1 Recommendations about useful and useless regulations and strategies concerning employment of VIP BULGARY FRANCE GERMANY ITALY GUIDELINES REPORT
2 Useful Regulations BULGARIA There are funding programs: for employers to open and adapt working places for disabled persons. for disabled people to open their own business. for specialized enterprises they receive back their taxes and obtain preferences in public tenders.
3 Useful Regulations FRANCE - 1 Law of 1987 : A minimum rate (6%) of employment of disabled people for companies above 20 employees : incentive element. Law of 1987 : Companies less than 20 employees are not submitted to this minimum rate but benefit from the aids for the support of disabled people in access or maintenance to employment.
4 Access to Employment for Useful Regulations FRANCE - 2 A good structure is in place : specialized structures in disability exist in France, which aims to favour the connection between the companies, legal funding organizations, work company doctors, expert services (like in VI, etc ), and people with disabilities themselves. Workplace adaptation : free for the intervention of experts on VI and the material/adaptation is taken in charge (almost totally) by the legal funding organizations.
5 Access to Employment for Useful Regulations GERMANY - 1 Compulsory employment quota for severely disabled persons. Employers who don t achieve employment quota must pay a compensation fee. Compensation fee is reserved for special purpose to improve employment situation of severely disabled persons. Subsidies are suable by individual. This regulation provides a comprehensive budget.
6 Useful Regulations GERMANY - 2 Budget is used for various instruments to improve employment situation. Examples: Vocational training, integration services, assistive devices, financial incentives for employers. Public employers try to achieve the employment quota and offer partially special occupations for disabled persons. Impairment-related vocational re-training can be funded for a duration up to 2 years.
7 Useful Regulations ITALY Law 113/1985 providing access to the labour market for VIP: Switchboard operator. Law 68/1999 providing access to the labour market for people with disabilities. Law 114/1999 providing career transition opportunities for the outdated role of switchboard operators. Advantage: Employability for VIP that can afford switchboard operator vocational training.
8 Not useful Regulations BULGARIA there is a subsidized employment without any sustainability: after the program is finished the disabled person is unemployed again. there is a quota for hiring disabled persons in enterprises, but there isn t any control mechanism to monitor and to sanction those employers who don t fulfil this quota. lack of vocational orientation and training in special schools for VIP.
9 Not useful Regulations FRANCE - 1 Following the Law of 2005 on disability : the fine became high: Now some companies employ more people with disabilities, sometimes without real jobs. With the Law of 2005 : the different categories of handicap are replaced by one category. This favours the employment of people with disabilities without or few adaptation (this is not the case of VI people).
10 Not useful Regulations FRANCE - 2 A System of financial penalty is in place but not an incentive- for example : lack of campaign of awareness to favour the employment. The fine is the same for all the companies : the Impact of the penalty is not the same for a big company or a SME.
11 Not useful Regulations FRANCE - 3 Not an useful regulation but an incoherent one: more and more companies respect the minimum rate of employment or some activity sectors/branches make agreement with legal funding organisations. consequently: less money for legal funding organisations and so less money for expert services to adapt workplaces.
12 Not useful Regulations GERMANY Strict separation between employment related requirements and needs for private life. E.g. it is almost impossible to have devices or trainings funded for disabled people outside the field of employment. Legislation concerning job protection for disabled persons, e.g. regulation against dismissal of disabled persons raise obstacles for employing this target group. Regulation allows de-centralization with too many players. Results for the target groups are depending on the motivation and experience of the responsible professionals.
13 Not useful Regulations ITALY We can say that sometimes there are lack of strategies Lack of specific strategies for people with multiple disabilities. Lack of specific strategies for new professions such as: translator, civil mediator, transcriber. (for example, there is only one school who can prepare VIP s for massophysiotherapist profession).
14 Useful Strategies FRANCE Creation of the first expert services in VI in 1995 in 3 regions in France with legal funding organisations on the basis of the law of 1987, with ergonomists as specialists.
15 Useful Strategies GERMANY - 1 Individualisation of assessment, consulting and vocational rehabilitation (technical term: Rehabilitation Integration Management / RIM). Co-operation between training institutes and public or private employers. - Training on demand and supported training in companies. Training courses with long term internship (ISB).
16 Useful Strategies GERMANY - 2 Improving the employment probability by supporting employer and visually impaired person. Supporting employment strategies by case management; employers, benefactors of rehabilitation services and VIP are contacted only by one responsible person who cares about the integration process.
17 Useful Strategies ITALY Preparatory course after the school and before going to work. Support to job emplacement. Support to job maintenance. Financial support for employing people with disabilities. Regional committee for people with disabilities and their family in Friuli Venezia Giulia. Employment integration service.
18 Not useful Strategies FRANCE At the beginning, the support of VI People in employment was only the fact of some regions (due to personal initiatives ). The evolution of the support of VI people in employment: Services are created in all regions in France, on the basis of call for offers. With this context, which would aim to increase the quality of services, every organisation can respond to the call for offers, with or without expertise on VI/handicap, whereas criteria are based on the costs, the application contents and presentation.
19 Not useful Strategies GERMANY Dedicated or invented occupations for VIP, which are not requested by the labour market are not successful. De-centralisation requires from the VIP a higher degree of information and knowledge about the funding system and regulations. Job-placement in occupation with low wages (attractive for employers) may cause age-poverty and long-term dependency of subsidies.
