The work of this contract provides for the furnishing of certain technical services for brush, tree, and grass cutting services, removal and clean-up, tree trimming, and right of way clean-up on SEPTA s active and inactive right of way. This includes SEPTA s yards, substations, special assignments and properties situated in SEPTA s five (5) county area, Bucks, Montgomery, Delaware, Chester, and Philadelphia Counties. B. The Contractor shall provide all technical services including material, labor, tools, equipment, transportation, and supervision necessary to perform all tasks specified within this contract and/or as directed by SEPTA s Project Manager. C. The Contractor will be responsible for but not necessary be limited to the following: 1. Tree Trimming. 2. Tree Cutting. 3. Brush Cutting. 4. Grass Cutting. 5. Dead Tree Removal. 6. Stump removal. 7. Brush Removal. Specification Page 2 of 12 4/3/15

3 8. Trash and Debris Removal. 9. Chemical Spraying Vegetation and Stump. 10. Clean-up and complete removal of cuttings and debris. 11. Safety and tool box meetings. 12. Visual surveying existing conditions of area. 13. Maintenance of traffic if required. D. The overhead catenary wire and electrical lines will be ENERGIZED and remain in place for each location. The Contractor may request in writing for the lines to be deenergized if required. E. The Contractor shall provide all services necessary to accomplish any task. F. The Contractor shall maintain pedestrian traffic flow at each location by a means acceptable to the SEPTA Project Manager. G. Without intending and/or restricting the volume of work required by this Contract, the work generally includes furnishing all materials, tools, equipment, supervision and transportation, and performing all labor and services necessary for completing each task as required completing all work in a satisfactory manner as described in these Specifications RESPONSIBILITY OF CONTRACTOR A. Examine all of the Contract Documents to ascertain the extent and nature of the work prior to submitting bids. B. The Contractor shall instruct, and has the sole responsibility to fully inform, all workers, including sub-contractors and agents, that the performed work will be near and adjacent to SEPTA active railroad service. Contractors shall inform all workers and employees to perform work in a prudent, safe and workmanlike manner and with all due care. C. All Contractors and their supervisors are required to attend a mandatory SEPTA Roadway Worker Safety Seminar. D. The contractor shall provide the required insurance documentation as set forth in the Contract documents. E. The Contractor shall erect and maintain all required detours and traffic control devices if required. F. The Contractor shall provide all materials required for each required work location. G. The Contractor shall completely clean-up work location at the completion of the job, including tree limbs, spare tires, appliances, home furnishings, concrete and miscellaneous debris. 4 H. The Contractor will be held responsible for a satisfactory and complete piece of work. Provide, without extra compensation, all incidental items required as part of its work I. Have the charge and care of the work until its final acceptance by SEPTA. Take every reasonable precaution against injury or damage to any part of the work by the action of the elements, theft, and vandalism or from any other cause, whether arising from the execution or from the non-execution of the work. Rebuild, repair, replace, restore and make good, to the satisfaction of the SEPTA Project Manager, all injuries or damages to any portion of the work occasioned by any of the above causes until final acceptance of the work and bear the expense thereof at no cost to SEPTA. J. As necessary for proper execution and completion of work and as applicable for each location, and secure and pay for: 1. Permits and/or reviews 2. Governmental Fees 3. Licenses K. Compliance with the requirements of this specification shall not release the contractor of performing work satisfactory to SEPTA, State and Municipal Authorities having jurisdiction and the owners of such Private Properties as may be affected. L. Verify location of existing utilities prior to working in or adjacent to areas containing existing utilities. 1. Notify utility owners as specified on the Contract Drawings prior to intended start work date in an area in which the utilities may be located. Deliver a copy of this notice to the SEPTA Engineer within eight (8) hours of the submittal of the day notification. M. The work of the Contract includes coordination of each location, including preparation of diagrams and schedules, and control of site utilization, from beginning of work activity through completion. Coordinate prosecution of the Work with those public utilities, governmental bodies, SEPTA s Regional Railroad operations and other contractors having access; either eliminate or minimize, as possible, delays in the work and conflicts with those utilities and bodies and contractors. Confirm coordination measures for each individual case with the Project Manager by memorandum. O. The Contractor shall carefully select, train and instruct his personnel on the performance of work operation. The Contractor will be fully responsible for all personnel and liable for their actions, including possession, verification and maintenance of any/all applicable and/or required individual qualifications, licenses, or certifications required by any agency having jurisdiction over any aspect of the Specification Page 4 of 12 4/3/15

5 contract work. Any changes in personnel or their work schedule shall be reported to SEPTA s Project Manager immediately in writing. P. The Contractor will be responsible for repair of any damaged property of others or SEPTA property by any act or omission of contractor s employees or agents relating to this contract. Q. The Contractor shall instruct all personnel that the use of radios and/or headphones shall not be permitted while performing work in this Contract. R. The Contractor shall set-up a telephone equipped business office which shall be staffed during normal business hours (8:00 a.m. to 4:30 p.m.), Monday through Friday CONTRACTOR S CREW AND EQUIPMENT REQUIREMENTS A. Crew Requirements. It is essential for the timely completion of each location that the contractor provides sufficient manpower and equipment on a daily basis to effectively progress the work. B. The Contractor must have the capability to fulfill a minimum Six - (6) man crew requirement daily and for emergencies. C. Crew Requirements: Tree Work 1 Climbers/Bucket Operator 2 Groundsman/Driver/Crane operator One Crew member shall be designated as Foreman/supervisor and must be a certified arborist and have a minimum of four (4) years experience performing tree surgery and removal, and certified for working around high voltage wires, along with having skilled knowledge of safety rules and regulations required for working along SEPTA Railroad. All climbers shall have a minimum of two- (2) years experience for performing tree surgery and removal. Climbers shall be certified for working around high voltage wires. Use of climbing hooks in trees near wires is prohibited. Climbers shall provide evidence of certification upon request by SEPTA s project Manager. Note SEPTA will at times require contractor to provide more than one crew at a time. In such cases additional crews mat not be required to contain Foremen/Supervisors. Brush/Weed/Grass Cutting and/or Trash/Debris Removal 1 Foreman/Supervisor 5 Groundsmen Specification Page 5 of 12 4/3/15

6 Note may not be required to contain Foremen/Supervisors. Chemical Spraying 1 - Groundsman D. Contractor shall provide to SEPTA a list of equipment that will be used to perform this contract in a professional and workman like manner. Equipment must be in good serviceable condition and shall be no more than four (4) years old, to minimize downtime. As a minimum, the basic crew equipment shall include but not be limited to the following: Brush cutters equipped with saw blades and brush knives Variable size chain saw, 16 to 36 1 Hydraulic chain saw, minimum 6 reach with 14 bar and chain, insulated for safety to eliminate shock 1 Hydraulic lopper with a minimum 6 reach, with 14 bar and chain, insulated for safety to eliminate shock. 2 Climbing and lowering lines, 120 feet 2 Climbing saddles with safety straps ands snaps 1 Generator-operated lighting system, for emergency night work trailer type chipper, complete with safety chains, warning lights and flashers. 1 Stump Grinder Contractor s vehicles must be less than ten (10) years old and in good serviceable condition. As a minimum, the basic crew equipment shall include but not be limited to the following: 1 hi-rail Bucket Truck to be used on operations to reach limited access 1 hi-rail chipper Trucks or vehicles sufficient to transport the crew(s), and remove cuttings, debris and refuse as required. SEPTA may at times require contractor to provide more than one crew at a time. In such cases each crew must be fully equipped with vehicles and equipment as described above. E. As needed the contractor shall supply one (1) 16 flatbed truck mounted crane, capable of lifting 1600 lbs. with 60 minimum telescoping reach, completely equipped with all required lifting tongs, cables sling chains and binders within 24 hours seven (7) days a week. Normal and hi-rail dump trucks (including roto-dumps) and giraffes may also be required during the course of the contract. These instances are infrequent and, to the extent possible, advance notice will be given. F. All equipment must be well maintained and in good condition and possess current inspection certifications. 7 G. In the event the contractor does not provide the required crew and equipment during a track/power/signal power outage required to perform the work, the contractor shall bear the cost of all SEPTA Protection and Transportation personnel supporting the work for that day. The cost for SEPTA personnel will be deducted from the contractor s total contract amount. SEPTA s Project Manager shall be the sole judge as to whether the contractor has complied with the intent of the minimum crew and equipment requirements EMERGENCY TREE AND BRANCH REMOVAL A. Upon receiving notice from SEPTA s Manager that an emergency exists, the contractor shall dispatch within one (1) hour of receiving call qualified supervisor to determine what personnel and equipment is required at the site of the emergency. B. The Supervisor shall remain at the emergency site until the situation has been declared normal. C. Emergency Services shall be considered on a 24-hour, 7 days a week CONTRACTOR NORMAL WORK HOURS A. The contract hours will be 8:00 a.m. to 4:30 p.m., 8-hour shift with one half-hour (non-paid) for lunch. Travel time of one (1) hour is included in the eight- (8) hour shift. No extras will be allowed for equipment servicing, or restrictions. SEPTA s Project Manager will be the sole judge as to the Contractor s adherence to these hours. Invoice submittals will be based on the hours worked at each location. B. Lost time due to Contractor s equipment failure will be the Contractor s responsibility. All equipment must be adequately maintained and in good condition. Time lost to work stoppage because of equipment failure will be deducted from contractor s invoice BASIS OF PAYMENT A. All invoices must be accompanied by job record sheet indicating hours worked, crew size, and equipment. All payments shall be based on actual time spent at the job site. SEPTA will allow for one-hour travel time, which will include to from job site and dump location. B. Work that is requested to be performed outside of normal business hours, at night, on weekends, or holidays, shall be based on the contracted hourly rate. Night and Weekend work is required for some on-track locations. SEPTA will accommodate emergency and/or night and weekend track outage work that lasts less than a complete 8 hour shift with a minimum reporting payment of 3 hours work and 1 hour travel time. 8 1.07 PROMPT REPORTING OF ACCIDENTS A. Any accidents occurring to the Contractor s employee (s) or agents, while performing work for this contract, must be reported to SEPTA s Project Manager, in writing, within forty-eight (48) hours of their occurrence (s), so that he may comply with appropriate regulations of the Federal Railroad Administration as required SEPTA S RESPONSIBILITY A. To ensure the safety of SEPTA s Railroad operations and the integrity of the SEPTA right-of-way, SEPTA protection service personnel (Flagman) will be required at some locations. B. A qualified SEPTA employee will be required when a track is taken out of service to allow the Contractor to perform work. If the Contractor plans to use equipment that has the potential of fouling SEPTA s catenary system, a SEPTA Electrical Traction personnel (A-man) will be required on site. If SEPTA s Project Manager determines that a power outage is required to perform the work, two (2) A-men will be required to de-energize the catenary system and any other SEPTA power system that needs to be de-energized. The SEPTA s Project Manager shall determine what protection services will be required and will make all necessary arrangements. No extras will be allowed because of equipment restrictions. C. All SEPTA s personnel costs will be borne by SEPTA. D. This is by nature an emergency contract, so the contractor cannot be afforded definitive schedules for planned work. In so much as possible, however, SEPTA will share information about its known backlog of contract work with Contractor, at intervals convenient to SEPTA. E. SEPTA will provide for the disposal of non- vegetation waste if the Contractor is assigned a job consisting of significant trash/debris clean-up. SEPTA may, at its discretion, spot a container or provide a dumpsite for the Contractor s dump trucks. Disposal of all other tree, brush, chippings, vegetation, and incidental litter, trash, and debris are the responsibility of the Contractor CONTRACTOR USE OF WORKSITE A. General 1. The Contractor shall confine operations at the site to areas permitted by law, ordinances, and permits, according to the schedule and the Contract Documents and shall not unreasonably encumber the site with any materials or equipment. 2. Consider the safety of the work and that of people and property on and Specification Page 8 of 12 4/3/15

9 1.10 LIMITS OF WORK adjacent to the worksite when determining amount and location of work being performed. 3. Move stored products and equipment, which interfere with foreseeable operations of SEPTA, public and private utilities, the public, and other Contractors at no expense to SEPTA. 4. Be responsible for the security of stored products and equipment. Secure additional storage, work areas needed for construction operations at no additional cost to SEPTA, and absolve SEPTA from any and all responsibility concerning the use of such property. 5. Throughout each work area, maintain premises and public properties free from accumulation of waste, debris, and rubbish caused by operations. Conduct daily inspections to verify that requirements of cleanliness are being met. INTERIM CLEANING - Generally clean areas within each work location and those areas outside the work location into which construction dirt, dust, and debris has accumulated as directed by the Project Manager. 6. Protect the public from contract-related activities. Do not unduly inconvenience those persons by contract activities. Conduct work in and on streets in a manner, which will ensure that pedestrian and vehicular traffic will not be obstructed or obstructed to the least possible degree and safeguarded against all construction. 7. Promptly vacate the worksite upon completion of the work. A. The work shall be performed at various locations on SEPTA s Right of Way. The Right of Way width varies, so the contractor shall familiarize themselves with the areas including in this contract. B. The Contractor shall conduct all operations, except hi-rail, in connection with this contract so that no part of his equipment may foul and operation of track, transmission signal or communication line or damage any other railroad structure or property of others. C. All equipment shall be kept at all times ten feet (10 ) from track area, unless otherwise approved by SEPTA s Project Manager. D. Should any question arise as to the actual starting or termination point, the SEPTA Project Manager will be the sole judge of the exact limits of work. E. Upon written receipt of specific authorization and instructions from SEPTA s Specification Page 9 of 12 4/3/15

10 Project Manager, the Contractor shall perform the following tasks: 1. Brush Cutting: The cutting of all brush, weeds, trees, tree limbs, vines and undergrowth. 2. Tree Cutting Undesirable trees and wood brush shall be cut to ground lines and stumps treated with chemical recommended by the industry and EPA approved to eliminate future re-growth. A 90% kill is required. Desirable trees, plants and ornamentals will not be cut or sprayed. 3. Stump Removal When requested by SEPTA s Project Manager, the contractor will remove stump and roots below grade using a stump removal machine. 4. Tree Trimming Shall include the cutting back or the removal of limbs, branches or other work not involving the complete removal of the trees, i.e. Elevation, Thinning, and topping. 5. Brush, Trash, and Debris Removal All cuttings, brush, trash, and debris removal, associated with the work performed shall be completely removed from SEPTA Property within (24) hours after completion of a job location. Grounds shall be raked clean and paved surfaces swept clean. Contractor shall provide a dump truck and/or trash container to remove all cuttings and debris. No chipping can be disposed of on SEPTA or private property. 6. Chemical Spraying Shall include hand spraying for pre-emergence and control of weeds, vines, and undergrowth. Chemicals must be EPA and SEPTA approved to eliminate re-growth without impacting neighboring property. 7. Dead Trees Dead Trees shall not be trimmed but shall be completely removed. 8. Grass Cutting Shall include mowing grass, and basic grounds keeping and landscaping services such as renewing mulch as required, hedge trimming, edging, hand spraying for weeds in paved areas and walkways, etc. Specification Page 10 of 12 4/3/15

11 1.11 SEPTA OCCUPANCY AND USE A. SEPTA reserve the right to use, or cause to be used, any portion of the work as soon as it is made ready for use. Such use shall not be construed as acceptance of the work by SEPTA. Contractor shall be responsible for maintenance and up-keep of all newly installed work and the site until final acceptance of the work COORDINATION WITH OTHERS A. Schedule and coordinate work with other contractors. Conduct work so as not to interfere with or hinder the progress or completion of work being performed by other contractors. B. SEPTA will not consider any time extension or monetary compensation for delays or damages as a result of the Contractors failure to adequately document or communicate with the other contractors activities in the integrated schedule or failure to act in accordance with the information by the contractor. SEPTA may only consider a time extension to the Contractor if it is documented by the Contractor to the satisfaction of the SEPTA that the Contractor has responsibly complied with these coordinating requirements. C. If the Contractor damages the work of a separate contractor; the Contractor shall promptly repair/replace the damaged work so as not to affect the schedule and warranty provisions of the other contractors with SEPTA. D. If the damage to the project s work occurs as a result of the other contractor s activities, the Contractor shall promptly settle the matter with the other Contractor so as not to impact the schedule and warranty provisions of this Contract. E. Arrange work and place and dispose of the materials being used so as not to interfere with the operations of the other Contractors and SEPTA within the limits of the Project. Join work with that of the others in an acceptable manner and perform it in proper sequence to that of the others EXISTING CONDITIONS A. Perform no work in close proximity to existing utilities without informing SEPTA. Follow all applicable safety regulations, as established by governmental agencies, the utility or SEPTA. B. Conduct operations so as to minimize interference with the normal operations of the transit system, the community, and the businesses TESTING AND ACCEPTANCE A. The Contractor is advised that the acceptance date of any or all components of construction covered by this Contract is that date when final payment is made, and Specification Page 11 of 12 4/3/15

12 not the date of completion of individual components nor the date upon which SEPTA started to use any or all of the components included in the Contract. B. Furnish an equipment list to SEPTA s project Manager for inspection, testing and approval 1.15 ACCESS AND STORAGE A. The Contractor shall have an overall plan for all work activities. This plan shall include the Contractor s proposed means of an access to the various work sites. The Contractor must obtain, at its own cost, any permit, temporary easements, leases or notices from property owners whose property it is intended to traverse or occupy. The Contractor shall be required to restore, at its own expense, any landscaping or adjacent property damaged, or any other damage caused by the operation involved third parties, and to hold SEPTA harmless from any claims incurred. The Contractor shall obtain necessary areas as may be required for the storage of materials and equipment and the staging of work. Approval of these storage areas shall be obtained from the SEPTA Project Manager, at start of the operation WORK SCHEDULING A. SEPTA s Project Manager will submit and update a weekly work schedule to contractor. Job description and location will be identified. Any special requirements for equipment or manpower will be included. Schedule may be adjusted daily as required due to emergencies or changes in SEPTA priorities ACT 287 A. As per Act 287, Pennsylvania House Bill 2543, the Contractor is required to notify utilities prior to all excavations. The Contractor is responsible for contracting the utilities to determine the location of all underground utilities. The Contractor shall be held responsible for any damage done to any structure in the prosecution of the work. He shall exercise any precaution necessary to prevent damage in working underneath or adjacent to any overhead or underground utility. If it becomes necessary for a utility company, through unforeseen conditions, to repair, reconstruct, relay or relocate their structure within the contract area, it shall be done at the sole expense of the Contractor. No compensation will be allowed the Contractor for the disruption to his work. Extra days will be granted him by SEPTA for the delay that has occurred. All the above shall be accomplished at the direction of the Engineer and at no extra expense or charge to SEPTA. END OF SECTION Specification Page 12 of 12 4/3/15
