1 COLLABORATIVE AGREEMENT BETWEEN Special Supplemental Nutrition Program for Women, Infants and Children and the (PAIHS) I. Purpose This collaborative agreement between the Special Supplemental Nutrition Program for Women, Infants and Children, herein after referred to as the ITCA, and the, herein after referred to as PAIHS, is entered into for the purpose of coordinating and streamlining maternal and child health activities of common interest and shared responsibility in the service areas described in Attachment 1. The sharing of information will be used only for the purposes of: a) Establishing eligibility for the ITCA WIC program and/or PAIHS programs and services; b) Conducting outreach to ITCA WIC applicants and clients for PAIHS programs and services and vice versa; c) Enhancing the health, education, or well-being of ITCA WIC applicants or clients who are currently receiving PAIHS programs or services; or d) Streamlining administrative procedures in order to minimize burdens on staff, applicants or clients in either PAIHS or the WIC program II. Scope The ITCA provides supplemental food, nutrition education and health care referrals to low income, nutritionally at risk pregnant, breastfeeding, and postpartum women, infants and children up to 5 years of age residing on or near the service locations listed in Attachment 1. ITCA administers the WIC program according to federal regulations and policies established by USDA. ITCA contracts with tribes and one urban Indian health center to provide direct services to WIC clients. Entities providing direct services are herein after referred to as WIC local agencies. The IHS is responsible for providing comprehensive health services to American Indians. The mission of the IHS is to raise the physical, mental, social and spiritual health of American Indians to the highest level. The is comprised of 11 service units in Arizona, Utah and Nevada that provide direct patient care. The service units affected by this agreement are listed in Attachment 1. III. Authority The ITCA is a federal program funded by the United States Department of Agriculture and is authorized by Section 17 of the Child Nutrition Act of 1966 (42 U.S.C. 1786), as amended. The Indian Health Service is a federal program funded through the United States Department of Health and Human Services. The IHS is authorized by the Snyder Act of 1921 (25 U.S.C. 13). The Indian Health Service became a primary responsibility of the Public Health Service under P.L , the Transfer Act, on August 5, Economy Act, Title 31.

Responsibilities Both PAIHS and ITCA WIC agree to collaborate in maternal and child health and nutrition services of mutual interest as set forth below: ITCA WIC agrees that the local agencies contracted with ITCA will comply with the following: Provide WIC services to the eligible populations living in the ITCA WIC service areas according to federal regulations and policies; Coordinate scheduling of WIC clinics with other PAIHS health services; Provide orientation to PAIHS staff on the WIC program as requested; Serve as an adjunct to the comprehensive health care services provided by the hospitals and clinics within the PAIHS by encouraging appropriate referrals of WIC clients to the hospitals and clinics for acute and preventative health care services and prenatal care; Coordinate nutrition education information with PAIHS to ensure continuity of messages to clients or patients that are served by both entities; Encourage women to exclusively breastfeed their babies for at least one year and provide support to assist them in achieving this; and Share only the following confidential client information with the PAIHS for the purposes outlined in section I above: o Name, address and/or location of home, and/or phone number o Heights, weights and/or hemoglobin values o Pregnancy status o Breastfeeding status or problems associated with breastfeeding o Immunization information o Nutrition Risks PAIHS agrees that the PAIHS service units and/or clinics will: Coordinate IHS activities with the in the service area; Refer potentially eligible women, infants and children to the WIC program in the service area; Coordinate scheduling of WIC clinics with other health services; Provide space for WIC clinics as feasible; Provide the following confidential patient information for a given WIC client to the WIC Program in the service area when requested: o Heights, weights and/or hemoglobin values (including pre-pregnancy and birth) o Pregnancy status o Medical reasons for special formula requests o Medical problems effecting nutritional status o SOAP notes and/or PC Form from Registered Dietitian o Gestational age of infant at birth Coordinate nutrition education information with ITCA WIC to ensure continuity of messages to clients/patients that are served by both entities; Provide nutrition counseling for high risk WIC clients; Provide documentation of medical need for special or non-contract formulas as needed; and Encourage women to exclusively breastfeed their babies for at least one year and provide support to assist them in achieving this.
3 In addition, the PAIHS and ITCA agree to support the location of a WIC clinic on the Phoenix Indian Medical Center (PIMC) campus as set forth in a separate agreement between PIMC and ITCA. V. Confidentiality of Client and Patient Information ITCA and PAIHS agree to protect the confidentiality of any client or patient information according to the standards set forth for each entity in federal law and regulation. Both parties agree to use the information only for the purposes outlined in Section I. Neither party will share any client or patient information received from the other party with a third party. VI. Cost This agreement does not include any transfer of funds between the two entities. VIII. Term and termination This agreement is effective July 1, 2007 until terminated by either party. Either party, upon thirty (30) days written notice to the other party, may terminate this agreement with or without cause. In witness thereof, the parties hereto have duly executed this Agreement in accordance with the terms and provisions contained herein.
