Creative Europe provides funding for at least artists and cultural professionals, cinemas, 800 films and book translations. It will also launch a new financial guarantee facility enabling small cultural and creative businesses to access up to 750 million in bank loans. Creative Europe builds on the experience and success of the Culture and MEDIA programmes, which have supported the cultural and audiovisual sectors for more than 20 years. The new programme includes a Culture sub-programme, supporting performing and visual arts, heritage and other areas, and a MEDIA sub-programme, which will provide funding for the cinema and audiovisual sector. 27 HUNGARIAN NATIONAL FILM FUND THE HUNGARIAN NATIONAL FILM FUND The Hungarian National Film Fund (MNF) is the new public film funding organization of Hungary, conceived by Andrew G. Vajna, the government commissioner for the renewal of the Hungarian film industry. The fund is a public institution governed by Hungarian law and its activities are regulated according to the Motion Picture Act (II) of The fund s main purpose is to support the production and distribution of Hungarian films and co-productions that provide art and entertainment for moviegoers and achieving significant success both domestically and internationally. It also focuses on the development of the national film industry and represents Hungary at international film forums. The Hungarian National Film Fund was founded by the Hungarian government in The chief executive of the fund is Ágnes Havas, who was appointed by the founder. The financing for the fund is automatically derived from the tax revenue earned by the no.6 National Lottery. The fund s budget for 2016 is HUF 5.1 billion (EUR 16,2 million). As of the end of January 2016, the fund has granted production funding for 57 projects, including 14 international co-productions, several debut features and documentaries, and more than 150 projects got development support. BRIEF PRESENTATION OF THE HUNGARIAN TAX RELIEF THE FILM TAX INCENTIVE Films (for cinema and television) produced in Hungary are eligible for a 25 % rebate based on their expenditure emerged in the country The incentive is available through local business companies who receive tax relief after their support of films The scheme is part of the film support program approved by the European Commission until the 31st of December WHAT PRODUCTIONS CAN BENEFIT? Films of all genres made for cinema release Feature films, series, documentaries and animations made for televisions or other distribution platforms Porn and extreme violent films, commercials, reality shows and daily soap operas are excluded CULTURAL TEST Films applying for the incentive have to be submitted to a cultural test Films must contain European content or cultural values and additional points are granted if EU nationals are either making or financing the movie (point system) 16 points has to be earned to pass t a x r e l i e f REGISTRATION OF COMPANY AND PRODUCTION Hungarian companies, registered with the National Film Office (NFO) are eligible to apply Foreign companies should conclude coproduction or service agreements with a registered Hungarian company Production has to be registered at NFO Start of filming has to be reported to NFO 50 51
28 TAX RELIEF WHO PROVIDES THE FINANCIAL SUPPORT? Corporate-tax-paying domestic companies that may reduce their tax payable and tax base by the financial support they provide (double write-off) - a maximum of 7,5% incentive available- The financial support is provided in the form of a cash refund (post-financing) ELIGIBLE EXPENSES All the direct film production costs are eligible except those excluded by the film law; other costs are limited by the law (see below) The producer is free to spend 20% of the budget outside Hungary without suffering a reduction in the amount of the incentive. This means that not only the spend made to Hungarian taxpayers will qualify, but also some of the services provided by foreign taxpayers - up to 20% of the total production budget. (Consequently 31,25% of the Hungarian spend will be refunded) EXCLUDED OR LIMITED COSTS Part of copyright costs over 4% of the budget Travel costs are limited to trips from and to Hungary, stopover possible P&A is limited up to 2% of the budget (but max 10m HUF) Cost of services delivered by non-hungarian sub-contractors limited up to 25% of eligible Hungarian spend. Producersʼ fee maximum up to 4% HOW MUCH IS THE INCENTIVE? Up to 25% of the eligible production expense (Hungarian or not-hungarian) The non-hungarian eligible spend is capped at 25% of the Hungarian eligible spend AID INTENSITY PROVISIONS TO TAKE INTO ACCOUNT Total state subsidies shall not exceed 50% of the production budget, or in case of co-productions 50% of the Hungarian contribution or 60% of the Hungarian contribution if the co-production involves a co-producer from another EEA Member State too in case of low-budget films, difficult audiovisual works and films produced in Hungarian language the extent of subsidies is 100% of the budget or the Hungarian contribution in case of documentaries, animation, shorts, experimental films etc % of the budget or the Hungarian contribution COLLECTION ACCOUNT OF THE NATIONAL FILM FUND AVAILABLE FOR NATIONAL AND FOREIGN PRODUCTIONS The account was launched at the end of 2012 to make the access to the 25% rebate easier for both domestic and foreign film productions. The National Film Fund as the account holder has the right to collect supports of private and state-owned business companies who benefit the same tax relief for their payment in the account as those paying the support directly to the production. t a x r e l i e f The payment of the rebate from the account takes place on a first-come, first-serve basis. Once the production company receives its certificate from the Film Office on the final amount of production costs incurred in Hungary, the production company may directly file the certificate at the Film Fund which pays the amount of the rebate indicated in the certificate within 5 working days. The Fund withholds 2.5% of the amount of the rebate as administration fee
