3 Final RISK AND BENEFITS SUMMARY The risks associated with new legislation have been identified by management of the Canadian Firearms Program to be categorized under the following headings: 1. Risk to Public 2. Risk to Police Officers/Law Enforcement 3. Investigation Tracing (Effective & Efficient) 4. Accountability/Stewardship 5. International Commitments Each category was expanded to include the following points on risks. 1. Risk to Public Firearms registration provides the link between a firearm and its rightful owner and enhances owners accountability for their firearms. There is nothing in the law that prevents rightful owners from pursuing lawful activities such as hunting, target shooting or collection. No tracking of safe storage, display and handling of Non-Restricted (NR) firearms. Firearms registration facilitates the enforcement of firearms prohibition orders and allows police to take preventive action, such as removing firearms from situations of domestic violence. Because the registry makes the owner responsible for their guns, they are more likely to store them safely. This reduces the chance of theft. Laws are an expression of societal values; in this case, they serve to educate the public about the risks inherent in gun access and to reinforce the ideal of public safety above the privilege of private ownership. Police officers would find it more difficult to remove NR firearms from an individual who has a prohibition order, as they are not registered. Stockpiling of high powered NR rifles and shotguns are an issue for the police. 2

4 Final Possession only licences (POL) for NR firearms will be an issue. If there are no requirements to register NR firearms there will be no way to determine if an individual has lawfully and continuously possessed in order to be eligible to maintain a POL. 2. Risk to Police Officers/Law Enforcement Safety of police officers: officers investigating private premises have the option to use CPIC & CFRO to check CFIS, which currently shows all firearms registered to the firearms licenceholders who are associated with an address. Dropping NR firearms from CFIS would mean that an address would show as having a licence-holder, but CFIS would not describe NR firearms, therefore the officers would have less information on what to expect during an entry. Police officers will not have an accurate picture of whether there are firearms at a residence. 3. Investigation Tracing (Effective & Efficient) Decreased investigative effectiveness: Most firearms used in violent acts are NR. Police investigators would have to search the records of individual firearms businesses to determine the history of a particular NR firearm, and could only trace it to the original owner. Today, with CFIS, investigators can trace in real time, using the database. No tracking of NR firearms sold to unlicensed individuals. Police officers will no longer be able to determine the difference between a legally imported NR firearm, and one that was smuggled. 4. Accountability/Stewardship Lack of accountability. No incentive for NR firearms owners to retain their licence, as the firearms they have don t require registration. Firearms registration links a specific firearm to its owner. Undermining licensing: most firearms licence holders only own NR firearms. If these firearms do not have to be registered, it is more likely that the licence-holders will not renew their licences, because the CFP and law enforcement will have no way of 3

5 Final knowing whether they still possess firearms. This undermines continuous eligibility screening. Increased costs to businesses: if businesses are required to keep extensive manual records of firearms transactions, this adds to their overheads. The multiplier effect of this extra overhead would result in a cost to the economy far greater than the operation of CFIS present business web services and service. Comfort/perception by non-clients. 5. International Commitment Increased difficulty enforcing efforts to stop smuggling and trafficking of NR firearms, undermining of Canada s treaty commitments to control imports and exports: investigators will be unable to confirm the origin of a firearm during an investigation, essentially removing the obligation for importers to register it once released by CBSA at the border. BENEFITS OF NEW LEGISLATION The benefits of new legislation include: Gun owners will no longer be required to register their NR firearms resulting in less administrative burden; and Canadian Firearms Program (CFP) will realize program savings over time. Program Savings (no classification requirement/ Appendix 4) are estimated to be: Salary Savings $ 2,800,000. Employee Benefits Savings (20%) 560,000. IT Desktop Savings 385,000. IT Operation Savings 280,000. Total estimated ongoing yearly savings $4,025,000. (approximately 35% of 2007/8 expenditures) Less: One time cost of System Enhancements 375,000. Estimated savings year one $3,650,000. 4

6 Final The preceding Program Savings reflects Salary and Employee Benefits Savings where no classification certification would be required under the proposed new legislation. If such certification were required additional effort would be required by CFP staff. This would reduce estimated savings to what follows (Appendix 2): Program Savings (classification requirement) are estimated to be: Salary Savings $ 980,000. Employee Benefits Savings (20%) 196,000. IT Desktop Savings 114,000. IT Operation Savings 280,000. Total estimated ongoing yearly savings $1,570,000. (approximately 14% of 2007/8 Expenditures) Less: One time cost of System Enhancements 375,000. Estimated savings year one $1,195,000. 5

7 Final BACKGROUND The Canadian Firearms Program (CFP) mission is to enhance public safety by promoting responsible ownership, use and storage of firearms and by providing police and other organizations with expertise and information vital to the prevention and investigation of firearms crime both in Canada and internationally. CFP was created in Since 2006 CFP has been assigned to the Royal Canadian Mounted Police (RCMP) as an operational service line within the RCMP s Police Support Services (PSS). In 1993, the Government of Canada indicated its intention to proceed with a universal licensing system and a universal registration system that would apply to all firearms. Bill C-68 an Act Respecting Firearms and Other Weapons was tabled before Parliament on February 14, 1995, and received Royal assent on December 5, This legislation required: Individuals to hold a valid licence to either possess or acquire a firearm and ammunition; Businesses to possess a valid licence if they are to engage in activities related to firearms, other weapons, devises, and/or ammunition; and That every firearm be registered. A transition period allowed for gradual implementation of the Firearms Act individuals had until January 1 st, 2001, to obtain a firearm licence, and until January 1 st, 2003 to register them. As of December 31 st, 2007 over 7.22 million (M) firearms have been registered (Non Restricted 6.54 M, Restricted.45 M and Prohibited.23 M) and over 1.87M valid licences have been issued. For the year ended March 31 st, 2008 the actual cost of administering the Canadian Firearms Centre was $61.72 M (Appendix 4).This does not include costs for the Firearms Support Services Directorate, which was aligned with the program in June of According to a Costing Model developed by KPMG in September 2004 (Appendix 3) that has been used for appropriation purposes and which has been subject to a review by the Office of the Auditor General of Canada the 6

8 Final preceeding actual expenditures can be broken out as approximately ($50.56 M) for Licencing Services and ($11.16 M) for Registration Services. On June 19, 2006 the Government of Canada tabled Bill C-21 to amend the Criminal Code and the Firearms Act (non registration of firearms that are neither prohibited nor restricted). This Bill proposed to repeal the legislative responsibility to register non restricted firearms and introduce the requirement for firearm retailers to record all sales transactions of these firearms. This Bill expired on the order paper, and was reintroduced as C-24, and eventually in the Senate as S-5. This Report tables the risks and benefits that have been identified by CFP management of implementing a Bill similar to Bill S-5 and attempts to identify a reasonable estimate of the potential savings of implementing this new legislation. The scope of this engagement was by design limited and therefore the estimate of savings should not be considered as exact, precise or immediate. We relied on information that was provided by management and not subject to our audit or verification. Financial information was sourced in the FIS/System, which is internally audited by the RCMP and presented to Parliament annually. APPROACH The approach used on this assignment consisted of a combination of management interviews, data gathering and the conduct of a one day management forum. The management interviews disclosed that significant effort was completed by KPMG in October of 2004 to develop a Costing Methodology for Registration Services (Appendix 3). The purpose of this KPMG report was to document a costing methodology to help determine the cost of the Registration function and to identify issues for CFP to consider in attributing and allocating costs related to the registration function. It was further disclosed in these interviews that the KPMG costing model had been used in the appropriation process and has continued to be used albeit in a modified version. An audit report by the Office of the Audit General of Canada 7

9 Final acknowledged this costing methodology to be a reasonable approach to costing. Further in this report this KPMG costing methodology has been used to form the basis of allocating actual expenditures between the licensing and registration functions (Appendix 4). We also disclosed in our interviews that management had conducted an impact analysis of Bill C-21/24/S-5 on CFP operations in September of Upon our review of the work that was completed we believed that it was a reasonable approach in lieu of completing an exhaustive time and motion study which was impossible within the time allocations of this assignment. We, therefore, asked management to update their work which was completed in November of This Impact Analysis (Appendix 2) is used in this report to identify the potential salary savings as the result of the introduction of New Legislation. The objectives of our management forum (Appendix 7) were: to identify, discuss and document the risks to Public Safety and Program Effectiveness; to agree to and understand the costing model which will be used to identify the savings to the Canadian Firearms Program as a result of the implementation of New Legislation. At this forum management identified the risks identified in this report and agreed to the costing models used to estimate the savings as outlined in the benefits section. 8

BENEFITS OF NEW LEGISLATION The benefits of new legislation include: Gun owners will no longer be required to register their NR firearms resulting in less administrative burden; and CFP will realize over time program savings. In 2007 more than 113,000 firearms were newly registered in Canada. Of these 89,000 were NR, 23,000 were restricted 330 were prohibited. In the total registry there are some 7.2 million firearms registered. Of these 6.5 million are NR,.45 million are restricted, and.23 million are prohibited. To determine gun owner reduction in administrative burden is a relatively simple observation based on the above numbers. To determine the CFP program cost savings has proven to be a greater challenge. Several factors have been considered including: 11

13 Final 1 Salary Savings: Early in the conduct of this assignment it was identified that management had completed a detailed review of the Impact of new legislation on the resource requirements for the Canadian Firearms Program (Appendix 2). A Clause by clause analysis of Bill C-21/24/S5 was performed which revealed that this legislation would influence the registration transfer and import/export functions of the Canadian Firearms Program. As a result the operational areas impacted were identified as the CFP Headquarters, the Central Processing Site (CPS) and the ten provincial offices of the Chief Firearms Officer (CFO). The model was developed in September of 2006 and resulted in the identification of resource saving by percentages in each of the above areas. These resource saving percentages were then applied to the then current level FTE s and resulting FTE savings were identified. In discussions with various management members of CFP we realized that this model could provide the bases for determining the impact of New Legislation on current resources ( actual). 14 Final Full details of the analysis are included within the actual model (Appendix 2). Figures should not be considered as exact as portrayed in this table. Note 1: According to management, the CFP HQ numbers do not reflect the December 1, 2008 (outside of the timeframe of this report) implementation of Public Agents Firearms Regulations (PAFR). These Regulations, which require police services and other government agencies to report to the CFP HQ their service firearms plus all other firearms seized/found/recovered, have created significant new workloads at the CFP HQ. Please note that CPS operates from Miramichi, New Brunswick, CFP HQ from Ottawa, Ontario and the CFO s from various locations throughout Canada. The distinction between Post Bill legislation (classification) and Post Bill legislation (no classification) relates to interpretation of clause in the proposed legislation (Bill C-21/24/S-5) section 27(a)(i)(ii)) which simply put would require additional effort on the part of CFP to verify the classification for NR firearms. Applying the resulting percentage savings to the March 31, 2008 actual salary dollars and FTE s at that time we can identify a potential resource saving of: 13

This new cost has not been factored into the cost savings calculation, as it is outside of the time frame of this report. 18 Final We further believe that once the transition to The RCMP is complete the IT Group should be able through efficiencies to further reduce IT Costs by another 20% ($560,000). (Appendix 5). Subparagraph 33(a)(ii) of the Act is replaced by the following: (ii) in the case of a prohibited firearm or a restricted firearm, lends the registration certificate for it to the borrower; or 11. Paragraph 34(a) of the Act is replaced by the following: (a) in the case of a prohibited firearm or a restricted firearm, the transferor lends the registration certificate for it to the borrower; and 12.
