its maintenance in the scope of economical possibilities of the SDD, b) to use common premises of the SDD, c) to receive visitors in visiting hours after registering them and picking them up at the reception desk of the SDD, d) to participate in the social life in the SDD, e) to take part in events in the SDD that are organized by the Student Council (SC), f) to present suggestions and comments concerning all fields of life in the SDD and to receive feedback, g) if the residence fees are markedly increased to terminate the Contract. 2. The Tenant has these obligations: a) to familiarize himself/herself with regulations and directives concerning safety, health and fire Protection (BOZP) - see Annexe No. 1 of the Contract and the AR SDD and to keep them, b) during check-in the Tenant has to submit: - identity card or passport, - 1 photograph 4x4cm no older than 2 years (photos are not given back to the Tenant), - to write true details in the Contract, c) to hand in the second part of the Lodging Card to the place determined by the staff of the SDD, d) to pay the residence fees and other charges and fines in the way and period determined by the management of the SDD, e) to occupy only the room assigned to them, the tenant can move to a different room only with the approval of the management of the SDD only in special cases, 6
7 f) to check, sign and return the Inventory to the Accommodation Office and notify the Accommodation Office of any discrepancies as soon as possible and in any event within 5 days of taking occupation in the SDD. Failing this, the SDD shall assume that the Inventory is correct, g) to observe the regulations of the AR SDD as well as other directives and instructions concerning the SDD, to behave towards employees of the SDD and other persons in the premises of the SDD with respect to their human dignity, h) to avoid anti-social behaviour, i) to undergo a medical check or other medical of hygienic measures if circumstances demand it, j) to respect quiet hours from 10pm till 6am. All Tenants resident in the SDD have the right to sleep, study, or work in their room without undue interference. During quiet hours making any noise is prohibited. This noise policy applies also to the lobby, hallways and the courtyards surrounding the SDD, k) not to cause persistent noise nuisance, l) to keep the studio apartment tidy and clean, to maintain the tidiness in common premises as well as in the whole residential complex of the SDD, m) to let the cleaning lady in their room. The cleaning lady is responsible for cleaning the hall of the apartment, toilet, bathroom and weekly mopping the floor or the room, n) to make the apartment accessible to the Accommodation Provider in working days from 8am till 3pm for the purpose of the checks of inventory, hygiene, the proper use of the apartment, technical revisions and for other special purposes (e.g. decorating), o) when entering the SDD to show their lodging card without being asked and in the premises of the SDD upon request to the staff of the SDD (wearing a name badge of the SDD), p) to keep consistently all security, anti-fire and hygiene regulations and to protect the environment, q) to report any discovered damage to the staff of the SDD without delay, r) when receiving guests to accompany and register them at the reception of the SDD, s) to pay the costs incurred to repair damages (such as broken windows) the Tenant caused (intentionally or accidentally) in the full amount and in the way the management of the SDD decides, t) to save water and electricity, u) to protect the room against theft by locking the door when leaving the studio apartment and not lending the keys or leaving them available to anyone, v) before leaving the apartment, the Tenant has to turn off all electrical appliances, shut the windows and the balcony door, w) to behave according to the statements and directives of the Director of the SDD or a person authorized by the Director when special occasions (like decorating, disinfection etc.) require that, x) to change their bed linen every 2 weeks in the laundry store. If the tenant loses their bed linen or exceedingly soils it they are obliged to pay the price for a new set, y) if the Tenant finds any parasitic insects in the apartment (bed bugs, lice, fleas) they are obliged to inform the Accommodation Office about this fact asap. The Tenants living in the affected rooms are supposed to follow all steps determined by the management of the SDD leading to extermination of the parasites, z) to use only allowed electrical appliances in the room and the premises of the SDD (see Annexe No. 1), aa) if the Tenant loses the lodging card and gets a temporary one, they are obliged to get a new lodging card at the Accommodation Office within 5 days after the issue of the temporary card. Failing this will be considered a minor offence. 7
8 3. Before vacating the apartment, the Tenant is required: a) to hand over personally: a clean room and its inventory, b) to give back bed-linen, keys and their lodging card to the SDD, c) to pay any outstanding fees and fines, d) to check out of the accommodation at the Accommodation Office. 4. Damage to apartments (caused intentionally or accidentally) is covered by the Tenants in the full amount upon ending their accommodation in the relevant year at the latest. When wallpaper or front doors are visibly damaged, the students are required to pay the full amount of the price for new wallpaper or door, covering all real costs. 9 Rights and obligations of the Accommodation Provider 1. The Accommodation Provider has the following rights: a) to enter, even without an approval of the Tenant, the premises reserved for their accommodation at any time: if life or property is in danger, in order to stop danger to public order, when removing any faults or doing a technical revision or in the case of a serious suspicion of unauthorized accommodation of strange persons, b) to move the Tenant out, possibly to put their belongings to a different place, if the Tenant does not vacate the room upon ending of their accommodation, c) to carry out a check of hygiene and the proper use of the apartment in the presence or absence of the Tenant. The staff carrying out the check wears a name badge of the SDD. In the case of unsatisfactory assessment, a record of the check is written. The record includes: date and time of the check, names, surnames and signatures of the staff, the purpose of the check and the result. The Tenants will be informed about an established breach of obligations resulting from the Contract on the same day of the check of the apartment, d) if the staff of the SDD (the porter, the security guard or other staff wearing a name badge of the SDD) find out that the Tenant is violating the Contract or the AR of the SDD, they are authorized to withhold the Tenant s lodging card. 2. The Accommodation Provider has the following obligations: a) to hand over the apartment to the Tenant in condition that enables normal use of the apartment, b) to inform the Tenant about the regulations concerning Safety, Health and Fire Protection and the AR SDD, c) to provide the Tenant with normal and undisturbed use of their rights related to accommodation in conditions laid down in the Contract and the AR SDD, d) to notify the Tenants about activities and works in the SDD and its surroundings that restrict an undisturbed use of their rights related to accommodation, e) in emergency upon the request of the Tenant to open the door to their room 24/7 under the conditions determined by the landlord see the AR SDD Annexe No. 3, f) to change the lock to the apartment and provide the Tenant with new keys if the Tenant loses their keys (or they were stolen); the Tenant has to pay a fixed fine. 8
9 10 Residence Fees 1. The Tenant is obliged to pay residence fees according to terms set in the Contract. The accommodation fees are established for one bed (one person) for one calendar month. 2. If the residence fees are increased the tenant is obliged to the full increased price. 3. The maturity date for the residence fees is specified in the Contract. 4. The Tenant is required (upon request) to show the proof of payment for the accommodation to the Accommodation Provider. The Tenant is obliged to keep the bill during the whole period of accommodation. 11 Fines and Charges 1. If the Tenant did not pay the residence fees in the period defined in the Contract, they are obliged to pay a fixed fine in the amount defined in the Contract for each day of delay. 2. If the Tenant does not vacate their room in accordance with the AR SDD and the Contract by the term of the Contract expiry, they will be charged a fixed fine for each day of delay. Upon eventual handing back the room the Tenant will be required to pay residence fees for the current month. 3. If the lodging card or room keys of the Tenant are lost or stolen, the Tenant must pay all costs defined in the Contract. 4. If the tenant breaks Safety and fire regulations 15, point 1 of the AR SDD, they will be charged a fixed fine in the amount set in the Contract. 12 Disciplinary measures 1. A disciplinary measure is applicable to a tenant who broke a rule/ rules defined in the AR SDD or in the Contract. Disciplinary measures are imposed individually, considering the gravity, danger, character and consequences of an offence. Disciplinary measures are imposed by the Director of the SDD in accordance with the Disciplinary Order of CU. Succession of disciplinary measures acc. to point 2, a) d) is not taken into account the SDD will consider the gravity of an offence. 2. Disciplinary measures are: a) reproof, b) conditional cancellation of the Contract (for a minor offence), c) increase of the residence fees by the amount set by the Academic Senate CU for the period determined by the decision about imposing a disciplinary measure according to the Contract, d) cancellation of the Contract (for a repeated minor offence or a major offence) implying the loss of the right to get accommodation in all accommodation facilities of the CU during the whole period of study at CU. 3. Rights of the faculties to punish their students according to their Disciplinary Order are not touched by the AR SDD. 4. The Tenant has the right to defend themselves by explicating the offence before imposition of any disciplinary measure. 5. The decision about imposing any disciplinary measure on a person has to have a written form. 9
10 13 Internal order 1. The Student dormitory opens at 6am and closes at midnight (12 pm). After this time it opens every 30 minutes or every hour depending on the season and the decision of the Director of the SDD. After midnight, the Tenant has an obligation to show their valid lodging card before entering the building. 2. The receptionist can let the person in only if they possess their personal and valid lodging card of the SDD. The Tenants can receive visitors only between 8am and 11pm. Visitors can be welcomed only on the ground floor of the SDD next to the reception or in rooms of the Tenants. 3. Visitors who are drunk or have used any narcotics will not be allowed to enter the SDD and they lose the right to visit the Tenant. 4. The Tenant is obliged to pick up and register the visitor at the reception desk. Visitors are required to show a card proving their identity and leave this card at the reception (not their ID card, passport or health insurance card) during their temporary visit. The Tenant is also obliged to provide their lodging card to the staff of the SDD as a guarantee for the whole period of visit. Upon the ending of the visit, the Tenant has to accompany the visitor back to the reception desk for check out. Visitors must not stay in the SDD after 11pm with the exception of 6, point 3 of this document. The visitor must remain in the Tenant s company until departure from the SDD. 5. According to the rule of the city manager of Bratislava IV, quiet hours in the SDD are between 10pm and 6am. 14 Safety and fire regulations 1. The Tenant must comply with the ban on smoking in the whole building of the SDD. 2. It is strictly forbidden to use any heating or electrical appliances, heaters included that are not a part of the apartment s equipment. It is also forbidden to do any activity where fire is open, to use matches or candles as a light source. Everyone who uses permitted appliances by the management of the SDD is required to maintain the producer s manual and instructions. The appliance has to be immediately switched off after use. 3. Any interference in the electric system in the building is forbidden. 4. The building is equipped by portable fire extinguishers that are designed for a possible anti-fire action. Everyone is required to be familiarized with their use. Fire extinguishers and fireplugs must not be damaged, moved or used for a different purpose to extinguishing fire. The access to fire extinguishers and fireplugs must be permanently free. 5. The Tenants are required to maintain the electrical installation in working order and are forbidden to do any work where fire can be kindled or that requires special qualification according to special regulations. 6. It is forbidden to damage or to remove protection and safety equipment or its components and to put them out of service. 7. Any damage to equipment or its components or breach of these regulations must be notified by the Tenant at the reception immediately. 8. Paper, wood and textile represent highly flammable materials. A temperature above 160ºC sets them on fire. The premises of the SDD can contain only such an amount of flammable materials, which is indispensable for ensuring feasible accommodation conditions. 9. In the case of fire it is necessary to turn off electricity and to extinguish the fire by using a fire extinguisher and fireplugs. If it is not possible to extinguish fire personally, tenants must report the fire according to Fire alert directives. 10
11 15 1. The SDD is considered an academic ground. Members of the police have the right to enter the building and the whole area of the SDD in conditions defined and written in the law about universities and in the Special Directive of CU. Only the rector of CU or a person authorized by him can allow entry of authorities active in crime scene investigation. 2. Political parties are not allowed to create their institutions or to promote their activity in the SDD. 3. Special events can be held on premises of the SDD only with the approval of the Director or his representative in charge. 4. The Accommodation Rules adequately refer also to other Tenants in the SDD and they are obligatory also for all employees regardless of their working contract, in the SDD and in CU, as well as strangers present in SDD s buildings and their surroundings. 5. The Tenant agrees with the use of their personal data for the purpose of processing agenda of the accommodation. 6. Questions and matters not included in this document have to be settled in accordance with the Special Directive of CU and other valid regulations This document called Accommodation Rules is operative and rightful from the day of its confirmation by the Director of the SDD. 2. The Accommodation Rules can be possibly modified or complemented in a written form. 3. The AR SDD include the following Annexes: a) Annexe No. 1: The list of approved appliances and banned appliances in the SDD b) Annexe No. 2: DIRECTIVE no. 1/2011 OF THE DIRECTOR OF THE SDD concerning occurrence of any parasitic insects (bed bugs, lice, fleas) in the students rooms c) Annexe No. 3: Emergency Access to the Tenant s apartment In Bratislava, 1 September 2015 Mgr. 13 Annexe No.2 Comenius University in Bratislava, Students Dormitory Družba Botanická 25, Bratislava 4 DIRECTIVE no. 1/2011 OF THE DIRECTOR OF THE SDD concerning occurrence of any parasitic insects (bed bugs, lice, fleas) in the students rooms 1. If any parasitic insects occur in the room (bed bugs, lice, fleas), the Tenants are obliged to inform the Accommodation Office about this fact ASAP. 2. The staff of the Accommodation Office informs a responsible person the head of the technical department, who will be responsible for coordinating all measures taken and for the communication with a pest control company. 3. A pest control company will be called instantly and an immediate action for exterminating the parasites will be taken. 4. The tenants living in the affected rooms are obliged to follow all instructions given by the management of the SDD. 5. A proper spraying will be performed in the affected room with a subsequent placement of a smoke cartridge. 6. Immediate surroundings of the room will also undergo spraying. 7. At least 4 hours upon the application of the spraying the Tenants are not allowed to enter the room. 8. Subsequently, the Tenants are allowed to take their belongings from the affected room and the clothes must be properly washed at a high temperature. 9. A following spraying of the room will be repeated according to the need, the earliest in days. A proper pest control will be performed and the bed linen changed. 10. The maximum duration of the whole procedure (including the repeated spraying) is 3 weeks. 11. This Directive is part of the AR SDD. Mgr. Ivan Daňo Director of the SD Družba In Bratislava 1 September
14 Annexe No.3 Emergency Access to the Tenant s apartment If the Tenant is locked out of their room the Accommodation Provider can open their apartment upon request in the following way: The service is provided: 1) Mo Thu: 7 am 3 pm by the maintenance staff of the SDD 2) Fri: 7 am 12:30 pm by the maintenance staff of the SDD 3) on working days between 3 pm and 7 am, at weekends and during public holidays by the porter of the SDD The Tenant must meet the following conditions: 1) the Tenant has to submit their lodging card to the porter at the reception desk, 2) the porter writes down the name of the Tenant, the room number and the date to the Book of emergency apartment access, 3) the Tenant will be charged 3,30 in working days between 3 pm and 7 am, during weekends and public holidays, 4) the staff of the SDD will open the apartment only to the Tenant who submits their lodging card and pays the charge. 14
