INTRODUCTION 1-1 This has been prepared as part of the Submission by the Republic of Seychelles to the Commission on the Limits of the Continental Shelf ('the Commission') made pursuant to paragraph 8 of Article 76 of the 1982 United Nations Convention on the Law of the Sea ('the Convention') in support of the establishment by the Republic of Seychelles of the outer limits of the continental shelf that lies beyond 200 nautical miles (M) from the baselines from which the breadth of the territorial sea is measured (hereinafter referred to as the territorial sea baselines ) in the Northern Plateau Region. 1-2 The Republic of Seychelles is a small island developing State in the Indian Ocean, northeast of Madagascar and approximately 1,600 km east of Kenya. The 155 islands that comprise the Republic of Seychelles are divided into various groups under Schedule 1 to the Constitution of the Republic of Seychelles. 1-3 The Mahé Group comprising 42 granitic islands includes Mahé, which is the location of the capital (Victoria). To the west of the Mahé Group is the Amirantes Group of 29 coral islands, which includes Bancs Africains (African Banks: African Banks and South Island). In addition, a further 13 coral islands located south-south west of the Amirantes Group make up the Farquhar Group of islands. The Aldabra Group, located west of the Farquhar Group, represents the largest collection of islands, comprising 67 coral islands. Finally, there are two coralline islands found to the south of the Mahé Group and two further coral islands, including Ile aux Vaches (Bird Island), to be found to the north of the Mahé Group. 7 1-4 The Republic of Seychelles is a Party to the Convention, which it signed on the day it was opened for signature on 10 December 1982 and subsequently ratified on 16 September The Maritime Zones Act No. 2 of 1999, provides for the establishment and delimitation of the maritime zones of the Republic of Seychelles, including the continental shelf, in a manner that is consistent with the provisions of the Convention. In this regard, a list of geographical coordinates of points defining the outer limits of the exclusive economic zone and certain areas of the continental shelf of the Republic of Seychelles is contained in the Maritime Zones (Exclusive Economic Zone and Continental Shelf) Order, 2008 (S.I. 89 of 2008), also made under the Maritime Zones Act. 1-6 Under Article 4 of Annex II to the Convention, as supplemented by the decisions of the Eleventh (SPLOS/72) and Eighteenth (SPLOS/183) meetings of the States Parties to the Convention respectively regarding the ten-year period established by Article 4 of Annex II to the Convention, a coastal State for which the Convention entered into force before 13 May 1999 is requested to submit particulars of the outer limits of the continental shelf to the Commission, together with supporting scientific and technical data by 13 May This Submission by the Republic of Seychelles satisfies that requirement in respect of the Northern Plateau Region. 1-7 As provided for under paragraph 1 of Article 76, the Republic of Seychelles has a continental shelf comprising the seabed and subsoil of the submarine areas that extend beyond its territorial sea throughout the natural prolongation of its land territory to the outer edge of the continental margin, up to the limits provided for in paragraphs 4 to 6 of Article 76 or, to a distance of 200 M from Page 6 of 39

8 the territorial sea baseline where the outer edge of the continental margin does not extend beyond that distance. Article 121 of the Convention provides in effect that in the case of Islands, the outer limit of the continental shelf is to be determined in the same manner as other land territory. 1-8 Paragraphs 4 to 6 of Article 76 set out a number of provisions by which a coastal State may establish the outer edge of its continental margin, and its legal continental shelf, wherever that margin extends beyond 200 M from its territorial sea baselines. 1-9 As provided for in paragraph 7 of Article 76, the coastal State is to delineate the outer limits of those portions of its continental shelf that extend beyond 200 M from its territorial sea baselines by straight lines not exceeding 60 M in length, connecting fixed points ( Article 76 fixed points ) defined by coordinates of latitude and longitude The data submitted by the Republic of Seychelles in support of this Submission establish that the outer edge of the continental margin extends beyond 200 M from the territorial sea baselines established in respect of Ile aux Vaches (Bird Island) and Bancs Africains (African Banks) in the Northern Plateau Region. The Republic of Seychelles intends to establish the outer limits of the continental shelf in this region following the making of recommendations by the Commission pursuant to paragraph 8 of Article A separate section of this document provides an outline of the region of extended continental shelf. A map depicting the outer limit of the extended continental shelf is shown in Figure 1 below (SEY-DOC-ES- MAP 1). Page 7 of 39

9 1-12 The part of the continental shelf lying more than 200 M from the territorial sea baseline of the Republic of Seychelles is referred to in this Executive Summary document and throughout the Submission as the 'extended continental shelf'. 2. PARTIAL SUBMISSION 2-1 In accordance with paragraph 3 of Annex I to the Rules of Procedure, this Submission represents a partial submission in respect of a portion only of the extended continental shelf of the Republic of Seychelles. 2-2 In this regard, the Republic of Seychelles notes that it made a partial submission jointly with the Republic of Mauritius on 1 December 2008 in respect of an area of extended continental shelf in the region of the Mascarene Plateau (see: Section 9, Notes). The Republic of Seychelles intends also to submit in accordance with the decision contained in SPLOS/183, Preliminary Information in respect of another area of its extended continental shelf in the Aldabra Island Region. 3. MAPS AND COORDINATES 3-1 Two maps at an appropriate scale are included in this in two forms: as Figures 1 to 2 within this document, and as separate A0-size maps. Figure 1 (-MAP 1) depicts the outer limit lines and the area of extended continental shelf submitted to the Commission. 10 of the Article 76 fixed points that define the outer limit of the area and the provisions of Article 76 invoked. 3-2 Lists of coordinates of the Article 76 fixed points that define the outer limits of the extended continental shelf of the Republic of Seychelles in the Northern Plateau Region are supplied in two annexes to this. Annex 1 (-ANNEX 1), lists the fixed points defining the outer limits of the extended continental shelf in decimal degrees. Annex 2 (SEY- ES-DOC-ANNEX 2), lists the fixed points defining the outer limit of the extended continental shelf in degrees, minute and seconds. The provision of Article 76 invoked to define each fixed point, as well as the distance between adjacent points, is indicated in the relevant annex. Page 9 of 39

PROVISIONS OF ARTICLE 76 INVOKED The Republic of Seychelles invokes paragraphs 4(a)(ii), 4(b), 5 and 7 of Article 76 of the Convention in support of the determination of the outer limit of the extended continental shelf in the Northern Plateau Region, as outlined in Section 7 of this. 5. COMMISSION MEMBERS WHO PROVIDED ADVICE ON THE SUBMISSION The Republic of Seychelles was assisted in the preparation of this Submission by Mr Michael Rosette (Seychelles, 2007-present) and Mr Harald Brekke (Norway, 2002-present). In addition, a list of advisers that provided legal and technical assistance to the Republic of Seychelles during the preparation of the Submission is included in the Preface to this Executive Summary. 6. OUTSTANDING MARITIME DELIMITATIONS The area of the extended continental shelf of the Republic of Seychelles included in the Submission is not affected by any outstanding delimitations with opposite or adjacent coastal States. OVERVIEW OF THE EXTENDED CONTINENTAL SHELF IN THE NORTHERN PLATEAU REGION 7-1 This Submission concerns the Northern Plateau, a plateau that lies between latitudes 1º and 6º south of the equator and longitudes 51º and 56º east. It covers an area of approximately 100 sq km and is located at the northern extremity of the spectacular bathymetric feature known as the Mascarene Plateau. The geological, geophysical and geo-morphological setting of the Northern Plateau is that of a passive continental margin formed as a result of processes of rifting and continental breakup, which commenced with the separation of the Mascarene Plateau from the east coast of Africa and the subsequent rifting/tectonic episode that separated the Mascarene microcontinent from Madagascar. 7-2 The Northern Plateau and its associated landmasses (Ile aux Vaches (Bird Island) and Bancs Africains (African Banks)) are all physically juxtaposed as part of the same morphological feature and are the result of a linked chain of geological processes and events. As such, the Northern Plateau and its structural highs are natural components of the continental margin and comprise the submerged prolongation of the relevant land territory of the Republic of Seychelles. 7-3 The outer limits of the extended continental shelf in the Northern Plateau Region determined by the Republic of Seychelles in accordance with Article 76 of the Convention encloses an area of approximately 22,143 km 2 beyond 200 M from the territorial sea baselines. 14 7-4 The outer limits of the extended continental shelf of the Republic of Seychelles in the Northern Plateau Region are defined by 398 fixed points, of which: 396 are defined by arcs 60 M from the foot of the slope (Article 76, paragraph 4(a)(ii)); and, 2 are points (ECS-1 and ECS-398) where the outer limit line commences and terminates respectively at points located along the line 200 M from the territorial sea baselines of the Republic of Seychelles. 7-5 Each successive pair of fixed points delineating the outer limits, including points where the outer limit line commences and terminates, is connected by geodesics not exceeding 60 M in length as provided for under paragraph 7 of Article 76 of the Convention. 7-6 The list of fixed points delineating the outer limits of the extended continental shelf of the Republic of Seychelles is given in the two annexes to this.
